The objective of this application is obtain council consent for Strata subdivision for an existing dual occupancy at Nos. 2 and 2A William Street, South Strathfield to suit the needs of the owners.

Property Description

The land subject to this application is the whole of the land being Lot 38 in Deposited Plan No. 1701, situated at Strathfield, in the Local Government Area of Strathfield, Parish of Bankstown and County of Cumberland. The property is also known as 2 (& 2A) William Street, South Strathfield.

The Subject land has a frontage of 16.495 metres to William Street and a second frontage to Water Street of 39.625 metres, providing a site area of 653.61 metres square.

Existing Development

The existing dual occupancy was approved 27 February 1997 (BA96/348) and constructed shortly after. The site contains a single storey dwelling fronting William Street with a driveway to a single car space, known as No. 2. The second dwelling has a frontage to Water Street with access to a single garage, known as No. 2A. Each dwelling has access to private open space and occupied by family members.

Proposed Subdivision

Pursuant to Section 76A of the Environmental Planning and Assessment Act (1979) an assessment of the impact of proposed Strata Title subdivision at 2 William Street, South Strathfield is contained within the material set out below. The proposal is assessed with respect to its compliance with the heads of consideration contained within section 90 and the provisions of existing or draft environmental planning instruments, policies or guidelines, State and Local applying to the land.

Statutory Provisions:

The Environmental Planning and Assessment Act (1979) Strathfield Local Environmental Plan 2012 Strathfield Consolidated Development Control Plan 2005. The site is zoned R2 under Council’s LEP and is not listed as a heritage item nor within a heritage conservation area. Strata Subdivision is permissible with consent.

It is intended to formalise the existing situation by strata subdividing the subject lot into two new lots by Strata subdivision in accordance to Section 4.1 “ Minimum subdivision lot size” and 4.1A “Minimum lot sizes for dual occupancies, multi dwelling housing and residential flat buildings” in Strathfield Local Environmental Plan 2012.

4.1 Minimum subdivision lot size

(1) The objectives of this clause are as follows:

(a) to promote consistent subdivision and development patterns that reflect and reinforce the predominant subdivision pattern of the area,

(b) to ensure a variety of lot sizes are maintained of sufficient size and shape to accommodate a variety of development types,

(c) topreservelargeindustriallotsinordertoprovidearangeoflarge-scale sites suitable for industrial activities that require integrated and large floorplates.

2. (2) This clause applies to a subdivision of any land shown on the Lot Size Map that requires development consent and that is carried out after commencement of this Plan.

3. (3) The size of any lot resulting from a subdivision of land to which this clause applies is not to be less than the minimum size shown on the Lot size Map in relation to that land.

(4) This clause does not apply in relation to the subdivision of individual lots in a strata plan or community title scheme.

4.1A Minimum lot sizes for dual occupancies, multi dwelling housing and residential flat buildings

The objective of this clause is to achieve planned residential density in certain zones.

Development consent may be granted to development on a lot in a zone shown in Column 2 of the Table to this clause for a purpose shown in Column 1 of the Table opposite that zone, only if the area of the lot is equal to or greater than the area specified for that purpose and shown opposite in Column 3 of the Table.

The proposed two strata lots (Nos. 2A and 2) will have area of 262 metres square and 391 metres square, respectively. These lots areas and boundaries are consistent with the original dual occupancy approval issued in 1997.

Minimum land lot size of 560 metre square for subdivision in accordance Section 4.1A in Strathfield Local Environmental Plan 2012 is not applicable as this is a strata subdivision application.

Compliance with Strathfield Consolidated Development Control Plan 205

This proposed development is consistent with the objectives of Strathfield Consolidated Development Control Plan 2005 Part B.2.12 for subdivision in that subdivision of dual occupancy developments within the 2 (b) Residential zone only is permitted.

Conclusion

This proposed strata subdivision is only creating separate title for a dual occupancy and is considered to have a negligible environmental impact. The site benefits from two street frontages, allowing each dwelling to have its own frontage and direct access. The dwellings are separated by a dividing fence each with their own dedicated off street car parking space and principle private open space.

The strata subdivision of the two lots does not change the physical appearance of the dwellings and does not impact the streetscape nor natural environment.
