Dear Brothers and Sisters,
On the occasion of „ Gurupujan‟ Saprem Namaskar
The practice of meeting you at quarterly intervals through circular has been slightly delayed this
time. As you know, the rates of D. A. payable to retirees change in February and August every
year. To enable incorporating these rates in our circular, it has been decided to issue quarterly
circulars in the months of August-November-February-May hereafter. Accordingly the table of
D.A. payable for the period from August 2013 to January 2014 is attached for your information
and ready reference. Please take a note of this change.
As per the revised timetable this second circular in this year is being issued on the day of
„Nagpanchami‟. Actually we intended to issue the same on “Ashadhasya Pratham Divase” i.e.
on 9th July 2013 which is also celebrated as “Mahakavi Kalidas Day”. The Great Poet Kalidas
was known as a Gem of the nine gems in the court of Chandragupta, king of Ujjain. Kalidas had
written his one of the blockbusters (Mahakavya) „Meghdoot‟ on hills of Ramgiri at Ramtek near
Nagpur and gave our Sanskrit language a distinctive level.
1st August was the day of death anniversary of Lokmanya Tilak and birth anniversary of „People
Minstrel‟ (Lokshahir) Annabhau Sathe. On this occasion both great personalities were
remembered every place, so also at our weekly meeting held on Saturday 3rd August. During
the current month the birth anniversary of Bhagwan Shrikrishna will be celebrated on 28th
August. The Government of our country as well as our society badly needs the devine guidance
of Lord Bhagwan Shrikrishna. Such guidance would only enable us to tackle threat of external
and internal enemies who are set to destroy social equality in our country. Shrikrishna should
take birth, but at neighbour‟s house, not at my home. We should put down such mentality. We
have to start with our own house. Being a Senior Citizen let us keep in mind the sayings of
Bhagwan Shrikrishna to Arjuna that “I will not take part in the battle (at kurukshetra) but only
give few Ideas about the battle” and let us be ready to give proper consultation and participate
in social rebuilding using our experience. This will be a true following of Lord Shrikrishna.
Our beloved Bank of Maharashtra-
After the scorching heat of summer, we are now experiencing pleasant greenery all around. In
such atmosphere our Bank has also displayed shining performance. The Bank has secured
following awards under the program of 2nd Banking Financial Services and Insurance Awards.
1) Best Public Sector Bank.
2) Best Bank with most Admired services.
3) Best Security Initiative.

4) Best Business Sustainability Initiative.
5) Best Corporate Social Responsibility.
Time and again we have stated that the management as well as all employees, officers, their
families have contributed to this grand success. Their work is a type of paid social service and
they are indirectly participating in the work of nation building. We offer hearty congratulations to
all of them. Accordingly, we make a polite but insisting demand to allow 1% extra rate of interest
on term deposits in the names of retirees and employees as well as their spouse in order to
recognise the hardships and difficulties being experienced by them.
Review of Organisational work during last four months:
1. As per circular dated 06-02-2012 issued by the Bank it was decided to pay Rs. 4000/- to each
retiree (with the exception of those who had resigned and those who made to retire
compulsorily) towards reimbursement of medical expenses for the year 2011-12. As a result of
proper follow up made by our Organisation, this benefit has been received by a large number of
retirees till date. Still many retirees are yet to receive this reimbursement. They are suggested to
contact Mr. V. S. Bhagwat, Our Secretary Admn. (Mobile no. 07588230330) along with copy of
claim submitted to the branch in prescribed form.
2. We had received encouraging response from our members as well as well wishers to our
appeal made in the last circular to contribute towards donation to be given for the work of
Draught Relief in many parts of Maharashtra. Hence, within a short period we could collect and
donate our contribution to the tune of Rs. 2.50 lakhs to Jankalyan Samitee Maharashtra in a
small function arranged on 12th May 2013.
3) As usual the meet of our members at Aurangabad was concluded on 31st July 2013 with
great enthusiasm.
4) The last meeting of earlier Executive Committee took place on Tuesday 02-07-2013. 51 E. C.
members from Pune, Ahmedabad, Nashik, Ahmednagar, Mumbai, Kolhapur, Thane, Dombivali,
Amravati, Akola, Solapur participated in the meeting. All Units furnished desired information
about respective Units. In brief it is as under.
