Constitutional Safeguards for Afghan Women,

Art.22, . prohibiting discrimination among the citizens of Afghanistan, and declaring that both men and women have equal rights and duties before the law, discriminatory customary laws could be challenged on the basis of these equality guarantees.

Article 53, The rights and privileges of women without caretakers are upheld by the state.

Article 54 explicitly deals with the rights of women, recognizing the family as the fundamental unit of society and requiring that the state adopt “necessary measures to ensure physical and psychological well being of family, especially of child and mother, upbringing of children and the elimination of traditions contrary to the principles of sacred religion of Islam”.

Although under Afghan law the legal age of marriage is 18 for men, and 16 for women,

Afghanistan’s Constitution says , Men and Women are Equal .
