General Conditions of Sale:The terms and conditions of acceptance of sale set forth here, includingdrawings, specifications, descriptions and other documentation at-tached to the quotation constitute the entire agreement between CASand the buyer and not subject to change by the buyer’s purchase orderor other documentation. If such conflict is noted the CAS terms of saleshall prevail.

Material Pricing: All prices are subject to change from list price. CAS tries to provide ac-curate prices within our catalogs. However, at times a metal surchargemay be in effect to compensate for the fluctuating metal market. Thecustomer will be notified by the sales person of any surcharges.Delivery: Please consult your sales person for estimated time of delivery.Customers are responsible for freight cost unless otherwise stated onthe order. CAS will try to ship by the customer’s preferred carrier. How-ever, CAS reserves the right to make the final decision regarding carri-ers.

Claims: (Freight Claims) CAS will do everything possible to assist the customerwith freight damage or freight loss claims but does not assume respon-sibility for such losses. Any claims for loss, breakage are the Buyer’s re-sponsibility and should be made to the carrier. CAS will assist insecuring satisfactory adjustment of such claims. (Shortages) CAS strives to ensure orders are shipped correctly. However,processing errors may occur. For shortages or errors please contactCAS in writing within 5 business days of receipt of order to begin claimsprocess. Failure to give such notice shall constitute unqualified accept-ance and a waiver of all claims by Buyer. Risk of loss for damages tothe products sold hereunder passes to Buyer upon delivery to the carrierregardless of who pays shipping cost.

Warranties: CAS warrants that the products sold conform to any applicable drawingsand specifications provided by CAS and will be free of material defectsand craftsmanship deficiencies which become apparent under normaluse within 6 months of installation not to exceed 12 months from dateof shipment. If within that period, CAS receives from the Buyer writtennotice of any alleged defect and CAS judges the product to be defec-tive the Buyer shall with the return authorization, return the part F.O.B.CAS shipping point and CAS at our option or expense shall repair orreplace the part or determine to repay the Buyer the full price paid forthe part. Dismounting and reinstallation of defective part is done at theBuyer’s expense. Warranty for delivery of spare parts or replacementparts will expire when the warranty for the original equipment expires.Any repayment of purchase price will be without interest. Seller’s soleresponsibility and Buyer’s exclusive remedy shall be limited to such re-pair, replacement, or repayment of purchase price as above provided.There are no other warranties, expresses, statutory or fitness for pur-

pose, nor any affirmation of fact or representation which extends be-yond the description on the face hereof. The warranties of CAS do notcover and CAS makes no warranty with respect to:A) Failures not reported to CAS within the warranty period as speci-

fied aboveB) Failure or damage due to misapplication, abuse improper installa-

tion or abnormal conditions of temperature, dirt or other corrosivematter.

C) Failures due to operation, either intentional or otherwise, aboverated capacities or in an otherwise improper manner

D) Products which have been in any way tampered with or altered byanyone other than an authorized representative of CAS

E) Products damaged in shipment or otherwise without fault of CASF) Expenses incurred by Buyer in an attempt to repair or rework any

alleged defective product G) Defects in material and workmanship which are attributable to

drawings and specifications provided by the Buyer.

Limitation of Liability:CAS’s sole responsibility and Buyer’s sole and exclusive remedy with re-spect to any breach of warranty or guarantee under this agreement shallbe limited to repair, replacement or repayment of the purchase price atCAS’s sole option. CAS ‘s total responsibility and liability for any and allclaims, damages of any nature, losses, liabilities or costs of correctiveefforts, including but not limited to those relating to any warranty orguarantee arising out of or related to performance of this agreement orthe products covered hereunder or the performance thereof shall notexceed the purchase price. In no event shall CAS be liable for any spe-cial, indirect, incidental of consequential damages of any character; in-cluding but not limited to loss of use or productive facilities orequipment, lost profits, property damage, expense incurred in relianceon Seller’s performance hereunder, or lost production, whether sufferedby Buyer or any third part. CAS disclaims all liability for any and all costs,claims, demands, charges, expense or other damages, either direct orindirect, incident to all property damages arising out of any cause of ac-tion based on strict liability.

Returns:All returns have to be authorized by CAS management. Items returnedshould arrive to CAS in the same condition as it was shipped from CASin order to receive refund. Returns are subject to a 25% restocking fee.Customers will be responsible for all freight cost.
