Panel members - attorney Sara Beachy of the law firm Axley Brynelson LLP; Wisconsin DOT’s statewide relocation program facilitator Kassandra Walbrun, and relocation consultant Kathy Rudolph from CORRE, Inc. will provide an overview of the statutory changes, discuss implementation of the new laws in WisDOT, and use a case study example of the application of the new provisions. 11:00 am – 12:00 pm In the thirty-six years since Leathem Smith, Wisconsin courts have limited the use of the income approach to all but a few situations in eminent domain. Now, with 2017 Wis. Act 243, the legislature has instructed courts to consider appraisals using the income approach when determining just compensation. Attorney J.J. Rolling will explain the Act’s backdrop and will suggest how the new law may affect just compensation cases. Appraiser John Rolling will provide tips on when and how the income approach can be used to estimate damages and on how to recognize and avoid misusing this valuation tool. 1:00 pm – 3:00 pm The Packers are celebrating their 100 th Season! Act 243 was signed into law by Governor Walker in April 2018. Dubbed the “Developer’s Bill”, Act 243 included significant changes to Wisconsin’s eminent domain laws, specifically in the appraisal and relocation provisions. Panel members - attorney Sara Beachy of the law firm Axley Brynelson LLP; Wisconsin DOT’s statewide relocation program facilitator Kassandra Walbrun, and relocation consultant Kathy Rudolph from CORRE, Inc. will provide an overview of the statutory changes, discuss implementation of the new laws in WisDOT, and use a case study example of the application of the new provisions.

Notes from the President’s Desk

Greetings,

I look forward to serving you this coming year. Thank you to all who serve and put in time to make our chapter large, financially stable, fun, and a great organization to connect with others in our field. There are several things that I would like to accomplish this year, particularly:

● Update the chapter budget based on the IRWA year of July 1 toJune 30.

● Establish a permanent website administrator, and havemembership contact information easily accessible through thewebsite.

● Update our committees.

● Ensure we are operating in accordance with our 2016 chapter bylaws.

Seven people from our chapter attended the International Education Conference in Edmonton. Three of our chapter members from Duff & Phelps were busy representing their company with the Canadian representative. Other attendees were Jenny Frese, Beth Smith and Jeff Olson. Highlights for me included:

● Hearing the “Battling the Beast” on the Fort McMurray fire of May 2016 that burned a goodportion of the city and thousands of acres of forest. Even the emergency command center hadto be evacuated, and relocated twice!

● Hearing the “State of the Nation” presentation on global energy demands and supplies in thenext 20 years.

● Discussing acquisition methodology with a Saudi Arabia right of way professional.● Discussing transmission line easements with a South African right of way professional. The

transmission lines need to be high enough that giraffes don’t get tangled in them! The utilitysometimes buys game preserves if the owner is concerned that tourist will no longer join asafari that includes a cleared HVTL easement.

Plan now for attending next years International Education Conference on June 9-12 in Portland, Oregon!

In the meantime, back in Wisconsin, I encourage everyone to volunteer to do one thing for the organization this year. No effort is too small. Consider joining a committee, coming to a board meeting, writing an article for the newsletter, or your own idea. Volunteering increases your own skills and knowledge. I look forward to getting to know many of you and to improving facets of our strong chapter.

In memory of Robert J. Timbers May 11, 1931 – July 22, 2018

Chapter 17’s longest serving member, Bob Timbers, passed away on Sunday July 22, 2018. Bob began his career in 1950 at the WI Department of Transportation and retired in 1989 as a Real Estate Supervisor. In 1993 he formed Timbers Land Acquisition and was an active member and officer of IRWA.

Bob and his wife Arla “Katie” celebrated 65 years of marriage in May 2018 and during their many years together they enjoyed spending time with family, entertaining friends and traveling.

