The partnership between the Thailand Institute of Justice (TIJ) and the Institute for Global Law and Policy (IGLP) at Harvard Law School provides Thai and international emerging leaders with exclusive opportunities to share and strengthen their policy analysis and critical thinking skills by working closely with world-class faculty members from the Harvard IGLP network. This interactive, inter-disciplinary, and innovative approach in mainstreaming the rule of law into policy discourses promises to be a unique and unparalleled experience.

AT A GLANCE: The Workshop Format

The TIJ Workshop focuses on peer-to-peer learning and the necessary skills for understanding policies and initiatives that affect people’s lives and the world at large, while drawing upon the rule of law as a guiding framework. Participants will have the opportunities to:

The objective of the TIJ-IGLP Workshop is to cultivate an appreciation of the importance of the rule of law, particularly its vital role in the achievement of sustainable development. It provides a platform that encourages constructive discussions among practitioners across sectors and promotes interactive learning through experience-sharing. With a deeper understanding of how and why the rule of law is essential for equitable and inclusive socio-economic growth, human rights protection, and sustainable development, participants will become a part of an ever-growing networkofemergingleaderswhowillactasagentsofchangeintheirrespectivefields,andbridgethinking and practice.

THE OPENING PLENARY

Kittipong KittayarakhasservedastheExecutiveDirectoroftheThailandInstituteofJustice(TIJ)—aninstituteaffiliatedwiththeUnitedNationsCrimePreventionandCriminalJusticeProgrammeNetwork(PNI)—sinceearly2015.Since1983,hehasheldseveralkeypublicofficesincludingDirector of Office of Thailand Criminal Law Institute at the Office oftheAttorneyGeneral,DirectorGeneralof theDepartmentofProbation,DeputyPermanentSecretaryandPermanentSecretaryoftheMinistryofJustice, respectively.

Beforehisappointmentas thePermanentSecretaryof theMinistryofJustice, he has played crucial roles as members of various committees. HehelpedsteertheConstitutionDraftingCommittee,whichpromulgatedthe 1997 Constitution—renowned as the “People’s Charter.” As thePermanentSecretaryoftheMinistryofJustice,hehelpedengineerkeyreform initiatives including the reorganization of the Ministry of Justice, promotion of due process and rights protection, implementation of rehabilitation programs for drug offenders, as well as reduction of prison overcrowding. He has played a crucial role in mainstreaming restorative justice and community justice in Thailand, which contributed to the development of innovative frameworks within the field of alternativedispute resolution. Throughout his career, he has sought to promote the rule of law as one of the fundamental building blocks for sustainable development through a multi-stakeholder approach, and called for greater public participation in the justice system.

David Kennedy isManleyO.HudsonProfessor of Law and Faculty Director oftheInstituteforGlobalLawandPolicyatHarvardLawSchoolwhereheteachesinternational law, international economic policy, legal theory, law and development andEuropeanlaw.HejoinedtheHarvardLawfacultyin1981andholdsaPh.D.fromtheFletcherSchoolatTuftsUniversityandaJ.D. fromHarvard.He istheauthor of numerous articles on international law and global governance. His research uses interdisciplinary materials from sociology and social theory, economics and history to explore issues of global governance, development policy and the nature of professional expertise. He has been particularly committed to developing new voices from the third world and among women in international affairs. As a practicing lawyer and consultant, Professor Kennedy hasworkedon numerous international projects, both commercial and public, including work with PricewaterhouseCoopers with their emerging markets and anti-corruption practice,with theUnitedNations, the Commission of the EuropeanUnion, theQatarFoundationandwiththeprivatefirmofCleary,Gottlieb,SteenandHamiltoninBrussels,wherehisworkcombinedEuropeanantitrust litigation,governmentrelationsadvisingandgeneralcorporate law.Amemberof theU.S.CouncilonForeignRelations,heispastChairandMemberoftheWorldEconomicForum’sGlobalAdvisoryCouncilonGlobalGovernance.In2011,hewasappointedForeignAdvisor to Thailand’s Truth for Reconciliation Commission and now serves as a member of the Asian Peace and Reconciliation Commission.

