GENERAL SALES CONDITIONS These general sales condi ons relate to orders or order confi rma ons. Unless defi ned by special condi ons.

PRICES All prices are expressed in EURO.Unless otherwise agreed by the Par es, the prices will be those of the ecoBirdy price list at the me of the shipment of the goods. Possible discounts could be applied on the prices VAT excluded, and the VAT will be charged on the net amount. ecoBirdy reserves to change without any prior no ce, simply with a wri en communica on, the prices at any me, except for goods already on order.

PRODUCT TRANSPORT AND PACKAGING Unless otherwise agreed in wri ng between the Par es, the goods will travel with courier chosen by ecoBirdy. Goods are sold on EX-WORKS basis, at ecoBiry’s warehouse located in Belgium or Italy. The delivery mes are indica ve, un-less agreed diff erently. Possible delays cannot jus fy the cancella on or claim for damages of the order. ecoBirdy pro-vides the packaging according to the rules of use. The packages will be prepared at the discre on of ecoBirdy. Goods travel at customer’s own risk.

RETENTION OF PROPERTY The products remain ecoBirdy’s property un l fi nal payment. The goods sold through an extended payment are re-leased under the condi on with property reserve un l full se lement. WARRANTY ecoBirdy products are guaranteed against all manufacturing faults, granted that the items are appropriately used, for twenty-four (24) months from the date of purchase upon presenta on of the invoice. LEDs are guaranteed for twelve (12) months from the date of purchase upon presenta on of the invoice. Warranty doesn’t include parts that are subject to wear and tear due to usage, ba eries when provided, wiring and electrical parts that do not have manufac-turing faults. Due to the unique produc on process with recycled plas c, small holes can some mes arise in the sur-face. Holes with a diameter of less than 5 mm are considered as no error and are also not eligible for return. ecoBirdy declines any liability to damages caused to things or persons by an illegi mate use of the product.

RETURN OF GOODSReturning goods is only accepted a er wri en approval with ecoBirdy. A cost of 20% will possibly be charged in case of unauthorized return.

PRODUCTS SPECIFICATIONS AND MODIFICATIONS Technical specifi ca ons, weight, size, colours and designs described in catalogues and/or brochures and/or price lists and/or technical sheets and/or samples are only indica ve. ecoBirdy reserves the right to make changes or improvements to products that may be necessary or appropriate with-out prior no ce. Addi onally, it can apply a price varia on of Products modifi ed, based on the new produc on costs that appear jus -fi ed.

NON CONFORMITY OF PRODUCTS AND COMPLAINTS The Purchaser is obliged to examine the goods received, in par cular will have to check the packaging, and that there is a correspondence between the products packed and the number of ar cles ordered. Complaints for incomplete and incorrect deliveries, as well as goods not matching the order, must be no fi ed directly to the courier on the document of transport.

The Purchaser must communicate in wri ng to ecoBirdy with any complaints for defects of external conformity of the products within 8 (eight) days from the date of receipt of goods, a aching all details of the document of transport and of the referring invoice, in addi on to digital images showing the defects no ced. No claims are accepted a er 8 (eight) days of receipt of goods. Should the products present conformity defects ecoBirdy may choose to: a) exchange the non compliant products with the compliant ones, without any addi onal burden on the Purchaser; or b) send a credit note for the purchase price of the product to the Purchaser. Returned products must, however, in any case be authorized in wri ng by ecoBirdy, unauthorized ones will be returned to the Purchaser charging the costs of transport. Any other form of warranty and/or compensa on addi onal to the ones provided by these condi ons of sale are ex-pressly excluded and denied, to the extent permi ed by law.

JURISDICTION AND LAW Every contract between ecoBirdy and the buyer is regulated by the Belgian law. For any dispute arising from or in connec on with the Contract they shall have exclusive jurisdic on by the Court of Antwerp - Belgium.

CANCELLATION ecoBirdy reserves the right to refuse cancella ons. Total or par al orders.

RECYCLED PLASTICSWe do reuse plas c. It is o en plas c that comes from toys and household goods. Our primary aim/goal is to reduce the sea of plas c waste, that is so harmful to/for our ecosystem. We use an infrared scanning machine to separate the colours and get rid of any contamina on. We don’t use any addi onal pigments to colour our products. Instead, we chose to keep the source material visible. This is done on purpose to remind the user of the importance of making the most of our precious and limited resources. Manual verifi ca on of the material takes place several mes throughout the produc on process.

PRODUCTIONOur furniture is made in Italy. The technique is rota onal moulding, which is a tradi onal way to produce plas c fur-niture. But we invented the new process of adding upcycled raw material using our own special formula. During the produc on process, not only machines are used, but there is signifi cant manual input from skilled operators. Because of the special produc on process, each product is unique. The speckled pa ern is never iden cal. The colour of the products may not look equal. The reason for this, the gradient look comes from the rota onal moulding which is used in our produc on and from the composi on of the material. It is a design choice we have consciously made, and we feel it contributes to the special iden fi able look. The colour comes from the natural look, and it is part of its charm. Due to the unique produc on process, small holes can some mes arise in the surface. Holes with a diameter of less than 5 mm or similar size are considered as no error and are also not eligible for return.

PRODUCTION COSTSThe produc on costs are rela vely high, but this off set by the saving to the environment. Making furniture from upcy-cled plas c may not be cheap but we believe it is worth it.

ETHOSThe value of cherishing our precious resources, this is what ecoBirdy is all about. Our ethos is making the most of our precious resources and avoiding unnecessary waste.
