PROTOCOL AMENDING THE AGREEMENT FOR THE SUPPRESSION OF THE CIRCU­

LATION OF OBSCENE PUBLICATIONS, SIGNED AT PARIS ON 4 MAY 1910

The Parties to the present Protocol, consid­ering that under the Agreement for the Suppres­sion of the Circulation of Obscene Publications, signed at Paris 011 4 May 1910, the Covernment of the French Republic was invested with certain functions; considering that the said Government has offered to transfer to the United Nations the functions exercised by it under the above-men­tioned Agreement; and considering that it is expedient that these functions should be assumed henceforth by the United Nations, hereby agree as follows:

ARTICLE 1

The Part.ies to the present Protocol undertake that as between themselves they will, in accord­ance with the provisions of the present Protocol, attribute fuJI legal force and effect to, and duly apply, the amendments to this instrument which are set forth in the annex to the presen t Protocol.

ARTICLE 2

The Secretary-General shall prepare the text of the Agreement of 4 May 1910 for the Sup­pression of the Circulation of Obscene Publica­tions, as revised in accordance with the present Protocol, and shaH send copies for their infonna­tion to the Governments of every Member of the United Nations and every non-member State to which this Protocol is open for signature or acceptance. He shall also invite Parties to the aforesaid Agreement to apply the amended text of this instrument as soon as the amendments are in force, even if they have not yet been able to become Parties to the present Protocol.

ARTICLE 3

The present Protocol shall be open for signa­ture or acceptance by any of the Parties to the Agreement of 4 May 1910 for the Suppression

of the Circulation of Obscene Publications, to which the Secretary-General has communicated for this purpose a copy of the present Protocol.

ARTICLE 4

States may become Parties to the present Protocol by:

(a) Signature without reservation as to ac­ceptance;

(b) Signature with reservation as to accep­tance, followed by acceptance;

(c) Acceptance_

Acceptance shall be eflected by the deposit of a formal instrument with the Secretary-General of the United Nations.

ARTICLE 5

The present Protocol shall come into force on the date on which two or more States shall have become Parties thereto.

The amendments set forth in the annex to the present Protocol shall come into force in respect of the Agreement of 4, May 1910 for the Sup­pression of the Circulatjon of Obscene Publica­tions whell thirteen Parties thereto shall have become Partjes to the present Protocol, and consequently, any State becoming a Party to the Agreement after the amendments thereto have come into force shall become a Party to the Agreement as so amended.

ARTICLE 6

Upon the entry into force of the amendments se t forth in the annex to the present Protocol, the French Government shall deposit with the Secretary-General of the United Nations the original of the Agreement, together with the vari­ous documents which were in its custody by virtue of the functions which it exercised.

ARTICLE 7

In accordance with paragraph 1 01 Article 102 01 the Charter 01 the United Nations and the regulations pursuant thereto adopted by the General Assembly, the Secretary-General 01 the United Nations is authorized to effect registration of the present Protocol and the amendments made in the Agreement by the present Protocol on the respective dates of their entry into force, and to publish the Protocol and the amended Agreement as soon as possible after registration.

ARTICLE 8

The present Protocol, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited in the ar­chives of the United Nations Secretariat. The

Agreement to be amended in accordance with the annex being in the French language only, the French text of the annex shall be authentic and the Chinese, English, Russian and Spanish texts shall be translations. A certified copy of the Protocol, including the annex, shall be sent by the Secretary-General to each of the Parties to the Agreement 01 4 May 1910 lor the Suppres­sion of the Circulation of Obscene Publications, as weU as to all Members of the United Nations.

IN WITNESS WHEREOF the undersigned, being duly authorized thereto by their respective Gov­ernments, signed the present Protocol on the date appearing opposite their respective sig­natures.

II invitera egalement les ELats Parties a l'Arrangement susmentionne it appliquer Ie Lexte amende de eel instrument des I'entree en vigueur des amen dements, meme s'ils n'ont pas encore pu deveni_r Parties au present Protocole_

tion; b) En Ie sign ant sous reserve d'acceptation et

en I'acceptant ulteriemement; c) En I'acceptant.

