CROSSROADS MEMORIAL

STATE OF TEXAS § § COUNTY OF HAYS § WHEREAS, the people of the United States will observe the federal holiday honoring Dr. Martin Luther King, Jr. on January 20, 2014 to celebrate the birthday of this significant civil rights leader who inspired profound and lasting change in our nation; and WHEREAS, local, state and national organizations will remember this great man by living the theme of his legacy in 2014, observing the holiday as a national day of service—“A Day On, Not a Day Off;” and WHEREAS, 2014 marks the 151st anniversary of the Emancipation Proclamation issued by President Abraham Lincoln on January 1, 1863 during the third year of the Civil War that led to the end of slavery in the United States and the great journey to secure the civil rights of all people in America; and WHEREAS, the citizens of Hays County, San Marcos and Texas State University each year commemorate the contributions of Dr. Martin Luther King, Jr. to our nation, our state and to the people of Hays County with special observances, including this year honoring the 50th anniversary of passage of the Civil Rights Act of 1964; recognizing local Civil Rights Trailblazers, holding our annual program at the Hays County Courthouse with a march to the unique crossroads of Lyndon B. Johnson Drive and Martin Luther King Jr Drive in San Marcos, Texas; and WHEREAS, at this intersection, our community will celebrate the dedication ceremony for the “LBJ-MLK Crossroads Memorial,” a public sculpture by artist Aaron Hussey of Baton Rouge, LA., commemorating the historic connection between President Lyndon B. Johnson and Martin Luther King, Jr. as they transformed American civil rights in the 1960s; and WHEREAS, the purpose of this holiday is to encourage all Americans to fulfill Martin Luther King’s vision of freedom, equality and opportunity for all people;

WHEREAS, The Hays County Commissioners Court is pleased to join citizens across the state in paying tribute to the men and women who volunteer to ensure the smooth functioning of the electoral process on the occasion of Volunteers for Democracy Day, which is being celebrated on January 14, 2014; and WHEREAS, The orderly and graceful transfer of power that characterizes the American electoral system is a model for the nations of the world to emulate, and the system’s reliability and integrity are largely secured through the efforts of election volunteers; and WHEREAS, The precinct chairs, election judges, and other volunteers who guide and support our elections serve our state and nation with honor, passion, and patriotism as they strive to ensure that the ideals expressed in our founding documents continue to be upheld and advanced; and WHEREAS, Volunteers for Democracy Day was established by the 80th Texas Legislature to acknowledge the contributions of these men and women; the second Tuesday in January of each year has been set aside to honor their outstanding efforts; and WHEREAS, It is truly fitting that all Texans acknowledge the contributions of these men and women whose singular efforts play such a large role in our electoral process; now, therefore, be it NOW,THEREFORE, BE IT RESOLVED that the Hays County Commissioners Court does hereby honor the election volunteers whose dedication helps to make our electoral process run smoothly and extend to them sincere gratitude for their hard work and commitment on Volunteers for Democracy Day.

Davis, Executive Director of the Hays Caldwell Council on Alcohol and Drug Abuse spoke of Commissioner Ingalsbe’s dedication to the Board for the past 17 years. 28552 APPROVE PAYMENTS OF COUNTY INVOICES A motion was made by Commissioner Ingalsbe, seconded by Commissioner Whisenant to approve payments of County Invoices in the amount of $1,261,313.09 as submitted by the County Auditor. MOTION PASSED 28553 APPROVE COMMISSIONER COURT MINUTES OF DECEMBER 17 AND 20, 2013 A motion was made by Commissioner Ingalsbe, seconded by Commissioner Whisenant to approve Commissioner Court Minutes of December 17 and 20, 2013 as presented by the County Clerk. All voting “Aye”. MOTION PASSED 28554 AUTHORIZE ACCEPTANCE OF A FORMULA GRANT AWARD FROM THE TEXAS

