Lockwood called the regular meeting of the Delaware Township Committee to order on September 26, 2016 at 6:30 p.m., at the Delaware Township Municipal Building, 570 Rosemont Ringoes Road (County Route 604) in Sergeantsville, New Jersey. PLEDGE OF ALLEGIANCE All present recited the Pledge of Allegiance. NOTICE REQUIREMENTS Ms. Lockwood read a statement noting the Notice Requirements provided for in the Open Public Meetings Act have been satisfied. Notice of this meeting was properly given by transmission to the Hunterdon County Democrat, Lambertville Beacon, Trenton Times, Courier News, and Star Ledger, by posting at the Delaware Township Municipal Building, and by filing with the Township Clerk all on January 6, 2016. ROLL CALL Present: Susan Lockwood, Charles Herman, Alan Johnson Samuel Thompson, Joseph Vocke Absent: NONE JCP&L Mayor Lockwood introduced Mr. John Anderson and Mr. Stan Prator Area Managers for JCP&L. Mayor Lockwood explained that residents are upset with the handling of the power outage on August 12, 13, & 14 th of 2016. Mayor Lockwood requested Mr. Anderson explain what happened and why the power outage last for over three days. Mr. Anderson proceeded to explain the power failures and the steps that JCP&L had to take to repair multiple equipment issues. Mr. Anderson explained how the electric had to be restored and the steps that had to be taken to bring the electric back up safely. The cross country transmission lines were damaged and needed to be repaired in order to find issues with the substation. Once these were repaired, the lineman could then work on the substation. Once the substation was repaired, JCP&L linemen could proceed to repair the power lines throughout Delaware Township. Mr. David Hirsch, 25 Lambertville -Headquarter Road, asked Mr. Anderson why the updates of outage times were not updated properly. Mr. Hirsch asked, how does a customer get a live body to answer when he called to tell them the power was not being restored and the time for restoration kept changing? Mr. Anderson apologized that this error was not caught right away and once it was discovered, JCP&L disconnected the updates due to JCP&L not being able to override set times. This issue was researched and a glitch with the software was discovered. JCP&L iscurrently working to correct this issue so in the future, this will not happen, and the updates on the website will give correct information on outage time. Mayor Susan D. Lockwood called the regular meeting of the Delaware Township Committee to

order on September 26, 2016 at 6:30 p.m., at the Delaware Township Municipal Building, 570

PLEDGE OF ALLEGIANCE

All present recited the Pledge of Allegiance.

NOTICE REQUIREMENTS

Ms. Lockwood read a statement noting the Notice Requirements provided for in the Open Public

Meetings Act have been satisfied. Notice of this meeting was properly given by transmission to

the Hunterdon County Democrat, Lambertville Beacon, Trenton Times, Courier News, and Star

Ledger, by posting at the Delaware Township Municipal Building, and by filing with the

Township Clerk all on January 6, 2016.

Present: Susan Lockwood, Charles Herman, Alan Johnson Samuel Thompson, Joseph Vocke

Absent: NONE

JCP&L

Mayor Lockwood introduced Mr. John Anderson and Mr. Stan Prator Area Managers for

JCP&L. Mayor Lockwood explained that residents are upset with the handling of the power

outage on August 12, 13, & 14th of 2016. Mayor Lockwood requested Mr. Anderson explain

what happened and why the power outage last for over three days.

Mr. Anderson proceeded to explain the power failures and the steps that JCP&L had to take to

repair multiple equipment issues. Mr. Anderson explained how the electric had to be restored

and the steps that had to be taken to bring the electric back up safely. The cross country

transmission lines were damaged and needed to be repaired in order to find issues with the

substation. Once these were repaired, the lineman could then work on the substation. Once the

substation was repaired, JCP&L linemen could proceed to repair the power lines throughout

Delaware Township.

Mr. David Hirsch, 25 Lambertville -Headquarter Road, asked Mr. Anderson why the updates of

outage times were not updated properly. Mr. Hirsch asked, how does a customer get a live body

Mrs. Kristen McConkey, 141 Lambertville-Headquarters Road, stated linemen where outside of

her home on Friday around 12:30 a.m. The linemen reported there were transformer damaged

and other extensive damage. Mrs. McConkey spoke with live people at JCP&L three times over

the weekend. The first call was made on August 12th around 5:30 p.m. and the employee was

very helpful. Mrs. McConkey called two other times after and was treated rudely and

unprofessionally.

