    development site for inspection as part of the Councils approved practice of monitoringdevelopments and reviewing current policies.

    9. BROOKFIELD PARK SHIERS FAMILY TRUST MID-YEAR UPDATE (Pages 66 - 69)

    To consider a report of the Corporate Director for Corporate and Support Services

    The report provides an update on the financial standing of the Brookfield Park ShiersFamily Trust as at 30 September 2015, indicates the amount of money available fordistribution to organisations and reports on the relevant performance of investment funds.

    The Area Committee is requested to:-

    note the contents of the report;

    decide upon the policy that they wish to adopt in respect of distribution of the

    Trust; and advise as to the investment policy that they wish to follow.

    4. PROGRESS ON AREA COMMITTEE DECISIONS

    A representative of the Democratic Services Manager submitted a report (copies of whichhad been circulated) updating the Area Committee on progress since the last meeting ondecisions taken by the Area Committee and the current position on Ward Flexibility

    Funding. The report also included the current position on the ward delegated budgets.

    RESOLVED That the report be noted.

    5. COMMUNITY ENGAGEMENT

    (i) Chair's Announcements

    No announcements were made.

    (ii) Public Question Time

    Members of the public were invited to put questions to the Chair of the Area Committee onany matters within the powers and duties of the Area Committee, subject to the exclusionsset out in the Code of Practice.

    One public question was submitted relating to when waiting restrictions on Carrs Road,Cheadle would be implemented.

    The questioner was advised by a representative of the Corporate Director for PlaceManagement and Regeneration that objections to the initial consultation on trafficmanagement proposals for the area were currently being examined by Officers and areport would be submitted to a future meeting of the Area Committee.

    (iii) Public Realm

    David Wilson (Public Realm Inspector) attended the meeting to report on current issuesand to answer questions from Councillors and members of the public in relation to publicrealm issues within the area represented by the Cheadle Area Committee.

    The following comments were made/issues raised:-

    A request was made for Officers to investigate an advertising trailer which waslocated on Demmings Road, Cheadle.

    The vegetation on the footpath at Parsonage Way, Cheadle was overgrown andneeded cutting back.

    RESOLVED That David Wilson be thanked for his attendance.

    (iv) Petitions

    (a) Gatley Skate Park Improvement

    An e petition containing 59 signatures was submitted requesting improvements toGatley Skate Park in order to alter the terrain of the skate park. Another e petition

    was submitted containing 2 signatures requesting that the unused grass area becleared and that new ramps be built.

    RESOLVED That the petitions be referred to the Corporate Director for PlaceManagement and Regeneration for investigation.

    (b) High Grove Hotel, Silverdale Road, Gatley Asset of Community Vale Nomination

    Two petitions were submitted in support of an Asset of Community Valuenomination with regard to the High Grove Hotel, Silverdale Road, Gatley which wasto be considered by the Area Committee later on in the meeting (agenda item 13refers). An e petition to list the site as an Asset of Community Value had beensigned by 414 people and a petition to keep the High Grove as a public house hadbeen signed by 72 people.

    RESOLVE D That the petitions be considered in connection with item 13 on the

    agenda for this meeting (Minute 13 refers) regarding High Grove Hotel, SilverdaleRoad, Gatley Asset of Community Value Nomination.

    (v) Open Forum

    In accordance with the Code of Practice, no organisation had indicated that they wished toaddress the Area Committee as part of the Open Forum arrangements.

    (vi) Ward Flexibility Funding - Gatley Village Partnership

    Andrew McKnight from Gatley Village Partnership attended the meeting to answerquestions from the Area Committee in relation to an application for Ward FlexibilityFunding seeking funding towards the cost of a sculpture on Gatley Green, near to the WarMemorial, as a commemoration to all servicemen from Gatley who lost their lives in war.

    RESOLVED That the Democratic Services Manager be recommended to make a grantof 400 to Gatley Village Partnership towards the cost of a sculpture on Gatley Green,near to the War Memorial, to be funded from the Cheadle and Gatley Ward budget,subject to planning permission being obtained for the sculpture.