INDIGENT DEFENSE COMMISSION IN THE AMOUNT OF $230,526 AND AMEND THE BUDGET ACCORDINGLY

On October 30, 2012 the Commissioners Court authorized submission of a grant application to the Texas Indigent Defense Commission (TIDC) for up to $72,029.00. An accompanying Resolution designated the County Judge as the authorized official ". . . to apply for, accept, decline, modify, or cancel the application for the Indigent Defense Formula Grant Program and all other necessary documents to accept said grant". Notice of award has been received, and the award amount has been increased to $230,526.00. The amount includes a one-time award of $93,456 to be dispersed immediately, and quarterly payments of $34,268. While the cover letter from TIDC indicates that acceptance of the award has been authorized by the Resolution submitted with the grant application, it has been the practice of Hays County to formally accept such awards by Commissioners Court action. However, no additional grant contract needs to be executed. Funding for this formula grant has been utilized by Hays County for a number of years to help offset costs associated with indigent defense. A motion was made by Commissioner Ingalsbe, seconded by Commissioner Whisenant to authorize acceptance of a Formula Grant Award from the Texas Indigent Defense Commission in the amount of $230,526 and amend the budget accordingly. JANUARY 7, 2014 ***** ***** VOLUME V PG 305 28555 AUTHORIZE THE SHERIFF'S OFFICE, TRAINING DIVISION TO PURCHASE

EQUIPMENT FOR THE BASIC PEACE OFFICER ACADEMY AND AMEND THE BUDGET ACCORDINGLY

The Training Academy is requesting to purchase three FIST Training Suits @ $758.00 each, a total of $2,274.00. These suits are designed to keep as much mobility as possible for the DT Instructors, yet still provide ample protection for a vast array of strikes and takedowns. The helmets are covered by a Lexan face shield to prevent taser probes and marking cartridges from striking the face. Amount required $2,478.00 Increase Revenue: 001-618-00.4408 ($2,478.00) Increase Law Enforcement Equipment 001-618-00.5717_400 $2,478.00. A motion was made by Commissioner Ingalsbe, seconded by Commissioner Whisenant to authorize the Sheriff’s Office, Training Division to purchase equipment for the Basic Peace Officer Academy and amend the budget accordingly. STAR RAIL BOARD OF DIRECTORS FOR A TWO YEAR TERM BEGINNING FEBRUARY 1, 2014

Commissioner Conley is currently the Hays County representative on the Lone Star Rail District Board of Directors. His current term expires on February 1, 2014. If re-appointed his new term will run until February 1, 2016. A motion was made by Commissioner Jones, seconded by Commissioner Whisenant to approve re-appointment of Commissioner Will Conley to the Lone Star Rail Board of Directors for a two year term beginning February 1, 2014. All voting “Aye”. MOTION PASSED 28557 APPROVE THE SHERIFF'S OFFICE, TRAINING DIVISION TO GENERATE

REVENUE BY HOSTING THREE NEW COURSES AND CHANGE EXISTING FEES TO THE TRAINING FEE SCHEDULE

In 2011, the Sheriff's Office with Commissioner's Court approval was authorized to accept revenue for continuing education courses and is requesting to add three additional courses to the fee schedule. The courses are as follows: Field Training Officer Course - This course teaches instructors how to provide supervised field training for new recruits in any law enforcement discipline. The goal is to transition the recruit from a classroom setting to an actual hands-on assignment. The course includes training in instructional techniques, coaching and evaluation, remedial training and record keeping. The course is designed to provide training guidance and training aspects to future Field Training Officers in the area of law enforcement, including peace officers, jailers, telecommunication operators, correction officers, public service officers, etc. The course fee is $150.00 and free for HCSO Employees, course code # 3702 FTO. New Detective Course - This course is composed to assist the newly appointed Detective in becoming familiar with the many aspects of a Criminal Investigation. It is designed to assist in providing a solid foundation of basic techniques from which Detectives can build upon as they progress through their careers. The course fee is $150.00 and free to HCSO Employees, course code #3200 New Detective Course. New Supervisor Course - This 5-day course is a basic supervisory skill workshop. It is designed for recently promoted Supervisors and those on the current Promotional lists. It meets the requirements for TCOLE and includes specific information relevant to HCSO. The course fee is $150.00 and free to HCSO Employees, course code #3737 New Supervisor Course. Furthermore, HCSO is requesting approval for adjustments in the existing fee schedule. The adjustments are as follows: Course 1007 - Basic Corrections Academy - from $300.00 to $360.00 Course 2106 - ICC Crime Scene Investigators - from $150.00 to $120.00 Course 3031 - Background Investigator Course - from $30.00 to $60.00 Course 3277 - Identity Crimes - from $30.00 to $15.00. A motion was made by Commissioner Jones, seconded by Commissioner Whisenant to approve the Sheriff’s Office, Training Division to generate revenue by hosting three new courses and change existing fees to the training fee schedule. CONTRACT WITH THE DEPARTMENT OF STATE HEALTH SERVICES FOR THE IMMUNIZATION PROGRAM GRANT

