MINUTES OF THE MEETING PUBLIC HEALTH, WELFARE AND SAFETY COMMITTEE The fifth meeting of the Public Health, Welfare and Safety Committee met January 19, 1979, in Room 410 of the State Capitol Building at 1:00 p.m. ROLL CALL: All committee members were present. ACTION ON HOUSE B l L L 40: Discussion on House Bill 40 was opened by Chairman Olson a t 1:00 p.m. Senator Himsl once again raised the question on why the age of the senior citizen was set at 60 instead of 55. Senator Lensink then questioned whether specifying the age of the consumer to s i t on the Board is even constitutional. Dave Cogley, Director of Legal Services for the Legislative Council, stated that setting an age is legal if there is good cause; and in this case there is definitely good cause. Senator Palmer made a motion that the Commi ttee strike "60" and change i t to "55 .I1 The motion was seconded and passed wnanimousl y . Senator Palmer moved that House Bill 40 do pass as amended. The motion was seconded and passed unanimously. CONSIDERATION OF SENATE BlLL 125: Senate Bill 125, by request of the Code Commissioner, is an act to generally revise and clarify the laws relating to health and safety. John Bobinski , staff counsel for the Personnel Division of the Department of Administration, stated that he had put the bill together for the Code Commissioner. He went through the summary o f changes made t o Senate Bill 125. See At tachmen t "A." Chairman Olson asked the Committee if anyone had any questions. Senator Himsl asked for clarification on why both references were deleted on page 17, 1 i nes 7 through 13. The hearing on Senate Bil 1 125 was closed at 1 :35 p.m. CONSIDERATION OF SENATE BlLL 127: Senate Bill 127, by request of the Code Commissioner, is an act to generally revise and clarify the laws relating to social services and institutions. John Bobinski, staff counsel for the Personnel Division of the Department of Administration, stated that he also drafted this bill for the Code Commissioner. He went through the summary o f changes made t o Senate B i l l 127. See Attachment "B." He stated that Section 2 was changed because of a phone call from Tom Mahan, legal counsel for the Department of Social and Rehabilitative Services, who referred him to Chapter 30 of the Laws of-1943. A lengthy d iscuss ion fo l lowed on whether t h i s $2400 l i m i t a t i o n i s f o r the At torney General o r f o r ou ts ide l e g a l counc i l f o r the departments. Senator Lensink asked t h a t someone o b t a i n a copy of the Laws o f 1943 t o h e l p c l a r i f y t h i s change.

M r . Bobinski s t a t e d t h a t Sect ion 13 was rev i sed t o c l a r i f y t h a t t he re a r e two ways o f p r o v i d i n g serv ices : (1) by s t a t e agency, and (2) by inde- pendent con t rac to r . The way I t i s worded would make one be1 ieve there a r e three ways t o p rov ide serv ices .

Sec t ion 14 was changed t o c l a r i f y t h a t i f a minor i s committed t o a s t a t e i n s t i t u t i o n by guardian o r parent w i t h o u t h i s consent i t would be 'regarded as a mandatory vo lun ta ry commitment and would r e q u i r e a c o u r t hear ing. This was c l a r i f i e d t o conform w i t h the o r i g i n a l i n t e n t o f the law.

Sect ion 18 was changed t o c l a r i f y t h a t bo th an i n t o x i c a t e d person and a person i ncapaci t a ted by a1 coho1 can rece ive emergency treatment.

The area covered i n Sect ion 19 author izes the governor w i t h approval o f the Board o f Pardons t o commute the sentence f o r a youth under 21 years o f age from p r i s o n t o a j u v e n i l e home. Chairman Olson quest ioned why the age i s 21 instead o f 18. Nick Roter ing from the Department o f I n s t i t u t i o n s s ta red t h a t the department asked i n 1975 t o r e t u r n the age t o 21 o r 25 and t h a t i t has he ld up i n the cour ts . The Federal law has a separate law where you can deal w i t h them c l e a r up t o age 25. The c o u r t recognizes them as y o u t h f u l o f fenders . More d iscuss ion fo l lowed on t h i s . Senator Lensink s t a t e d t h a t s ince t h i s i s a r e c o d i f i c a t i o n b i l l the law should n o t be changed i n i t .

Discussion re turned t o Chapter 30 of the Laws o f 1943. The o r i g i n a l law was d r a f t e d i n 1937. Therefore the Laws o f 1943 do supersede the o r i g i n a l law; and the $2400 l i m i t f o r lega l counc i l was deleted.

Aage Hansen, Assoc ia t ion f o r the Retarded, spoke i n o p p o s i t i o n t o t h e sentence on page 9, l i n e s 3 and 4. He s a i d t h a t the a s s o c i a t i o n i s n o t happy about having the department e s t a b l i s h the q u a l i f i c a t i o n s f o r persons employed t o do a job, They f e e l t h a t i f they accompl i s h the j o b which they a r e con- t r a c t e d t o do tha t i s a l l t h a t i s necessary. The Committee po in ted o u t t o M r . Hansen t h a t t h i s i t em has been a p a r t o f the present law and t h a t i t i s no t being changed. They s a i d t h a t i f the assoc ia t i on wants t o change t h i s " they w i 1 1 have t o come back i n two years w i t h an amendment.

He says t h a t they use t h i s p a r t o f the law t o get ass is tance from the l o c a l law enforcement o f f i c i a l s t o b r i n g back j u v e n i l e s who have escaped from Boulder River School and Hosp i ta l . A f t e r much d iscussion, M r . Ro t te r i ng s ta ted t h a t t o make the b i 1 1 c o n s i s t e n t w i t h the Code he would propose t h a t the change s tay i n and i f the department has a problem i n the nex t two years they w i l l b r i n g i t up a t t he nex t session.

Chairman Olson c losed the hear ing on Senate B i l l 127.

ACTION ON SENATE BILL 125: Senator Norman moved t o pass Senate B i l l 125. The mot ion was seconded and passed unanimously. Senator Palmer moved

AN ACT TO GENERALLY REVISE AND CLARIFY THE LAWS RELATING TO SOCIAL SERVICES AND INSTITUTIONS.

(This summary does not include discussion of routine form or grammatical changes.)

I Section 1. 53-2-104. "Welfare" was changed to "public AO - assistance" for consistency with 53-2-lOl(2) defining "public

Section 20, 53-30-214. "The Montana children's center, ---- Boulder River school and hospital", and "Eastmont training center" were deleted as obsolete in the context of this section and to clarify that the juvenile facilities being referred to in Title 53, chapter 30, are juvenile correctional facilities. "Whose" was changed to "which has as its" and "is" was deleted for grammatical reasons.

Section 21. Repealer. 38-121, R.C.M. 1947, is recommended for repeal because the target terminology therein was appropriately chanqed throughout the MCA to reflect current terminology. In instances where "of unsound mind" did not fit w e l l , it was replaced by amendment.

80-2101 through 80-2107 are recommended for repeal because the.Montana children's center is out of operation and references to it are obsolete.
