Federal Law Change for Salaried Workers Daniels joins Chamber as Business Development Manager By Laura Hamblin, JD, SPHR, SHRM-SCP The most frequently filed claim against an employer by an employee is one for back wages. Thatʼs understandable, because paychecks equate to food on the table and rent payments. Accordingly, itʼs imperative that employers are legally compliant in their pay practices. Effective December 1, 2016, there will be a major change to the federal wage and hour law regarding most exempt employees. An “exempt” employee, as defined in the Fair Labor Standards Act (FLSA), is one who is exempt from the requirement that an employer pay them time and a half the regular rate of pay for hours worked over 40 in a workweek. There are several types of exempt employees, but the majority fall under the “white collar” exemption; those who perform executive, administrative or professional duties. Three tests must all be met for an employee to be classified as exempt from the FLSAʼs overtime pay requirement: (1) the employee must be paid a predetermined and fixed salary that isnʼt subject to reduction due to quality or quantity of work performed; (2) the amount of the salary must be at least $455 week (until December 1st); and, (3) the employeeʼs job duties must primarily involve executive, administrative or professional duties as defined in the FLSA regulations. The most frequently filed claim against an employer by an employee is one for back wages. Thatʼs understandable, because paychecks equate to food on the table and rent payments.

Accordingly, itʼs imperative that employers are legally compliant in their pay practices.

Effective December 1, 2016, there will be a major change to the federal wage and hour law regarding

most exempt employees. An “exempt” employee, as defined in the Fair Labor Standards Act (FLSA), is one who is exempt from the requirement that an employer pay them time and a half the regular rate of pay for hours worked over 40 in a workweek.

There are several types of exempt employees, but the majority fall under the “white collar” exemption; those who perform executive, administrative or professional duties. Three tests must all be met for an employee to be classified as exempt from the FLSA̓ s overtime pay requirement: (1) the employee must be paid a predetermined and fixed salary that isnʼt subject to reduction due to quality or quantity of work performed; (2) the amount of the salary must be at least $455 week (until December 1st); and, (3) the employeeʼs job duties must primarily involve executive, administrative or professional duties as defined in the FLSA regulations. Job titles arenʼt enough to classify an employee as exempt.

On December 1st, the FLSA minimum salary level is more than doubling—from $455 week ($23,660 year) to $913 week ($47,476 year). Clearly, this is a significant change that will impact most employers.

So, whatʼs an employer to do if theyʼre currently paying salaries to employees that are below $913 week ($47,476 annually)? Here are some options:

September is a time for fall, football and spice lattes. Around the chamber we are busy with expos, job fairs, conferences and a candidate forum. All in a dayʼs work around here.

Our Business and Lifestyles Expo is September 16 and 17. We are excited to partner with Prescott Chamber this year for a great show with exhibitors representing all areas of life from business, construction, recreation, community service to flu shots, VIN etchings and an RV display. Admission is free. There is still time to participate just contact Gloria at the chamber. Reasonable rates for chamber members.

We will be joining the Town of Prescott Valley for Patriot Day ceremonies on 9/11 at 1 p.m. We also hope you will visit the Prescott Valley Healing Fields of Northern Arizona. With 3,000 flags and 20 for our Granite Mountain Hotshots, this is truly a sight to see and experience.

The Candidate Forum is another partnership with our local Chambers. As of this writing, the primary election has not been determined, however those candidates that will move on to the General Election will be invited to speak and meet the public. It will be held at Yavapai College in the Building 19 Community Room at 6 p.m.

And joining us in time for the fun is Pattrik Daniels, our new business development manager. His first day is September 6, but he is ready to get out and meet our businesses and members.

Chamber volunteers Barbara Clark and Devona Pace helped out at the Senior Fun Days at CASA Senior Center by teaming up to work the Chamberʼs Corn Toss Game on August 24.

Bearizona Wildlife ParkWildlife Park officials at Bearizona report that they have worked with Arizona Game & Fish to facilitate a rescue of a young female bear that was seen multiple times around the Mt. Lemmon area. The bear reportedly followed hikers, tried to get into homes and had no fear of humans. In cases like this, usually the bear would be euthanized, Often timeʼs bears will venture into campsites or urban areas for food that is more easily accessible. Thatʼs where the saying a fed bear is a dead bear comes from. Itʼs important for people to clean up after themselves while camping and not make it easy for bears to get a quick meal. If a bear finds easily obtainable food and/or food trash, the animal will continue to return until the food source is gone.Sean Casey, Bearizonaʼs owner stated “This past year we enacted a birth control plan for all of our bears. Cubby and Rizzo, our current cubs, will very likely be the last bear cubs born at the Park. We do this so we are able to rescue bears out of the wild when possible. Unfortunately we wonʼt be able to rescue every bear in need, but we are moving in a direction to rescue when the situation works for all parties involved.”Out of all of the bears that call Bearizona home, over 60% were rescued. Bearizonaʼs newest addition named “Lemmon” after Mt. Lemmon in Tucson where she lived,

The Phoenix Suns and Northern Arizona Suns have named Tyrone Ellis the first head coach in Northern Arizona Suns history, it was announced today.