On October 1, 2013 the Commissioners' Court authorized a grant contract renewal with the Texas Department of State Health Services (DSHS) for the Immunization program. This grant helps to support the salary and benefits of the staff involved in this program in the Hays County Local Health Department. The pending amendments will modify the contract as follows: 1.) One word change to the Work Plan/Exhibit, under unit C-5, fourth bullet under activities section ("over" to "under"). 2.) Addition of the Financial Status Report requirements and due dates to the Programmatic Reporting Requirements Section. 3.) Update of the LHD ILA reporting requirements program end date for the third quarter (“05/30/2014” to “05/31/2014”). Amendment effective date: September 01, 2013. This amendment has a retroactive effective date because the amendment module in CMPS did not become accessible until November 2013. A motion was made by Commissioner Jones, seconded by Commissioner Whisenant to authorize the County Judge to execute Amendment to the Contract with the Department of State Health Services for the Immunization Program Grant. On October 1, 2013 the Commissioners' Court authorized a grant contract renewal with the Texas Department of State Health Services (DSHS) for the Public Health Emergency Preparedness (PHEP) program. This grant helps to support the salary and benefits of the Emergency Preparedness Coordinator and SNS Coordinator in the Hays County Local Health Department. The pending amendments will modify the contract as follows: This amendment is to add language to the Statement of Work and Special Provisions. DSHS will update the following forms in CMPS as appropriate: 1. Statement of Work 2. Special Provisions 3. Exhibit A (Work Plan) 4. Exhibit B (Work Plan) 5. Programmatic Reporting Requirements. This amendment has a retroactive effective date because the amendment module in CMPS did not become accessible until November 2013. Amendment effective date: September 1, 2013. All voting “Aye”. MOTION PASSED 28561 AUTHORIZE INSTITUTIONAL OSSF PERMIT AT 2312 SOUTH OLD BASTROP RD,

SAN MARCOS, TX OBTX-LLC is proposing an OSSF to serve a relocation business/warehouse in Precinct 1. This property is 14.72 acres in the Ace Relocation Subdivision. Water will be supplied by public water system. The system designer, Jason Clark, R.S. has designed a treatment system which consists of standard treatment and an equalization tank to equalize the effluent dispersal to a low pressure dosed drainfield at a daily usage rate of 510 gallons. A motion was made by Commissioner Conley, seconded by Commissioner Whisenant to authorize Institutional OSSF Permit at 2312 South Old Bastrop Rd., San Marcos, TX. All voting “Aye”. Roxie McInnis Development Services Manager spoke. Silver Spur Ranchettes is a recorded subdivision located off of Nutty Brown Road in Precinct 4. Lot 3 was platted in 1968 as a 4.00 acre lot and was divided by metes and bounds rather than the requisite plat revision in 1982. The 0.9996 acre portion of Lot 3 which is now being platted has been served by a private well and on-site wastewater service since 1983. Current Hays County minimum lot size requirements dictate that new lots in this area which are served by private wells and on-site sewage facilities be at least 2.00 acres in size. Given the date that the parcel was created and the lot size requirements in place at that time, a variance to the county's minimum lot size requirements has been requested and will be heard upon final plat approval. A motion was made by Commissioner Whisenant, seconded by Commissioner Conley to call for a public hearing on January 21, 2014 to discuss final plat approval of the amended plat of a portion of Lot 3, Silver Spur Ranchettes, Section 3. Hays County’s current maximum jail capacity is 362 inmates. Jail Standards recommends holding approximately 10% of capacity open. That lowers our recommendation to 311. The jail’s daily average was 260 and peak was 268 on January 3, 2014 for the week of December 29, 2013 to January 4, 2014. The maximum female capacity is 56 inmates. Last week’s average was 36 and peak was 38 on 12/29/2013 and 1/3/2014. The maximum male capacity is 276 inmates. Last week’s average was 224 and peak was 232 on 1/1/2014. 1) Prime Recipient hereby awards a cost reimbursable subaward, as described above, to Subrecipient. The statement of work and budget for thissubaward are (check one): As specified in Subrecipient's proposal dated ; or as shown in Attachment 5. In

