BACKGROUND OF THE STUDY

• Legal empowerment of the grassroots of a community which is not limited only to the women, children, or even the poor; for the most part it does not begin in the courtrooms. Legal empowerment springs from the smallest part of a society, which is the community, and in the case of the Philippines, it starts in the barangay level.

• Information dissemination regarding Human rights, Welfare and protection of women and children, knowledge of the basic law of the land, and procedures pertaining to mediation is a necessity for a society.

• Under the Article 3 Section 15 Philippine Constitution it is stipulated that courts are required to follow a schedule to decide a case to wit: Supreme Court, 24 months; 12 months for all collegiate courts; and 3 months for all other lower courts, despite this constitutionally mandated rule, the courts have been having a hard time following schedules.

STATEMENT OF THE PROBLEM

• this study will be conducted to assess the level of effectivity of the Legal Information and Dissemination Program through the assessment of knowledge and level of implementation of the said knowledge of the barangay officials regarding the Katarungang Pambarangay which is a major topic of the Legal Information and Dissemination program

Scope and Limitation of the Study

• The study will cover the 3 political districts of the Island

Garden City of Samal namely Babak, Samal, and

Kaputian, wherein the researcher intends to gather data from the barangay officials of the barangays located in the urban area of each district and barangays which are located in the rural areas of each district. Therefore, there will be 2 barangays from each district wherein the members of the lupong tagapamayapa will be interviewed. Thus, there will be a total of 60 lupong tagapamayapa members which will be interviewed

which includes 6 Punong Barangays from the 6 barangays.

• The grassroots of the community is not just composed of people that are able to have access to the law, but also those who does not even recognize it and this is where oppression begins, in the ignorance of the law.

“Poverty is amongst the gravest human rights challenges in the world. It embodies a range of interrelated and mutually reinforcing deprivations, and is associated with stigma, discrimination, insecurity and social exclusion. Poverty is not simply the lack of material goods and opportunities such as employment,

ownership of productive assets and savings. It is also the lack of intangible assets and social goods, such as legal identity, good health, physical integrity, freedom from fear and violence, organizational capacity, the ability to exert political influence, and the ability to claim rights and live in respect and dignity. A human rights approach to development is fundamentally concerned with empowerment, believing that poverty results from disempowerment and multiple exclusions. (Ban Ki-Moon, 2009)”

• Local Government Code, in Section 17, paragraph b, sub paragraph iii, the barangay is tasked to maintain the Katarungang Pambarangay Act or the PD 1508 of 1978

Katarungang Pambarangay Act/PD 1508

• Presidential Decree No. 1508- It is a System of Amicably Settling Disputes at the Barangay Level. The barangay justice system is an extrajudicial system wherein disputes are settled within the barangay for speedy disposition of justice and also to minimize referral of such cases to the court.

The Lupong Tagapamayapa

• The Katarungang Pambarangay under the Local Government Code of 1991 mentions that every barangay must have an appointed Lupong Tagapamayapa. This is a duty which is vested upon the Punong Barangay, wherein the appointment does not have to be confirmed and approved by the Barangay Council.

• The Lupong Tagapamayapa is composed of 10 to 20 members depending upon the discretion of the Barangay Captain and the limitation of the barangay budget. A conciliation team composing of three lupon members shall also be formed in order to create a Conciliation Council or the Pangkat Tagapagkasundo.

Cases which can be tried under the Katarungang Pambarangay Act

• All civil cases involving individuals who are residing in the same city or municipality, regardless of the amount involved.

• Criminal offenses punishable by imprisonment exceeding one (1) year or a fine exceeding Five thousand pesos (P5,000.00) are exempt from the coverage of the katarungang pambarangay law.

Island Garden City of Samal

• The Island Garden City of Samal ( IGaCos ) was created with the merger of the municipalities of Babak, Samal, and Kaputian by virtue of Republic Act. No. 8471 which was approved by then President Fidel V. Ramos on January 30, 1998 , and later ratified by the its residents on March 7 of the same year.

• The study will use descriptive-evaluative method, it will describe the level of knowledge and utility of the information gained by the barangay officials from the lectures and information disseminated from the Legal Information and Dissemination Program of the Island Garden City of Samal.
