Eaton County Drain Commissioner, Old River Trail Pathway (ORT) Project and Acceptanceof Encroachment Agreement for Carrier Creek Drainage DistrictThe Engineering Department recommends that the Delta Township Board Delta Township Boardapprove the Encroachment Agreement between Delta Township and the Eaton County DrainCommissioner for the purpose of installing, operating, maintaining and repairing a path andfootbridge which may impact the Drainage District’s ability to perform future maintenance and/orimprovements to the Drain on existing Delta Township easement, as described in the agreement.

    8. Clements and Underhill Drain ResolutionThe Engineering Department recommends that the Delta Township Board approve the resolutionauthorizing the Eaton County Drain Commission to expend funds for the maintenance and repair ofthe Clements and Underhill Drain.

    10. Eaton County Tax ReversionThe Accounting Department recommends that the Delta Township Board take no action on thismatter.

    RESOLUTION OF RECOGNITION

    WILLIAM LONG

    WHEREAS, William (Bill) Long was appointed as a non-voting member of the Lansing Board of Water and Light (LBWL) representing Delta Township on July 1, 2015; and WHEREAS, Bill Long, prior to his appointment, served on the LBWL Community Review Team where he reviewed the company’s policies and procedures, making recommendation for improvements to better serve the citizens of Delta Township and the Greater Lansing Region; and WHEREAS, Bill has a life-long history of public service as an attorney and consultant to several state offices and non-profit agencies including the Michigan Department of Human Service, Michigan Department of Management and Budget, and the Michigan Department of Labor; and WHEREAS, Bill was appointed by Governor Blanchard to the State Civil Service Commission and later as a member and Chair of the Michigan Public Service Commission; and WHEREAS, in addition to his professional contributions, Bill has been an active volunteer throughout the community with organizations that include the Great Lansing Food Bank Board, the Lansing Economic Development Commission, and the Capital Area United Way review teams. NOW THEREFORE, BE IT HEREBY RESOLVED that on this fifteen day of July two-thousand nineteen the Delta Township Board is indeed grateful to William (Bill) Long and wishes to recognize his outstanding service to the citizens of the Township.

    DAREN S. BEBEE

    WHEREAS, Daren S. Bebee faithfully served the residents of Delta Township for fifteen years as a member of the Parks, Recreation & Cemeteries Commission; and WHEREAS, Commissioner Bebee and his wife Nicole have lived in Delta Township since 1969; and WHEREAS, Commissioner Bebee has a rich history of sharing with others as demonstrated by serving as chairperson of the Parks, Recreation & Cemetery Commission 7 years and serving as co-chairman of the Fireworks Committee and increasing fundraising and attendance; and WHEREAS, Commissioner Bebee also has a rich history of community engagement as demonstrated by the recruitment of businesses and organizations for parks & recreation programs and park amenities. NOW, THEREFORE, be it resolved that on this fifteenth day of July Two Thousand Nineteen, the Delta Township Board is indeed grateful to Daren S.     BWL is launching into their integrated resource plan. Several board members may be contacted to take part in a small group, or they may come to a board meeting to talk about getting feedback about their integrated resource planning.

