Subcontractor wi$$ review Submitta$s or accuracy, com$eteness, and com$iance with the Contract+ocuments. <eore submission to Contractor, Subcontractor wi$$ veriy that materia$s, ie$d measurements, roducts, materia$s, systems, e8uiment, rocedures and conditions in the Submitta$ com$y with theContract +ocuments and other re$evant Submitta$s. Subcontractor wi$$ erorm no ortion o the !or" re8uiring arova$ o Sho +rawings, roductdata, Sam$es, or other Submitta$s unti$ the aroriate Submitta$ has been reviewed and aroved byContractor. !or" that re8uires arova$ wi$$ be done in accord with the arova$ as issued by Contractor,and as re8uired by the Contract +ocuments.

or $oca$ aw or regu$ations are in con$ict, Subcontractor sha$$ com$y with the most stringent ordemanding rovision.

Subcontractor sha$$ su$y to Contractor and Sub2subcontractors, a coy o each 5ateria$ Saety+ata Sheet(s) (5S+S) on any 6aardous 5ateria$ that Subcontractor or any Sub2subcontractor, brings onthe 7ob Site. !hen no $onger needed or construction, Subcontractor sha$$ ensure that 6aardous 5ateria$sare removed rom the 7ob Site. No 6aardous 5ateria$ sha$$ be disosed o or discarded in any meansother than as rescribed in the a$icab$e 5S+S. No to&ic or 6aardous 5ateria$s o any descrition wi$$ be $aced in reuse disosa$ containers used or genera$ construction debris.

Subcontractor wi$$ ma"e avai$ab$e to Contractor a coy o any accident reort Subcontractor is re8uired toi$e with any ub$ic agency or insurance carrier.

A. '&cet as rovided e$sewhere in the Contract +ocuments, Subcontractor is resonsib$e or a$$6aardous 5ateria$s brought to the 7ob Site by or or use by Subcontractor or Sub2subcontractors.Subcontractor wi$$ distribute to Contractor the aroriate materia$ saety data sheets when any 6aardous5ateria$ is brought to the 7ob Site. Contractor wi$$ rovide Subcontractor with a materia$ saety data sheetdisc$osing the chemica$ comosition o any haardous materia$ "now to be used on the 7ob Site which (-)might be harmu$ to those wor"ing or Subcontractor, or (0) or which Subcontractor has a $ega$ ob$igationto notiy em$oyees.

A. Contractor asserts that the #ro1ect 2 Subcontract is e&emt rom sa$es and use ta& and that noneshou$d be charged to Subcontractor or Sub2subcontractors or bui$ding materia$s, su$ies, i&tures,e8uiment, and 3nsta$$ation $abor which actua$$y become art o the structure. Su$ies, too$s ande8uiment used in the construction rocess (such as erimeter encing) wi$$ be sub1ect to sa$es and use ta&and ayab$e by Subcontractor, even i used e&c$usive$y on the #ro1ect 2 Subcontract. *n re8uest o

Subcontractor or any Sub2subcontractor, Contractor sha$$ cause a certiicate o e&emtion to be issued asevidence o the ta& status o the #ro1ect 2 Subcontract. Shou$d sa$es or use ta& be imosed other than asdescribed in this aragrah, Contractor agrees that the Contract #rice sha$$ be increased by the u$$ amounto a$$ such sa$es or use ta& (inc$uding ines and ena$ties) actua$$y aid by Subcontractor or Sub2subcontractors.

A. Contractor sha$$ ma"e e$ectric ower, water, heat and coo$ing avai$ab$e to Subcontractor and Sub2subcontractors through e&isting out$ets and at reasonab$e cost determined by Contractor. Subcontractorsha$$ insta$$ and maintain temorary connections, distribution $ines, and meters re8uired to measure theamount o water, e$ectric ower, heating and coo$ing consumed during construction. <eore ina$

accetance o the !or", Subcontractor sha$$ remove a$$ the temorary connections, distribution $ines, andmeters and issue a credit to Contractor or uti$ity services used during construction.