Mr. Anderson stated when the storm was predicted they held workers and also pulled workers

from projects to help restore the power. Mr. Anderson apologized for employee rudeness and

will look into customer service.

Mr. Bill Horne, Brookville Hollow Road, submitted a claim on Monday with JCP&L for damage

with a live person and received a denial letter on Tuesday. Mr. Horne stated he had $6,000.00 in

damage and loss of four major appliances. Mr. Horne asked Mr. Anderson why JCP&L is not

responsible for the damage from the surge.

Mr. Anderson stated he would not be able to comment on claims and why they were denied. Mr.

Anderson recommended residents resubmit their claims or call the claims department and request

further review.

Ms. Karyl Patterson, 30 Hamp Road, stated she lost a washing machine and the deductible for

homeowners insurance. Ms. Patterson received a denial letter stating the outage was due to a

tree falling. Ms. Patterson requested Mr. Anderson answer why everyone got different reasons

for denial.

Mr. Anderson explained, due to there being multiple repairs in many different areas of the

township, there could be different reasons why power failed.

Mr. Timothy Soltis asked if JCP&L could bring a representative to Delaware Township to meet

with individual residents and file claims in person.

Mr. Anderson explained that he would not be able to commit to having claims processed at

Delaware Township. Mr. Anderson will bring complaints back to JCP&L and JCP&L will

discuss a plan to make changes for future outages.

Mr. Richard Kulas, 80 Brookville Hollow Road, asked why JCP&L denied claims so quickly if

the causes for the outage were still being evaluated.

Ms. Geri Siwulec, 70 Lambertville-Headquarters Road, commented that they loss $70,000 in a

geo thermal solar system and lights were exploding.

Mr. Anderson suggested the residents resubmit their claims or call and receive a more in depth

explanation on the denial.

Mr. Stan Prator will report back to the Township Committee with the outcome of the software

repair and the outcome of the meeting within JCP&L on future changes.

RECOMMENDATION FROM CONSTRUCTION DEPARTMENT TO HIRE TIMOTHY

DETTERMAN FOR THE POSITION OF PLUMBING, MECHANICAL, AND FIRE

INSPECTOR EFFECTIVE OCTOBER 3, 2016.

Mr. Herman explained that the current inspection official is unable to perform inspections at this

time and is only licensed to complete one type of inspections. Mr. Detterman would be filling in

ad-hoc, and he has three types of inspection certifications. This change would be a zero net cost

to the Township.

Mr. Herman motioned to approve Mr. Timothy Detterman for the position of Plumbing,

mechanical, and fire inspector effective October 3, 2016. Mr. Vocke seconded the motion. Roll

call vote.

ORDINANCE NO. 2016-15

AN ORDINANCE OF THE TOWNSHIP OF DELAWARE IN

HUNTERDON COUNTY, NEW JERSEY, AMENDING ORDINANCE 2016-

14 ENTITLED “AN ORDINANCE AUTHORIZING THE ACQUISITION

OF PROPERTY LOCATED ON KINGWOOD ROAD, DESIGNATED AS

BLOCK 31, LOT 6.08 ON THE DELAWARE TOWNSHIP TAX MAP IN

COOPERATION WITH THE NEW JERSEY CONSERVATION

FOUNDATION, THE COUNTY OF HUNTERDON, AND THE STATE OF

NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION,

AND ALSO TO PROVIDE FOR THE CONVEYANCE OF INTERESTS IN

THE PROPERTY TO THE NEW JERSEY CONSERVATION

FOUNDATION.”

WHEREAS, the Delaware Township Committee adopted Ordinance #2016-14 on September

12, 2016; and

WHEREAS, subsequent review of Ordinance #2016-14 revealed incorrect references therein to

the Wichecheoke Creek;

NOW, THEREFORE, BE IT ORDAINED, by the Township Committee of the Township of

Delaware, in Hunterdon County that Ordinance #2016-14 is amended by changing all references

therein to the Wichecheoke Creek to the Lockatong Creek.