Fletcher and the Delta Township Board From: Township Manager Brian Reed Date: July 8, 2019 Subject: Fireworks Ordinance Discussion The Fireworks Safety Act of 2012 prevented a local municipality from regulating the use of fireworks between 8:00a.m and 12:00 midnight (1:00am on New Year’s Day) on the day before, the day of, or the day after any national holiday. On December 28, 2018 former Governor Richard Snyder approved House Bills 5939, 5940, and 5941, amending the Michigan Fireworks Safety Act. In terms of local government this legislation gives authorization to reduce the number of days and hours that a person may ignite, discharge, or use consumer grade fireworks. 28.457 Local ordinances. Sec. 7. (1) Except as provided in this act, a local unit of government shall not enact or enforce an ordinance, code, or regulation pertaining to or in any manner regulating the sale, display, storage, transportation, or distribution of fireworks regulated under this act. (2) A local unit of government may enact an ordinance regulating the ignition, discharge, and use of consumer fireworks, including, but not limited to, an ordinance prescribing the hours of the day or night during which a person may ignite, discharge, or use consumer fireworks. If a local unit of government enacts an ordinance under this subsection, the ordinance shall not regulate the ignition, discharge, or use of consumer fireworks on the following days after 11 a.m.: (a) December 31 until 1 a.m. on January 1. (b) The Saturday and Sunday immediately preceding Memorial Day until 11:45 p.m. on each of those days. (c) June 29 to July 4 until 11:45 p.m. on each of those days. (d) July 5, if that date is a Friday or Saturday, until 11:45 p.m. (e) The Saturday and Sunday immediately preceding Labor Day until 11:45 p.m. on each of those days. (3) An ordinance under subsection (2) shall impose a civil fine of $1,000.00 for each violation of the ordinance and no other fine or sanction. The ordinance must provide for the remittance of $500.00 of the fine collected under the ordinance to the local law enforcement agency responsible for enforcing the ordinance. (4) Beginning August 1, 2019, a local unit of government with a population of 100,000 or more or a local unit of government located in a county with a population of 750,000 or more may enact or enforce an ordinance that regulates the use of a temporary structure. An ordinance established under this subsection may include, but is not limited to, a restriction on the number of permits issued for a temporary structure, regulation of the distance required between 2 or more temporary structures, or a zoning ordinance that regulates the use of a temporary structure. An ordinance established under this subsection may not prohibit the temporary storage, transportation, or distribution of fireworks by a consumer fireworks certificate holder at a retail location that is a permanent building or structure. As used in this subsection, "temporary structure" means a movable structure that is used in the sale, display, storage, transportation, or distribution of fireworks, including, but not limited to, a tent or a stand.     SUBJECT: Eaton County Drain Commissioner, Old River Trail Pathway (ORT) Project Acceptance of Encroachment Agreement for Carrier Creek Drainage District

    As part of the permitting process for the Old River Trail Pathway project, approval from the Eaton County Drain Office (ECDO) was required, due to the pathway crossing over the Carrier Creek on the south side of Old River Trail. The pathway construction will include a steel pedestrian bridge spanning the creek and timber boardwalks approaching the bridge from each direction. These structures are located within the Carrier Creek Drain Drainage District Easement. As such, the ECDO requires an encroachment agreement between the Township and the ECDO.

    Township staff and have worked with the Township Attorney and ECDO staff to develop a proposed agreement. The proposed agreement is presented for your consideration.

    Staff Recommendation

    Based upon the requirement to enter into an encroachment agreement in order to obtain project approval and the on-going construction of the project, staff recommend acceptance of the proposed agreement that has been reviewed by the Township Attorney.

    Proposed Motion

    The following motion is offered for your consideration:

    "I move that the Delta Township Board approve the Encroachment Agreement between Delta Township and the Eaton County Drain Commissioner for the purpose of installing, operating, maintaining and repairing a path and footbridge which may impact the Drainage District’s ability to perform future maintenance and/or improvements to the Drain on existing Delta Township easement, as described in the agreement. I further move that the Township Supervisor and Clerk be authorized and directed to sign the agreement on behalf of the Township.”

  • ENCROACHMENT AGREEMENT

    CARRIER CREEK DRAIN

    THIS AGREEMENT, made and entered into this ____ day of ______________ 20__, by and between the Carrier Creek Drain Drainage District (“Drainage District”), a public corporation, by and through the Eaton County Drain Commissioner, whose address is 1045 Independence Blvd., Charlotte, Michigan 48813 (“Drain Commissioner”), and Delta Charter Township, a Michigan charter township organized and operating under the Charter Township Act, MCL 42.1, et seq., as amended, whose address is 7710 W. Saginaw Hwy., Lansing, Michigan 48917 (“Township”). WITNESSETH: WHEREAS, the Carrier Creek Drain (“Drain”) is a county drain established pursuant to Public Act 40 of 1956, as amended (“Drain Code”); and

    WHEREAS, Township holds an easement over certain lands as described and depicted in Exhibit A (“Township Easement”). Township Easement attached as Exhibit B; and

    WHEREAS, Township has entered an agreement to perform work within the County

    Road Right of Way (“Road ROW”) as depicted in Exhibit A; and

    WHEREAS, the Drainage District holds an easement over portions of the Township Easement as depicted in Exhibit A (“Drain Easement”); and WHEREAS, the Township has requested the use of portions of the Drain Easement for purposes of installing, operating, maintaining and repairing a path and footbridge depicted in Exhibit A, which may impact the Drainage District’s ability to perform future maintenance and/or improvements to the Drain (“Encroachments”); and WHEREAS, the Drainage District agrees to take all reasonable steps to cooperate with the Township in the use of the Drain Easement consistent with the terms of this Agreement. NOW THEREFORE, in consideration of the premises and covenants of each, the parties agree as follows:

    1. The Township agrees not to commence construction of the Encroachments without at

    least five (5) days advance notice to the Drainage District so that the Drainage District may make arrangements for an inspector to be present during construction.

