2. Bids must be accompanied by a non-refundable fee as indicated at Column (6) of Annexuretowards cost of bid documents in shape of Bank Draft/ Demand Draft in favour of Executive Engineer,M.I. Division, Khurda drawn on any Nationalised Bank payable at Khurda only otherwise their bidsmay not be taken into consideration. Bid must also be accompanied by bid security specified inColumn (4) of the Annexure and will have to be submitted in any one form such as Post Office SavingsBank Account/National Savings Certificate/Post Office Time Deposit Account/Kisan Vikash Patra/Deposit Receipt of any Scheduled Bank duly pledged in favour of the Executive Engineer, M.I. Division,Khurda and shall be valid for 45 days beyond the bid validity period.

4. Additional performance security shall be obtained from the bidder when the bid amount isless than the estimated cost put to tender. In such an event, the bidders who have quoted less bidprice/rates than the estimated cost put to tender shall have to furnish the exact amount of differentialcost i.e., estimated cost put to tender minus the quoted amount as additional performance security in

shape of Term Deposit Receipt/Post Office Savings Bank Account/ National Savings Certificate/PostOffice Time Deposit Account/ Kisan Vikash Patra/Deposit Receipt of any Scheduled Bank duly pledgedin favour of the Executive Engineer, M.I. Division, Khurda in the sealed envelope along with the pricebid at the time of submission of bids failing which the tender will be rejected.

5. Bid documents consisting of qualification information and eligibility criteria of the bidders,plans, specification, drawings and abstract of various classes of work is available in Website :www.tendersodisha.gov.in .

6. Bid for the work shall remain open for acceptance for a period of ninety days from the lastdate of receipt of bids. If any bidder/tenderer withdraws his Bid /Tender before the said period ormakes any modifications in the terms and conditions of the bid, the said earnest money shall standforfeited.

7. A bidder shall not be permitted to bid for the work in the M.I. Circle concerned for awardand execution of contracts in which his or her spouse’s near relative (defined as first blood relations,and their spouses) is posted as Divisional Accountant/ Divisional Accounts Officer or as an officer inany capacity between the grades of Superintending Engineer and Junior Engineer (Both inclusive).

8. No Engineer of Gazetted Rank or other Gazetted Officer employed in Engineering orAdministrative duties in an Engineering Department in State Government is allowed to work ascontractor for period of two years after his retirement from Government service without Governmentpermission.

9. The name of the contractors, who are participating in this e-tender but not submitting theoriginal cost of tender paper and bid security, will be reported to the State e-Procurement Cell aswell as to the higher authorities for necessary action against them. Non-submission of bid securitywithin the designated period shall debar the bidder from participating in the Online bidding systemand his Portal Registration shall be blocked. His name shall also be informed to the registering authorityfor cancellation of his registration as contractor.

10. If L1 bidder does not turn up for agreement after finalization of the tender, then he shall bedebarred from participation in bidding for three years and action will be taken to blacklist the contractor.In that case, the L2 bidder, if fulfils, other required criteria would be asked for drawing agreement forexecution of the work if he negotiates at par with the rate quoted by the L1 bidder otherwise thetender will be cancelled. In case a contractor is blacklisted, it will be widely publicised and intimated toall Department of Government and also to Govt. of India agencies working in the State.

11. If the rate quoted by the bidder is less than 15% of the tendered amount, then such a bidshall be rejected and the tender shall be finalized basing on merits of rest bids. But if more than onebid is quoted at 14.99% (Decimal up to two numbers will be taken for all practical purposes) less thanthe estimated cost, the tender accepting authority will finalize the tender through a transparent lotterysystem, where all bidders/ their authorised representatives, the concerned Executive Engineer andDAO will remain present.

12. Before acceptance of tender, the successful bidder will be required to submit a workprogramme and milestone basing on the financial achievement so as to complete the work within thestipulated time and in case of failure on the part of the agency to achieve the milestone liquidateddamage will be imposed.





13. The contractors who want to participate in the tender are to submit only one bid for anyparticular work.

14. The bids must be accompanied with all printed pages of the scanned copy of contractor’slicense, VAT-612,PAN, price preference in case of SC/ST contractor, No relation Certificate, failingwhich the bids will be rejected.

15. Engineer contractor asking for exemption of EMD/ISD has to produce scanned copy ofaffidavit stating that “I have not exempted for more than two works during the financial year 2016-17”failing which the bids will be rejected.

16. Bidders who participated in the bid can witness the opening of bids after logging onto thesite through their DSC. If the office happens to be closed on the date of opening then the bids will beopened on the next working day.

17. The authority reserves right to cancel any or all bids without assigning any reasonthereof.

6. The bidder may ask questions in the e-procurement portal using his/her DSC from 10-00 Hrs.of the 17th April 2017 up to 13-00 Hrs. (1-00 P.M.) of the 29th April 2017.

7. Bidders desirous to hire machineries or equipments from outside the State or owned butdeployed outside the State are required to furnish 2% of the amount put to tender Column (3)as bid security.

8. Subsequent Corrigendum/Addendum, if required, shall only be available in website indicatedabove.

9. Scanned clear copies should be uploaded. Non-visible copies of documents may be liable forrejection.

10. Amendments made to the contractual and codal provisions of OPWD Code vide WorksDepartment, Government of Odisha, Office Memorandum No. 5288, dated the 4th May 2016will be followed scrupulously. Additional Performance Security shall be deposited by the bidderwhen the bid amount is less than the estimated cost put to tender. In such an event, thebidders who have quoted less bid price/rates than the estimated cost put to tender shall haveto furnish the exact amount of differential cost i.e. estimated cost put to tender minus thequoted amount as Additional Performance Security in shape of Demand Draft/Term DepositReceipt of Scheduled Bank duly pledged in favour of Executive Engineer, M.I. Division,Rayagada in the sealed envelope separately along with the price bid at the time of submissionof bids.

The bids of the technically qualified bidders will be opened for evaluation of the pricebid. In case of the bidders quoting less bid price/rate than estimated cost put to tender andhave not furnished exact amount of differential cost (i.e. estimated cost put to tender minusthe quoted amount) as Additional Performance Security in shape of Demand Draft/Term DepositReceipt duly pledged in favour of EE,M.I. Division, Rayagada, their price bid will be taken intoconsideration for evaluation even if they qualify in the technical bid evaluation.

11. The amendments made vide Works Deptt. Memorandum No.12366, dated the 8th November2013 will be followed scrupulously.

12. General instructions to contractors issued vide Lr. No. 20415/DOWR, Dt. 14-09-2015 will beadhered strictly.

13. No extension of time will be allowed. Penalty will be imposed as per agreement conditions, ifthe work is not completed within the stipulated period / not in proportion to the work programme.

14. Name of the work should be superscribed on the cover submitting original documents failingwhich the tender will be outrightly rejected.
