Adoption of an Amendment to the Sphere of Influence for the Padre Dam Municipal Water District (SA13-55) “South Coast Development – Ridge Hill Road Reorganization” (Padre Dam Municipal Water District) (RO13-55)

Description/Justification
Proposed by resolution of the Padre Dam Municipal Water District (MWD) is a
reorganization of an approximate 0.51-acre portion of one unincorporated parcel (Assessor
Parcel Number 398-110-75, totaling approximately 1.0-acre). The subject parcel is
presently located within the sphere of influence and service area of the Padre Dam MWD;
however, a portion of the parcel containing the proposed reorganization area is currently
located within the sphere of influence and service area of the Helix Water District (WD).
The County of San Diego has approved a tentative map (TM5444) and an Environmental
Impact Report (EIR) (SCH No. 2005111013) for the “Lake Jennings Village,” a 160-unit
multi-family residential project that includes the subject parcel and the proposed
reorganization area. The proposed reorganization is intended to consolidate water service
provision from Padre Dam MWD to the residential development and involves: detachment
of the approximate 0.51-acre portion from the Helix WD; an amendment to the Padre Dam
MWD sphere to include the reorganization territory; and, annexation of the proposal area to
the Padre Dam MWD for the provision of water service.
Padre Dam MWD has indicated that adequate capacity exists to extend water services to
the development project. The landowner will finance all costs for the approximate 15-foot
connection to the existing Padre Dam MWD facilities within Rios Canyon Road.
The proposed reorganization area is surrounded by single family residential and
commercial development and will continue to receive fire protection services from the
Lakeside Fire Protection District (FPD) and sewer services from the San Diego County
Sanitation District (SD) following the proposed reorganization.

Padre Dam MWD has determined that, pursuant to Section 15320 of the State CEQA
Guidelines, the proposed reorganization is not subject to the environmental impact
evaluation process because the proposal consists of changes in organization of
government agencies which do not change the area in which previously existing powers
are exercised. The San Diego County Board of Supervisors has adopted a Master
Enterprise District Resolution (MEDR) that will govern the exchange of property taxes
between the affected districts.
Executive Officer Recommendation
(1) Concur in the determination by the Padre Dam Municipal Water District that this
reorganization is exempt from CEQA review pursuant to Section 15320 of the State
CEQA Guidelines because the proposal consists of changes in the organization or
reorganization of local governmental agencies where the changes do not change
the geographical area in which previously existing powers are exercised;
(2) Amend the sphere of influence of the Padre Dam Municipal Water District and
adopt the written Statement of Determinations as shown in Exhibit A;
(3) Approve the “South Coast Development – Ridge Hill Road Reorganization” involving
detachment of the proposal area from the Helix Water District with concurrent
annexation to the Padre Dam Municipal Water District; and,
(4) Adopt the form of resolution approving the sphere amendment and reorganization
for the reasons set forth in the Executive Officer’s Report, waiving the Conducting
Authority proceedings according to Government Code Section 56663(c), and
ordering the reorganization subject to the following conditions:
Padre Dam Municipal Water District
Payment by property owner of district fees and charges, and State Board of
Equalization charges.

RECOMMENDED STATEMENT OF DETERMINATIONS
PROPOSED AMENDMENT TO THE LARGER-THAN-DISTRICT
SPHERE OF INFLUENCE FOR THE
PADRE DAM MUNICIPAL WATER DISTRICT
“South Coast Development – Ridge Hill Road Reorganization”
The following statement of determinations is prepared pursuant to section 56425 of the Government Code for designation of the area shown on the attached map as an amendment to the sphere of influence for the Padre Dam Municipal Water District (MWD).
(1) The present and planned land uses in the area, including agricultural and open space lands.
The proposed sphere amendment area involves an approximate 0.51-acre portion of one unincorporated parcel (Assessor Parcel Number 398-110-75, totaling approximately 1.0-acre). Land uses on the proposal territory are governed by the County of San Diego General Plan and the Lakeside Community Plan.
The present General Plan designation is Village Residential (VR-15 du/ac). The present County of San Diego zoning is RU – Residential Urban (RU-13 12.6 du/ac). The proposal area is surrounded by unincorporated territory with commercial and single-family residential uses; no agricultural or open space uses are present or planned in the area.
(2) The present and probable need for public facilities and services in the area.
The proposed sphere amendment territory is located within the service areas of the Lakeside Fire Protection District (FPD) and the San Diego County Sanitation District (SD) for the provision of structural fire protection services and wastewater services, respectively; no changes to these service arrangements are proposed as part of the subject annexation.
As of 2013, the Lakeside Community Planning Area has an estimated population of 74,471. The 2050 SANDAG Regional Growth Forecast (2010) projects the Lakeside population to increase to 79,242 by the year 2020; however, significant local growth is not anticipated in the next 5 years.
(3) The present capacity of public facilities and adequacy of public services that the agency provides or is authorized to provide.
The Padre Dam MWD has indicated that capacity is available to extend water service to the proposal territory via an approximate 15-foot connection to the existing Padre Dam MWD facilities within Rios Canyon Road.
In 20007, LAFCO determined that the Padre Dam MWD was adequately providing its authorized services and the district’s larger-than-district sphere of influence was affirmed.
(4) The existence of any social or economic communities of interest in the area if the commission determines that they are relevant to the agency.
Social and economic communities of interest are not relevant in considering this amendment to the Padre Dam MWD sphere of influence.

(5) For an update of a sphere of influence of a city or special district that provides public facilities or services related to sewers, municipal and industrial water, or structural fire protection, that occurs pursuant to subdivision (g) on or after July 1, 2012, the present and probable need for those public facilities and services of any disadvantaged unincorporated communities within the existing sphere of influence.
The proposed sphere amendment and reorganization does not involve an update to the sphere of influence for the Padre Dam MWD. A disadvantaged unincorporated community is defined as an unincorporated area, containing at least 12 registered voters where the annual median household income is 80 percent or less of the statewide annual median ($46,166 or less in 2010). Refer to the SB244 Local Agency Matrix approved by the San Diego Local Agency Formation Commission on March 4, 2013 for the status of disadvantaged unincorporated communities and the Padre Dam MWD.