    2. This Agreement does not waive the necessity for the Township in for obtaining all other required federal, state, or local permits, and specifically includes any Soil Erosion and Sedimentation Control permits.

    3. The Township shall not undertake activities within the Drain Easement outside of

    those specifically depicted in Exhibit A without the prior written consent of the Drain Commissioner, which consent shall not be unreasonably withheld. In the event that the Township undertakes construction activities that impact the Drain and/or that impact the Drain Easement without a prior written agreement with the Drain Commissioner, the Township agrees that it shall be responsible and pay for all costs incurred by the Drainage District to respond to the activities.

    4. The Township is responsible for any directly related out of pocket costs to the

    Drainage District for the operation, maintenance or improvement of the Drain due to the existence of the Encroachments within the Drain Easement. The Township further agrees that should the Drain require maintenance or improvement in the future that reasonably requires the relocation and/or replacement of the Encroachments, the Encroachments shall be relocated and/or replaced in a timely manner upon the written request of the Drain Commissioner at the sole cost of the Township.

    5. The Township agrees to pay the total costs incurred by the Drainage District,

    including all engineering, inspection, easement acquisition, recording, legal and administrative expenses and costs attendant to this Agreement, the total amount of which shall not exceed Seven Thousand Five Hundred and 00/100 Dollars ($7,500.00). The Drainage District shall provide the Township with written verification of all costs incurred and the Township shall pay this amount within thirty (30) days after receipt.

    6. This Agreement shall be recorded with the Eaton County Register of Deeds and shall

    be binding on the parties, their assigns and successors in interest.

    Based upon discussions at the July 8, 2019 Committee of the Whole Meeting, the proposed Resolution for the Clements-Under Drain is attached to this memo.

    Proposed Motion

    The following motion is offered for your consideration:

    "I move that the Delta Township Board approve the resolution authorizing the Eaton County Drain Commission to expend funds for the maintenance and repair of the Clements and Underhill Drain. I further move that the Township Supervisor and Clerk be authorized and directed to sign the agreement on behalf of the Township.”

    Staff will attend the July 15, 2019 Board meeting to answer any questions or address any concerns the Board may have. If there any questions in the interim, please let us know. Thank you.

    RESOLUTION

    WHEREAS, the Eaton County Drain Commissioner has advised the Delta Charter Township Board that certain maintenance and repair is necessary to be performed on the Clements and Underhill Drain; and WHEREAS, the Eaton County Drain Commissioner has authority to expend up to Five Thousand and 00/100 Dollars ($5,000.00) per mile or fraction thereof of drain in any one year for the maintenance and repair of the Drain, and where it is estimated that expenditures in excess of Five Thousand and 00/100 Dollars ($5,000.00) per mile or fraction thereof of drain are necessary, those amounts may not be expended until approved by Resolution of the governing body of each township, city and village affected by more than twenty (20%) percent of the cost when combining the at-large apportionment and the total apportionment for private lands within Delta Charter Township pursuant to MCL 280.196(5); and WHEREAS, the Eaton County Drain Commissioner has advised the Delta Charter Township Board that it will be necessary to expend funds in excess of Five Thousand and 00/100 Dollars ($5,000.00) per mile or fraction thereof of drain for the maintenance of the Clements and Underhill Drain. NOW, THEREFORE BE IT RESOLVED by the Delta Township Board, that pursuant to Section 196 of the Drain Code, the Eaton County Drain Commissioner is authorized to expend money for the maintenance and repair of the Clements and Underhill Drain in excess of Five Thousand and 00/100 Dollars ($5,000.00) per mile or fraction thereof and, to the extent that the drain fund for the Drain contains insufficient funds for the payment of costs incurred for the maintenance or repair of the Drain, then the Eaton County Drain Commissioner is authorized to levy a special assessment, as allowed by law.     Sponsorship and Referral of Proposed Zoning Ordinance Amendments Pertaining to (1.) Table 9.02-A.1 (Site Development Standards for Accessory Buildings) of the Delta Township Zoning Ordinance to allow for Accessory Building dimensional and placement standards for institutional uses in all Zoning Districts and (2.) Primary / Secondary Schools as a permitted use by Special Land Use Permit in Commercial and Office Districts. Case No. 7-19-8

    The Township Planning Department has received requests to add back into the 2017 Zoning Ordinance language which was initially part of the 1990 Zoning Ordinance regulating accessory buildings for institutional uses and to allow schools to be established in the Office and Commercial Districts. The Planning Department believes their omission by the consultant was unintentional in the 2017 Zoning Ordinance.

