This public document gives the Baker City Police Department's record of what they saw or heard from witnesses when Milo Pope, Andrew Bryan, Jennifer Watkins, and Steve Brocato, came across the street from former Circuit Court Judge and current City Councilor Milo Pope's law office to confront Jason Bland and myself on public property where we had been documenting Milo Pope's meeting with former City Manager Steve Brocato, who is suing the city, four Councilors and a private citizen. Mr. Pope was also meeting with other former city Councilors and an ex-assistant City Manager, most of whom were active supporters of a recent failed recall against two of the four Councilors who had voted to fire Mr. Brocato. Milo was skipping his duty to attend to city business at a Council meeting that was going on at the time. The report is a generally accurate account of what happened, but there are some errors of fact, in my opinion, from my perspective as a participant in the events. -Chris

SUPPLEN4ENTAL:On August 24, 2010 at about 2043 hours I responded with Officer Plaza to the disturbance at1990 td St. Baker City, OR. As I walked up to the scene behind the Yervasi Law office lsawAndrew Bryan, Milo Pope, Chris Christie and Jennifer Watkins talking to one another. Officerplaza wasialking with Jason Bland further down the sidewalk on Washington St. I asked Jenniferwhat was going on and she told me she was not sure. She told me Steve Brocalo and JasonBland had some words with each other but she told me she did not know what happened l askedher where Steve was and she told me she thought he was inside the office stil l At this time Icould hear Jason tell Officer Plaza that he was assaulted by Steve. I walked into the officethrough the back door and saw Sleve Brocato walking down the hallway. I asked Steve whathappened and he told me Jason Bland and Chris Christie were photographing them when theystepped out of the office because Milo was not at the city council meeting like Jason and Christhought he should have been. He told me he and Jason got into an argument about it l askedStev; if it gol physical between the two of them and he replied, "No, I did not touch him "

I did not see any signs on Steve that led me to believe he had been in a fight l walked backoutside to talk with officer Plaza. officef Plaza was interviewing chris and I spoke with Jasonwho told me how he lhought it was wrong lhat Milo was having beer and pizza with Steve' whohas a law suit against the City of Baker, and that l\4ilo was not at the city council meeting thatevening. Jason did tell methat Steve knocked his hatoffduringthe argument but later toldOfficer Plaza and I that he did not wish to press charges.

SUMMARY:On August 24, 2010 at about 2043 hours, Steve Brocato got into an argument with Jason Bland infront oi2001 2nd Slreet, Baker C1y, Oregon. During the argument Brocato knocked the baseballhat Bland was wearing off of his head. Bland did not wish to pursue charges.

NARRATIVE:On August 24, 2O1O at about 2043 hours, lwas dispatched to Ace Hardware at 2001 2nd Street'Baker bity, Oregon for the report of Jason Bland trying to start a fight While I was driving to thearea dispatch advised Bland was trying to start a fight with Steve Brocato.

When I arrived to the area I saw Andrew Bryan, Jennifer Watkins, and Milo Pope' all of whom Iknew from previous contacts, talking with christopher Christie and Jason Bland' whom I lateridentified by their oregon Driver's licenses. They were now standing across the street from AceHardware ;n the south side of the road. Officer Downing arrived near the same time as me Seehis supplemental report for further details.

When I got out of my car I was approached by Jason Bland Bland was saying he was assaultedby Stev; Brocato and that everybody else there had touched him Bland and lwalked away fromthe group and spoke.

Bland told me he and Christie had come to the area to photograph a meeting between Bryan,Watkins, Brocato, and Pope. Bland said the reason was because Pope was currently skipping acity council meeting to be there and he was concerned due to the fact Brocato was suing the cily.The meeting was in Pope's office at 1990 3rd Sheet, Baker City, oregon

Bland said he was sitting in his car which was parked on the north side of washington street andchristie was about 1oo feet west of him on his bike taking the pictures. Bland told methegroupcaught Christie taking the pictures and walked across the streel to confront him

Bland said Pope walked across lhe street and got in front of christie's bike, straddling the fronttire. Bland heard Pope call christie a creep and walked over to assist him. Bland arrived to Popeto confront him and was approached by Brocato. Bland stated Brocato got in his face and startedyelting at him and then flipped the baseball hat off of his head by hitting the bill with his hand.

Bland said he felt threatened by it and thought Brocato was going to hit him. The argumentescalated and proceeded back across the slreet nearthe back of Pope's office Once the twowere separated Brocato went back inlo Pope's office and called the police.

Inextspokewith Christie. Christie said he had been there to photograph the meeting. Christiesaid at one point Brocato came outside and saw the flash of his camera. The whole group cameoutside and everybody but Brocato came across the street.

christie said Pope called him a creep and some other names Christie said he knew Pope anddid not feel threatened by Popes words. Christie added he was worried Pope might try to take orharm his camera so he secured it around his neck The group continued to argue with Christie,and Bland walked up from his car and an argument started between him and Pope. Christie saidBrocato then came from across the street, got into Bland's face, and began yelling at Bland.Christie said Brocato then knocked Bland's hat off his head by hitting the bill

Christie said Bland got very angry when his hal was hit, he added he had never seen Bland actlike that. The argument then escalated and Pope and Bryan started to try and separate the twoChristie said he couldn't provide speciflc details about what happened then because he wastalking to Watkins.

christie said the afgument across the street continued to escalate until Brocato was separatedfrom the two and went inside to callthe police. We arrived shortly after

I then spoke with Bryan. Bryan told me about having the meeting with friends and having Brocatotell them that someone was outside taking pictures. Bryan said they then went outside to confrontthem. Bryan said they started across ihe street and Pope confronted Christie Bryan said whilepope wai talking to him he noticed someone in a vehicle behind them. Bryan started toward thevehicle and then Bland got out and walked towards the group

Bryan said Bland started to confront Pope and then Brocato and Bland started yelling at eachother. Bryan said Brocato knocked the hat off of Bland's head and then the argument got veryheated. Bryan said he and Pope tried to separate the two and the argument continued across thestreet. Bry;n said across the street Brocato and Bland were slill yelling back and forth and lookedas though they may fight. Bryan said he atso was yelling at Bland and trying to separate the h^'oAfter the two ieparated Brocato went inside Pope's office and called the police Bryan saidbesides trying to separate the two there was no physical contact

I next spoke with Pope. Pope told me about the meeting with his friends and then flnding outsomeone was talking pictures of them. when lhey went outside Pope said he walked across thestreet and told Chrisiie what he thought of him. Pope said while he was talking with Christie Bland

approached them. Pope stated he and Bland argued and then Brocato and Bland got into a moreheated argument. Pope said Brocato knocked Bland's hat off and then the argument escalated

pope said he tried to separate Brocato and Bland and the argument continued across the street.Eventually Pope and Bryan got the tur'o separated and Brocato went inside and called the police'Pope said besides trying to separate the two the confrontation was verbal only.

I then walked over and spoke with Bland again. ltold Bland he could file a harassment report ifhe wanted. Bland said he did not wish to pursue any criminal charges. Both Bland and Christierequested a report be pulled to document the incident lexplained to them a report wasn't goingto be pulled but the incident would stil l be documented in our local electronic system

When I cleared the area I called dispatch and advised them on what had happened

On August 27, 2010 the report was pulled to document the incident per Chief Lohner'