A) There are 318 members in Nagpur Unit. Out of the them more than 100 members
have enrolled as a result of efforts put in by Shri P. N. Wanikar. We congratulate him.
Letters about 100% D.A. neutralization were collected from 100 members and sent to
Bank,IBA and Govt.
B) Nashik Unit arranges quarterly meetings regularly. A good number of members
participate in the work undertaken by „SAKSHAM‟ for blind and physically handicapped
children.
C) Solapur Unit has succeeded in converting 11 out of 20 ordinary members as life
members within a period of one year. The Unit had arranged a lecture of Dr. Degavkar
on the subject of Knee Replacement.
D) A small article written by Shri Prakash Khadke Ahmednagar about the incidence he
had experienced while working as Branch Manager was published in a local daily
Newspaper „Divya Marathi‟. Shri Vinayak Pawle our member performed one man show
of the drama „Natsamrat‟ in a program arranged by Senior Citizen‟s Forum at Sawedi
Ahmednagar.

We congratulate all above persons. We again request our Units to report such
special performances and news from their area.
Biennial Conference:
The 7th biennial conference of our nationwide Organisation having crossed the membership
milestone of 3100 was concluded on Wednesday 3rd July 2013 at Niwara Hall Pune with great
fervor. Breaking all expectations about 600 enthusiastic members attended the conference. The
feature of this conference was the felicitation of retirees having crossed the age of 75 since the
last conference. They were felicitated with shawl, Sriphal and Manpatra. In all 43 retirees were
felicitated at the hands of Chief Guest Shri Chaitram Pawar. This felicitation was not restricted
to members of organisation but all other eligible retirees were also invited and many of them
attended it. In reply to the affectionate felicitation one of the felicitated retirees, Comrade
Dhodapkar ( not our member ) appreciated working of our Organisation. Since inception we
have taken a stand that the retiree should join the organisation only as a “Retired Employee”
forgetting the cadre in which he was placed prior to retirement and the organisation of which he
was a member while in service. Owing to this our membership includes retired Chairman to a
retired sub staff brother of the Bank.
In the morning session, before staring the felicitation General Secretary Shri Devendra Soman
gave introductory speech before the gathering. Vice President Shri Bhaskar Manakeshwar
introduced the Chief Guest Shri Chaitram Devchand Pawar. He explained how Shri Pawar was
instrumental for total transformation of village Baripada in Sakri Tahsil in Dhulia District where
the entire population is of Adivaasi community. Everybody was eager to hear Shri Chaitram
Pawar. This highly educated and an internationally known personality is most modest and
selfless. At the very beginning he admitted that he could do this work only because he had
come in contact with Vanvasi Kalyan Ashram 20 years ago in 1992. The forest which was totally
destroyed is again in full bloom. All the wells in the village area where water was scarce earlier,
are now full with water. Water is supplied to five nearby villages also. The families in the village
have passed a resolution unanimously and informed the Government that they have no longer
remained poor, hence their BPL (Below Poverty Line) cards may be cancelled. Their forest
development experiment has received recognition and award from International Fund for
Agricultural Development, Rome Italy.
In his concluding speech the President of the organisation Shri Balasaheb Fadanvis reiterated
that we always insist that the retiree should forget the cadre in which he was working and the
trade union with which he was associated and join our organisation as a retired employee only.
Due to this all members come together with free mind. A few minutes back our senior friend Shri
Dhodapkar urged that the retirees should participate in the social activities. In this regard I can
say proudly that many of our members have engaged themselves in the activities of various
social organisations. Our members voluntarily and whole heartedly donate towards Samajik
Krutadnyata Nidhi thinking that we should contribute towards the social cause. Out of this fund
we could partially meet the requirements of nearly 30 social organisations like Bhatke Vimukta
Vikas Parishad Pratisthan, Yamgarwadi. We have donated Rs.35.00 lakh so far to various
NGOs during last 7-8 years. We are one from Kanyakumari to Kashmir. With this in mind our
lady members keep in touch with the girl students coming from North East India and staying in
Pune and other parts of Maharashtra. These girls do not feel that they are away from their
home. I therefore always say that we have a group of “Devdurlabha Karyakartas”. None other
organisation has such a cohesive group of karyakartas.
