Currently BHEL has Solar PV plant projects of various ratings like 10MW, 15MW, 20 MW & 50 MW respectively under various stages of execution/operation. However, we do not have the experience certificate for having executed at least similar SPV Power plant of unit capacity in the range of 15MW and above, in any one of the last three years and which is/are in successful operation on the date of bid opening. In view of the above, we request you to consider our request for modification of the clause for “having executed one grid connected solar project with capacity of 6MW and above, running successfully without any major problem as on the date of bid opening”.

OFFERED PV modules are IEC approved with 3.2 mm thick glass for 72 cell configuration. This module, during IEC certification, type tests has passed through Hail impact test and static wind load test of 5400 Pa. Hence please allow 3.2 mm thick top glass for 72 cell configuration.

This shall not take into consideration any downtime caused due to plant tripping’s associated with the UTILITY GRID.

GRID NON AVAILABILITY period is not in the purview of EPC contractor. It is not possible to estimate realistically non availability of gird as depends on many parameters.

The issue with regard to grid down time is already explained in the Clause. The uptime calculation shall not take into consideration plant tripping / down time associated with utility grid.

Array Junction Boxes WITH Remote PLC link

Array junction box shall have RS 485 link which shall get connected to a centralized SCADA thus enabling monitoring of SMB parameters in the SCADA. Considering the increased size, cabling and cost with PLC in each SMB this may please be removed.

AJBs must convey the array data to the Central PLC. RFP clause will prevail.

35. Sterling & Wilson Pvt Ltd

IFB 50 All bids must be accompanied by a bid security of Rs. 80.00 lacs. Bidders must deposit 25% of the Bid Security (EMD) amount through e-banking/e-payment and for the balance 75% of the Bid Security (EMD) amount, Bank Guarantee may be submitted. Scanned copy of Bank Guarantee for the 75% of the Earnest Money must be uploaded at the time of online bid submission.

SWPL requests PEDA to provide the option to the Bidder of submitting the whole 100% amount of EMD as a Bank Guarantee since it is a huge amount to be submitted the e-payment

RFP clause will prevail. This is as per Pb. Govt. E-bidding guidelines.


ITB 13.3 (a) That, in the case of a Bidder offering to supply goods under the contract which the Bidder did not manufacture or otherwise produce, the Bidder has been duly authorized by the goods' manufacturer or producer to supply the goods in the Purchaser’s country.

As this is turnkey based tender, EPC should be responsible for assurance of material, when it’s about authorization. If that is the case, there need to be multiple authorization letter as it can’t be on single manf’ basis due to the reason of price control. Request PEDA to leave this to EPC's discretion.

PEDA is not seeking authorization certificates from EPC. But EPC to ensure that it has manufacturer’s authorization to supply imported equipment / goods in India, so that long term service, technical support for the said equipment is available from the manufacturer. RfP clause will prevail.

37. ITB 14.3 A list giving full particulars, including available sources and current prices, of all spare parts, special tools, etc., necessary for the proper and continued functioning of the goods for a period to be specified in the Bid Data Sheet, following commencement of the goods by the Purchaser; and

In turnkey EPC these all are part of detailed engg after project award, current price can only be disclosed for the items mentioned in PRICE BID. Request PEDA to amend the same accordingly.

RFP clause will prevail These are required to evaluate the price bids on equal level


38. ITB 15.5 Unsuccessful Bidder's bid security will be discharged/returned as promptly as possible but not later than thirty (30) days after the expiration of the period of bid validity prescribed by the purchaser, pursuant to ITB Clause 16.

Request PEDA to incorporate this line as well to the clause : On issue of LoI to successful bidder, whichever is earlier.

RFP clause will prevail. RfP ITB Clause 15.6 relates to successful bidder’s bid security.

This will only consider the O&M duration for the project from bidder side as the component life consideration in PV Module case is 25years. Request PEDA to amend the same accordingly.

ITB 22.4 - b) The Purchaser requires that the goods under the invitation for bids shall be delivered (shipped) at the time specified in the Schedule of Requirements. No credit will be given to earlier delivery. Bids offering any deviation from the scheduled delivery period shall be liable for rejection.

This is usually a part of the detailed scheduled activity chart for the project, after issuance of LoI. Request PEDA to amend the same accordingly.


