RESOLUTION NO. 2021-89

A RESOLUTION HONORING ST. ANGELO-GAGE FURNITURE FOR SERVING THE CITIZENS OF THE CITY OF

ASHTABULA FOR 50 YEARS

WHEREAS, it has come to the attention of this City Council and these Public Officials of the City of Ashtabula, Ohio, that the month of July 2021 marked the Golden Anniversary of the St. Angelo-Gage Furniture Store in the City of Ashtabula; and,

WHEREAS, two generations of the St. Angelo-Gage family own and manage the business, and have offered quality furniture to the citizens of the City of Ashtabula and surrounding communities from their Downtown Ashtabula, Park Avenue location for fifty years; and

WHEREAS, owners Fredrick and Sandra Gage believe in providing superior customer service and

making friends of their customers; and WHEREAS, the St. Angelo-Gage Furniture Store has served their community by donating and

supporting local organizations; and WHEREAS, the St. Angelo-Gage family is admired and respected by their community, their

staff, and their friends and customers; and,

NOW, THEREFORE, BE IT RESOLVED that this City Council and these Public Officials of the City of Ashtabula, Ohio, do hereby convey to St. Angelo-Gage Furniture, our heart-felt appreciation and commendation on their 50th anniversary and best wishes for the future years of continued dedication and service to the City of Ashtabula.

Regular Meeting Minutes Monday, August 16, 2021

Opening The regular meeting of the ASHTABULA CITY COUNCIL was held in Council Chambers and viewed on the City of Ashtabula website and Facebook page as well as Spectrum channel 1024. The meeting was called to order at 7:00 p.m. by the Council President. The Ward 1 Councilor offered the opening prayer, and the Pledge of Allegiance was recited.

Members Present Ward 2 Councilor – Mr. Calvin Crawford, Ward 4 Councilor – Ms. Octavia Harris, Ward 5 Councilor – Ms. Jane E. Haines, Ward 1 Councilor – Mrs. Kym A. Foglio, Council President – Mr. John S. Roskovics

Members Absent Ward 3 Councilor – Ms. Laydean Young, Council Vice President – Mr. Michael D. Speelman Mrs. Foglio moved; Mr. Crawford seconded to excuse the Council Vice President and Ward 4 Councilor from the meeting; motion CARRIED. Officers Present City Manager – Mr. James M. Timonere, City Solicitor – Mike Franklin, Finance Director – Ms. Traci R. Welch, Clerk of Council – Mrs. Stacy H. Senskey Sunshine Law The Clerk of Council certified conformity to the Ohio Sunshine Law. Executive Session The Council President announced the City Manager’s request for an Executive Session prior to the adjournment of the Regular Council Meeting. Mrs. Foglio moved; Ms. Haines seconded to convene an Executive Session for the purpose of discussing the purchase or sale of property. On the roll call: Mr. Crawford, Ms. Harris, Ms. Haines, Mrs. Foglio, Mr. Roskovics voted yea; motion CARRIED.

Approval of Minutes The Clerk of Council presented minutes from the August 2, 2021, Regular Meeting. Mrs. Foglio moved; Ms. Harris seconded to waive the reading of the minutes; motion CARRIED. Hearing no corrections, the minutes were approved as presented. City Manager Report and Communications The City Manager formally requested an ordinance to enter into an agreement with GPD Group to provide a Capital Improvement Plan and Rate Study for the Wastewater Treatment Plant and Sanitary Sewer System in an amount not to exceed $500,000.00. Funding for this service will be taken from fund 504 and 261. Mrs. Foglio moved; Mr. Crawford seconded to approve the request; motion CARRIED. The City Manager formally requested an ordinance to enter into an agreement with Glazier Insurance Agency with a mailing address of 41 Wall Street, Jefferson, OH 44047 for the purpose of providing Liability, Auto, Property, and Public Officials insurance through Travelers Insurance for a period of one year in the amount not to exceed $192,719.00. Funding for this expense to be taken from accounts 101, 225, and 503. Mrs. Foglio moved; Ms. Harris seconded to approve the request; motion CARRIED. The City Manager formally requested an ordinance to enter into an agreement with Refuse Equipment & Truck Service with a mailing address of P.O. Box 1424 Ashtabula, Ohio 44004 for an amount not to exceed $13,000.00. Funding for this service will be taken from fund 225. Mrs. Foglio moved; Ms. Haines seconded to approve the request; motion CARRIED. The City Manager requested approval to hire three new Patrol Officers through lateral transfers for the Police Department. Mrs. Foglio moved; Ms. Haines seconded to approve the request; motion CARRIED. The City Manager commented the City Charter states Council approval is required for purchases over $10,000. He requested Council consider a Charter change by increasing the approval level to $30,000. Ohio Revised Code sets a limit of $50,000. The Planning Commission’s Public Hearing scheduled for Thursday, August 19, 2021, was cancelled. The City Manager requested the Council consider developing legislation to put a moratorium on discount retail establishments within the City limits.