<. Contractor sha$$ rovide, at no cost to Subcontractor, ade8uate ar"ing or construction ersonne$during the eriod o construction.

C. ?n$ess agreed to in advance by Contractor, construction ersonne$ sha$$ use temorary toi$etaci$ities rovided by Contractor, and none other.

Anything to the contrary in this contract notwithstanding, Contractor wi$$ rovide, at no cost toSubcontractor, --B vo$t e$ectrica$ ower rom the e&isting distribution system on the 7ob Site or hand2he$d ortab$e ower too$s. Subcontractor wi$$ not use the e&isting e$ectric ower system or we$ding machinesor other e$ectrica$ e8uiment with heavy ower e8uirements.

A. Subcontractor sha$$ regu$ar$y remove rom the 7ob Site and storage areas a$$ sur$us materia$, wasteand debris resu$ting rom !or" done by Subcontractor. Construction debris sha$$ be removed to a $ega$reuse co$$ection site with disosa$ or recyc$ing ees aid by Subcontractor. At com$etion o the !or",Subcontractor sha$$, in addition, remove rom the 7ob Site a$$ too$s, e8uiment and staging

brought to the 7ob Site by Subcontractor or Sub2subcontractors.

<. Contractor sha$$ rovide a trash disosa$ aci$ity on the 7ob Site or use by Subcontractor at nocharge. A$$ construction debris created by Subcontractor and Sub2subcontractors sha$$ either be $aced in atrash container rovided by Contractor or hau$ed to a $ega$ disosa$ site at the e&ense o Subcontractor.Subcontractor wi$$ notiy Contractor i the trash aci$ity rovided by Contractor is u$$.

C. 3 Subcontractor or any Subcontractor wor"ing on the #ro1ect ai$s to com$y with e8uirements inthe Contract +ocuments or rogressive or ina$ 7ob Site c$eanu, Contractor may notiy any and a$$Subcontractors wor"ing on the #ro1ect to be resent or a meeting on the 7ob Site at a time no sooner than; Ca$endar +ays rom the date o the notice. At that meeting, Contractor wi$$ so$icit reasons ande&$anation why Subcontractor and other Subcontractors shou$d not be bac" charged or remova$ oconstruction debris in roortion to the debris each Subcontractor has discarded on the 7ob Site. At theconc$usion o this 7ob Site meeting, Contractor wi$$ advise a$$ Subcontractors resent o the rooseda$$ocation o cost or #ro1ect c$eanu. The a$$ocation sha$$ be based on the reasonab$e oinion oContractor ater viewing the site and hearing reresentation o a$$ Subcontractors resent. ; +aysthereater, i Subcontractor or Subcontractors remain in non2com$iance with c$eanu e8uirements in theContract +ocuments, Contractor may begin 1ob c$eanu and deduct the actua$ cost rom ayments due

A. Subcontractor sha$$ em$oy a cometent Suerintendent and any necessary assistants or a$ternates,a$$ aroved by Contractor. The Suerintendent sha$$ not be changed e&cet with the consent oContractor, un$ess the Suerintendent is discharged by Subcontractor. The Suerintendent sha$$ haveauthority to reresent Subcontractor in a$$ matters re$ating to the #ro1ect. Communications with the

Suerintendent sha$$ have the same orce and eect as direct communication with Subcontractor.<. A. The Contract +ocuments are the entire agreement and constitute a com$ete integration o a$$understandings between Contractor and Subcontractor on the sub1ect o the #ro1ect 2 Subcontract. The

Contract +ocuments suersede a$$ rior negotiations, reresentations and agreements, whether written orora$. No subse8uent notation, renewa$, addition, de$etion, change or amendment to this contract sha$$ haveany orce or eect un$ess in the orm o a written Change *rder or amendment to this contract.