    (vii) Ward Flexibility Funding - Cheadle Village Partnership

    Peter Fraser from Cheadle Village Partnership attended the meeting to answer questionsfrom the Area Committee in relation to an application for Ward Flexibility Funding seekingfunding towards the provision and promotion of events on the day of the Cheadle VictorianChristmas MarketRESOLVED That the Democratic Services Manager be recommended to make a grantof 1,000 to Cheadle Village Partnership towards the provision and promotion of events onthe day of the Cheadle Victorian Christmas Market to be funded as follows:-

    (viii) Ward Flexibility Funding - Cheadle Village Hall

    Mike Lappin from Cheadle Village Hall attended the meeting to answer questions from theArea Committee in relation to an application for Ward Flexibility Funding seeking fundingtowards refurbishment works at the hall.

    RESOLVED That the Democratic Services Manager be recommended to make a grantof 1,000 to Cheadle Village Hall towards refurbishment works at the hall, to be funded asfollows:-

    Cheadle and Gatley Ward - 600Cheadle Hulme North Ward - 400

    6. DEVELOPMENT APPLICATIONS

    Development applications were submitted.

    (NOTE: Full details of the decisions including conditions and reasons for granting orrefusing planning permission and imposing conditions are given in the schedule of plans.The Corporate Director for Place Management and Regeneration is authorised todetermine conditions and reasons and they are not therefore referred to in committeeminutes unless the committee makes a specific decision on a condition or reason.     The Chair outlined the procedure approved by the Council for public speaking on planningapplications.

    (i) DC057891 - 14 Lynton Vale Avenue, Gatley

    In respect of plan no. 57891 for an outline application including details of access and scalefor the erection of a single dwelling to the rear of 14 Lynton Vale Avenue, Gatley(amended description)

    a member of the public spoke against the application; and

    a representative of the applicant spoke in support of the application

    RESOLVED (1) That the Planning and Highways Regulation Committee berecommended to undertake a site visit in order to examine the proposed access to thedwelling and the impact on the existing access for residents and parking arrangements inLynton Vale Avenue.

    (2) That the Area Committee requests that the position of the access along with the treesscheduled for removal be identified and marked out at the site visit.

    In respect of plan no. 58331 for the delivery of new MRI Scanning Unit and change of useof former coal yard to form additional hospital car parking at The Alexandra Hospital, MillLane, Cheadle

    a member of the public spoke against the application; and

    a representative of the applicant spoke in support of the application

    RESOLVED That the Planning and Highways Regulation Committee be recommendedto grant planning permission and agree an additional planning condition to require aprotective screen fence to prevent loss of amenity from headlight light spillage to theproperties on the opposite side of Manchester Road.

    (iii) DC059168 - 19 Dawson Road, Heald Green

    In respect of plan no. 59168 for alteration to roof and side walls to form dormer bungalow(re-submission of Dc058451) at 19 Dawson Road, Heald Green

    a member of the public spoke against the application; and

    a representative of the applicant spoke in support of the application

    7. PLANNING APPEALS, ENFORCEMENT APPEALS & ENFORCEMENT NOTICES

    A representative of the Corporate Director for Place Management and Regenerationsubmitted a report of the Deputy Chief Executive (copies of which had been circulated)listing any outstanding or recently determined planning appeals and enforcements withinthe area represented by the Cheadle Area Committee.

    RESOLVED That the report be noted.

    8. CREATION OF A BRIDLEWAY - UNRECORDED LAND THAT ALSO FORMS ASECTION OF FOOTPATHS 8(A) & 9(B) CHEADLE AND GATLEY

    A representative of the Democratic Services Manager submitted a joint report of theCorporate Director for Place Management and Regeneration and Deputy Chief Executive(copies of which had been circulated) requesting the Area Committee to consider making abridleway creation order on a section of Footpath 8(a) and 9(b) Cheadle and Gatley thatruns from the intersection with Footpath 8(a) Cheadle and Gatley and Gatley Road to the

    intersection of Footpath (b) Cheadle and Gatley and Brentwood Drive.