41. Scope of Work BID-SUBJECT-Design, manufacture, supply, erection, testing and commissioning along with operation & maintenance for 10 years for a 6MWp SOLAR PV power plant at Village Handaya,Tehsil &Distt. Barnala,Punjab, India

SWPL requests PEDA to reduce the O&M period to 5 years as per the industry standards. Also, since the Warranty period have been stated as 5 years, request PEDA to amend the same accordingly.



42. BDS ITB 14.3 (g) A confirmation that the bidder is either the owner of the intellectual Property Rights in the equipment/hardware and the software items offered, or that it has proper authorization and /or license from the owner to offer them. An authorization from the OEM shall be furnished. Willful misrepresentation of these facts will lead to the cancellation of the contract without prejudice of other remedies that the Purchaser /implementing agency may take.

As this is turnkey based tender, EPC should be responsible for assurance of material, when it’s about authorization. If that is the case, there need to be multiple authorization letter as it can’t be on single manf’ basis due to the reason of price control. Request PEDA to leave this to EPC's discretion.


43. GCC 16.3 Payments shall be made promptly by the Purchaser within sixty (60) days of submission of the invoice/claim by the Supplier.

The period for payment is too high This will have major impact on working capital of project, should be 15 or 21days as most of PSU’s follow the same. Request PEDA to kindly amend the clause accordingly.

RFP clause will prevail This is as per CERC Regulations


SCC GCC 7.1 Within 21 days after the Supplier’s receipt of Notification of Award, the Supplier shall furnish Performance Security to the Purchaser for an amount of 10% of the contract value, excluding annual maintenance costs valid upto 60 days after the date of completion of performance obligations including warranty obligations and 10 years operation and maintenance contract period.

According to SWPL understanding, this is 10% of EPC Price to be kept for 180 days(Execution)+ 10 Years(O&M) as Performance Security • Request PEDA to take O&M BG equivalent to 10% of O&M Charges on return of Performance security at operational acceptance.



45. SCC 8.1.19 - vi) During O&M contract, the plant performance will be evaluated based on annual Capacity Utilization Factor. The Capacity Utilization Factor will be determined based on annual radiation measured at the plant and the guaranteed PR by the bidder. Second year onwards plant deration factor also will be considered to evaluate the CUF.

Request PEDA to kindly consider the degradation of PV Module as well. Kindly specify the formula to be used to calculate CUF

46. SCC 8.1.19 - vii) During the performance demonstration period after the commissioning of the plant and during the O&M period, the bidders need to maintain 100% uptime of the plant to achieve the proposed CUF at the end of each year.

100% uptime needs to be maintained, except when attributable because of the grid. 99% is industrial practice. Kindly amend the same accordingly. Request PEDA to specify the LD for not meeting along with Top Cap

Clause 8.1.19 e)-(ix) Specifies the compensation in case of non- achievement of CUF and PR. For LD calc in SCC clause 14 (ii), any delay after 48 hrs, Clause 23.1 GCC shall apply.

47. SCC 8.1.19 - viii) Bidder to access the corresponding solar insolation values and related factors of solar plant along with expected grid availability. The Bidder should access all related factors about the selected Site for the Project before giving commitments of PR and CUF of the proposed Project.

Whether PEDA will specify source for irradiation whether Meteonorm or NASA or Solar GIS. Kindly clarify.

SCC 10-Warranty GCC 15.2

– In partial modification of the provisions, the OEM / Supplier warranty period shall be 60 months from date of commissioning of the SPV Power plant or 72 months from the date of shipment, whichever occurs earlier.

Accordingly to SWPL understanding, the warranty for OEM is 5 years, Request PEDA to specify the warranty mechanism for the next 5 years totalling to a period of 10 years with respect to the O&M.

Warranty period for plant has been specified as 60 months from the date of commissioning and other manufacturer warranties for


equipments like modules etc which are beyond 60 months shall continue as per OEM standards.

49. SCC 15.7.1 Operation &Maintenance services shall be provided by the supplier during the period of 10 yrs from the COD. Annual maintenance and repairs of the entire system including supply of spares etc. for next 120 months will be done by the supplier.

