Stanislaus County is located in Central California within 90 minutes of the San Fran-cisco Bay Area, the Silicon Valley, Sacramento, the Sierra Nevada Mountains and California’s Central Coast. With an estimated 538,388 people calling this area home, the community reflects a region rich in diversity with a strong sense of com-munity. Two of California’s major north-south transportation routes (Interstate 5 and Highway 99) intersect the area and the County has quickly become one of the dominant logistics center locations on the west coast.

The County is home to a vibrant arts community with the world-class Gallo Center for the Arts, a symphony orchestra, and abundant visual and performing arts. Temperatures range from an average low of 38 degrees Fahrenheit in the winter to an average high of 85 degrees in the summer. Temperatures move up into the 90s during the summer months with low humidity and cool evening breezes from the San Joaquin Delta.

About the Department

The Public Defender’s Office is an integral part of the criminal justice system. The Department mission is to ensure and promote justice, reduce recidivism and pro-vide zealous advocacy through client-centered high quality legal representation that protects the liberty and constitutional rights of indigent persons accused of crimes. The Department mission also supports the Stanislaus County Focus on Pre-vention countywide initiative to Reduce Recidivism and Re-entry into the Criminal Justice System, Strengthen Families and Reduce Homelessness. The Public Defend-er’s Office also represents parents in matters in which the state seeks to make their children dependents of the court, people accused of criminal contempt of court and people who are involuntarily committed during certain mental health proceedings. Duties of the Public Defender are mandated by the Constitution of the United States, the Constitution of the State of California, and statutes enacted by the California Legislative. Services provided by the Public Defender’s Office help assure orderly administration of justice within our community and protection of liberty of those accused of crimes as well as those who might someday find them-selves accused.

The Ideal Candidate

• Five (5) years of experience as an

attorney in the practice of criminal

law, three (3) years of which must

be in an administrative or supervi-

sory capacity over attorney’s

providing legal counsel and indi-

gent defense services or compara-

ble legal counsel that demon-

strates the ability to perform the

essential functions of the classifi-

cation.; AND

• Active Membership in the State

Bar of California; AND

• Possess and maintain a valid Cali-

fornia’s Driver’s License at the

time of appointment.

Desirable Qualifications

• Extensive, in-depth management

experience in the provision of legal

services.

TYPICAL TASKS

• Provide day-to-day leadership for de-partment employees through commu-nication and demonstration of theorganization's Vision, Mission and Val-ues;

• Set direction through the develop-ment of a strategic/business plan forthe department;

• Ensure accountability for duties andprojects assigned to managers andother staff;

• Oversee processes for recruitment,hiring, selection, evaluation and disci-pline of employees;

• Plan, organize, and direct a programfor providing legal counsel and repre-sentation to eligible persons accusedof criminal offenses;

• Formulate and apply policies relatedto the Public Defender's Office;

• Assign criminal calendar to appropri-ate staff members;

• Counsels with staff on the conduct ofcases in progress and gives advice andassistance as necessary;

• Direct procedures to determine eligi-bility for Public Defender's Office ser-vices;

• Review and evaluate completed staffwork;

• Discuss the public defense programwith judges, prosecutors, law enforce-ment officials, and other persons toobtain information and possible actionrelative to defendants;

• Personally appear in court as defenseattorney of major and other cases orat arraignment to obtain first-handknowledge of cases going to court;

• Decide on borderline cases of eligibil-ity for legal aid;

• Determine whether convictions shouldbe appealed to higher courts;

• Confer with office staff on recordkeeping and reporting systems andinitiate changes as required;

• Confer with senior staff members re-garding policies, procedures and activ-ities of departmental programs;

• Direct the preparation of the depart-mental budget and administer theapproved budget and control expendi-tures;

• Keep up-to-date on statutory changesaffecting departmental programs;

• Speak before civic and professional

groups to explain and interpret the public defender function; and

• Attend professional meetings and

conferences.