    The Area Committee was advised that funding for the surface improvement works hadbeen secured through a Department for Transport Cycle City Ambition Grant. Theproposed bridleway upgrade was tied in with other Gatley Railway Station links works onGatley Road and Foxland Road, Cheadle which were currently underway. The proposalswoud enhance and better connect vehicular traffic free routes between communities in the

    vicinity of Gatley Railway Station.

    RESOLVED That the making of a bridleway creation order in respect of the followingsection of the route between points A-B, as shown on drawing number 0066_GatleyStation attached to the report, be approved :-

    Commencing at Point A (a point 0.5 metre from the curb on the adopted highway at GatleyRoad at point A), and continuing generally north easterly for a distance of 87.7 metreswhere Footpath 8(a) Cheadle & Gatley intersects with Footpath 9(a) Cheadle & Gatley,and continuing in a south easterly direction for a distance of 34.9 metres at Point B (a pointwhere Brentwood Drive intersects with Footpath 9(b) Cheadle & Gatley.

    9. DAMAGE TO HIGHWAY GRASS VERGES

    A representative of the Democratic Services Manager submitted a report of the CorporateDirector for Place Management & Regeneration (copies of which had been circulated)summarising the Councils policy and options in responding to damage to grass vergescaused by parked vehicles.

    RESOLVED (1) That the limited options available to the Council to take formal actionagainst people who cause damage to grass verges be noted.

    (2) That the approach to prevent repeated damage by considering each verge on a site bysite basis be endorsed.

    (3) That the Ward Spokesperson be authorised to act as the point of contact for discussionand final decision on the recommended solution.

    (4) That the costs of any works (above the cost of equivalent repair) being requested fromthe Ward Delegated Budget be noted.

    10. UPDATE ON TRAFFIC REGULATION ORDERS IN THE VICINITY OF OAK TREE

    PRIMARY SCHOOL, CHEADLE HULME

    A representative of the Democratic Services Manager reported that this item had beenplaced on the agenda at the request of Councillor Paul Porgess.

    Councillor Porgess reported that following the opening of Oak Tree Primary School,Cheadle Hulme at the beginning of September there were still parking problems onQueens Road and junctions leading from it, and access protection markings were requiredfor certain properties. The safety of school children was also of paramount concern.

    Members of the Area Committee expressed concern about the time it had taken for the

    Traffic Regulation Orders approved at the last meeting of the Area Committee to beadvertised.

    RESOLVED That the Area Committee expresses concern about the safety of childrenattending the new Oak Tree Primary School in Cheadle Hulme and requests that theTraffic Regulation Orders approved by the Area Committee at its last meeting held on 11August 2015 (Minute 12 refers) be advertised and implemented as a matter of urgency.

    11. VICTORIA AVENUE AND CHEADLE ROAD, CHEADLE - NO WAITING AT ANYTIME TRAFFIC REGULATION ORDER

    A representative of the Democratic Services Manager submitted a report of the CorporateDirector for Place Management and Regeneration (copies of which had been circulated)outlining the results of an investigation into parking concerns at the junction of VictoriaAvenue and Cheadle Road, Cheadle Hulme.

    RESOLVED That the Executive Councillor (Supporting Places) be requested to approvethe legal advertising of the following No Waiting At Any Time Traffic Regulation Order onCheadle Road and Victoria Avenue, Cheadle Hulme at an approximate cost of 525 to be

    funded from Ward Delegated Budget (Cheadle Hulme North allocation) and, subject to noobjections being received within twenty one days from the advertisement date, the Orderbe made:-

    Proposed No Waiting at Any Time

    Cheadle Road, Cheadle Hulme, north side - from a point 10 metres south east of thesouth eastern kerbline of Victoria Avenue to a point 10 metres north west of the northwestern kerbline on Victoria Avenue.

    Victoria Avenue, Cheadle Hulme - both sides, 15 metres north east of the north easternkerbline of Cheadle Road for a distance of 5 metres in a south westerly direction.

