Dear Mr. and Mrs. Sundstrom,

As you know, the Health District CalUlot approve any new onsite septic systems in the Kentucky Wellhead Protection Zone as per Douglas County Code Chapter 19.18E, however; there is sufficient evidence to support the fact this septic system was installed in early 1974 prior to the adoption of the Protection Zone in the late 1990's. After a review of the information your attorney supplied to the Health District and staff comments, the Health District will recognize the existil1g septic system at 1016 S. Marna Lane. I cannot reissue a septic system permit because I cannot find your name in the old pernlit ledger . Please see attached copies from the ledger of sequential septic system permits issued from April 1973 to May 1974.

This recognition of the existing system is conditional. The Health District requires a report from a licensed onsite septic designer or professional engineer as to the location, size, and depth of the existing septic system components. This report must also include a detailed site plan of the system location including drainfield reserve area and soil information via a test pit. If the exiting septic system is deemed in a failing condition or an immediate public health threat (as identified in WAC 246-272A), you will be required to repair the system.

Please note that it is tmclear if the recognition of this septic system will allow you to subdivide this parcel per Douglas County Code. However, the Health District does not believe the continuing use of this existing 39 year old septic system serving an existing single family residence will cause an increase in current nitrate levels at the Kentucky wellhead.