RESOLUTION #2016-63 2015 AUDIT AND GROUP AUDIT AFFIDAVIT

RESOLUTION #2016-63

WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have

made an annual audit of its books, accounts and financial transactions; and

WHEREAS, the Annual Report of Audit for the year 2016 has been filed by a Registered

Municipal Accountant with the Municipal Clerk as per the requirements of N.J.S. 40A-5-6, and a

copy has been received by each member of the governing body; and

WHEREAS, the Local Finance Board of the State of New Jersey is authorized to

prescribe reports pertaining to the local fiscal affairs, as per R.S. 52:27BB-34; and

WHEREAS, the Local Finance Board has promulgated a regulation requiring that the

governing body of each municipality shall by resolution certify to the Local Finance Board of the

State of New Jersey that all members of the governing body have reviewed, as a minimum, the

sections of the annual audit entitled:

General Comments

Recommendations

and

WHEREAS, the members of the Delaware Township Committee have personally

reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual

Audit entitled:

General Comments

Recommendations

as evidenced by the group affidavit form of the Township Committee; and

WHEREAS, such resolution of certification shall be adopted by the Township Committee

no later than forty-five days after the receipt of the annual audit, as per the regulations of the

Local Finance Board; and

WHEREAS, all members of the Township Committee have received and familiarized

themselves with, at least, the minimum requirements of the Local Finance Board of the State of

New Jersey as stated aforesaid and have subscribed to the affidavit as provided by the Local

Finance Board; and

WHEREAS, failure to comply with the promulgation of the Local Finance Board of the

State of New Jersey may subject the members of the Township Committee to the penalty

provisions of R.S. 52:27BB-52 to wit:

of a misdemeanor and, upon conviction, may be fined not more than one thousand

dollars ($1,000.00) or imprisoned for not more than one year, or both, and in addition

shall forfeit his office.”

NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the

Township of Delaware, County of Hunterdon and State of New Jersey hereby states that it has

complied with the promulgation of the Local Finance Board of the State of New Jersey dated

July 30, 1968 and does hereby submit a certified copy of this resolution and the required

affidavit to said Board to show evidence of said compliance.

WHEREAS, NJS40A:4-87 provides that the Director of the Division of Local

Government Services may approve the insertion of any special item of revenue in the budget of

any county or municipality when such item shall have been made available by law and the

amount was not determined at the time of the adoption of the budget; and,

WHEREAS, the Director may also approve the insertion of an item of appropriation for

equal amount.

NOW, THEREFORE, BE IT RESOLVED that the Township Committee of the

Township of Delaware, in the County of Hunterdon, New Jersey, hereby requests the Director of

the Division of Local Government Services to approve the insertion of an item of revenue in the

budget of the year 2016 in the sum of $11,903.15 which is now available from the County of

Hunterdon Historic Preservation Grant Project; and,

BE IT FURTHER RESOLVED that the Township Committee of the Township of

Delaware, in the County of Hunterdon, New Jersey hereby requests the Director of the Division

WHEREAS, the Township of Delaware in Hunterdon County, State of New Jersey is a

municipal corporation of the State of New Jersey and a “contracting unit” authorized pursuant to

N.J.S.A. 52:34-6.2(b)(3) to use national cooperative contracts as a method of procurement and;

WHEREAS, Houston-Galveston Area Counsel is a regional planning commission and

political subdivision of the State of Texas operating under Chapter 391, Texas Local

Government Code; and,

WHEREAS, Houston-Galveston Area Counsel is authorized to contract with eligible

entities for the purchase of goods and services; and,

WHEREAS, Houston-Galveston Area Counsel has instituted a cooperative purchasing

program under which it contracts with eligible entities; and,

WHEREAS, the Township of Delaware desires to enter into an interlocal contract with

Houston-Galveston Area Counsel for cooperative purchasing as permitted by N.J.S.A. 52:34-6.2

(b)(3);

NOW, THEREFORE, BE IT RESOLVED by the Delaware Township Committee as

follows:

1. The Delaware Mayor and Clerk are hereby authorized to execute an interlocal contract

for cooperative purchasing with the Houston-Galveston Area Counsel;

