LEGAL NOTICE Application for Revision of Mine Permit and Closeout/Closure Plan

Continental Mine

Pursuant to the New Mexico Mining Act Rules, 19.10.5 and 19.10.9.903 A. through H., New Mexico

Administrative Code, Freeport‐McMoRan Cobre Mining Company (Cobre) provides this notice of its

application to the Mining and Minerals Division (MMD) of the New Mexico Energy, Minerals and Natural

Resources Department for a revision to Permit GR002RE (Permit). Cobre proposes to revise this Permit

to end standby status and return the Continental Mine (also known as the Cobre Mine) to active

operating status. An update to Cobre’s approved Closure/Closeout Plan has also been submitted to

MMD and is part of the application to end standby status.

Location of real property affected: Cobre Mine is on Cobre property and public land and is located

approximately 15 miles east of Silver City in Grant County, New Mexico. Cobre Mine is located in all or

portions of the following land subdivisions: Township 17 South, Range 12 West, Sections 3, 4, 5, 8, 9,

10, 11, 14, 15, 16, 17, 20, 21, 22, 23, and 27. All Cobre facilities are located within the USGS Santa Rita

quadrangle map.

General description of the operation and proposed changes: Cobre Mine is an existing mining operation,

currently on standby status with MMD. The Permittee is authorized to conduct mining and reclamation

operations on those lands specifically designated and authorized as the Permit area. Upon returning to

operating status, Cobre will re‐engage in surface mining operations, as approved by MMD, and transport

ore to Freeport‐McMoRan Chino Mining Company for milling or leaching.

Procedure for Requesting a Public Hearing

Any interested person may request that the MMD Director conduct a public hearing on the Permit

Revision Application, including the Closure/Closeout Plan. Such request must be written and made at the

MMD Director’s address above within 30 days of the date of the newspaper publication of this notice

unless the MMD Director determines that a longer period is appropriate and such period is specified in

the published notice. If a hearing is timely requested, the MMD Director shall set a hearing, unless the

request is clearly frivolous. The MMD Director may hold a public hearing absent of any request.

Procedure for Submitting Comments

Any interested person may file written comments on the Permit Revision Application, including the

Closure/Closeout Plan, with the Director at the above address. If a public hearing is held, written

comments must be received by the MMD Director prior to the close of the hearing. If no public hearing is

held, written comments will be considered only if they are received by the MMD director within 60 days

after the newspaper publication of the notice of the Permit Revision or within 60 days after the person

filing the comment received notice of the Revision, whichever is later.