its performance of the subaward work, Subrecipient shall be an independent entity and not an employee or agent of Prime Recipient.

2) Prime Recipient Shall reimburse Subrecipient not more often than monthly for allowable costs. All invoices shall be submitted using Subrecipient's standard invoice, but at a minimum shall include current and cumulative costs (including cost sharing), subaward number, and certification as to truth and accuracy of invoice. Invoices that do not reference Prime Recipient's Subaward Number shall be returned to Subrecipient. Invoices and questions con-

cerning invoice receipt or payments should be directed to the appropriate party's Contact as shown in Attachments 3A & 3B.

3) A final statement of cumulative costs incurred, including cost sharing, marked "FINAL" must be submitted to Prime Recipient's Contact, as shown in Attachments 3A and 3B, NOT LATER THAN sixty (60) days after subaward end date. The final statement

of costs shall constitute Subrecipient's final financial report.

4) All payments shall be considered provisional and subject to adjustment within the total estimated cost in the event such adjustment is necessary as a result of an adverse audit finding against the Subrecipient. Prime recipient reserves the right to reject an invoice.

6) Matters concerning the request or negotiation of any changes in the terms, conditions, or amounts cited in this subaward agreement, and any changes requiring prior approval, should be directed to the appropriate party's Contact, as shown in Attachments 3A & 3B. Any such changes made to this subaward agreement require the written approval of each party's Authorized Official as shown in Attachments 3A & 3B.

7) Each party shall be responsible for its negligent acts or omissions and the negligent acts or omissions of its employees, officers, or director's, to the extent allowed by law.

8) Either party may terminate this subaward with thirty days written notice to the appropriate party's Contact as shown in Attachments 3A & 3B. Prime Recipient shall pay Subrecipient for termination costs as allowable under OMB Circular A-21 or A-122 or 45 CFR Part 74 Appendix E, "Principles for Determining Costs Applicable to Research and Development under Grants and Contracts with Hospitals" as applicable.

9) No-cost extensions require the approval of the Prime Recipient. Any requests for a no-cost extension should be addressed to and received by the

Contact, as shown in Attachments 3A & 3B, not less than thirty (30) days prior to the desired effective date of the requested

change.

10) The Subaward is subject to the terms and conditions of the Prime Award and other special terms and conditions, as identified in Attachment 2.

11) By signing below Subrecipient makes the certifications and assurances shown in Attachments 1 and 2. Community and Civic Activities

Here are a number of areas that I have been involved in that provides some insight into my varied experience, skills and contributions.

Dripping Springs Comprehensive Plan Development Committee

I served on the Dripping Springs Comprehensive Plan Development Committee in 2011 as a non-city resident representative. While involved in all phases of the project, I was a key contributor to creating the action item implementation plan for the comprehensive plan itself which is still being used to implement the comprehensive plan.