Course Instructor:David E. Burgoyne, ASA, SR/WA is the owner of Burgoyne Appraisal Company LLC located in Ann Arbor, Michigan and is active throughout the States of Michigan, Indiana, Kentucky and North Carolina specializing in Right of Way, Eminent Domain, Contaminated Properties, and other Litigation. He has also appraised in Ohio, Wisconsin, California, and Missouri. He is currently a Certified General Real Estate Appraiser in Michigan, Indiana, Missouri, and North Carolina. He holds senior designations in both the American Society of Appraisers and the International Right of Way Association. Mr. Burgoyne has been an independent fee appraiser in Michigan for well over 30 years and has been instructing appraisal courses for IRWA since 1990. He has taught appraisal and other courses for IRWA in Alaska, Connecticut, Idaho, Illinois, Indiana, Iowa, Kentucky, Michigan, Missouri, Nebraska, North Dakota, Ohio, Virginia, Washington, West Virginia, and Wisconsin. He also taught for IRWA as a CLIMB certified instructor in the Kingdom of Saudi Arabia on three separate occasions and twice in the People’s Republic of China. In 2015, Mr. Burgoyne was awarded the 2014 W. Howard Armstrong International Instructor of the Year Award by the International Right of Way Association. This is the highest award given to instructors by the IRWA. Mr. Burgoyne is an AQB Certified USPAP Instructor, has testified in Federal and State Courts over 100 times, and has been deposed on several hundred occasions. Mr. Burgoyne has been an independent fee appraiser since 1985 and has been instructing appraisal courses for IRWA since 1990. Course Instructor:Raymond O. Howd has worked for the Michigan Department of Attorney General since 1985. He worked in the Transportation Division from 1994 through 2007. Mr. Howd represented MDOT in a variety of matters involving property acquisition, condemnation litigation, and environmental issues. He was involved in all of MDOT’s condemnation appeals, and oversaw all of MDOT's condemnation litigation. He is the Michigan Chapter 7 committee chair on law and legislation and a frequent speaker at IRWA meetings and conferences. Mr. Howd co-chaired the CLE International Michigan conferences on Eminent Domain in 2002, 2004, and 2005. In addition, Mr Howd has given numerous other group presentations on issues concerning environmental law, property acquisition, and condemnation law and strategy.

Course Instructor:Raymond O. Howd has worked for the Michigan Department of Attorney General since 1985. He worked in the Transportation Division from 1994 through 2007. Mr. Howd represented MDOT in a variety of matters involving property acquisition, condemnation litigation, and environmental issues. He was involved in all of MDOT’s condemnation appeals, and oversaw all of MDOT's condemnation litigation. He is the Michigan Chapter 7 committee chair on law and legislation and a frequent speaker at IRWA meetings and conferences. Mr. Howd co-chaired the CLE International Michigan conferences on Eminent Domain in 2002, 2004, and 2005. In addition, Mr Howd has given numerous other group presentations on issues concerning environmental law, property acquisition, and condemnation law and strategy.

Cancellation Policy: All classes scheduled by IRWA are subject to cancellation. All class registrants must contact the Course Coordinator prior to making travel arrangements, keeping in mind that the class may be cancelled at any time (for reasons including, but not limited to, insufficient registration, Instructor emergencies or other issues beyond the control of the chapter and/or IRWA). Fully liquidated damages for any losses incurred by a class registrant are limited solely to a refund of the registrant's prepaid class tuition. IRWA and its chapters assume no other registrant liability resulting from class cancellation.

Tuition Refund Policy: Written notification of intent to cancel registration must be received via email by both the Course Coordinator and IRWA Headquarters Education Staff ([email protected]) prior to the class start date in order to be eligible for a tuition refund. A full tuition refund will be issued if notice is received 15 days or more prior to the class start date; a 75% refund will be issued if notice is received less than 15 days prior to the class start date, and no refund will be issued for notice received on or after the class start date.

Course Instructor:Richard F. Dickson, SR/WA is currently retired from the Wisconsin Department of Transportation (WisDOT). He retired from WisDOT after over 24 years of experience in appraisal, appraisal review, litigation, negotiations, LPA, property management, relocation and project certification. After retirement he joined CORRE, Inc.an engineering where he had been the Director of real estate. He developed and implemented a real estate program creating offices in 4 locations in the state and expanding the program to include transportation, LPA, and utility power line and pipe line projects in acquisition, appraisal and relocation. His career with the department included statewide oversight of the Property Management program, LPA Program, Litigation Program, Relocation Program, Statewide Appraisers, and Statewide review appraisers. He retired after serving 15 years as the principle review appraiser. He chaired the State Environmental Contamination Exemption Committee, wrote the state appraisal procedures for appraising contaminated property, and he worked with wetland mitigation sites. He has created and taught numerous in-house appraisal and review classes for staff and management throughout the years. He worked closely with the Department of Justice, reviewing state and plaintiff reports to help determine litigation strategy. His experience in all the disciplines of the eminent domain process and his in-house instruction for the Wisconsin DOT personnel led to his interest in instructing for the IRWA. He completed the pre-qualification class in the early 1990's and has taught ever since. He has taught in Texas, Tennessee, Kentucky, Colorado, Minnesota, Iowa, Nebraska, Wisconsin, and West Virginia.
