NOTIFICATION

In continuation of notification No. F. 6(5-134)-GLlPRl93 dated 28-10-1994 and in .exercise of the powers conferred by sections 32,92 and 145 of the Tripura PanchayatsAct. 1993 the State Government hereby assigns the powers and functions as mentionedbelow to the Gram Panchayats, Panchayat Samitis and Zilla Parishads to enable thesaid Panchayats to function as vibrant institutions of self Government.

1. Name of Department : Agriculture (including Horticulture)

1.2 Functional empovverment

(a) Transfer of responsibility for implementation of all schemes including CSSexcept special individual/pilot projectlwork needed for State level function.This will include right from selection of beneficiaries upto the end ofexecution subject to scheme guidelines and orders of the State Govt. asmay be issued from time to time.

(b) Transfer of all Farms, Orchards and Hiring centres, Markets except farmslorchards needed for State level function or those which cannot betransferred for any special reasons.

(c) Transfer of power of supervision and control for management and functioningof VLW stores.

1.3 Administrative empovverment

(a) Deputy director posted in the District will be deslqnated as the Deputy ChiefExecutive Officer, (Agri) for 'his functioning in.; the ZP. Similarly,Superintendent, (Agri) posted in the Block win be disignated as the AdditionalExecutive Officer, (Agri) for his functioning in Ute Panchayat Samiti. In theGram Panchayat, full time service of the VLW/Agri Assistants will be placedwith Gram Panchayat. •

(b) Responsibility for payment of salary, Establishment expenses andhanding ofother administrative matters will, however, continue to be with DeputyDirector and Supdt. Agri under the System prevaing for Officers and Staff ofthe Panchayat and RD Department. (SC$-u.e0 c)·e (;)~Q_?" ~ Gt

(c) Accounts, Establishment matters including disciplinary matters, Audit willcontinue to be performed by the Head of Department, Head of Office andDDOs of the Department under existing manner.

(d) Transfer of Group-C and D staff of the Department within the District relatingto the implementation of the transferred schemes I institutions will be issuedby the Deputy Director, Agriculture I Horticulture (Deputy Chief ExecutiveOfficer) with' concurrence of the respective Zilla Parishad. However, theGovernment reserves the right to transfer any Govt. servant wjthin the state inpublic interest. All transfer posting of Group-A and B Officers within andoutside the District and all inter District transfers of Group-C and D staff willcontinue to be done by the Department.

(e) The Zilla Parishads will have authority to utiJisethe services of all field staffrelating to the implementation of the transferred schemes I Institutions postedin the establishment of Deputy Director. Similarly, Panchayat Samitis will haveauthority to utilise the services of the all field staff posted in the establishmentof Superintendent of Agriculture related to the implementation of thetransferred schemes I institutions The appropriate level of Panchayat RajBody will have authority to closely monitor the performance of the suchemployees within their jurisdiction and will send performance reports atperiodic intervals of not exceeding a quarter commenting on the performanceto the Controlling Officer of concerned Deptt. It is mandatory on the part ofthe Controlling officer to look into the observation made in the performancereport and take necessary action on the observations under intimation to thePRI within one month of the receipt of the report.

1.4 Financial empowerment

(a) All programme funds of the Department earmarked for the Panchayatareas of the District under the District Plan I Departmental plan relating to theschemes aSsigned to the PRls for implementation will be placed with ZillaParishad for coordinated expenditure as per scheme guidelines and orders ofState Govt.as may be issued from time to time. It would be the responsibilityof the Zilla Parishad to sub-allocate the fund according to the Plan approvedby the Zilla Parishad for the Panchayat Samiti areas. The Panchayat Samiti inturn will re-allocate the fund among the Gram Panchayats according to theannual plan finalised by the respective Block. The method I formulae of sub-allocation I re-allocation will also be subject to scheme guidelines and ordersof State Govt. as may be issued from time to time. .4.

(b) The Gram Panchayat will have authority to sanction scheme uptoRS.50,OOOI-.The Panchayat Sarniti will have authority to sanction schemeupto RS.2,OO,OOOJ-.The Zilla Parishad will have authority to sanction schemeupto Rs.5,OO,OOOI-This power can be exercised subject to the observance ofcodel formalities, instructions and guidelines as may be issued by the StateGovernment from time to time.