    Accessory Buildings for Institutional Uses

    Presently there is no language which regulates or permits accessory buildings for institutional uses in any Zoning Districts. The Township Planning Department is proposing the following language from the 1990 Zoning Ordinance be added to Table 9.02-A.1 as an additional footnote to the table:

    “5. There shall be no limit on accessory building area within the zoning district in which it is located; the front setback shall at minimum align with the principle structure, the side and rear setbacks shall be 20 feet, and the maximum height shall be 25 ft. measured from base to peak.”

  • Primary/ Secondary Schools permitted by Special Land Use in Commercial and Office Districts

    Presently in the District Use Table “Primary / Secondary Schools” are permitted in only residential zoning districts. In the 1990 Zoning Ordinance schools were permitted in all zoning districts except the industrial zones. Further, language exists within the 2017 Zoning Ordinance which would indicate it was planned to have them be permitted in Commercial and Office Zoning Districts. In Section 8.47, the Zoning Ordinances lists the Special Land Use Standards which are required for approval. In Section B the text reads:

    Setbacks: The minimum front setback for any principal or accessory building from a property line shall be fifty (50) feet, and the minimum side and rear setbacks shall be forty (40) feet. Parking areas shall provide a minimum setback of thirty (30) feet. Primary/Secondary Schools located completely within the Office (O) or Commercial (C) zoning districts may be reduced to comply with the minimum required setbacks mandated for principal buildings, accessory buildings, and parking lots within these districts. Greater setbacks may be required when abutting or facing residentially zoned properties.

    Staff proposes to add “S” to the District Use Table for Primary/Secondary Schools in Section 4.18-B.1, Under the O and C Columns. Staff finds the existing language within the Special Land Use section adequately protects health, safety, and wellness.

    The proposed amendments were discussed as part of a larger packet of amendments which will come to the Board in upcoming months. Township staff has tentatively set a Planning Commission public hearing date for July 22, 2019 as long as the Board does not disagree with the proposed language.

    The following motion is offered for the Board’s consideration:

    "I move that the Delta Township Board sponsor proposed Zoning Ordinance text amendments prepared by staff pertaining to Accessory Buildings for Institutional Uses and Primary/Secondary Schools in Case No. 7-19-8; and refer the proposed amendments to the Planning Commission for the purposes of holding a public hearing and submitting a recommendation to the Township Board."

    Tax Reverted Property in the Township

    Each year the Eaton County Treasurer forecloses on properties in the county in which property taxes have not been paid for a period of time. These tax foreclosed properties are annually auctioned by the County Treasurer, with the minimum bid being the amount of back taxes and any associated fees. Prior to public auction, the local municipality is given the opportunity to purchase the parcels within their jurisdiction for the minimum bid price (all back taxes). Pursuant to Public Act 206 of 1893; MCL 211.78m, purchased properties by local municipalities are only for public purpose. The Attorney General’s office has concluded that public purpose means property activity that is for the functions of the government, e.g. parks, cemeteries, parking, and the activity does NOT have as its primary objective the benefit of a private interest. If properties go unsold at auction, ownership reverts to the local unit unless a resolution is passed by the governing body declining to take ownership of the parcel. This normally occurs in December of each year.

    Annually in June or July, we receive a list of parcels located in Delta up for tax sale and analyze the list to see if there are any parcels that make sense for the Township to purchase for public purpose. This year, there are two parcels set to go to auction located in Delta Township. Below you will find a property description, parcel map, and purchase price for both parcels. Our initial analysis indicates it may prove difficult to designate a public purpose for either of these parcels.

    If we choose not to purchase either of these parcels prior to the County auction, there is no action necessary. If we chose to purchase one or both of the properties, we would need to submit a completed Local Unit of Government Purchase Application, along with an explanation of the public purpose for that parcel with payment by the end of July.

  • Property #1 – this is the Sturdevant Property on Davis Hwy, just West of Canal. It was two parcels at one time that we combined into one [now -053-00]. It’s an approximately 48 acre parcel as shown below. The cost to the Township to purchase this property would be $17,160.34.

  • Property #2 – 087-000-980-00. This vacant lot is behind the Prince Apartments on St Joe. The cost to the Township to purchase this property would be $3,457.22

    Recommended Action:

    “I recommend that the Delta Township Board take no action in this matter.”