“We are thrilled to have Ty return with us in his new role as head coach of the Northern Arizona Suns,” said Phoenix Suns Director of Player Personnel and Northern Arizona Suns General Manager Bubba Burrage. “With Tyrone Ellis, the Suns have a highly-qualified coach who also possesses the highest of character and reputation.”

Ellis joins the NAZ Suns after spending the 2015-16 season as the lead assistant with Phoenixʼs former NBA D-League affiliate, the Bakersfield Jam. It marked Ellis ̓fourth season as an assistant coach in the D-League, previously working as the lead assistant for one season each with the Grand Rapids Drive (2014-15), Reno Bighorns (2013-14) and Tulsa 66ers (2012-13).

the coaching ranks following a successful 11-year career as a player in the D-League and internationally. His final five seasons were spent playing with three different clubs from 2007-12 in Liga ACB, Spainʼs first-tier professional league, where he also played in his first professional season overseas in 2002-03. Ellis

played one season apiece with clubs in the highest-tier leagues in Italy and Turkey from 2005-07 and played two seasons with the Frankfurt Skyliners from 2003-05, helping the team to their first title in Basketball Bundesliga, Germanyʼs highest league.

Originally from Dallas, Ellis played four seasons at Southern Nazarene University in Bethany, Okla., from 1997-2001. As a senior in 2000-01, he averaged 22.5 points and earned NAIA First Team All-America honors. He also helped lead the Crimson Storm to an NAIA national runner-up finish in 1998.

convert salaries to an hourly rate based on straight 40 hour workweeks and limit employees ̓work to 40 hours a week after the conversion. Jobs may have to be restructured, with duties assigned to others, to allow the affected employees to complete work in 40 hours. Other employers may calculate the conversion to an hourly rate based on average hours worked by employees while salaried, and allow the employees to continue working more than 40 hours a week, with overtime pay.

3. Pay a weekly salary, plus overtime for hours worked in excess of 40 (salaried non-exempt). In this case, the salaried employee will need to accurately track and report hours worked. They can lawfully be paid a weekly salary below $913 as long as the employer compensates the employee at time and a half for hours worked over 40. While many races were decided in the August 30 primary election, several races had to wait until the November 8 general election. The Prescott, Prescott Valley and Chino Valley Chambers of Commerce invite you to a meet and greet on the remaining races on Tuesday, Sept. 27 in the Yavapai College Community Room in building 19 at 6 p.m.

SAFETY FIRST - Get Some Sleep and Stay Safe on the JobSleep is a crucial part of health and well-being, but some

workers may not be getting an adequate amount of sleep, which may affect their productivity. Sleep deprivation may have a detrimental impact on work performance leading to situations that could compromise safety in the workplace.

Three of every four workers in the United States acknowledge they were “tired” for most of the days of their work week, according to a survey by the Virgin Pulse Institute.

Sleep deprivation may cause difficulties concentrating on the job, increasing the chance of safety incidents and reducing their engagement and attention throughout the day, the surveyʼs results show.

“Showing up to work sleep deprived can be the equivalent of showing up to work intoxicated,” said Dr. Jennifer Turgiss, director of the Virgin Pulse Institute and co-author of the study. “Employees who donʼt sleep well have poorer concentration, poorer decision-making abilities, are significantly less able to cope with stressful situations and are more likely to make unhealthy choices.”

Employees in occupations where they work long hours may benefit from their employers addressing the

risk factors of fatigue in the workplace, according to a study on fatigue risk management published in Journal of Occupational & Environmental Medicine (JOEM).

In jobs where safety is dependent on being alert, employers may want to find ways to reduce fatigue before it becomes a safety issue. Risk factors of fatigue may result in financial losses of more than $1,960 per employee annually in lost productivity, the article stated.

Here are three major risk factors connected to sleep deprivation, according to the Journalʼs story:

• Motor vehicle crashes in the early morning. The article noted workers often are at risk for fatigue-related incidents in the early morning hours as this time period is when a personʼs circadian rhythm reaches a period of peak sleepiness. While some workers who work long hours or night shifts may not feel affected by sleep loss, employees may want to be cautious about the potential for motor vehicle crashes if staff members are behind the wheel after working an extended or late shift.• Chance of errors increase after long shifts. In addition to motor vehicle crashes, the study suggests workers who work more than 24 hours have twice as many attention failures and a 36 percent higher chance of making significant errors. For instance, employees may have an increased risk of incurring an injury from handling sharp objects or running machinery.• Chronic medical conditions linked to sleep loss. Employers may want to be aware of chronic medical conditions that are connected with lack of sleep. When workers do not get enough rest the night before, they have a higher chance of developing health problems, such as diabetes, cardiovascular disease and obesity-related health effects.Employers may consider establishing workplace safety

programs that concentrate on addressing employee fatigue, according to the Virgin Pulse Institute.

“Our study made one thing clear: lack of sleep is crippling Americaʼs workforce,” Trugiss said. “Employers canʼt turn a blind eye. Whether they offer an online sleep program, encourage employees to use vacation days, or provide other tools, employers must address sleep issues in order to create a thriving workforce and business.”

By participating in these programs, employees may become more rested and feel as though they are valued and supported by their employers. This is an important aspect in encouraging workers to increase their performance and engagement in and out of the workplace, according to Turgiss.