2. Name of Department :- Fisheries.,

2.1 Functional empowerment

(a) Transfer of responsibility for implementation of all schemes includinqCSS except speciaJ individual! pilot project! work needed for State levelfunction. This will include right from selection of beneficiariesupto the endof execution subject to scheme guidelines and orders of State Govt. asmay be issued from time to time.

(b) Transfer of all water areas including tanks, mini-barrage, lakes etc. of theDepartment except water areas needed for State level function likeDumbur Lake, Rudrasagar etc. or those which canrrot be transferred forany special reasons.

! 2.2. Administrative empowerment

(a) Deputy Director posted in the District will be designated as the DeputyChief Executive Officer, (Fisheries) for his functioning in the ZP. Similarly,Superintendent, (Fisheries) posted in the Sub-divisions will be designated asthe Additional Executive Officer, (Fisheries) for his functioning in thePanchayat Samiti. Full time service of the. Fishery Officers !Inspectors willbe placed with Panchayat Samiti. In the Gram Panchayat full time serviceof the Fishery Assistants will be placed.

(b) Responsibility for payment of salary, Establishment expenses andhandling of other administrative matters will, however, continue to be withthe Deputy Director and Supdt.Agri under the system prevailing for Officersand Staff of the Panchayat and RD Department.

(c) Accounts, Establishment matters including disciplinary matters, Auditwill continue to be performed by the Head Department, Head of Office andDDOs under existing manner.

(d) Transfer of Group-C and 0 staff of the Department within the Districtrelating to the implementation of the transferred schemes! water areas will beissued by the Deputy Director,Fisheries (Deputy Chief Executive Officer) withconcurrence of the respective Zilla Parishad. However, the Governmentreserves the right to transfer any Govt. servant within 1he. State in publicinterest. All transfer posting of Group-A and B Officers within and outside theDistrict and all inter District transfers of Group-C and D staff will continue to bedone by the Department.

(e) The Zilla Parishads will have authority to utilise the services of all field staffrelated to the implementation of the transferred schemes I water areas postedin the establishment of Deputy Director. Similarly, Panchayat Samitis will haveauthority to utilise the services of the all field staff, posted in the establishmentof Superintendent, Fisheries having jurisdiction in the Block, relating to theimplementation of the transferred schemes I water areas. The appropriatelevel of Panchayat Raj Body will have authority to closely monitor theperformance of such employees within their jurisdiction and will sendperformance reports at periodic intervals of not exceeding a quartercommenting on the performance to the Controlling Officer of concernedDeptt. It is mandatory on the part of the Controlling officer to look into theobservation made in the performance report and take necessary action on theobservations under intimation to the PRI within one month of the receipt of thereport.

2.3 Financial empowerment

3.1 Functional empowerment

(b) Transfer of Veterinary Dispensaries to Panchayat Samiti andStockmen Sub-centres and First Aid centres to Panchayat Samiti orVillage Panchayats as may be decided by the Department.

3.2. Administrative empowerment

(a) Deputy Director posted in the District will be designated as theDeputy Chief Executive Officer (AR) for his functioning in jhe ZP.Similarly, Assistant Director (AR) posted in the Sub-divisions will bedesignated as the Additional Executive Officer, (AR) for his functioning inthe Panchayat Samiti. Full time services of Veterinary Surgeons will beplaced with Panchayat Samiti and staff of Stockmen Sub-Centres,. FirstAid Centres will be placed with Panchayat Samiti or Gram Panchayat asmay be decided by the Department.

(b) Responsibility for payment of salary, Establishment expenses andhandling of other administrative matters will, however, continue to be withthe Deputy Director and Assistant Director(AR) under the systemprevailing for Officers and Staff of the Panchayat and RD Department.

(c) Accounts, Establishment matters including disciplinary matters,Audit will continue to be performed by the Head of Department, Head ofOffice and DDOs under existing manner.

