ANALYSIS AND EVALUATION

According to the informants from Tablon, Cagayan de Oro City, particularly

Barangay officials and neighbors, accused-petitioner is not considered a notorious

criminal. She has still time to reform through an individualized, community-based treatment

of rehabilitation, if given another chance.

Records check conducted revealed that accused-petitioner is facing another

criminal charge; this time of Carnapping in Criminal Case No. 14-01-4980. Even with the

recent information, accused-petitioner is still considered a first-offender; thus she has the

privilege to avail of the benefits of P.D. 968, as amended.

This Post-Sentence Investigation Report is the result of the community interview/background investigation and records check conducted by the City Parole and Probation Office, Cagayan de Oro City.

RECOMMENDATION

WHEREFORE, In view of the foregoing, it is respectfully recommended to the Honorable

Court that the petition for probation of SARAH JAEL AMION y RUSIANA be GRANTED for a

period of ONE (1) YEAR, to be counted from Probationer’s initial report for supervision and subject

to the following conditions:

1. Probationer shall report initially to the Chief Probation and Parole Officer at Bukidnon Parole and Probation Office, No. 1, Manolo Fortich, Bukidnon within seventy-two (72) hours from the receipt of the Order granting probation.

2. She shall, thereafter, report to her supervising Probation and Parole Officer once a month unless otherwise modified by the Chief Probation and Parole Officer.

3. She shall reside at 074 Virgen de Regla Village, Zone 2, Tablon, Cagayan de Oro City and shall not change her residence without prior approval of the Chief Probation and Parole Officer, or Court, as the case may be.

4. She shall secure a written permit to travel outside the jurisdiction of the Parole and Probation Office from the Chief Probation and Parole Officer and from the Court if such travel exceeds thirty (30) days.

5. She shall not commit any crime or any other offense.6. She shall render community service and will participate in tree-planting activities.7. She shall allow the supervising Probation and Parole Officer or an authorized Volunteer

Probation Aide to visit her home and place of work.8. She shall meet her family responsibilities.9. She shall devote himself to a specific employment and shall not change said

employment without prior notice to the supervising officer and/or pursue a prescribed secular study or vocational training.

10. She shall refrain from associating with persons of questionable character. 11. She shall cooperate with his program of supervision, and shall satisfy any other

condition related to her rehabilitation and not unduly restrictive of her liberty incompatible with her freedom of conscience.

12. She shall plant ten (10) trees during her probation period and shall see to it its proper growth and survival.

In the event that Petitioner fails to observe the preceding conditions and/or has committed any material misrepresentation in his application for probation, his probation may be revoked by the Court or the conditions thereof modified.

III. Offender’s StatementHe was on his way home when his friends called him to join them. After more than an hour of drinking Tanduay rum with his friends he decided to go home. It was then that the incident happened. He admitted that he was drunk but could not remember anymore what he did to the complainant.

IV. Victims’ Statement The family of the victim could not believe that the accused-petitioner would harm the

complainant because they know each other very well and he used to pass by their place almost everyday when he goes to his work in the morning and either in the afternoon or evening after his work.

Barangay Lingating, Baungon, Bukidnon. They grew up together and they have been very close

was attacked and harmed by the accused-petitioner.