Community Advisory Committee at Walnut Springs Elementary School

I was asked to serve as a community representative on the Community Advisory Committee at Walnut Springs Elementary School in 2011 and continue on the committee. My role as not being on the faculty at the school and as a non-DSISD parent is to provide input and suggestions concerning the operation of the school and the educational principles and practices at the school from a broader perspective without the more vested interests of the others.

Hays County Water Conservation Working Group and Rainwater Revival

In 2009, then Commissioner Karen Ford asked me to serve on the Hays County Water Conservation Working Group. One of the accomplishments of the group was the Rainwater Revival, first held in October of 2010. Amongst a variety of tasks, a key role I played was to recruit, coordinate and manage the volunteers for the day of the event.

Texas Master Naturalist, State Advisory Committee and Hays County Chapter

I have been a member of the Hays County Master Naturalist chapter since 2001 and have held various positions on the board of directors. During the early to middle years of the organization, I played a key role in structuring the governance of the organization. In 2003 I was asked by the state coordinator to join the Texas Master Naturalist State Advisory Committee. Statewide, the organization was expanding rapidly with chapters being formed across the state. I was specifically asked to lead the development of a uniform organizational and governance structure of all the chapters, which at that time numbered about thirty.

Going back in time a little there are two significant areas that might shed a bit more light on my experience.

Deerwood Gardens Condominiums, Houston Texas

In 2002, while living in Houston and residing at Deerwood Gardens Condominiums, I served initially on the Architectural Control Committee and then was elected to the Board of Directors. As Vice President, I

implemented a process to allow the board to track and evaluate the performance of the management company and then led development of the first long range plan and associated financial planning for the complex.

Katy Youth Soccer League

Going back further in time, in 1978 we moved to Katy, Texas with our four children. Two of our kids had played soccer in California and there was no league in Katy. Along with a local PE coach, we developed Katy Youth Soccer League where I was the first league president and given the early stages of the league, a coach and referee. Later going on to be president of the Katy Soccer Referees Association and lead trainer for new referees.

I hope this was not too long winded but provided some insight into the breadth of my experience and the significance of my contributions.

Walter L. Krudop • Mediator • Adjunct Professor • Conflict Resolution Consultant

Walt Krudop is a mediator and consultant in the conflict resolution field and holds an Advanced Credentialed Mediator designation with the Texas Mediator Credentialing Association. Walt mediates with the Hays County Dispute Resolution Center, The Better Business Bureau of Central and South Central Texas and in private practice He has mediated over 250 civil, business, family, CPS and community disputes. He has taught mediation and conflict resolution in a variety of venues and consults in the area of program design and implementation. He was an adjunct professor at St. Edwards University from 2008 to 2012. He retired from Shell Oil Company in April of 2001, while at Shell he served as an ombudsman in Shell RESOLVE, the Shell employee conflict resolution program. Walt retired from Shell Oil Company in April of 2001. In over thirty years with Shell he held a variety of management positions in research and development and business, a number of these involving quality improvement and change management. In his last four years with Shell he held the position of ombudsman in Shell RESOLVE, the Shell employee conflict resolution program. Walt played a key leadership role in design and implementation of the RESOLVE program. Walt has spoken at a number of local and national conferences. He is a past member of the Association for Conflict Resolution (ACR) where he has served in a national capacity on the ACR Chapter Task Force and is a past-president of the Houston chapter. Walt was awarded the ACR national Presidential award in both 2000 and 2002. He is a former president of the Fort Bend County Dispute Resolution Center and the current president of the Hays County Dispute Resolution Center. In collaboration with Walter Wright and Anna Bartkowski, he designed and implemented the Hays County Dispute Resolution Center in 2009. Walt is a member of the Texas Association of Mediators, the Texas Mediator Trainers Roundtable, the Ombuds of Texas and the International Ombudsman Association. He has served on the board of the Texas Mediator Credentialing Association. In 2005, Walt was awarded the Legacy in Leadership Award in the field of mediation from Innovative Alternatives in Clear Lake City. EDUCATION

Residence in Dripping Springs

We’ve owned our property in DS since 1997. We moved here in 2004 after building our guest house/workshop/garage and then later our house. We have a rainwater collection system as our sole source of potable water. During the construction of the guest house/workshop/garage, I personally did all the electrical, plumbing, finish carpentry and painting. I played an integral role with our architect in designing both the guest house and our house.