(d) Transfer of Group-C and 0 staff of the Department within theDistrict relating to the implementation of the transferred schemes Iinstitutions will be issued by the Deputy Director, Animal ResourceDevelopment Department (Deputy Chief Executive Officer,ARD) withconcurrence of the respective Zilla Parishad However, the Governmentreserves the right to transfer any Govt.servant within the State in publicinterest.AII transfer and posting of Group A and B Officers within andoutside the District and all inter District transfers of Group-C and 0 staffwill continue to be done by the Department.

(e) The Zilla Parishads will have authority to utilise the services of all fieldstaff relating to the implementation of transferred schemes I institutionsposted in the establishment of Deputy Director; Similarly, PanchayatSamitis will have authority to l!tilise the services of the all field staffposted in the establishment of Assistant Director(AR) having jurisdictionin the Block relating to the implementation of the transferred schemes Iinstitutions. 4. Name of Department :- Education Department.(including Social Education)

4.1 Functional empowerment

(a) Transfer of power of supervision of all Primary Schools, Balwadi,ICDS and Adult Education centres to the Village Panchayat. Similarly,transfer of power for supervision of Senior Basic, Hi§h Schools and HigherSecondary Schools to the Panchayat Samitt. The Zilla Parishad will exerciseover-all supervision of all educational Institutions within the District uptoHigher Secondary level.

(b) The appropriate level/levels of PRI Body / Bodies will haveauthority to implement supervise and monitor followingprogrammes / schemes .

.,(i) Promotion of hundred percent enrolment of children in primary school

and initiative measures to reduce drop-outs.

(ii) Management, Supervision and Control over all Ba(ahar programme,TLC programme and schemes of similar nature.

(iii) Selection of beneficiaries, supervision and monitoring of Old Agepension scheme and other schemes of similar nature.

(iv) Execution of implementation of all works of construction andmaintenance of houses and buildings of all Institutions upto Primarylevel.

(v) Supervision and monitoring of schemes for payment of stipend, bookgrants etc.

4.2 Administrative empowerment

(a) Deputy Director posted in the District will be designated as the DeputyChief Executive Officer, (Education) for his functioning in the ZP. SimHarly,Inspector of Schools posted in the Sub-divisions will be designated as theAdditional Executive Officer, (Education) for his functioning in thePanchayat Samiti.

(b) Responsibility for payment of salary, establishment expenses, andhandling of other administrative matters will, however, continue to bewith the Deputy Director, Inspector of Schools, Headmaster of High/Higher Secondary Schools.

(c) Accounts, Establishment matters including disciplinary matters,Audit will continue to be performed by the Head of Department, Head ofOffice and DDOs under existing manner.

(d) Transfer of all Group-C and D staff of .the Department under Highand Higher Secondary establishment within the District and transfer of allGroup-C and D staff right from pre-primary to Senior Basic level within nen-ADC area of the District will be issued by the Deputy Director, Education(Deputy Chief Executive Officer, Edn) with concurrence of the respectiveZilla Parishad. However, the Government reserves the right to transfer anyGovt. servant within the State in public interest. All transfer posting ofGroup-A and B Officers within and outside the District and all inter Districttransfers of Group-C and D staff will continue to be done by theDepartment.

(e) The appropriate level of Panchayat Raj Body will have authority toclosely monitor the performance ·of the employees working in the institutionwithin their jurisdiction and will send performance reports at periodicintervals of not exceeding a quarter commenting on the performance to theControlling Officer of concerned Deptt. It is mandatory on the part of theControlling officer to look into the observation made in the performancereport and take necessary action on the observations under intimation tothe PRI within one month of the receipt of the report.

The Panchayat Samiti in turnwill re-allocate the fund among the Gram Panchayats according to the annualplan finalised by the respective Block. 5. Name of Department :- PWD including IFe & PHE

5.1 Functional empowerment

(a) Transfer of responsibility for selection of sites and projects exceptprojects having inter District and State level importance.

(b) Transfer of management of Minor irrigation projects, water supplyprojects, to Panchayats as per scheme that may be evolved by theGovt. in this regard except major repairs, replacement and salaryand establishment expenses.

5.2 Administrative empowerment

(a) Superintending Engineer posted in the District will. be designatedas the Addl. Chief Executive Officer, (PWD,IFC &PHE)) for hisfunctioning in the ZP. Similarly, Senior Assistant Engineer I SDO of theDepartment posted in the Sub-divisions I Block will be. designated asthe Additional Executive Officer, (PWD,IFC & PHE) for his functioningin the Panchayat Samiti. .