AtHarvard,heservedasChairoftheGraduateCommitteeandFacultyDirectorofInternationalLegalStudies.HefoundedtheEuropeanLawResearchCenteratHarvardin1991andservedcontinuouslyasitsFacultyDirector.Hehasadviseda number of educational institutions on their academic programs, and lectured asaVisitingProfessoratnumerousuniversitiesacrosstheworld.In2008-2009,heservedasVicePresidentforInternationalAffairs,UniversityProfessorofLawandDavidandMariannaFisherUniversityProfessorofInternationalRelationsatBrownUniversity

Nicholas Booth is the Programme Advisor for Governance, Conflict Prevention, Access to Justice and Human Rightsat the United Nations Development Programme, BangkokRegional Hub. His lecture will highlight the vital roles of the rule of law in realizing the global objectives enshrined in theUN2030AgendaforSustainableDevelopment.Priortojoining theUN in2001,NicholashadextensiveexperienceasalegalpractitionerintheUnitedKingdomandtheUnitedStates,specializinginlaborrightsanddiscriminationwithaninter-disciplinary focuson race,gender,disability,andHIV/AIDS.Duringhisyears inprivatepracticehewasanactivepro bono lawyer working with the Terrence Higgins Trust, the FreeRepresentationUnitandtheEmploymentLawAppealsAdvisoryScheme,amongothers.

Osama Siddique is a legal scholar, policy reform advisor and author. He is an Associate Fellow at the Institute of Development and Economic Alternatives (IDEAS), Lahore,Pakistan. He has also worked as an Associate Professor of Law&Policyandwasthefoundingheadofdepartment(2005-2007)atLahoreUniversityofManagementSciences(LUMS),Lahore, Pakistan. Dr. Siddique has extensive experiencein researchandpolicywork in thefieldsof lawandpublicpolicy. He has several scholarly publications in international academic journals in the areas of comparative constitutional law, law and development, legal history, human rights, legal education, and justice sector reform. He has also worked extensively as a justice sector reform adviser to Pakistani courts, federal and provincial government departments, the United Nations and various international bilateral andmultilateralfinancial institutions, includingtheADB,USAID,DFID,EU,GIZandWorldBank.Heisaregularparticipantinlocal and international academic conferences and policy dialogues. He has also practiced as a transactional lawyer inNewYorkandasanadvocateof theappellatecourts inPakistan. His most recent book publication is ‘Pakistan’s ExperiencewithFormalLaw:AnAlienJustice’ (Cambridge:Cambridge University Press, 2013). Dr. Siddique is alsocurrentlyamemberoftheSeniorFacultyoftheInstituteforGlobal Law&Policy (IGLP) atHarvard LawSchool for the2015IGLPWorkshop.

Radhika Coomaraswamy, a lawyer by training and formerly the Chairpersonof theSri LankaHumanRightsCommission, is aninternationally known human rights advocate who has done outstanding work as Special Rapporteur on Violence againstWomen (1994-2003). In her reports to the UN Commission onHuman Rights, she has written on violence in the family, violence inthecommunity,violenceagainstwomenduringarmedconflictandtheproblemofinternationaltrafficking.Astrongadvocateonwomen’s rights, she has intervened on behalf of countless women throughouttheworld,seekingclarificationfromGovernmentsincases involving violence against women.

SheisagraduateoftheUNInternationalSchoolinNewYork,andreceived her B.A. from Yale University, J.D. from ColumbiaUniversity,andLL.M.fromHarvardUniversity,aswellashonoraryPhDs from Amherst College, the University of Edinburgh, theUniversityofEssexandtheUniversityofLeuven.

