However, we do not have the experience certificate for having executed at least similar SPV Power plant of unit capacity in the range of 15MW and above, in any one of the last three years and which is/are in successful operation on the date of bid opening. In view of the above, we request you to consider our request for modification of the clause for “having executed one grid connected solar project with capacity of 6MW and above, running successfully without any major problem as on the date of bid opening”.

OFFERED PV modules are IEC approved with 3.2 mm thick glass for 72 cell configuration. This module, during IEC certification, type tests has passed through Hail impact test and static wind load test of 5400 Pa. Hence please allow 3.2 mm thick top glass for 72 cell configuration.

In the design and fabrication of the INVERTER the site temperature (5O to 55O C), incident sunlight and the effect of ambient temperature on component life shall be considered carefully. Similar consideration shall be given to the heat sinking and thermal for blocking diodes and similar components.

Beyond 50DEGC, the inverter output gets derated. Hence the clause may please be accordingly changed.

: It is national and international practice to have DC fuse for each string so as to avoid circulating current amongst the PV strings hence diodes are not considered as this is a lossy component. During the performance demonstration period after the commissioning of the plant and during the O&M period, the bidders need to maintain 100% uptime of the plant to achieve the proposed CUF at the end of each year. This shall not take into consideration any downtime caused due to plant tripping’s associated with the UTILITY GRID.

GRID NON AVAILABILITY period is not in the purview of EPC contractor. It is not possible to estimate realistically non availability of gird as depends on many parameters.

The issue with regard to grid down time is already explained in the Clause. The uptime calculation shall not take into consideration plant tripping / down time associated with utility grid.

SWPL requests PEDA to provide the option to the Bidder of submitting the whole 100% amount of EMD as a Bank Guarantee since it is a huge amount to be submitted the e-payment

ITB 13.3 (a) That, in the case of a Bidder offering to supply goods under the contract which the Bidder did not manufacture or otherwise produce, the Bidder has been duly authorized by the goods' manufacturer or producer to supply the goods in the Purchaser’s country.

As this is turnkey based tender, EPC should be responsible for assurance of material, when it’s about authorization. If that is the case, there need to be multiple authorization letter as it can’t be on single manf’ basis due to the reason of price control. Request PEDA to leave this to EPC's discretion.

PEDA is not seeking authorization certificates from EPC. But EPC to ensure that it has manufacturer’s authorization to supply imported equipment / goods in India, so that long term service, technical support for the said equipment is available from the manufacturer. RfP clause will prevail.

ITB 14.3 A list giving full particulars, including available sources and current prices, of all spare parts, special tools, etc., necessary for the proper and continued functioning of the goods for a period to be specified in the Bid Data Sheet, following commencement of the goods by the Purchaser; and

In turnkey EPC these all are part of detailed engg after project award, current price can only be disclosed for the items mentioned in PRICE BID. Request PEDA to amend the same accordingly.

BDS ITB 14.3 (g) A confirmation that the bidder is either the owner of the intellectual Property Rights in the equipment/hardware and the software items offered, or that it has proper authorization and /or license from the owner to offer them. An authorization from the OEM shall be furnished. Willful misrepresentation of these facts will lead to the cancellation of the contract without prejudice of other remedies that the Purchaser /implementing agency may take.

As this is turnkey based tender, EPC should be responsible for assurance of material, when it’s about authorization. If that is the case, there need to be multiple authorization letter as it can’t be on single manf’ basis due to the reason of price control. Request PEDA to leave this to EPC's discretion.

43. GCC 16.3 Payments shall be made promptly by the Purchaser within sixty (60) days of submission of the invoice/claim by the Supplier.

45. SCC 8.1.19 - vi) During O&M contract, the plant performance will be evaluated based on annual Capacity Utilization Factor. The Capacity Utilization Factor will be determined based on annual radiation measured at the plant and the guaranteed PR by the bidder. Second year onwards plant deration factor also will be considered to evaluate the CUF.

Request PEDA to kindly consider the degradation of PV Module as well. Kindly specify the formula to be used to calculate CUF

The Bidder should access all related factors about the selected Site for the Project before giving commitments of PR and CUF of the proposed Project.

49. SCC 15.7.1 Operation &Maintenance services shall be provided by the supplier during the period of 10 yrs from the COD. Annual maintenance and repairs of the entire system including supply of spares etc. for next 120 months will be done by the supplier.

According to SWPL understanding, Defect Liability Period is till the end of contract period (10 Years). No clear mentioning of DLP but defects needs to incurred by the Bidder for complete 10 years, even though warranty is for 5 years. DLP of 10years is not backed by any manufacturer, these are normally for 1 or max 2years. Request PEDA to kindly specify the DLP clearly as it puts the contractor under and open ended liability and amend the same accordingly

50. SCC 15.7.3 Failure to arrange for the immediate repair/replacement will be liable for penalty of 0.5% of the item/items cost per day per item.

At the Site Visit, it was noted that a11kv Transmission line passing through the site, around 15 m from the Boundary inside the plot. Request PEDA to provide clarification on what would be the course of action to not let the transmission line intervene with the capacity being put up.

2.Structural material shall be corrosion resistant and electrolytically compatible with the materials used in the module frame, its fasteners, nuts and bolts. Galvanizing should meet ASTM A-123 hot dipped galvanizing or equivalent which provides at least spraying thickness of 80 microns on steel as per IS5905, if steel frame is used. Aluminum frame structures with adequate strength and in accordance with relevant BIS/international standards can also be used.

The minimum acceptable PR of the plant is 0.76 and CUF shall be 18% against installed DC capacity at STC.

SWPL requests PEDA to specify the correct PR value required for SPV plant as PR value mentioned under given two clauses are mismatching. Request to have CUF of 17% as CUF of 18% not achievable as per meteonorm satellite calc.

PR is 0.78, typo error -correction corrigendum already issued. CUF of 17% allowed.
