PRINCIPAL’S MESSAGE
Spiritually, it is believed that the life on the earth is regulated by the
laws of the Lord or Divinity. It is the ‘rule of law’ that draws the essential
difference between human society and the animal world. The legal
education plays an important role in promoting the social justice as Law
professionals are characterized as ‘Social Engineers’. Our College is
greatly revered for organising National Level Moot Court Competitions &
Client Counselling Competitions and this year we have decided to
combine it together into a Law Festival. Thus, it gives me immense
pleasure to introduce our National Level Law Fest – Legis Centrum.
K. C. Law College, Mumbai was established under the aegis of the HSNC
Board. Over the years, it has been recognized and ranked as one of the
leading law Colleges in the country.
It is said unique ideas and thoughts cannot be inherited and taught.
Thoughts give birth to a creative force that is neither elemental nor sidereal.
When mind comes together it catalyzes great thoughts and creates a unique
experience which is ‘Legis Centrum’. The Fest is aimed to develop
knowledge, awareness of legal implications, communications and
management skills etc. of all the students. I hope that this Fest would be
much information and fruitful to all participants, since it will give an
opportunities for students to develop their level of confidence to work in
any kind of environment.

LETTER TO THE CHIEF JUSTICE COMPETITION
Date: 23rd March, 2019
“Letter to the Chief Justice” Competition is an event which is inspired by
cases where concerned members of civil society in India wrote to the Chief
Justices of various High Courts or the Supreme Court, on Inland Letters or
post cards, to draw attention to pressing issues. These letters were later
converted into writ Petitions/SLPs. One such case is that of D. K. Basu and
Others v/s State of West Bengal & Others, wherein D. K. Basu attached a
newspaper article to an inland letter and sent it to the Chief Justice of
Calcutta High Court, to bring light to the issue of custodial deaths. On
similar line, we have conceived this event, which entails writing a letter to
the Chief Justice of India on an inland letter.
General Rules:
1) Each team will comprise of 2 participants.
2) The topic for the letter will be disclosed 15 minutes before the start of the
competition, at the venue.
3) A blank Inland Letter will be provided to the participants at the time of
the competition.
4) The letter should be hand written in English.
5) Participating teams should enter only their team code in the space
provided for the address on Inland Letter provided to them.
6) The time allotted to write the letter will be 1 hour.
Guidelines for writing the letter:
1) Avoid excessive use of legal terms. Participants should keep in mind that
this is a method of appeal used by the common man.
2) Clean and legible handwriting is welcome.
3) The letter should be formulated so as to emphasize the larger public
interest of the given topic.

13th NATIONAL LEVEL MOOT COURT COMPETITION, 2019
Moot Court Problem
Akash Talreja has businesses across five countries which requires him to
travel frequently. His wife, Tina Talreja is a former super model and
socialite. After three years of marriage, Akash was desirous of having a
child. However, the couple was unable to have a child. On seeking medical
advice and after medical examination, it was learned that due to a genetic
condition, Tina was infertile and would not be able to carry the baby.
As Akash continued to be keen to have a child, Akash and Tina sought the
assistance of medical experts at ISK fertility clinic. Akash and Tina were
advised that they could opt for surrogacy and the surrogate mother would
also be the egg donor. Akash and Tina completed all the formalities and
agreed to bear all the medical and other expenses involved. Anjali Menon,
the proposed surrogate, was contacted and treatment commenced. Akash
and Tina would regularly contact Anjali to enquire about her health and the
health of the baby. After seven months and one week of the pregnancy,
Akash and Tina informed ISK fertility clinic and Anjali that they had
divorced and were no longer desirous of going ahead with the pregnancy.
While they did not disclose the reasons leading upto their divorce, they
stated that as a result of their divorce, they may not now be able to provide
an environment conducive to the well-being of the baby. As the eighth
month had commenced and it was a matter of weeks before the child would
be born, it was uncertain what effect such termination of pregnancy would
have on the health of Anjali. On 1st January, 2019, Baby Q was born in
Bluebell Hospital. Both, Akash and Tina refused to take Baby Q. Baby Q
continues to be in the care of the Bluebell Hospital.
Baby Q, through Anjali, ISK fertility clinic and Bluebell Hospital have jointly
filed a public interest litigation against Akash, Tina and the State to not only
protect the rights of Baby Q but also to seek the intervention of the highest
court in framing guidelines to protect and ensure that no more babies suffer
the same fate as Baby Q.
Issues framed
(a) Do Anjali Menon, ISK fertility clinic and Bluebell Hospital have the locus
to file this petition?
(b) Were Akash and Tina justified in requesting termination of pregnancy in
the eighth month on the ground of their divorce?
(c) Was ISK fertility clinic justified in rejecting Akash and Tina's request on
the ground of Anjali's health being possibly at risk?
(d) Are there guidelines presently in place to protect and provide for a baby
born of surrogacy whose parents refuse to take custody of such baby after
her/his birth?