2. All activities under this agreement will be in accordance with all applicable rules,

regulations, ordinances and laws in effect or promulgated during the term of the agreement;

3. The initial period of the agreement shall be for the balance of calendar year 2016;

4. The purchase of any product will be in accordance with procedures established by

the Houston-Galveston Area Counsel and in accordance with the Laws of the State of New

Jersey;

5. Any payments made pursuant to the agreement will be in accordance with

procedures established by the Houston-Galveston Area Counsel;

6. The agreement may be amended only by a written amendment executed in

accordance with procedures established by the Houston-Galveston Area Counsel;

7. The agreement may be terminated by either party at any time upon thirty (30)

days written notice by certified mail to the other party to this agreement.

Mr. Timothy Soltis, 620 Rosemont-Ringoes Road, submitted the following proposed objectives

to the Township Committee:

Mr. Johnson presented a review of the sidewalk issues and recapped the role the Township

Committee has been taking to find solutions for this issue.

Ms. Kristen McCarthy recalled, that some issues are that the property where the sidewalks would

be placed is privately owned and door to door conversation will need to be done. There might be

some resistance from property owners.

Mr. Herman stated there might be some resistance from residents whose homes would be in the

sidewalk route. There might be residents that will not want the sidewalks close to their homes.

Attorney Hadinger agreed with Mr. Herman that this could affect the residents property, such as

retaining walls, landscaping, etc.

Mr. Timothy Soltis requested the Township Committee consider creating a committee to work

with the Township Committee on the expansion of sidewalks, radar signs, etc. in the

Sergeantsville Village.

Mr. Thompson stated other residents have approached the Township Committee with interest in

creating a sub-committee relating to sidewalk issues. Mr. Thompson will contact the other

residents and verify interest.

Mr. Herman motioned that a resolution be drafted for the October 11, 2016 meeting to authorize

a “Sergeantsville pedestrian safety, walkability and speed safety” committee to work with the

Township Committee on safety issues for the Village of Sergeantsville. Mr. Thompson

seconded the motion. All voted in favor.

PIPELINE UPDATE- PENNEAST APPRAISERS

Mr. Thompson commented that residents have been getting letters from Integra Realty

Resources, a contractor for PennEast, informing residents that their property will be appraised.

Integra Realty resources has been contracted to appraise the value of the proposed PennEast

easement across properties. The letter from Integra stated if residents choose not to let Integra

assessors on the property, they will be assessing property from the public road way. Mr.

Thompson asked to discuss the protocol residents should follow if they choose not to participate

in the appraisal portion of this project. Mr. Thompson asked what steps should the residents take

if the appraisers trespass on their properties and/or on the public road way? Attorney Hadinger

stated the right of way is different for roads and properties. There is no generalized right of way

for all roads and properties.

Mr. Thomas Kowalczyk asked if anyone can conduct business in the right of way in front of his

house.

Mr. Vincent DiBianca asked if a company stops in the road and has equipment can they be asked

to leave.

Attorney Hadinger stated Integra has the right to be on the public road way as long as they are

not obstructing traffic or causing a public safety issue. Attorney Hadinger advised the residents

to ask the trespasser to leave the property. If the appraiser chooses not to leave, then the resident

should notify the Delaware Township Police Department.

Chief Chris Cane stated, if the appraiser enters a resident’s property, the resident should

document the trespassing and can also take pictures or video. The resident can file a suit with

the municipal court for trespassing against the trespasser.

The Township Committee discussed creating no parking restrictions on Township Roads and

how this process could work.

Attorney Hadinger stated no parking can be established and signage would be needed. The main

issue with having no parking is it will have to be enforced for everyone including homeowners

and their guests.

Mr. Johnson stated he will come up with areas where no parking could be created.

The Township committee discussed creating resolutions and letters to mail to Integra Realty

Resources, FERC and other officials as the Township Committee did with the surveyors last year

informing them that the Township opposes use of the public right of way for appraisal activities.

Mr. Herman suggested the Township Committee revise Resolution 2015-57 and 2015-70 which

addressed surveyors, and the letter created in 2015, that went with the resolutions.

