INTRODUCTION

M/s Spaze Towers Pvt. Ltd. has made a collaboration agreement with land owners of land area

42540.72 sqm. On 23.10.2010 located at Khasra No. Survey No.5912 village Sihi, Gurgaon. The

land owners have obtained the license from DTCP (Directorate of Town & Country Planning),

Haryana on 23.03.2011.

M/S Spaze Towers Pvt. Ltd. has conceptualised the residential Group Housing on above area

and obtained approval of building plan in 1403.2012.

The application for Environmental Clearance was filled at SEIAA, Haryana on 18.06.2012.

The Environmental appraisal was done on 11.12.2012 in which committee has deferred the

case due to non-matching of sign of land owners. The documents were submitted and again

case was appraised by SEAC on 29.04.2013.

SEAC appraised the case on 17.06.213, 27.11.2013, 16.04.2014 and finally asked for site

inspection by sub-committee.

PP started the construction work and submitted documents to SEAC on 12.01.2015.The

Environmental Clearance was pending at SEAC due to violation proceedings.

Now, as per gazette notification dated 14.03.2017 we are submitting the details for EC as per

the said notification as violation case.

ENVIRONMENTAL LEGISLATION APPLICABLE:

Following legislations are applicable to the project. Therefore, it is the responsibility of the

developer to comply with these legislations.

➢ THE WATER (PREVENTION AND CONTROL OF POLLUTION) ACT 1974

Under Section 25. Restrictions on New Outlets and New Discharges

– Applicable due to discharge of waste water from the group housing colony.

– Under the above-mentioned act, we shall take consent “consent to establish” &

“consent to operate” of the State Pollution Control Board.

➢ THE AIR (PREVENTION AND CONTROL OF POLLUTION) ACT, 1981

Under section 21. Restrictions on use of certain industrial plants.

– Applicable due to provision of DG Sets which will be source of air emission to

atmosphere. Stack shall be installed.

– Under the above mentioned act, we shall take consent “consent to establish” &

“consent to operate” from the State Pollution Control Board.

➢ THE WATER (PREVENTION AND CONTROL OF POLLUTION) CESS ACT, 1977

Under Section 3: Levy and Collection of Cess

– There shall be levied and collected a cess for the purpose of the Water (Prevention and

Control of Pollution) Act, 1974 (6 of 1974) and utilization there under.

– The cess under sub-section (1) shall be payable by—

– Every person extracting water from ground.

– Everyone using supply water.

➢ S.O.908 (E), [25/9/2000] - THE MUNICIPAL SOLID WASTES (MANAGEMENT AND HANDLING)

RULES, 2000 and as amended

As per this rule solid waste is to be segregated and disposed as per defined procedure at

MSW approved site or within its own colony by using different solid waste disposed

technologies.

➢ HAZARDOUS WASTES (MANAGEMENT, HANDLING & TRANSBOUNDRY MOVEMENT) RULES,

2008 amended in 2016

– Hazardous wastes shall be collected, treated, stored at isolated locations.

– It will be given to authorized recyclers/ service providers only.

– Authorization under this rule shall be taken from SPCB.

➢ E-WASTE (MANAGEMENT & HANDLING) RULES, 2016

– E-waste shall be collected and stored at isolated location in the Complex.

– It shall be disposed through approved recycler only.

➢ PLASTIC WASTE MANAGEMENT RULES 2016

– Plastic waste shall be collected and disposed as per Plastic Waste Management Rules

2016

➢ CONSTRUCTION AND DEMOLITION WASTE MANAGEMENT RULES 2016

– The Ministry of Environment, Forest and Climate Change notified the Construction &

Demolition Waste Management Rules, 2016 on 29 March 2016.

– Construction and demolition waste shall be disposed and managed as per C& D Waste

Management Rules 2016

➢ THE NOISE POLLUTION (REGULATION AND CONTROL) RULES, 2000

– The noise levels in any area shall not exceed the ambient noise quality standards in

respect of noise as specified in the schedule.

– The authority shall be responsible for the enforcement of noise pollution control

measures and the due compliance of the ambient noise quality standards in respect of

noise.

➢ EIA NOTIFICATION, 2006 AND AMENDMENTS

EIA Notification, 2006 falls under EPA, 1986 under this act any project which has probable impact

on the environment is listed under 34 categories, then unit are required to take prior

environmental clearance after occupying/identifying the land for particular use.

The project comes under category “B” & listed in 8(a) schedule as per EIA notification, 2006.

All projects or activities in the schedule, whether expansion and modernization of existing

projects or activities and change in product mix shall require prior environmental clearance

from the MoEF&CC/State Environmental Impact Assessment Authority (SEIAA) or in absence of

SEIAA, Central Government in the ministry of Environment and Forests on the recommendation

of Expert Appraisal Committee to be constituted by the Central Government.

AMENDMENTS:

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION

dated 9th December, 2016

– The integrated environmental conditions with the building permission being granted

by the local authorities and the construction of buildings as per the size shall adhere to

the objectives and monitorable environmental conditions

– The States adopting the objectives and monitorable environmental conditions referred

to in subparagraph(1), in the building bye-laws and relevant State laws and

incorporating these conditions in the approvals given for building construction making

it legally enforceable shall not require a separate environmental clearance from the

Ministry of Environment, Forest and Climate Change for individual buildings.