(b) Responsibility for payment of salary, Establishment expenses andhandling of other administrative matters will, however, continue to bewith the DDOs of the Department from Departmental fund.

(c) Accounts, Establishment matters including disciplinary matters,Tender matters, Audit, Store etc. will continue to be performed by theDepartmental Engineers functioning as Head of Department, Head ofOffice and DDOs under existing manner.

(d) Transfer of Group-C and 0 staff of the Department within the Districtrelating to the implementation of the transferred schemes I works willbe issued by the' Superintending Engineer (Addl.Chief Executiveofficer) with concurrence of the respective Zilla Parishad. However, theGovernment reserves the right to transfer any Govt.servant within theState in public interest. All transfer posting of Group-A and B Officerswithin and outside the District and all inter District transfers of Group-Cand 0 staff will continue to be done by the Department.

(e) The Zilla Parishads will have authority to utilise the services of alltechnical staff, relating to the implementation of the transferredschemes I works posted in the establishment of Executive Engineer.Similarly, Panchayat Samitis will have authority to utilise the services ofthe all technical staff, relating to the implementation of the transferredschemes / works, posted in the establishment of Assistant Engineer ISDO having jurisdiction in the Block.The appropriate level of Panchayat

5.3 Financial empowerment

(a) The Panchayat will be authorised to levy and collect tax / charges forproviding benefit to the beneficiaries subject to the guidelines as may beframed in this regard by the Government. Operational cost except major repair/ replacement for running these projects will be borne by the Panchayats.However, Salary and establishment cost of the staff will be borne by theDepartment.

6. Name of Department :- Power Department

6.1 Functional empowerment

(a) Transfer of responsibility .for selection of sites for extension of LTpower lines for public benefit.

(b) Transfer of management of Call Centres to Panchayats exceptsalary and establishment expenses of staff.

(c ) Transfer of responsibility for collection of power tariff from theconsumers in the villages on commission basis as per scheme thatmay be evolved by the Department.

6.2 Administrative empowerment

(a) Superintending Engineer posted in the District will be designated asthe Addl.Chief Executive Officer, (Power) for his functioning in the ZP.Similarly, Senior Assistant Engineer / SDO of the Department postedin theSub-divisions / Block will be designated as the AdditionalExecutive Officer, (Power) for his functioning in the Panchayat Samiti.

(b) Responsibility for payment of salary, Establishment expenses andhandling of other administrativematters will, however, continue to be

(d) Transfer of Group-C and 0 staff of the Department within the Districtrelating to the implementation of the transferred schemes I institutionswill be issued by the Superintending Enqineer (Addl.Chief Executiveofficer) with concurrence of the respective Zilla Parishad. However, theGovernment reserves the right to transfer any Govt.servant within theState in public interest. All transfer posting of Group-A and B Officerswithin and out side the District and all inter District transfers of Group-Cand 0 staff will continue to be done by the Department.

(e) The Zilla Parishads will have authority to utilise the services of alltechnical staff relating to the implementation of the transferred schemesI institutions posted in the establishment of Executive Enqineer.Similarly, Panchayat Samitis will have authority to utilise the services ofthe all technical staff relating to the implementation of the transferredschemes I institutions posted in the establishment of Assistant EngineerI SDO having jurisdiction in the Block. The appropriate level of

(a) The Panchayat may be authorised to collect power tariff from theconsumers on commission basis as per scheme as may be evolved bythe Department. Rate of Commission and modalities for operation ofthe same will be issued from the Govt. The Panchayats will beresponsible for ensuring deposit of tariff on monthly basis in theAccount of the Department after retaining the part of its commission asper scheme guidelines.

7. Name of Department :- Health and Family Welfare

7.1 Functional empowerment

(a) Transfer of power of supervision of all Primary Health centres/Homeopathec/Ayurbedic Dispensaries will be entrusted to thePanchayat Samity. Similarly, power of supervision of all Dispensaries/ Sub-centres will be entrusted to Gram Panchayats / PanchayatSamiti as may be decided by the Department. The Zilla Parishad willexercise over-all supervision of all Health Programmes within theDistrict including supervision of Rural Hospitals.