    12. BURNS AVENUE AND SHAKESPEARE DRIVE, CHEADLE - NO WAITING AT ANYTIME TRAFFIC REGULATION ORDER

    13. HIGH GROVE HOTEL, SILVERDALE ROAD, GATLEY - ASSET OF COMMUNITYVALUE NOMINATION

    A representative of the Democratic Services Manager submitted a report of the CorporateDirector for Corporate and Support Services (copies of which had been circulated whichprovided Members with information about the nomination that the Council had received in

    response to the Community Right to Bid from the Friends of the High Grove to list theHigh Grove Hotel, Silverdale Road, Gatley as an asset of community value.

    The Community Right to Bid was one of the community rights derived from the LocalismAct 2012. The Right provided for voluntary and community organisations with a localconnection to nominate an asset (land and buildings) for inclusion on a list of communityassets. Should a listed asset come up for sale, voluntary and community organisationswould have a chance to delay a sale by up to six months in order to prepare a bid to buythe asset.

    The Area Committee considered the information provided in the report, together withcomments from the Area Manager for Hydes Brewery and observations from HydesBrewery on specific points contained in the application form. An e petition to list the site asan Asset of Community Value signed by 414 people and a petition to keep the High Groveas a public house signed by 72 people had been submitted earlier in the meeting.

    RESOLVED - (Seven for) That the High Grove Hotel, Silverdale Road, Gatley (the Asset)be listed as an Asset of Community Value as the Assets main use (i.e. not ancillary) hadrecently been or is presently used to further the social wellbeing or social interests of thelocal community and could reasonably do so in the future i.e. within the next five years.

    14. GATLEY RECREATION GROUND- FORMER PAVILION

    The Scout Building Committee is consistently improving the building to keep it to a highstandard for all who use it. After years of patching and trying to improve the toilet and kitchenfacilities we feel we now need to address them on a more permanent scale. We would like todevelop the toilet area and gain a couple of small toilets for the pre-school children includingchildren with disabilities. At the moment the pre-school children use adult size toilets. Thepreschool has been required to accommodate children from 2 years and have noticed they arestruggling even with steps to use the toilets. Although we have a disabled toilet we would like toupdate this to the latest standards. The small kitchen area which adjoins the toilet stud wall, isin need of modernisation with the units being last replaced in the 1980s. In addition the kitchenneeds a new water heater. We have raised money for an new water heater, however have putthis on hold as we would like to replace and refurbish the area at the same time.

    10. Who wil l benefit from this grant?The building is in the heart of where local residents live. We support a wide range of localresidents ranging from children who use the preschool, scouts and guides. Plus variouscommunity groups such as a karate group, occasional dance groups and as a venue forchildrens parties and community groups (rented for a nominal charge). We have StockportHomes (housing trust) directly in the area. We have Oak Tree primary school which is 5minutes walk away. Over the river in the Ladybrook Valley we have the Calderbrook estatewhich caters for many families. We have families who walk the short distance over theLadybrook River from Tarvin Road and Councillor Road. We have families from many areaswho use the building which helps provide a diverse setting from all walks of the community.

As part of theoutline consent contributions of 100,000 and 145,000 were agreed through a S106Agreement, towards the provision of affordable housing and recreational open spacerespectively.     National Planning Policy

    The National Planning Policy Framework (NPPF) issued by DCLG on 27th March 2012sets out the Governments planning policies for England, and how they are expected tobe applied.

    Paragraph 6 states: The purpose of the planning system is to contribute to theachievement of sustainable development.

    Paragraph 7 states: There are three dimensions to sustainable development:economic, social and environmental.

    Paragraph 11 states: Planning law requires that applications for planning permission

    must be determined in accordance with the development plan unless materialconsiderations indicate otherwise.

    NEIGHBOURS VIEWS

    A total of 96 nearby commercial and residential properties were notified in writing of theproposal. The application has also been advertised via site and press notices. The

    consultation period expired on 25/09/15. A total of 3 letters have been received objecting tothe application on the following summarised grounds:-

    (1) Loss of wildlife habitat;(2) Impact of additional traffic generation generated by 153 dwellings, particularly in respectof the safety of local children;(3) Loss of light to gardens serving existing properties;(4) Loss of privacy to existing properties;(5) Loss of accessibility to nearby football fields, bike ramps, fields, etc;(6) Concerns over level of noise and dust during construction;(7) Noise problems from other nearby premises along Birdhall Lane are already causing

    problems for local residents;(8) Concern over when any potential start date would be if permission is granted;(9) The pedestrian pathway through to Bridgehall Community Orchard is only possiblepedestrian link. This path is well defined and well used by local people. The pedestrian linkmust be be built into the layout as a definitive path through the eastern boundary.