L'acceptation s'effectuera par Ie depot d'un instrument formel aupres du Secretaire general de l'Organisa tion des Nations Unies.

ARTICLE 5

Le present Protocole entrera en vigueur it ia date it laquelle deux ou plusieurs Etats seront devenus Parties audit Protocole.

Les amen dements contenus dans l'Annexe au present Protocole entreron t en vigueur, en ce qui concerne I'Arrangement du 4 mai 1910 relatiI it la repression de la circulation des publi. cations obscenes, lorsque treize Etats Parties audit Arrangement seront devenus Parties au present Protocole ct, en consequence, tout Etat qui devicndra Partie it l'Arrangement ap res que les amendements s'y rapportan t seront entres en viguellf, deviendra Partie it l'Arrangement ainsi amende.

Gouvernement fran~ais deposera aupres du Secre­taire general de l'Organisation des Nations Unies l'original de l'Arrangement ainsi que les dif­ferents documents dont il avait Ia garde en vertu des fonctions qu'il exer~ait.

ARTI CLE 7

Conformement aux dispositions du paragraphe premier de I'Article 102 de la Charte des Nations Unies et au reglement adopte par l'Assembh~e generale pour I'application de ce texte, Ie Secre­taire general de l'Organisation des Nations Unies est autorise a enregistrer Ie present Protocole ainsi que les amendements apportes a I' Arrange­ment par Ie present Protocole, aux dates respec­tives de leur entree en vigueur, et a publier, aussitot que possible apres leur enregistrement, Ie Protocole et Ie texte amende de l'Arrangement.

ARTI CLE 8

Le present Protocole, dont les textes anglais, chinois, espagnol, £ran~ais et russe font egalement

foi, sera depose aux archives du Secretariat de l'Organisation des Nations Unies. L'Arrange­ment qui sera amende conformement a l'Annexe ayant ete redige seulement en franc;ais, Ie texte fran~is de I' Annexe {era {oi et les textes anglais, chinois, espagnol et russe seront consideres comme des traductions. Une copie certifiee con­forme du Protocole, y compris l'Annexe, sera envoyee par Ie Secretaire general a chacun des Etats Parties a I'Arrangement du 4 mai 191 0 relatif a ]a repression de la circulation des publi­cations obscenes, ainsi qu'a tous les Eta ts Mem­hres de I'Organisation des Nations Unies.

EN FOI DE QUOI les sOllssignes, dument au­torises par leurs Gouvernements respectifs, ont signe Ie present Protocole it la date ligurant en regard de leurs signatures respectives.

PROTOCOLO QUE MODIFlCA EL ACUERDO PARA LA REPRESION DE LA CIRCULA­

CION DE PUBLlCACIONES OBSCENAS, FIRMADO EN PARIS EL 4 DE MAYO DE 1910

Los ESlados Partes en el presente Protocolo, consideranclo que en virtud del Acuerdo para la repreSlO1l de la circulacion de publicaciones obscenas. firmado en Paris el 4 de mayo de 1910, el Gobierno de la Repi.blica Francesa es taba inves tido de ciertas funciones ; conside­rando que clicho Cobierno ha ofrecido esponta­neamente traspasar a las Naciones Unidas las fun eiones que ejerce en virtud de clicho Acuerdo; y considerando que es conveniente que en ade­lante sean estas asumidas por las Naciones Unidas, han convenido en las siguicntes disposiciones:

ARTicULO 1

Los ESlados Partes en el prescote Protocolo se compromcten entre si, y con arreg]o a las disposiciones del presenle Protocolo, a atribuir plena efectividad juridica a las enmiendas a ese instrumento consignadas en el Anexo al presente Protocolo, a ponerl as en vigor y a asegurar su apl.icacion.