Mrs. McKinney will work with Mr. Thompson to revise the resolutions and letter.

Mr. Herman stated an estimate for the re-keying of the municipal building will need to be done.

Mayor Lockwood suggested that Kathy Klink look into obtaining the estimate and report back to

the Township Committee.

COMMENTS OF THE COMMITTEE

Committeeman Thompson reported the following:

Committeeman Herman reported the following:

Mr. Herman asked for an update on vacant properties.

Mr. Johnson stated he is working on developing procedure on these properties. Mr. Johnson has

sent Attorney Hadinger documents to review.

Mr. Herman asked if the Township could offer a place for leaf disposal to residents who have

smaller properties.

Mrs. Klink stated she will research and work with DPW to locate a viable location if possible.

Mr. Herman spoke with Bill Powell regarding the new engineering report, which is needed for a

revised grant application due to change of location for the generators. The location of the two

generators are the DPW building and the Sergeantsville Volunteer Fire House.

Mr. Herman wanted the Township Committee to acknowledge two events for Delaware

Township Childhood Cancer Awareness Day. Two families that have been personally touched

by cancer in Delaware Township sponsored two events. The Mackenzie Wright Family and

residents of Delaware Township participated in The Philadelphia Children’s Hospital walk/run

event which raised almost $19,000.00 and St. Baldrick’s event for Rayanna Marrero at the SVFD

helped raise over $40,000.00.

Committeeman Johnson reported the following:

Mr. Johnson stated Delaware Township has an employee that has an application license and

three certifications that qualify him for spraying of pesticides and herbicides. Mr. Johnson

requests permission to trade in the extra mower that is not in use at DPW to offset cost of a

sprayer with a net cost of $2,380.00. This would cost about the same amount as one season of

spraying would cost.

Mr. Thompson asked about storage and training.

Mr. Johnson stated that we already have the procedure and space for storage. We will buy the

chemicals as we are using them. Delaware Township has better control of procedures for

spraying.

Township Committee members agree this would be in the best interest of Delaware Township.

Mr. Johnson stated DPW has been waiting to hear from Approved Fire Protection. Mr. Johnson

will have Jay Trstensky contact Approved Fire Protection to review documents and set a date for

them to proceed with the repairs at Delaware Township Municipal Building.

Mr. Johnson thanked Delaware Township for the flowers and condolences his family received

for their recent family loss.

RESOLUTION TO GO INTO EXECUTIVE SESSION TO DISCUSS CANADATE TO

FILL A VACANCY OF AN OFFICER FOR THE POLICE DEPARTMENT

RESOLUTION AUTHORIZING CLOSED SESSION

DELAWARE TOWNSHIP COMMITTEE

WHEREAS, Section 8 of the Open Public Meetings Act N.J.S.A. 10:4-12 (b) (1) et seq.

permits the exclusion of the public from a meeting in certain circumstances; and

WHEREAS, the Delaware Township Committee is of the opinion that such

circumstances exist.

NOW, THEREFORE, BE IT RESOLVED by the Delaware Township Committee as

follows:

1. The public shall be excluded from discussion related to the closed session on

September 26, 2016.

2. The general nature of the subject matter to be discussed involves any pending or

anticipated litigation or contract negotiation in which the public body is or may become a

party. In this case the Township Committee will discuss anticipated litigation with

property owners in connection with zoning matters.

3. Any matter involving pending or anticipated litigation or contract negotiation in which

the public body is or may become a party and any matter falling within the attorney-

client privilege to the extent that confidentiality is required to preserve the attorney-

client relationship may be discussed in closed session pursuant to N.J.S.A. 10:4-12(b)(7).

4. The general nature of another subject matter to be discussed involves personnel matters

related to the employment, appointment or termination of current or prospective public

employees, unless all individuals who could be adversely affected request, in writing, that

the matter is discussed at a public meeting. The Committee will discuss items of

personnel, namely, the positions of Planning Board Administrative Officer and

Administrative Assistant.

5. Any matter involving personnel may be discussed in closed session pursuant to N.J.S.A.

10:4-12(b)(8).

6. Where permissible by law, the results of these discussions shall be released to the public

within six months or as soon as possible thereafter.

7. This resolution shall take effect immediately.
