Did you know the United States government spends billions of dollars to fund a

large variety of research, publications, training materials, films, books and more,

making the US government the largest content producer on the planet?

You see, the United States government is the largest publisher in the world, producing

thousands upon thousands of “products” on a daily basis and by law, works prepared by

the US federal government officers or employees as part of their official duties are not

copyrightable. What does that mean to you?

This means the majority of these government created products — publications,

photographs, images, films, software, books and more — are available in the public

domain, making them free for the taking so you can do whatever you'd like with those

works.

Before we go any further you may be wondering what the heck does public domain

mean. Well here is a brief definition...

A public domain work is a creative work that is not protected by copyright and

which may be freely used by everyone. The reasons that the work is not protected

include:

The term of copyright for the work has expired; the author failed to satisfy statutory

formalities to protect the copyright or the work is a work of the U.S. Government.

Although the vast majority of government created works are in the public domain there

are those cases when a work created by the US Government is not public domain.

Copyright 2010 – Public Domain Resource Guide

Page 5: Public Domain Gold

So when is a US government work NOT in the Public Domain?

US government works may not be in the public domain when:

• Work has been performed for the government by another party. In these cases the

site should have a statement making this clear.

• Copyright has been assigned to the U.S. federal government by others.

• The work is simply reproduced by the US federal government site, as "fair use"

or by permission, but the copyright is actually owned by others.

Here is an example.

Let’s pretend the US government hires a writer to produce a publication. Since the

writer is an independent contractor, the writer will own the copyright in their work

unless the writer assigns it to the government. In which case the US government will

then hold the copyright on the produced work making it available to the general public.

However, the independent contractor may decide to keep the copyright which means

you have no rights to claim that work.

On a side note, be careful when dealing with works produced by individual states,

although the majority of US government works are public domain, works

produced by individual states usually hold a copyright by said state meaning you

cannot use them as your own.

Here is a great resource that answers plenty of questions on US government copyright. I

recommend you utilize this resource.

Now onto the good stuff.....So what can you do with public domain material obtained from the U.S. Government?

Oh, let's see.......

• Take small reports on the same subject and create one massive report, using each

individual report as a chapter and create a mini-site around this subject and sell

the report to your email subscribers and site visitors.

• Repackage individual military manuals and create a massive themed collection

such as a Sniper Training Collection, Hand to Hand Combat collection and so on.

• Create foreign language courses. You could deliver these lessons by subscription,

make them part of a paid membership site, provide them as a free bonus for travel

products and so on.

• Identify an information need and create a consumer guide using government

publications.

• The US government routinely releases information on taxes, health care and other

government policies into the public domain. If you are involved in providing

consulting services in any of these areas, using the public domain as an important

resource for your website will help build trust and more importantly, increase

both your traffic and your conversion rates.

Copyright 2010 – Public Domain Resource Guide

Page 7: Public Domain Gold

• Create simple reports from the government material and use as content for your

mailing list or as a bonus for other products.

• Government agencies are constantly churning out information guides, and people

are hungry for information. Identify an information need, then compile and

repackage the government report to create your own unique product.

• Create PLR products from government publications.

The possibilities are quite endless and I can go on and on with product ideas. Put on

your thinking cap and I'm sure you can come up with over a dozen ways to profit from

US government public domain works yourself.

ResourcesBelow is a massive list of government resources where you can locate material that is in

the public domain.

But first..........

The easiest way that I have found to search for specific government works is by using

Google's U.S. Government Search Engine at http://www.google.com/ig/usgov. This

tool alone has saved me countless hours in searching for works on specific topics. The

only problem with using the Google U.S. Government Search Engine is that it does

return results from individual states and as previously mentioned not all works produced

by individual states are in the public domain.