Sompoat ChansomboonistheManagingDirectorofdtacAccelerateat Total Access Communication Public Company Limited (dtac). His lecture will focus on how technological advancements and innovation act as driving forces behind the creation of economic growth and sustainable development. Prior to this, he worked at UOB and Citibank as Digital Marketing Head and ManagementAssociate, respectively. He has leveraged the combination of his educational and professional backgrounds in engineering and finance to mentor outstanding young entrepreneurs to designinnovative tools, digital platforms and technology to create a better future.

Professor Dr. Surakiart Sathirathai served as the Minister of Finance, Minister ofForeignAffairs,DeputyPrimeMinisterandconcurrentlyActingMinisterofCulture.HewasChairmanofGovernmentPolicyDraftingCommitteein2001.He was an Adviser to several Prime Ministers and a Member of Parliament. He wasthefirstThaiForeignMinisterwhocompletedafour-yeartermofelectedgovernment.In2004-2006,hewasendorsedbyASEANtobeacandidateforthepositionofSecretary-GeneraloftheUnitedNations.BetweenSeptember2011–July2012hewasAdvisertotheTruthandReconciliationCommissionofThailand(TRCT),setupasaresultofmajorpoliticalconflictsinThailand.HeisPresidentofSaranromInstituteofForeignAffairsFoundation(SIFAF),athink-tank on foreign affairs of Thailand.

Vitit Muntarbhorn is an international human rights expert and professor emeritus of law at Chulalongkorn University in Bangkok, Thailand. Hislecture will examine the linkages between the rule of law and sustainable development, and their implications for human rights in Southeast Asia.Hewasdesignated inSeptember 2016as thefirstUN Independent Experton violence and discrimination based on sexual orientation and gender identitybytheHumanRightsCouncil.HispastinvolvementinUNactivitiesincludes: Special Rapporteur on the sale of children, child prostitutionand child pornography (1990-1994), Special Rapporteur on the Situationof Human Rights in Democratic People’s Republic of Korea (2004-2010),memberoftheCommitteeofExpertsontheApplicationofConventionsandRecommendations of the International Labor Organization, and has served as anexpert/consultantwiththeOHCHR,UNHCR,UNDP,FAO,UNCEF,UNESCO,theWHOandtheUNUniversity.HewasawardedtheUNESCOPrizeforHumanRightsEducationin2004,andreceivedtheBonhamCenterAwardfromtheMarkS.BonhamCenterforSexualDiversityStudiesin2018.

Punnamas Vichitkulwongsa is the former CEO of Ascend Money, one of the largest Fintech companies in SoutheastAsia, where he focused on creating innovative tools and services (related to lending, e-wallet payments, insurance and investments) to increase financial inclusion and reduceinequalities.Priortothis,hewastheDirectorofMobileFinancialServices of SingTel Group in Singapore, where he started anew retail bank, targeting digital consumers with innovative customer-centric propositions whilst integrating personal financialservicesandembarkingonmobile-commerce.

Sita Sumrit is the Assistant Director and Head of PovertyEradicationandGenderDivisionattheASEANSecretariat.Herwork focuses on the promotion of women’s access to justice, women political leadership, as well as the elimination of violence against women and girls. Prior to this, she has worked as Chief ofWomen and Children Empowerment Program atthe TIJ, Regional Research Advisor for Oxfam Asia Regional Office, and Gender Officer at the UN Food and AgricultureOrganization(FAO)inVietnam.

Bandid Nijathaworn is the immediate past Council Member and Secretary of Thailand’s Private Sector Collective ActionCoalitionagainstCorruption(CAC)andPresidentandCEOofthe Thai Institute of Directors (2010–2018). Presently, he isaVisitingProfessoratHitotsubashiUniversity inJapan,andmemberoftheboardofdirectorsoftheThailandDevelopmentResearchInstitute(TDRI).HeworkedattheBankofThailand(1990–2010) and held the position of Deputy Governorfor monetary stability (2006–2010), in which he oversawmacroeconomicpoliciesandfinancialmarketsmanagement.