    CONSULTEE RESPONSES

    Arboricul tural Officer :Where tree planting is to occur in areas where there is no footpath Iwould recommend species such as Prunus Hillier spire and Crataegus monogyna Stricta asthey have very narrow canopies to prevent conflict with the highway.

    Planting in and around the Leaps need to consider sight lines into the sight and so some

    plantings can be in the site rather than around the perimeter.Species such as Quercus Ilex should not be used in proximity to the residential propertiesand so either the species needs changing on one of the group or the tree relocated.The use of fruiting species should also be considered where appropriate to enhance thebiodiversity and access for all to free fruit.The Aesculus and Acer species trees need to be changed to more appropriate species andwhere possible native species that enhance the biodiversity of the site.The size of the trees also needs to be increased with all tree planting to be a minimal ofheavy standards 14-16cm but preferring them to be extra heavy standards and eitherroot-balled or container grown to increase survival rates with container grown trees havinghigher survival rates.Hedges need to be altered with the loss of portugese laurels where possible to be replacedwith more appropriate species and where possible native evergreen hedging.

    If the following alterations are made then this would be an acceptable scheme.

    Updated response to additional information: No objection, however 16-18cm heavystandards would be so big that the small thorns on the upright hawthorn would not be anissue and the issue of growing into the highway would outweight the street scene issues theagents raise. We cannot have canopies impacting on the highway with regular refusewagons and emergency vehicles.

    Highway Engineer: The layout of the estate road is acceptable in principle however thereare some minor alterations/inclusion that will be required prior to approval.

    The existing traffic calming scheme includes speed cushions along Europa Way and a

    number of these cushions are directly outside the access to driveways into the dwellings. Iwould therefore ask that the applicant makes minor amendments to some of the speedcushions to ensure that access to the proposed dwellings is not impeded. It may bebeneficial if the traffic calming on this section of the highway was amended to benefit boththe proposed dwellings and users of the highway particularly buses if speed tables wereintroduced at the junctions instead of the existing cushions. These details should be agreedwith the LPA prior to development commencement on site

    The proposed layout does not include the location of existing lighting columns so if theapplicant needs to relocate these columns to allow driveway access then this should bemade clear on the layout plan itself.

    The layout plan does not include the existing bus stops that are already in place alongEuropa Way. At this stage the location of the bus stops and how they are to beaccommodated within the development itself must be clarified. The application has sited theexisting bus service in proving the sites accessibility so a quality bus service would beenhanced by improvements to those existing bus stop and I would request a condition todeliver those improvements.

    In addition to improve further the sites accessibility/permeability I would ask that apedestrian and cycle link from the Easterly side of the site to the footbridge over the railwayline is improved. This will provide a direct and convenient route towards Edgeley Centre via

    Petersberg Road. A 3m wide route could be provided across Local Authority land and thiscould be delivered by the Council should a commuted sum be made available to cover the

    cost. I am therefore of the opinion that should permission be granted a S106 Agreementshould include for provision of a financial contribution of 25,000 to enable delivery of thisroute. This will greatly benefit the site and residents in particular and is fully in accordancewith National and Local Policy for providing accessible development. In addition to this wewould require the access from Pickmere Close into the development to be available topedestrians and cyclist and from the submitted plans this is not clear and the plans needamending.

    The proposed estate roads will have to be adopted by the Council via a s38 agreementwhich should be in place prior to any development commencing on site. At this stage Iwould require the adoption of the grass verge along the boundary of the site and the futureLRT stop to be included in the s38 agreement.

    The construction works will also affect the condition of the adopted highway of Europa Wayand I would therefore require a 278 agreement to be in place prior to development

    commencing on site to ensure that both the foot way and carriageway areresurfaced/reconstructed along the development frontage post construction. The requestedamendments to the traffic calming could be completed at this time.