According to SWPL understanding, Defect Liability Period is till the end of contract period (10 Years). No clear mentioning of DLP but defects needs to incurred by the Bidder for complete 10 years, even though warranty is for 5 years. DLP of 10years is not backed by any manufacturer, these are normally for 1 or max 2years. Request PEDA to kindly specify the DLP clearly as it puts the contractor under and open ended liability and amend the same accordingly


50. SCC 15.7.3 Failure to arrange for the immediate repair/replacement will be liable for penalty of 0.5% of the item/items cost per day per item.

This is too high % as standard is for 0.1% per week. Request PEDA to amend the same accordingly.




SCC GCC 16.1 - i)

(i) Advance Payment: Ten (10) percent of the contract price shall be paid within thirty (30) days of signing of the contract and upon submission of claim against a simple receipt and a bank guarantee for the equivalent amount valid until the goods/ equipment are delivered at plant site and in the form provided in the bidding documents or another form acceptable to be purchaser.

Request PEDA to kindly reduce the payment time to 15 or 21days to allow the Bidder to stick to the specified schedule at the time of Detailed Engineering.

At the Site Visit, it was noted that a11kv Transmission line passing through the site, around 15 m from the Boundary inside the plot. Request PEDA to provide clarification on what would be the course of action to not let the transmission line intervene with the capacity being put up.

11KV line will be shifted, otherwise, there is enough land space for plant installation.

There is a 1.5 km approach road from the Highway to the site which is not steady enough to sustain the transportation of heavy loads. Request PEDA to clarify wether PEDA would be developing the road.

2.Structural material shall be corrosion resistant and electrolytically compatible with the materials used in the module frame, its fasteners, nuts and bolts. Galvanizing should meet ASTM A-123 hot dipped galvanizing or equivalent which provides at least spraying thickness of 80 microns on steel as per IS5905, if steel frame is used. Aluminum frame structures with adequate strength and in accordance with relevant BIS/international standards can also be used.

It is requested that Pegal & Galvalume sheets be allowed for materials of MMS. Kindly Confirm.

The construction of the same shall be as under) RCC Works All RCC works shall be as per IS 456 and the materials used viz.

It is requested that Pre-Fabricated structures be considered for Inverter room, Security room & Control Room Building. Kindly confirm.



Cement rein- forcement, steel etc. shall be as per relevant standards.


13.15 The contractor shall provide stone pillars of about 1.5 meter height at the distance of 25 meter intervals for the entire land area of Solar Power Plant. All documents/records regarding test data, oscillographs and other measured values of important parameters finalized after site adjustment shall be handed over to purchaser in the form of test reports (in bound volume) for their future use and reference.

It is requested that instead of Stone pillars Steel posts be used for peripheral boundary pillars. Kindly confirm.


69. Technical Specification 13.2 Pg 89-90 Step Up Transformers 300V/11KV and 11KV/415VAuxiliary Transformer

— One no. 6 MVA 11/66KV step transformer with OLTC, control panel. — Two number transformers of 2 MVA each and 1 no. transformer of 1 MVA 300V/11KV. — Transformer LV side should be of same voltage as that of output of PCU and HV side should be 11 KV. — These transformers shall be of either five/three winding depending upon design 3) One number Auxiliary transformer mounted on H pole ofsuitable cap, 415 V/11 KV for meeting the captive loads with suitable control panel.

1) Power Transformer shall be rated for 100% of plant out put power as in case of solar max generation on peak radiation(which will happens once in a day for few minutes ) of the power will never exceed 5MVA so we request to consider % MVA transformer in place of 6 MVA . 2) For Clause no. '13.2' (page 89) LV voltage of Inverter Transformer is mentioned 300 Volts but in contrast to clause no. '13.1.4' (page 91) LV voltage of Inverter Transformer is demanded between 280 to 415 volts.SWPL requests you to take LV voltage rating of Inverter Transformer equally to or in accordance to the output voltage of

RFP clause to prevail LV voltage rating of inverter transformer to match with output voltage of inverter. Already stated in bidding document.

— The cable should confirm to relevant ISS. Please clarify that transmission of power will be through 66kV Cable or conductor if conductor than please clarify the requirement of 66kV Cable

The minimum acceptable PR of the plant is 0.76 and CUF shall be 18% against installed DC capacity at STC.