Finance Director Report and Communications The Finance Director formally requested an ordinance to make supplemental increases and/or decreases to appropriations in the Marina, Miscellaneous Grants, and Court Special Projects Funds for current expenses and other expenditures of the City of Ashtabula, State of Ohio, for the period January 1 through December 31, 2021. Mrs. Foglio moved; Ms. Haines seconded to approve the request; motion CARRIED. Clerk of Council Report and Communications The Clerk of Council formally requested an ordinance to approve current replacement pages to the Ashtabula Codified Ordinances. Ms. Harris moved; Mr. Crawford seconded to approve the request. Discussion: The replacement pages include two ordinances affecting the traffic control map and one ordinance adding chapter 1339 Residential New Construction and Additions. Motion CARRIED. Community Development/Economic Development/Parks & Recreation Committee Report and Communications The next meeting is scheduled for Tuesday, September 14, 2021, at 4:00 p.m. in Council Chambers. Finance and Personnel Committee Report and Communications The next meeting is scheduled for Friday, September 17, 2021, at 8:30 a.m. in Council Chambers. A D1 permit is for beer only for on premises consumption and in sealed containers for carry out, until 1:00 a.m. Tell Us Something We Don’t Know The Ward 1 Councilor wished a healthy and happy school year to all students and adults returning to school. She also congratulated the Ward 3 Councilor, Ms. Laydean Young, on a successful Back to School giveaway event over the weekend. The Ward 1 Councilor and Clerk of Council attended a 50th anniversary celebration for St. Angelo-Gage Furniture store. Mrs. Foglio moved, Ms. Haines seconded to draft a resolution in honor of St. Angelo-Gage Furniture’s 50th Anniversary; motion CARRIED. The Ward 2 Councilor wished luck to all the school athletes returning to their sports.

The Council President gave a welcome letter to Nights & Weekends, the new restaurant on Bridge Street.

The Ward 5 Councilor announced High Horse will be Rockin’ on the Beach at Walnut Beach this Sunday, August 15 from 5:00 p.m. to 8:00 p.m. Country Redford will be featured on September 6th, starting at 6:00 p.m. Also, the Ashtabula Fraternal Order of Police’s Annual Fish Fry is Thursday, August 26 from 3:00 p.m. to 8:00 p.m. at the Elks Lodge.

Public Discussion/Comments on General Matters Pete Bean of West 57th Street, President of My Neighborhood Collaborative and member of St. Peter’s Church asked Council to consider passing a resolution of commitment to resolving homeless problem in the City. Council is scheduling a work session to learn more information and discuss solutions.

County Commissioner J. P. Ducro of West Prospect Avenue announced a presentation regarding the criminal justice ballot initiative and Community Corrections & Rehabilitation Facility Wednesday, August 25 at 6:00 p.m. at the Ashtabula Kent State University. Public is encouraged to attend and will have the opportunity to ask questions on the topic.

Executive Session The Council President announced the executive session would convene off camera. After the executive session was over, the Council President reconvened the public portion of the meeting, with no action taken. Adjournment The Meeting was adjourned at 7:58 p.m. by the President of Council.

City Council will meet again on Tuesday, September 7, 2021, in Council Chambers. The Pre-Council Meeting will begin at 6:30 p.m. followed by the Regular Council Meeting at 7:00 p.m.

WHEREAS, the daily operations of the City of Ashtabula and the City Manager’s Department require the enactment of this ordinance; and

WHEREAS, it is deemed necessary and expedient by the Council of the City of Ashtabula, Ohio, to amend the traffic control map and file to preserve the health, safety and welfare of the citizens;

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Ashtabula, Ohio, that:

SECTION 1. The traffic control map and file shall be amended to prohibit parking on the entire length of the east side of Petros Drive.

SECTION 2. All violations of signs or other traffic control devices giving notice of the foregoing parking restrictions shall be subject to action in accordance with Ashtabula Codified Ordinances Chapter 313.

SECTION 3. It is hereby found and determined that all formal actions of this Council concerning and related to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its Committees that resulted in such formal action were in meetings open to the public in compliance with the requirements of Section 10 of the Municipal Charter of the City of Ashtabula, Ohio, and of R. C. Section 121.22.

SECTION 4. This amendment to the traffic control map and file shall take effect upon and be in force from and after the earliest period allowed by law.

AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN EASEMENT AGREEMENT WITH CASTLE BLOCK PROPERTIES LLC FOR A HISTORIC CONSERVATION

EASEMENT TO PROTECT HISTORIC FEATURES OF PROPERTY LOCATED AT 331-341 CENTER STREET IN THE CITY OF ASHTABULA

WHEREAS, the daily operations of the City of Ashtabula and the City Manager's Department require the enactment of this legislation; and,

WHEREAS, the City Manager has recommended that the City accept an offered historic conservation easement from Castle Block Properties LLC, covering certain property located at 331-341 Center Street in order to give the City authority and standing to protect certain historic character-defining features, materials and spaces attributable to said property in the future; and,

WHEREAS, the public health, safety and convenience will be improved by accepting the easement for the above purposes; and,

WHEREAS, there is no reasonable probability of any detriment to the public or loss to the public treasury in accepting such easement;

NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Ashtabula, Ohio:

SECTION 1. That the City Manager be, and he is hereby, authorized to enter into an agreement with Castle Block Properties LLC, a copy of which is attached hereto as an Exhibit, to make the City the grantee of the Historic Conservation Easement over property located at 331-341 Center Street, identified as permanent Parcel Number 05-215-00-010-00, in order to give the City authority and standing to protect certain historic character-defining features, materials and spaces attributable to said property in the future.

SECTION 2. It is hereby found and determined that all formal actions of this Council concerning and related to the passage of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and any of its Committees that resulted in such formal action were in meetings open to the public in compliance with the requirements of Section 10 of the Municipal Charter of the City of Ashtabula, Ohio, and of R. C. Section 121.22.