    I would also require conditions with regards to the retention of visibility on individualdriveways and at the junctions on Europa Way to ensure that road safety is improved withinthe layout itself. Other requested conditions include cycle parking provision and theretention of parking within the development.

    If the submitted plan could be amended to accommodate my comments and subject to therequested condition I would raise no objection to this planning application.

    Recommendation: No objection subject to conditions

    Updated response to additional information: It is essential that there is a public right ofaccess to the adjoining land to ensure the potential LRT Stop is capable of uninhibiteddelivery. The area highlighted (strip of land along the North side of the estate road) shouldultimately form part of the adopted highway network and the Council would accept Bellway,under license, managing and maintaining the area until such time as, or if at all, that it maybe required for LRT purposes. Without protection I would consider the deliverability of LRTto Stockport would be adversely and unacceptably affected.

    Any future LRT proposal will have to bring forward adequate mitigation and landscaping toensure adjoining residential development is not adversely affected.

    I have sought to be constructive supporting a shared surface road arrangement but need toprotect all interests and ensure future improvement is possible if deemed necessary. Theshared surface layout does not encourage general access but it would not preclude accessand passage by larger vehicles. It will not be likely to be the intention to direct LRT trafficthrough the housing estate however such movements cannot be prohibited.

    In the event that an LRT stop is forthcoming I would reasonably foresee foot way provisionwithin the strip along the North side of the road would help reduce any future risk of conflict

    that would arise by increased traffic movement in the area.

    Clearly any such works to improve the road network would form part of any futureapplication for construction of a LRT stop and associated facilities.

    With respect to pedestrian linkage from the Eastern corner of the site I maintain my viewthat a link should be provided from the site upto the pathway which connects betweenCuddington Crescent and Petersburg Road. It has always been my opinion and there is noquestion that delivery of this link will greatly improve the accessibility of this site. It willprovide convenient and direct linkage to a nearby School and provide the shortest walkingand in part cycling route between the site and Edgeley Centre, which comprises publictransport, shops, employment, Schools, health services etc.

    Notwithstanding the outline permission I will consistently maintain that this link should beprovided. The degree of benefit accrued by providing this link far outweighs any perceivablyrefute or concern that may be expressed. I consider the scheme is undermined by failing todeliver this connectivity; it will lack permeability and would do little to promote walking and

    cycling routes.

    My preferred methodology would be via a S106 Agreement but I would support a Grampiantype condition approach given the affected land is Council owned, giving comfort fordeliverability and enabling Bellway to undertake the works and bear the actual cost etc.

    Planning Policy Officer (Sustainability): I have the following comments:

    I cannot see a suitable energy statement on line. Section 5.0 of the DAS lays outsustainability aspects of the design, however this is not sufficient to satisfy the policyrequirements for an energy statement as laid out in Core Strategy Policy SD3 and the

    An energy statement must either be a specific section in a revised DAS or a separatedocument including the following information as a minimum and as suggested in the abovesample energy statement.

    Part L apply (equivalent to a 13% reduction over 2013 Part L) since the site is for more than10 dwellings this saving can be achieved through design and does not have to includerenewable energy options, however it should be noted that the energy statement MUSTshow evidence of consideration of all low / zero carbon technologies as laid out in bulletpoint 4 regardless of any intent to use them or not to achieve the targets

    A TER / DER calculation to show how the percentage improvement will be achieved (or atleast an acknowledgement that it will be done and I would suggest a condition on theapplication that such information will be submitted prior to commencement)

    Evidence of technical feasibility (i.e. will the technologies work on the site and what levels ofannual carbon savings each offers) and financial viability (i.e. estimated costs especially for

    those technologies that are technically feasible but are not being used on grounds of costs)as laid out and suggested in the sample energy statement which includes web links toresources to help with estimated costs

    Planning Policy (Open Space): The policy requirements of Dev Man Policy SIE 2 from theCore Strategy and the Recreational Open Space Provision SPG, indicates that occupancylevels of 100 or more are expected to provide 1.7 ha per 1,000 population for formalrecreation and 0.7 ha per 1,000 population for childrens play and casual recreation. Giventhe proposed housing numbers and types, the population capacity would be 623 whichrequires 4361 sum 0.44 Ha. (612 x 7sq.m. = 4361) for childrens play.

