Despite a glitch in the link to register to address the meeting on Wednesday I have

been given permission to address you That said there are a couple of important

preliminary matters I ask you to consider prior to you sitting because I would not a

determination to be made by the Committee on the Redrow Application that could be

overturned on a legal technicality

You were appointed at the Annual Meeting in May 2015 to sit as a quasi-judicial

committee with terms of reference Terms of reference to deal with section 257

Applications made under the TCPA 1990 were minuted and approved at the meeting of

Full Council on 29th September 2014 However the terms of reference have not yet

been incorporated into the Councils Constitution I therefore ask that you seek legal

advice to establish that since the terms of reference are not yet in the Constitution that

you do have jurisdiction to sit and consider s257 Applications

Insofar as the instant Redrow Application is concerned the Committee is being

presented with what is referred to as the third proposal consequent to the site meeting

with Redrow last month I attach correspondence from Redrow to the PROW

Department It is clear that this third proposal would only go forward subject to the

caveat of certain pledges being made - one being the removal of ALL objections My

objection stands as do those of two residents The other pledges relate to ones to be

made by the Council I have no information whether or not the Council has conceded to

Redrows demands In any event the point to be made is that since objections remain

outstanding then it is the second proposal that the Committee assuming it has

jurisdiction must decide because the third proposal according to Redrow will only be

viable subject to the pledges being made I would ask that legal advice also be sought

on this issue so that at the commencement of the meeting the appointed Chair can deal

with these preliminary issues with the benefit of having taken proper legal advice

I was present at the site meeting but was not party to all of the discussions between WRAG and Redrow There were a large number of people in attendance which meant that several group discussions were going on simultaneously Please be so kind as to send me the confirmation you refer to provided by the Applicant for the amendments as this may once and for all clarify the situation

With regard to the Gully - a blown up version does show the areas as a light pink - the unexploded map looks more grey to me That said I did speak about the Gully at some length with a person who is resident in one of the adjacent properties This person was under the impression that ownershipmaintenance of the Gully was not clear

Thank you for your recent query the form of application in the case of Public Path Orders is not prescribed and it is not necessary to receive a fresh application where proposals are amended following consultation The amended route agreed between parties was outlined to us on site and confirmed by the applicant following the visit previous objections have been withdrawn by WRAG on the basis of its acceptance

We are unclear as to your point in relation to the adoption of The Gully The route between 13 and 14 Clos Llanfair is shown shaded pink on each of the plans that have been distributed

Dear Mrs Thomas

I viewed the Wenvoe Files earlier today I have also checked the PROW Update Reports for Wenvoe 21 and 22 as reported to LAF on 30th September 2015 - ID 70 refers

The original application was put out to consultation on 1st May 2015 and due to the high level of objections received Redrow made a fresh application that went out to consultation on 29th June 2015

A site meeting took place with Redrow on the 13th October and subsequent to that you consulted on a new plan and schedule on the 16th October 2015 Did I miss something in the file because I could not find evidence on the file that a third application had been made by Redrow You will appreciate that in the absence of a third application then there was nothing to consult upon so any responses to the third proposals will be null and void

I did read emails from concerned residents adjacent to the gully With respect there is no evidence that the gully land is adopted highway - indeed your plan does not show the area shaded pink As far as I can see the gully follows the line of the route originally recorded under the NPACA 1949 so is still an extant footpath blocked off by Redrow for some 2 years - in my view unnecessarily

As stated if I have missed something please let me know

illustrate what was discussed and requested by the objectors

From my standpoint with Redrows current application we will appease the objectors and move plots 68 amp 69 to

provide the route requested by WRAG and others amending the application route only if

1 Objections are withdrawn by WRAG and others before changes to the green route are made

2 Objectors pledge not to raise any new protests and agree to the green route in writing before we change our

application

2 The above amendment to the green route entering Redrow land on the current PROW 21 route at point B does

not significantly delay the determination of the application by longer than 4-6 weeks as you stated

3 This amended route does not incur any delays to our phase 2 re-plan application or involve any amendment to

the duration of the application which is to be heard before committee on 19th November Please confirm this with

Steven Rennie in writing

If these pledges are agreed to we will then be able to appease WRAG and have comfort that the application will be

determined in reasonable time without further delay or reapplication If not we will not change our application and

let it run as it is

Would you please confirm this with the objectors and Steven Rennie before we proceed Also can you confirm the

timescale to a determination should the above fall into place and we make this minor alteration