ARTicULO 2

EI Secretario General preparara el texto del Acuerdo del 4 de mayo de 1910 para la repre­sion de la circulacion de publicaciones obscenas, revisado con arreglo a l presente Protocoio, y enviara copias del mismo, para su informacion, a los Gobiernos de cada uno de los Estados Miernbros de las Naciolles Unidas, asi como a los Gobicl'I1os de cada uno de los Estados no miembros a los (Iue este abierta la firma 0 la acep tacioll del prescntc Protocolo. Invitara igual­mente a los Estados Partes en el citado Acuerdo, a ap licar e] texto modificado de tal inslrurnento, tan pronto como entren en vigor las enmiendas, incluso si esos ESlados no han podido aim Jlegar a ser partes en el presente Protocolo.

ARTicuLO 3

EI presente Protocolo estara abierto a la firma o a la aceptacion de lodos los Estados Partes en

el Acuerdo del 4 de mayo de 1910 para la repre­sion de Ia circulacion de publicaciones obscenas, a los que el Secrelario General haya enviado, al efecto, copia del presentc Protoco]o.

ARTicULO 4

Los ESlados podran lIegar a ser Partes en el presente Protocolo:

a) Por la firma sin rescrva de aceptacion; b) Por la firma con reserva de aceptacion, y

la aceplacioll ulterior; c) Por la aceptacion . La acep tacion se efectuara mediante el de­

posito de Ull inslrumento en forma enlregado a] Secreta rio Genera l de las Naciones Unidas.

AIl.1'iCULO 5

El presente Protocolo entrani en vigor en la fecha en que dos 0 mas ESlados hayan llegado a ser Partes en dicho Protocolo.

Las enm iendas consignadas en el Anexo al presente Protocolo entraran en vigor, respecto al Acuerdo del 4 de mayo de 1910 para la repre­sion de la circulacion de publicaciones obscenas, cuando trece Estados Partes en dicho acuerdo ha­yan lIegado a ser Partes en e] presente Protocolo; y, en cOllsecuencia, todo Estado que lJegue a ser Parte en el Acuerdo despues de haber entrado en vigor tales enmicndas, sera. Parte en el Acuerdo asi ll1odificado.

ARTicULO 6

Cuando hayan entrado en vigor las enmiendas consignadas en el Ancxo al presente P rotocolo, el Gobierno frances depositara el original del Acuerdo, asi como los diversos documentos que dicllo Gobierno custodiaba en virtud de las fun­ciones que ejercia, entregandolos al Secretario Genera] de las aciones Unidas.

ARTicuLO 7

Conforme a las disposiciones del parrafo 1 del Articulo 102 de la Carta de las Naciones Vnidas y del reglamento aprobado por la Asam· blea General para la aplicacion del mismo, el Secretario General de las Naciones Vnidas es ta autorizado a registrar el presente Protocoio, asi como las enmiendas introducidas por este Pro­toeolo en el Acuerdo, en las feehas respectivas de su entrada en vigor y a publicar, tan pronto como sea posible despues de su registro, el Pro­toeala y eJ texto modificado del Acuerdo.

ARTicULO 8

EI presente Protocolo, cuyas textos chino, es­panol, frances, ingles y ruso son igualmente autenticos, sera. depositado en los archivos de la Secretaria de las Naciones Uoidas. Como el

Acuerdo que ha de ser modificado con arreglo al Anexo, fue redactado solamente en frances, el Lexto frances del Anexo sera el autentico, con­sidenindose como traducciones los textos chino, espanol, ingles y ruso. EI Secretario General en­viani copia certificada del Prolocolo, con inclu­sion del Anexo, a cada uno de los Estados Partes en el Acuerdo del 4 de mayo de 191 0 para la represion de la circulacion de publicaciones obscenas, asi como a lodos los Estados Miembros de las Naciones Unidas.

EN TESTIM ONIO DE LO CUAL los infrascritos, debidamente autorizados para ello por sus res­pectivos Gobiernos, han firmado el presente Protocolo en la fecha que aparece al lado de sus respectivas firmas.