    This policy requires as much as possible of the open space to be provided within or adjacentthe new development and play provision should incorporate facilities based on the hierarchyset out below;

    1. Local Area of Play (LAP)2. Local Equipped Area for Play (LEAP)3. Neighbourhood Equipped Area for Play (NEAP)

    As per Table 3 : Play facilities from the Core Strategy a LEAP should be provided where adevelopment exceeds a population capacity of 510 and every 50 persons requires theconsideration of a LAP and be within a walking distance of 100m of all homes.

    A total of one LEAP and two LAPs would cater for a population of 610. The plan indicatesthat there is a LEAP in the south west corner of the site. As outlined in the Core Strategypolicy, the safety and security of children within play spaces is an important consideration in

    the design. The orientation of the LEAP does not allow for natural surveillance. It istherefore suggested that residential properties which are in close proximity to the LEAP areredesigned in a way that would allow for the LEAP to be overlooked. The plan indicates thatthere are three LAPs are on the site. As previously mentioned two LAPs would be sufficientto cater for the population capacity, the design could be amended therefore to remove aLAP, providing that the remaining two are within a 100m of every home.

    With regards to the Play Provision to be provided on site, par 3.337 under Dev Man PolicySIE 2 does not state that the Council should take on the maintenance; it is for the counciland the applicant to come to an agreement. If the applicant agrees to taking on themaintenance, it is suggested a condition is attached that covers future maintenance of

    on-site open space in perpetuity, known as a submitting details of the managementarrangement for the future maintenance type condition.

    In the event the applicant does not wish to take the maintenance on and they wish theCouncil to take this on their behalf, the commuted sums the applicant should pay for theCouncil taking on the maintenance of the LAPs should be consistent with B19/B20 ofCircular 05/2005.http://webarchive.nationalarchives.gov.uk/20120919132719/www.communities.gov.uk/documents/planningandbuilding/pdf/147537.pdf

    Core Strategy Policy DM SIE 2: Provision of Recreation and Amenity Open Spaceindicates that residential schemes are expected to provide 1.7 ha per 1000 population forformal recreation. As mentioned above the requirement of the Core Strategy policy is for as

    much as possible of the open space to be provided on-site. The commuted sums for Formalrecreationalprovision to serve the future occupants would be as follows;

    Provision 623 x 198.35 = 123,572.05Maintenance 623 x 17(sq.m) x 11.86 = 125609.26Total 249,181.31

    With regards to the Play Provision to be provided on site. Par 3.337 under Dev Man PolicySIE 2 does not state that the Council should take on the maintenance, it is for the counciland the applicant to come to an agreement. If the applicant agree to taking on themaintenance, I would suggest putting a condition on the planning permission (in the event itis granted) that covers future maintenance of on-site open space in perpetuity, known as asubmitting details of the management arrangement for the future maintenance typecondition.

    Planning Policy (Housing): No response received.

    Nature Development Officer: I have looked at the proposed landscaping schedule andhave the following comments:

    The proposed species mix contains many non-native ornamental species. I wouldrecommend that these species are substituted or at least augmented with native speciesbeneficial to wildlife to maximise the biodiversity benefits associated with the scheme. Thisis particularly important since part of the application area falls within designated GreenChain (the north and west of the site).

    Following on from the above point, I would recommend that planting is supplementedparticularly around the northern, western and southern boundaries of the site, includinground the margins of the proposed LEAPs. This will help safeguard the functionality of theGreen Chain as a wildlife corridor, maintain habitat connectivity, and thus ensure that theproposed development does not contravene NE3.1 of the retained UDP.

    Updated response to additional information:I would prefer for more native species/speciesbeneficial to wildlife to be incorporated into the landscaping strategy as per my previouscomments, however, I can accept the proposals outlined.

    Environmental Health Contaminated Land: I would like to make the following comments

    to be included on any decision made upon this application.