(b) Transfer of responsibility for over-all supervision and monitoring ofHealth programmes under different schemes including CSS.

(c ) Selection and engagement of Community Health Guide, Personsengaged for DOT spray and similar other schemes subject to theguidelines of the State Government.

(d) Implementation of all works of construction and maintenance ofhouses and buildings of all Dispensaries and Health sub-centres.

7.2 Administrative empowerment

(a) Chief Medical Officer posted in the District will be designated asthe Deputy Chief Executive Officer, (Health) for his functioning in theZP. Similarly, In-charge, Rural Hospitals / PHCs posted in the Blockarea will be designated as the Additional Executive Officer, (Health)for his functioning in the Panchayat Samiti.

(b) Responsibility for payment of salary, establishment expenses, andhandling of other administrative matters will, however, continue to bewith the respective DDOs from Departmental fund.

It is mandatory on the part of the Controlling officer to lookinto the observation made in the performance report and take necessary actionon the observations under intimation to the PRI within one month of the receiptof the report.

7.3 Financial empowerment

(a) All programme funds of the Department earmarked for the Panchayatareas of the District under the District Plan I Departmental. plan relating to theschemes assigned to the PRls will be placed with Zilla Parishad forcoordinated expenditure as per scheme guidelines and orders of the StateGovt. as may be issued from time to time. It would be the responsibility of theZilla Parishad to sub-allocate the fund according to the Plan approved by theZilla Parishad for the Panchayat Samiti. The Panchayat Samiti in turn will re-allocate the fund among the Gram Panchayats according to the annual planfinalised by the respective Block. The method I formula of sub-allocation I re-allocation will also be subject to scheme guidelines and orders of the StateGovt. as may be issued from time to time.

(b) The Gram Panchayat will have authority to sanction scheme uptoRs.50,OOOI-. The Panchayat Samiti will have authority to sanction schemeupto Rs.2,OO,OOOI-. The Zilla Parishad will have authority to sanction schemeupto Rs.5,OO,OOOI-. This power can be exercised subject to the observance ofcodel formalities, instructions and guidelines as may be issued by the StateGovernment from time to time.

8. Name of Department :- R. D. Department.

8.1 Functional empowerment :-

(a) Transfer of responsibility for planning and implementation of all schemesincluding CSS. This wili include right from drawing up of plan, selection ofsites, preparation of schemes, selection of beneficiaries and execution asper schematic pattern, guidelines anp instructions and orders of the StateGovt. as may be issued by the State 'Govt. from time to time.

(b) Transfer of responsibility for maintenance of assets created from the fundof RD Department including RWS.

(a) Services of Executive Engineer,RED posted in the District will bedesignated as Deputy Chief Executive Officer, Rural Engineering for hisfunctioning in Zilla Parishad.

(b) Services of all field staff posted in the Block such as JuniorEngineers, Work Assistants, Mechanics, RD Officers, RD Organisers, GramSebikas are placed at the disposal of respective Panchayat Samiti.

(c) Responsibility of payment of salary, establishment expenses and handlingof other administrative matters will however continue to be with theDepartment.

(d) Accounts, establishment matters including disciplinary matters, audit etc.will continue to be performed by the Department through appropriateauthority/Agency.

(e) Transfer of Group-C and D staff of the Department within the Districtrelating to the implementation of the transferred schemes / works will beissued by the Chief Executive Officer (D.M & Collector) with concurrence ofthe respective Zilla Parishad. However, the Government reserves the right totransfer any Govt.servant within the State in public interest. All transferposting of Group-A and B Officers and all inter District transfers of Group-Cand D staff will continue to be done by the Department.

(a) Services of all staff of the Department posted in the District, including office ofthe District Panchayat Officers are formally placed with the Zilla Parishad.Similarly all staff of the Department in the Block Offices are formally placed at thedisposal of the Panchayat Samitis . In respect of staff of the Department posted inthe Grams, the services are placed with respective Gram Panchayats.

(b) Responsibility for payment of salary, establishment expenses, handling ofother administrative matters will however continue to be with the Department.