Matti JoutsenistheformerDirectoroftheEuropeanInstituteforCrimePreventionandControl(HEUNI),affiliatedwiththeUN.Currently,heistheSpecialAdvisortotheTIJ.Hehaslongrepresented Finland at meetings of the UN, the Council ofEuropeandtheEuropeanUnion.Hewasthechiefnegotiatorfor Finland on the UN Convention against TransnationalOrganized Crime, the UN Convention against Corruption,and the Mechanism for the Review of Implementation of the Corruption Convention.

The January 2019 TIJ International Forum is the seventh instalment of a continuing series of opendiscussionsaboutregionalapproachestoandissuesinmainstreamingtheruleoflaw,theefficacyoftheseattempts and cases that embody the rule of law in action. The goal is to use the concept of the rule of law as a lens to better understand complex socio-economic issues to establish a systematic framework to inform policy development. Asthetechnologiesofgovernment,industryandcivilsocietychange,somuchthelaw.Keynoteaddresseswill examine the intrinsic linkages innovation and technology in strengthening the rule of law to create more just and inclusive societies, the balance between technology-driven economies and justice reforms, as well as the inextricable relations between law and technology.

Tackling complex development challenges such as cyber threats, structural inequalities, access to justice and corruption in an ever-evolving environment requires more than cooperative efforts of key players across national boundaries, rather it calls for greater emphasis on adopting novel solutions to unlock the full potential of the rule of law.

The2019TIJInternationalForumwillincludepaneldiscussions,featuringfacultymembersfromthenetworkofInstituteforGlobalLawandPolicy(IGLP)atHarvardLawSchool,regionalandnationalexperts,aswellasTIJFellowsfromtheWorkshopforEmergingLeadersontheRuleofLawandPolicy.Thesesessionswillposition the rule of law among salient socio-economic issues.

Thefirstpanelon“RegionalExperiences”willbeledbyemergingleadersfromtheTIJWorkshopontheRuleof Law and Policy. To conclude the weeklong Workshop, this session will provide an opportunity for selected emerging leaders to present rule of law-based solutions for emerging public policy issues in different regional contexts, as well as opportunity to extract and analyze lessons learned.

Thesecondpanelon“ImprovingEqualityandJusticethroughInnovationandTechnology”willbeledbyregional experts and faculty members from the IGLP network. This discussion will explore how technological advancements and innovative policy tools could play crucial roles in reducing structural inequalities rooted in socioeconomic backgrounds, gender, education opportunities and access to redress mechanisms. Panelists will illustrate the ways in which effective design and implementation of more human-centric and digital-based solutions could improve daily lives of vulnerable and marginalized groups, in tandem with creating driving forces to overcome sustainable development challenges from the local to global level.

The thirdpanelon “UsingTechnology toRespond toCriminalChallenges inaBorderlessWorld”willbeled by regional experts and faculty members from the IGLP network. This discussion will highlight how globalizedeconomiesandregionshaveexperiencedanincreaseinfreeflowsofgoods,alongwithagrowingdependence on networked digital systems, products and services. This trend is wrought with a rise in both thevarietyandquantityofcyberchallenges,whichcontinuetoinfiltratethedailylivesofindividualsandthreaten the stability of modern institutions. In light of this, panelists will examine how concerted efforts acrosssectorsandborderscouldcreatedigital-basedsolutionsandstronginfrastructurestofightagainstcorruption and address cyber threats.

The Thailand Institute of Justice (TIJ) is a research institute affliated with the United Nations Crime Prevention and Criminal Justice Programme Network or UN-PNI.

TIJ’s vision is to be a promoter of change to enhance justice system and promote a culture of lawfulness in Thailand and wider international communities through research, capacity-building and policy advocacy activities in crime prevention, criminal justice and the rule of law.