– When the State Governments notifies the bye-laws and rules concurred by the Ministry

of Environment, Forest and Climate Change, the Central Government may issue an

order stating that no separate environmental clearance is required for buildings to be

constructed in the States or local authority areas.

MINISTRY OF ENVIRONMENT, FOREST AND CLIMATE CHANGE NOTIFICATION

14th March, 2017

• In case the projects or activities requiring prior environmental clearance under

Environment Impact Assessment Notification, 2006 from the concerned Regulatory

Authority are brought for environmental clearance after starting the construction

work, or have undertaken expansion, modernization, and change in product- mix

without prior environmental clearance, these projects shall be treated as cases of

violations and in such cases, even Category B projects which are granted

environmental clearance by the State Environment Impact Assessment Authority

constituted under sub-section (3) Section 3 of the Environment (Protection) Act, 1986

shall be appraised for grant of environmental clearance only by the Expert Appraisal

Committee and environmental clearance will be granted at the Central level.

• In cases of violation, action will be taken against the project proponent by the

respective State or State Pollution Control Board under the provisions of section 19 of

the Environment (Protection) Act, 1986 and further, no consent to operate or

occupancy certificate will be issued till the project is granted the environmental

clearance.

PROJECT DETAILS AND DESCRIPION

The proposed project is the construction of residential complex, which is spread over a land of

42540.72m2.The proposed residential complex “Spaze Privy AT4” at Village Sihi, Sector 84,

Gurgaon, Haryana, being developed by M/s. Spaze Towers Pvt. Ltd.

Privy AT4 is one such creation - a beautiful coming together of contemporary architecture and

natural harmony. This project will be equipped with contemporary and futuristic amenities. It

will offer a comprehensive solution to residents and will have sufficient provisions for leisure.

Site location and Connectivity

The proposed commercial complex is located at Village Sihi, Sector 84, Gurgaon, Haryana. The

nearest railway station is Garhi Harsaru Railway Station is ~4.5 km in NW direction and Gurgaon

railway station is about 10.2 km in NNE direction. Indira Gandhi International Airport is

approximate 23.3 km in NE direction.

DAMAGE ASSESSMENT

For assessment of damage to environment following Environmental aspects has been

identified: -

1. Air Quality: Deterioration due to air emission

2. Water Environment: Due to groundwater exploitation pollution in water bodies.

3. Soil Quality: Due to unorganised solid waste management, land contamination and

unplanned disposal of soil.

4. Exploitation of Natural resources.

5. Socio Economic scenario of the surrounding areas.

6. Environmental accidents.

7. Ecology & Biodiversity

8. Noise levels

9. Geological changes

10. Hydrological changes

To assess these environmental parameters team has been deputed to assess preliminary

assessment of damage to environment.

Based on site inspection and the documentary evidences the environmental aspects vs

activity has been filled.

SUMMARY OF ENVIRONMENTAL DAMAGE

The Construction has been done by the contractor M/s Krishna Conquest Construction (P) Ltd

Ambient Air Quality

The project work was started in march, 2013. Due to summer season dust emission was there.

The machineries & DG sets generated air emissions.

Water Generation

Since ground water table is quite low there was no dewatering done. Occasional ground water

was used due to scarcity of water. However most of the water is procured through tanker.

Waste Generation

Construction & demolition waste was generated and it was used in refilling of low lying area &

roads.

Non-Hazardous waste like packaging material wood, carton & plastics are sold to kabariwalas.

Only Hazardous waste was paint and used oils. The used oil has been sold to recyclers. Paint

drums were solds to Kabariwala.

Land Contamination

There was a defined space for construction machinery and land contamination was done to

spillage of oil.

There was no spillage of cleaning agent however concrete mixture was dumped at few places.

All the liquid were stored in drum and no spillage of any liquid were reported. The toilets were

having soak pits no surface water discharge.

The project plot was agriculture land and no natural drain was passing through the plot.

Use of Natural Resources

Water was taken through tanker; no ground water is used. Energy use was through diesel and

petrol.

Raw Material was RCC (Through RMC), Iron & Steel (From Secondary Steel), Cement, Door &

Windows were made-up of timber (Hence natural resources were used). Stone is used for

flooring tiles used in bathroom & Kitchen.

Local Issues

The nearest habitat is Sikandarpur Banda which is 1 Km in SW direction. There were other

projects in the vicinity and no local issues. There was noise during construction activities. Dust

was generated during excavation & transportation.

The land was agriculture land and converted into residential purpose.

Transport Issue

The transportation of material was done using kaccha road.

Due to Kuccha Road dust generation was quite high.

Environmental Accident

The project work was done by experienced and qualified contractor hence no environmental

accident like land subsidence or land slide happened.

Effect on biodiversity

The land was an agriculture land and hence there was no significant flora & fauna. However,

with organized plantation after completion of project biodiversity will improve.

Noise Pollution

The area was earlier an agriculture is and there were no noise sources in the vicinity. However,

with construction activity noise level is increased.

Soil quality & Management

The project was conceptualized with 1 level basement hence soil excavation was essential.

Mining permission was taken from Department of Mines & Geology, Gurugram (Dated

22.05.12) to excavate 1,12,896 MT of ordinary soil.

The excess soil was given by contractor for refilling of low lying area.

Geology

There was no mineral at project site and there was only ordinary soil. The soil excavation and

construction of basement has changed the geological profile.

Hydrology

There was no use of ground water in the area. The depletion of ground water in the area is due

to over exploitation of ground water by operational industrial & commercial units.
