Play-Based Regulation

Why is Alberta considering PBR for unconventional oil and gas development?

PBR - Single Application Process

Play-Based Regulation Pilot

PBR Pilot Application Guide, December 2014 •  Pilot: Sep - Dec 2014 (extended to Mar 2015) Pilot Region •  Duvernay play Objectives •  Regulatory process efficiency •  Operator collaboration •  Stakeholder understanding and engagement •  Minimizing cumulative environmental effects

The Project

Stantec supported proponent with bundled integrated water infrastructure system application in advance of PBR pilot.

Page 8: ppt watertech-1

Duvernay Project •  Used PBR approach in Simonette area prior to

official pilot •  Scope focused on infrastructure components to

support water withdrawal in an unconventional play

•  Stantec supported developer through the application/approval process

Page 9: ppt watertech-1

Project Schedule •  Application prep and regulatory

consultation: June/July 2014 •  Application submission: July •  Staggered approval: September to

December

Lessons Learned

What successes and challenges were learned from the PBR process?

3

Page 11: ppt watertech-1

Successes

•  AER – coordination role with other departments •  Multiple approvals through one application •  Improved regulatory review times •  Staggered approvals •  Operational flexibility

Page 12: ppt watertech-1

Challenges

•  No regulatory precedent •  New application process combined with relatively

new regulator •  AER not one-window (i.e., ACO) •  AER’s current IT systems do not align with

PBR approach

Page 13: ppt watertech-1

Future Considerations

What can proponents do to better position their applications under the PBR process?

4

Page 14: ppt watertech-1

Internal Understanding

Understand Your Project •  Set temporal, spatial, and technical boundaries •  Identify project components •  Determine stakeholders Application Process Understanding •  How does the regulatory process work? •  Set up action/decision tracker with AER

Page 15: ppt watertech-1

External Understanding

Consultation and Engagement •  AER and ACO •  Develop consultation and engagement plan Collaboration •  Collaborate with regional players during all

phases of development

Page 16: ppt watertech-1

Available Information

Existing Information •  What information exists for the project area? •  Stakeholder •  Internal or third party information

Gaps •  Is further data collection/analysis required? •  Baseline data •  Analysis/Assessment (e.g., cumulative effects)

Page 17: ppt watertech-1

Understand Risk

Understand Regional Issues •  Environmental (land, water, air) •  Socio-economic •  Cultural Risk Management •  Risk identification and analysis •  Risk evaluation and treatment •  Reporting

Page 18: ppt watertech-1

Reporting

Post-Approval Monitoring and Compliance •  Report on commitments made during

application process •  Compliance with approval conditions for

project life cycle

Page 19: ppt watertech-1

Conclusions

•  AER still “ironing out the kinks” with PBR •  Understand the limitations of the PBR process •  Look for New Activity Lifecycle Assessment in June
