General terms and conditions General For terms not mentioned in this information, pricelist and general conditions we refer to the general terms and conditions of the FME. Order confirmation After receipt of your final and complete order we will send you an order confirmation. Artifort counts on your checking of this confirmation. The order confirmation is binding. Eventual corrections to this order confirmation should be given to us in writing within two working days after our sending of the order confirmation.. Without your message to the contrary we will deliver the products according to the specifications in the order confirmation. Cancelling or modifications By Modification we mean a change in an execution, for instance a colour of fabric; by Cancelling we mean the withdrawal of an order line or of a complete order and/ or the lowering of a quantity. Since our products are produced per order, cancelling or modifications go with costs. After receipt of the order confirmation you have two working days to change your order free of charge. For modifications that are passed on to us after these two working days, we will charge you the costs that we have made already. For a cancellation we will always charge you for the costs we have made , even if we receive the cancellation within two working days. For a cancellation we will also charge you a percentage of 15% of the value of a cancelled order or order line. Cancelling or modification can only take place with written approval of our sales department Deliveries and transport Where our delivery condition is free house, the delivery is in the normal warehouse address, or agreed otherwise. The prices are based on delivery on the ground floor, after the first door. The delivery address should be reachable with a truck of 10-18 metres length. The delivery is done with one driver, unless agreed otherwise. We take it that our driver can unload by means of a pallet wagon. We do not deliver to end clients. Transport and/or handling costs will be invoiced when loose fabrics or parts are ordered. For orders < €1000,- net Artifort will charge € 100,- net allowance. The buyer must control immediately the delivered products for eventual deviations of the order. Any complaints must be given to Artifort in writing within five working days from the delivery date. After this term the delivered goods will be considered as irrevocably and unconditionally accepted by the buyer. Artifort reserves the right to examine the complaints. By filing a complaint the payment obligation by the buyer towards the invoiced goods cannot be delayed. If in view of superior power, delivery obligations by Artifort cannot be reasonably demanded , Artifort has the right to postpone the delivery. Under superior power we understand each failing that has its cause in circumstances that are beyond the control of Artifort. Postponing delivery time Orders on call are not accepted. It is possible to postpone a delivery for maximum 4 weeks. After that period we will charge storage costs. Customer’s own fabric Artifort is not responsible for delay in the delivery time caused by late receipt of the customer’s own fabric or leather. No guarantee is given to customer’s own fabric/leather, so we will not accept a complaint that concerns a customer’s own fabric/leather. When the client wants to send in a customer’s own fabric/leather, Artifort must receive always in advance a sample cutting. From this sample she judges whether the material is suitable for the model in question. When Artifort finds the customer’s own material not suitable or difficult to upholster she reserves the right to deny the material or to charge an additional price. Fabrics/leathers that form part of the standard Artifort collection as mentioned in the pricelist, will not be accepted as customer’s own material. Customer’s own materials must be addressed to: Lande Productie Schijndel BV, van Leeuwenhoekweg 20, NL-5482 TK Schijndel, The Netherlands. To be tagged with the customer’s name and reference, preferably with the Artifort order number. Service and guarantee Artifort grants 5 years guarantee on her products under the following conditions. The guarantee starts on the day of delivery. The Artifort guarantee comprises, on the request of the client, to repair assembly- and production defaults. For material defaults there are separate rules, which follow below. Claims on the Artifort guarantee must be sent in in writing (per e-mail) within the guarantee period with indication of the original invoice or order number. Not included in the guarantee: • Repairs executed by a third party. • Customer’s own materials • Normal wearing and using • Damage caused by metaphorical use or a wrong maintenance • Pleads • Natural characteristic features of leather, like insect bites, cicatrices, colour deviations. • Scotch guarded fabrics • Indirect damage which is caused by an eventual assembly- or production fault, like loss of income etc. • Colour deviations for repeat orders. Rules Artifort guarantee concerning material defaults. When Artifort , due to a justified claim on the guarantee, must replace the upholstery material of the furniture, the normal redemption on durable goods will be taken into account. The mentioned terms are valid for normal use and provided approval of the complaint. Furniture is durable so for replacement or repair of the materials we work with a redemption part per year. This means that depending on the age a contribution in the costs will be asked . Of course you will receive a price quotation in advance: 0-2 years 100% guarantee – your contribution 0% 2-3 years 75% guarantee – your contribution 25% 3-4 years 50% guarantee – your contribution 50% 4-5 years 25% guarantee – your contribution 75% 5- years, no more guarantee.