    LFG3:

    No part of the development shall be occupied until all works necessary to prevent landfillgas migration into the development have been approved in writing by the local planningauthority and carried out in full.

    Reason:

    The adjoining land may contain landfill gas and it may be necessary to undertake remedialmeasures in order to comply with Policy EP1.5, "Development on or near ContaminatedSites", of the Stockport Unitary Development Plan Review.

    Any works to be carried out must be undertaken in line with CIRIA 665

    Environmental Health (Public Protection): I have assessed the above development and Ido not object to this development however there will need to be a revised noise reportundertaken- this is necessary as the noise report was undertaken in 2006.

    However I have investigated noise complaints in this area only last year where a lowfrequency drone was reported and I found the source to be a large scale cardboard wasteand dust extraction unit and the noise from this is tonal in nature and operates 24 hours thisis situated to the rear of APS group which is on Birdhall lane . The noise was witnessed onOrchard vale and we did get this reduced to a level that was not audible on Orchard valehowever this may not be the case on the land that is identified for the houses.

    There are also other noise sources in the area that may need to be assessed, there arenitrogen storage tanks that are situated just off Spectrum way.

    Updated response to additional information: I feel that it would be prudent to conditioninternal noise levels within the finished properties to make sure that they can meet internal

    noise levels stated within BS8233:2014. Noise levels have changed in the area since 2012with some noises reducing and other noises increasing. There is a large dust/cardboardextraction unit which operates 24 hours and emits a low frequency noise and it has causedissues for occupants already in situ. The noise from the industrial equipment has beenreduced and no longer causes a problem in the complainant's property but this is somedistance away and the proposed development is much closer.

    Condition 1The proposed houses will have to meet the internal noise guidelines stipulated inBS8233-2014 and these are;

    living rooms Resting 07.00-23.00 35dB

    Dining 07.00-23.00 40dB

    Sleeping 07.00-23.00 35dB 23.00-07.00 30 dB

    Gardens 50-55dB

    Director of Public Health: The possible connection link to the north east of the siteenabling pedestrian and cycle access to Edgeley via the rail footbridge is crucial to ensuringthe site offers sustainable transport access to services beyond the railway line. To improvethe sustainable modes of transport to the site under CS9 and 10 this pedestrian link should,at a minimum, be maintained but ideally should be improved as a route to schools, openspaces and as a route to the railway footbridge to Edgeley including the District Centre,library and green spaces at that side of the rail line. It should be noted that this is not aPROW and that ideally this should be looked at for dedication for cyclists and pedestriansare far as practical, but for pedestrians especially along the whole route. In addition itshould be noted that pedestrian permeability on the site is important there is a 6lb weight

    difference for the female population and a 10lb weight difference for mens populationbetween permeable and impermeable street designs (source).

    Promoting sustainable transport (including active travel) contributes to management ofgood public health in the Borough, especially healthy weight. Achieving healthy weightreduces risks of other lifestyle diseases such as hypertension, coronary heart disease andstroke. Reducing risks of such diseases also reduces pressures on current and futurepublic sector health budgets. New development should reflect the fact that the builtenvironment can have major impacts on residents ability to be active. Active environmentsproduce benefits including ensuring a healthier local work force whilst benefiting theBoroughs economy and environment. In addition an appropriately designed builtenvironment can contribute to reducing social exclusion, as well as offering cycle andpedestrian routes for both commuters and recreational users.

    Core Strategy Policy CS8 highlights the need for Local Areas of Plan, Local Equipped Areasof Play and Neighbourhood Equipped Areas of Play (which are critical to child developmentand activity levels) and the need for access to open space for general amenity use. Carefulconsideration should be given, from a public health perspective, to the requirements ofStockports planning policies around play and open space provision and/or contributions inorder to ensure that the maximum benefit can be achieved from this development, takingaccount of how provision of such, benefits both the mental and physical health of

    populace. Compliance with these policies is critical because it contributes to improvedhealth for new and existing residents, who will be able to engage in activity as part of their

    everyday lives. Such design approaches foster community cohesion and enhance a senseof trust, benefiting mental as well as physical health.
