As the Executive Director of Community Clean Sweep, Mary Beth is excited to be a part of the Energy Upgrade California® Community Outreach Ambassador Program. Energy Upgrade California is a multi-faceted campaign aimed at educating the public about ways to manage energy use, save energy and conserve natural resources – to help reduce demand on the electricity grid. The campaign is supported by the California Public Utilities Commission and the California Energy Commission, and administered by the California Center for Sustainability.As part of the initiative, 25 community based organizations, like Community Clean Sweep, are charged with building awareness regarding the importance of energy, and provide pathways to take energy management steps to collectively help California “Stay Golden.”The 20-minute interactive program will provide valuable information about specific products and programs designed to reduce energy consumption and save money on utility bills. At the end of the presentation, I will give away a box full of energy-efficient items including LED light bulbs, solar lights, a low flow showerhead and more. Kaiser Permanente’s mission is to provide high-quality, affordable healthcare services to improve the health of its members and the communities it serves. This mission is accomplished through market leading performance in quality, service and affordability.

Kaiser Permanente provides healthcare services to more than 105,000 members in Kern County at thirteen locations with nearly 1,000 employees and physicians. Currently, over 5800 individuals in Tehachapi have chosen Kaiser Permanente to be their partner in health. Kaiser Permanente began providing primary care in the Greater Tehachapi area via our Mobile Health Vehicle in March of 2012. “It became very clear to us early on that there was a greater need for more space in Tehachapi. We were pleased to be able to expand our facility to meet the needs of our members,” stated David Womack, Senior VP and Area Manager for Kaiser Permanente in Kern County. In February of this year, Kaiser Permanente opened its medical offices located in the Tehachapi Junction Shopping Center.

There are three very important factors that make Kaiser Permanente special—care and coverage together, convenience and choice, and care you can trust. Kaiser Permanente brings together healthcare and coverage with connected teams of doctors, nurses, pharmacists and other professionals. Patients may manage their health on-line, anytime, anywhere. Patients also have their choice of great doctors and may change their doctor at any time for any reason. With Kaiser Permanente, patients have the support of an entire care team who work together and are closely connected through electronic health records.

Kaiser Permanente also invests directly in community health improvements by working to increase access for the underserved, funding safety-net agencies, disseminating care improvements, conducting research, educating healthcare workers and consumers, and informing public policy. To date, Kaiser Permanente has funded three specific programs in the Greater Tehachapi area. Funding through our Community Benefit Program has been awarded to replace the filtering system at the pool operated by the Tehachapi Valley Recreation and Parks District, new fitness equipment at Golden Hills Elementary School and physical education support curriculum at Cummings Valley School.

Mountain Festival Theme Winner Announced“Genuine Mountain Style, Best by a Country Mile” is the theme for the 2016 Tehachapi Mountain Festival® being held August 19-21. Congratulations to Dan Mahler, the winner of this year’s Mountain Festival Theme Contest.

Dan not only submitted the winning theme, he included a sketch that he felt portrayed the theme. The Mountain Festival Commit-tee agreed and the sketch was sent on to Ray Friesen at ‘hachapi Tees who worked his magic to create this year’s amazing artwork.

The U.S. Department of Labor (DOL) announced the highly anticipated federal overtime rule under the Fair Labor Standards Act (FLSA). According to the White House, an estimated 4.2 million white collar workers will become entitled to overtime pay when they work extra hours as a result of the new rule, and wages for workers will increase by $12 billion over the next 10 years. The final rule is effective December 1, 2016.

The final rule changes the salary level that must be met before an employee canbe exempt from overtime. The minimum salary threshold will increase to $913 per week, $47,476 annually, and will apply to nearly all employees — an employee paid less than this threshold amount will be guaranteed overtime pay.

The new federal salary threshold of $47,476 is more than double the current federal threshold of $23,660.

Importantly, it is also higher than California’s minimum annual salary threshold, which is currently $41,600. California em-ployees must earn a minimum monthly salary of no less than two times the state minimum wage for full-time employment to qualify for the so-called “white collar” exemptions, in addition to meeting all other legal requirements for the exemption. This currently amounts to $3,466.67 per month or $41,600 a year based on the $10 an hour minimum wage.

Under the final rule, more California employees potentially will be classified as nonexempt under the FLSA and entitled to overtime because they don’t meet the federal minimum salary threshold. A chart provided by the White House shows that California has the most workers potentially affected of any state — more than 392,000 affected workers. Cali-fornia’s share of the total number of workers affected nationwide is almost 10 percent. The next closest states are Texas and Florida.

Navigating the terrain between California and federal rules can be complicated. Employers must comply with the law that gives the most protection to the employee.

Other key points from the final rule:

• The minimum salary threshold will now be automatically updated every three years — with the first automatic update occurring January 1, 2020. Based on projections of wage growth, the White House stated that the salary threshold is expected to rise to more than $51,000 with the first update.

• The final rule amends the salary basis test to allow employers to use nondiscretionary bonuses and incentive payments to satisfy up to 10 percent of the new salary threshold. California does not have any such provision.

• The rule sets the total annual compensation requirement for highly compensated employees (HCE) at $134,004 — up from $100,000; HCEs are exempt almost solely on their salary and are subject to a minimal duties test. There is no HCE exemption under California law.

• The DOL left the federal duties test alone. An employee must meet both the salary threshold and a “duties” test to be ex-empt from overtime. The DOL sought comments on whether adjustments to the duties test were necessary and whether the FLSA should move more toward California’s duties test. But the final rule left the FLSA duties test as-is.

The announcement comes nearly two years after President Obama first directed the Secretary of Labor to begin creating new overtime rules. The DOL received nearly 300,000 comments on the contentious proposal.

Employers will want to prepare for the December 1 deadline. Although there will likely be challenges to the new rules, it is unknown if any such challenges will succeed. Employers don’t want to get caught out of compliance.

Since the Summer Olympics are being held this year, we are adding an Olympian Pavilion to the excitement of the event where you can meet and greet Olympic stars. We will also have Honky-Tonk music area where four of the top bands in Kern County will be playing their music throughout the day away from the main tent for those who want to take a break. The gates will open at 7:00 a.m. for complimentary continental breakfast and musical entertainment will be provided as you enter. Two opening speakers and entertainers will be appearing in the outside venues from 8:00 a.m. until 9:15 a.m. The Conference will conclude with a picnic, featuring music and dancing with Chubby Checker and his Wild Cats. The gates will close at 9:30 p.m.

In addition to the other tents with speakers running simultaneously, you can also visit the the Beer & Wine Garden, speaker meet & greets at the Stars & Stripes Arcade and Olympic Pavilion, enjoy the amusement rides, as well as complimentary food and refreshments at the Ice Cream Pavilion, Farmers Market and refreshment tents.
