    As Commissioner Paterson, Barbara Livingston of the CRA and Jack Galante of Galante

    Vineyards stated in various and different ways: the concept, licensing and representation is too

    muddled and sketchy. We believe that

    it

    is imperative that

    the type of

    license be identified and

    approved prior to the approval

    of

    any project

    to

    see

    if

    it

    is consistent with

    the cond

    it ions and

    guidelines that are in force.

    The concern of the Carmel Wine Walk by-the-Sea tasting rooms is that when we have new

    tasting roo s

    to

    our city,

    We do not want to undermine the experience of tasting Monterey County wines

    a. the City Council, the Planning Commission, the Carmel Chamber

    of

    Commerce, the

    Carmel Resident's Ass

    iation, the Innkeepers Association, the Monterey County

    Vintners and Growers Association and the Carmel Wine Walk by-the-Sea as well as

    many others have worked diligently in creating a destination marketing program to

    bring in quality visitors and appeal

    to

    the Carmel locals in order

    to

    regulate and

    responsibly re

    pr

    esent Monterey County and

    our

    local growers vintners.

    b. it is important

    to

    note that there is no condition that wou

    ld

    prevent a large Napa,

    Sonoma or other winery coming to Carmel-by-the-Sea and pouring their wines

    b Licensing issues for clarification:

    a. All off-s ite tasting rooms require a Duplicate 02 License. This is the law.

    b. Those who

    do

    pourin

    g s

    to the pub lic under a Type 42 License (like Southern

    Latitudes and Neilson's) re NOT tasting rooms. They buy other people's wines and

    sell them along with limited tastings allowed under their license. In addition, they

    usually hold other licenses, such as a Type 20 or a Type 21 so they can sell the

    wine.

    From my perspective, turning off the holiday lights is simply complyi

    Policy on Hol iday Lighting. A flip of the switch would do it

    The up-lights have been

    on in

    addition to the holiday lights, why, I don t know.

    While the Planning Commission sub-committee considers lighting, along with signage

    and awnings, we could all be evaluating the Ocean Avenue median islands without any

    lights. It would provide a respite from lights, and allow our creativity to imagine more

    tasteful illumination, if year round lighting on Ocean Avenue is deemed preferable.

    I'm sorry to have left so abruptly after delivering Skip's written comments regarding the

    Flanders' prel iminary options report. I felt like a rat abandoning a sinking ship, but I

    needed to get my ail i

    larynx to the warmth of home.

    I apologize for not identifying myself, not once, but twice when I came forward to speak

    to you . I'd planned to apologize in front of you, but forgot. It's said that the mind is the

    first to go. I thought

    it

    was my cataracts and bum knees

    I do hope you take to heart the kernel of truth

    in

    the resolution I presented. Almost two

    years ago I suggested to the Council that it not vote on something that would change

    the face of Carmel, but refer the median lighting issue to the Planning Commission.

    Although a motion to do so was formulated,

    it

    was voted down. Hence, the motion to

    keep the holiday lights on year round passed.

    However, a Resolution reflecting that motion was never passed by the Council. Hence,

    the Council Policy C95-08 should be honored and the holiday lights in town, both

    commercial and municipal, be doused.

    Meanwhile, the subject of what to do in

    the future regarding the median lighting can be

    discussed at the Planning Commission. I hope, a committee comprised of residents,

    both

    in

    town and the sphere of influence, members of the business community and

    Staff can meet to discuss options. Surely, there are other towns our size, with our

    sense of dignity and heritage, that have addressed and solved this same issue.

    At the April 3, 2012, Council meeting I offered to serve on such a committee. My offer

    still stands. I can be reached by email or at home, 624-8422 .

    Commission may also have a subcommittee work with staff and the business community on this issue. These efforts will

    start sometime next year, likely in the summer.
