PARSHAT MISHPATIM
The parsha begins with the words "V'elah Hamishpatim,
and these the ordinances which you shall set before
them." In this portion of Mishpatim we find a series of laws
dealing with the relationships between man and his fellow
man; including the laws of the servant, the maid-servant,
torts, theft and guardianship. Also the laws of Shmita, etc.
Why are all these ordinances spelled out so clearly? Rashi
comments that the word Elah (as the first word of the par-
sha) together with the Vavv means to teach us that, just
as the Ten Commandments mentioned last week; are the
words of Hashem, so too are all the ordinances listed here
in Mishpatim. When we said Na'aseh V'nishma (we will do
and will hear), we accepted all the laws and statutes
listed not only in the Ten Commandments but all of those
listed here in Mishpatim. Both Torah S'bal Peh and S'bictav
are the words of Hashem.
This weeks parsha also includes the portion called Sheka-
lim. On the Shabbat preceding the new month of Adar
we read the special Torah portion dealing with the Sheka-
lim which were used to purchase the sacrificial offerings
for the new year, beginning on the first of Nissan. The lat-
ter offerings were to be donated by each man, "Whose
heart made him willing," to donate as he saw fit; and from
these Moshe built the Mishkan (Tabernacle). But even
more than the Trumat Ha'adanim we are told that every-
one had to give Macatzit Hashekel (half a shekel). "The
rich shall not give more and the poor shall not give less
than the half-shekel to give the offering of Hashem." There
are certain donations that each person can make ac-
cording to his ability and will, while other donations must
be shared equally by everyone. Such shared donations, in
which each participant holds an equal share, are used to
maintain, strengthen and remodel the sanctuary. The To-
rah teaches us that each member of the community must
share a collective commitment of maintaining and up-
keeping their synagogues and institutions. No matter how
rich or poor, each must share equally in the community,
bringing Hashem into our midst to elevate our communi-
ties into a single unit (achdut) and to reach new spiritual
heights.

PARSHAT MISHPATIM
"When you will lend money to a poor person who is with
you" (Shemot 22:24). Look at yourself as if you are the
poor person (Rashi).
One cannot properly fulfill
the mitzvot of tzedaka and chesed unless one establishes
a strong sense of unity with the recipient. If one looks
down on the poor, or is emotionally detached, the mere
giving of money is only an incomplete mitzvah.
The only antidote to the hostility inherent in gazing is the
unity of tzedaka. If we look at ourselves as if we are the
poor person, if we overcome the adversarial relationship
that typically exists between two people, Hashem's gaze
upon us is transformed into a blessing.
"Do not take revenge nor bear a grudge against a
member of your people, love your friend as yourself
"(Vayikra 19:18). If one cut his left hand with his right,
would he take revenge by then cutting his right
hand?
So, too, if you love your friend as yourself, as a part of
you, you will not take revenge (Yerushalmi Nedarim
9:4, cited by Netziv).
Just as we must look at ourselves as if we are the poor
person, so too must we relate to our friend as if he is a
part of us. This unity is the true fulfillment
of tzedaka and ahavat Yisrael.
When kohanim complete the Birchat Kohanim (Priestly
blessings) they say, "Master of the world, we have done
what You have decreed, now may You also do as You
have promised us: Gaze from your holy abode and bless
Your people." A kohein must bless those present with love
(be'ahava). This love, like proper tzedaka, results in the
unity which transforms hashkafa, which is usually adver-
sarial, into a heavenly blessing.
In a world of adversarial relationships, of banging and
bruising, of looks which can kill, we are commanded to
achieve unity between donor and recipient, blesser and
blessed. By viewing and loving others as part of ourselves,
we can transform negative forces into positive ones, and
merit Hashem's bracha.
