(E'Chanel''), moves for entry of a preliminal'y injunction agains7 Defendants, the Partnerships and Unincorporated Associxions identitied on Schedule GW '' attach8 hereto tthe dDefendants'), for alleged violations of the Laljham Act, 15 U.S.C. jj 1 1 14, and 1 125(a

    2and (d).10 The Court convened the hearing on December 28, 201 1, at which only cotmsel for Plaintif11 was present and available to present evidence supprting the Applications for Preliminary12 lnjunction. The Defendmzts have not responded to the Applications for Preliminary lnjunction, no13 made any filing in this case, nor have the Defendants appeared in tM s matter either individually14 through cotmsel. Because Plaintiff hms satistied the requitements for the issuance of a prelimin15 injtmction, the Cout't will grant Plaintiff's Applications forjpreliminary Injunction.:16 1. Maggio's purchases were processed entirely online16 which included providing shipping and billing information payment, and conflrmation of her ord17 (Maggio Decl. ! 4 and Composite Exhibit A attached theteto; 2n2 Maggio Decl. :4 and Composite

    I18 Exhibit A attached thereto.) j19 Thereaher, a representative of Chanel, Adrienne Hnhn Sisbarro, reviewed and visua20 inspected the web page listings, including images, for each of the Chanel branded goods purchmsedi21 by Maggio and determined the items were non-genuine Cljanel products. Conclusions qf Law4 The declarations and supporting evidentiary submsssions Plaintiff submitted in support of its5 Applications for Preliminaty Injunction support the folloWing conclusions of law:6 A. Plaintiff has a very strong probability of proving at trial that consum ers are likely to7 be confused by the Defendants' advertisement, promotioli, sale, offer for sale, and/or distribution of

    I8 handbags, wallets, shoes, boots, stmglasses, scarves, tqe shirts, watches, and costume jewelry9 including necklaces, bracelets, earrings, brooches, and rings bearing counterfeits, infringemen10 reproductions, and/or colorable imitations of the Chanel M arks, and that the products tlle Defendants11 are selling are copies of Plaintiff's products that bear marks which are substantially indistinguishablei12 from and/or colorful im itations of the Chanel M arks on hqndbags, wallets, shoes, boots, stmglms

    :13 scalves, tee shirts, watches, and costllme jewelry, includipg necklaces, bracelets, eanings, brooches14 and rings.15 B. Because of tlle infringem ent of the Cho el M arks, Plaintiff is likely to suf16 immediate and irreparable injury if a preliminary injunction order is not granted. lt clearly appear17 from the following specific facts, as set forth in PlaintiF s First Amended Complaint, Plaintiff's

    l18 Applications for Preliminary Injunction, and accompanyijg declarations on tile, that irnmediate and19 irreparable loss, damage, and injury will result to Plaintiffand to consumers because it is more likely20 true th= not that:21 1. The Defendants own or control Int rnet business operations which adverti22 promote, oflkr for sale, and sell, at least, harldbags, wall ts, shoes, boots, sunglasses, scarves,23 shirts, watchess and costume jewelry, including necklaces, bracelets, eanings, brooches, and rings24 bearing cotmterfeit and infringing trademarks in violation jf Plaintiff's rights;25 2. Plaintiff has well-fotmded fears that ore cotmterfeit and infringing hmzdbags

    1 marketplace; that consumers may be misled, conftlsed, rnd disappointed by the quality of these2 products; artd that Plaintiff may suffer loss of sales for its jenuine products;;3 3. Plaintiff has well-founded fears tkat unless the injunction is granteds theI4 Defendants can easily and quickly transfer the registmtiorls for many of the Subject Domain Names

    5 or modify registration (IaL' and content, change hosts, and redirect traflic to other websites, thereby6 thwarting Plaintiffs ability to obtain m eaningful relief; !7 4. The balance of potential hnnn to thd Defendants in restraining their tradingI8 cotmterfeit and infringing branded goods if a preliminazy'injkmction is issued is far outweighed by9 the potential harm to Plaintiff, its reputation mzd goodwill as a manufacturer of high qua10 handbags, wallets, shoes, boots, stmglasses, scmwes, te shirts, watches, and costume jewelryl1 1 including necklaces, bracelets, earrings, brooches, and rinp , if such relief is not issued; and12 5.