We retired in 2001 but became active in the Dripping Springs/Hays County area in the 2000 timeframe, joining the Hays County Chapter of the Texas Master Naturalist organization and frequently spending time in the area and doing volunteer work with the organization. While we moved into Drippin in 2004, we began planning and building in the 2001 timeframe.

IN SUPPORT OF THE HAYS COUNTY MASTER NATURALISTS BIRDING NETWORK PROJECT

WHEREAS, the mission of the Texas Master Naturalists is to develop a corps of well-informed volunteers to provide education, outreach, and service dedicated to the beneficial management of natural resources and natural areas within their communities; and WHEREAS, Hays County is on the migratory flyway for many birds and, because of its location, maintains diverse populations of both eastern and western species; and WHEREAS, bird watching is a popular recreational and educational activity enjoyed by a diverse population of avocational and professional interests; and WHEREAS, the development of birding opportunities in the County can attract visitors and residents alike and has economic, environmental and social benefits for the citizens of Hays County; and WHEREAS, the Hays County Chapter of the Texas Master Naturalists has partnered with the Wimberley Birding Society, San Marcos Greenbelt Alliance, Hays County 4-H, and other groups to assess and develop birding opportunities for the general public, termed the Hays County Birding Network Project; and WHEREAS, the Hays County Master Naturalists are seeking support and additional partners to advance the project and develop bird watching sites throughout the County. NOW, THEREFORE, BE IT RESOLVED that the Hays County Commissioners Court encourages and supports the Hays County Master Naturalists Birding Network Project for the benefit of the citizens of Hays County. Position: CRIME SCENE / EVIDENCE TECHNICIAN History: In the FY ’14 budget process, the sheriff’s office requested two new positions titled Evidence Technician, both budgeted at the minimum of a grade 111. (Minimum of range: $36,043) One position was approved effective 10/1/14. Ms. Tracy Hill Dorty applied for the Crime Scene/Evidence Technician in October, was hired and processed shortly thereafter at the minimum salary of $36,043, with a start date of January 2014. This employee comes to the County with at least 26 years of law enforcement related experience; the most recent of which ended September 2013 at which time she was a Sr. Communications Officer for 8.5 years at the Travis County Sheriff’s office. Total years in 911/Communications jobs is greater than 14 years. This candidate worked for the Travis County Medical Examiner for 3.5 years (7/00 – 2/04) as a forensic investigator II. Duties performed included complex investigations of deaths and processing death scenes, liaison with other counties as well as expert witness. Additional experience related to Crime Scene Investigation includes 9.5 years at the Travis County Sheriff’s Department. She is certified by the FBI Academy for Forensic Photography. Comparing the responsibilities, knowledge and experience identified in the job description with information gleaned from Ms. Hill-Dorty’s resume reflect that she exceeds the minimum requirements of the job. Experience: Minimum Required: 3yrs Actual: > 27 years combined with the Travis Co. Sheriff Dept (and the Travis County Medical Examiner. Internal Equity: The County has one other Crime Scene/Evidence Technician who has been employed with the County for 10 years and is currently paid at the 29th percentile for an annual salary of $41,237. External Equity: Labor markets, supply and demand, geographic location, and available workforce are factors that affect external equity. The candidate brings over 25 years of specialized experience in the same skill set as is required in this job. Recommendation: The scope of the authority of the HR Director is to use the salary exception tool as an additional form of recruitment which occurs before the candidate has accepted employment. Our records in Human Resources and Payroll reflect that Ms. Hill-Dorty has already accepted the job at the minimum pay of $36,043. Additionally, my authority for salary exceptions is limited to the 25th percentile. This request is for the 50th. If this was a candidate for employment vs. an employee request, I would approve this individual at the 25th percentile. /ddb