After an excellent lunch, the second session commenced in the afternoon. The Chief Guest for
this session was Shri P. N. Deshpande, General Manager Pune City Zone of Bank of

Maharashtra. He was introduced by Shri Mukund Bhalerao. It was followed by opportune
speech by Shri P. N. Deshpande. Thereafter, Dr. Sunil Deshpande, Officer Director on the
Board of Directors of Bank of Maharashtra and President of BOM Officers‟ Organization,
explained the progress of 10th bipartite settlement. He appreciated the working of our
Organisation. General Secretary Shri Devendra Soman presented the minutes of 6th biennial
conference which was held on 11.06.2011 as well as his report on the working of the
Organisation. These unanimously adopted by the members. Audited Balance Sheet and Income
Expenditure Account for the year 2011-12 and 2012-13 were presented by the Treasurer Shri
S.V.Chaudhari. Both of them were adopted by the members with loud clapping. During the
same session two resolutions which were passed earlier by the Executive Committee in its
meeting on 2nd July 2013 were also placed before the meeting and were approved unanimously.
(Copies of these resolutions are attached with this circular for information). Then President of
the Organisation Shri Balasaheb Fadnavis addressed the meeting. He also offered vote of
thanks to E.C. Members for the cooperation extended by them during past two years and then
he declared the dissolution of Executive Committee. Thereafter the election process was started
and completed in excellent manner by Shri M.D.Deshpande. He declared that 32 Office
Bearers, 15 Regional Secretaries and 28 E.C.Members were elected unopposed. The list of
new Office Bearers and Executive Committee members is attached for information. Reelected
General Secretary Shri Devendra Soman informed his plans about membership mobilization
and working of the Organisation in next two years. Our Organisation gets excellent cooperation
of Officer Director and President of Officers‟ Organisation, Dr. Sunil Deshpande, General
Secretary Shri Viraj Tikekar, Vice President Shri Mukund Bhasme, Shri Ravindra Deshpande,
General Secretary of Karmachari Sangh and all of his colleagues. All of them were present at
the meeting. Dr. Sunil Deshpande reported important developments in the world of banking. We
offer our sincere thanks to him and to all others.
A joint meeting of the representatives of BOMREWO, BOMOO, NOBW and Bank of
Maharashtra Karmachari Credit Cooperative Society Ltd. was arranged on 21-7-2013. Dr. Sunil
Deshpande, Officer Director and President BOMOO proposed to have a coordinating committee
of all these four organizations. It was unanimously supported. Shri Balasaheb Fadnavis was
appointed as Coordinator and Shri Mukund Bhalerao and Shri Dinesh Kulkarni were appointed
as Asstt. Coordinators.
Samajik Krutadnyata Nidhi-
The Organisation has continued this ambitious project for last eight years. We are getting best
response to this scheme from our members who are prudent and cautious about extending
helping hand to the weaker and deprived elements of the society. There are many members
who give contribution of Rs. 1000 and in multiple thereof. The work of collecting donations for
current year is in full swing. Can we afford remaining away in this situation? Please think over
and contribute maximum amount remitting the same by cheque or draft favouring
BOMREWO or by direct credit to S/B A/C no.20057176796 in the name of our
Organisation. Donation given to this fund enjoys facility under section 80g of Income Tax
Act. We should always be aware of the fact that a large section of society immensely needs our
help. The poverty and powerlessness have weaken the human beings and perverse life -values
have occupied the life. We should help to reduce this poverty and weakness
Mahila Vibhag
The lady members in Pune come together on third Tuesday of every month. They celebrated
Spring Festival on 23rd April 2013. New lady members were greeted. An appeal was made to
contribute to the Draught Relief Fund. The attendance was remarkable. Mrs. Jyoti Patwardhan

and Mrs. Tanmai Kuber performed a one act play titled as „Shokparva‟ which was related to
Mahabharat. The audience was spellbound to hear their dialogues in the roles of Gandhari and
Draupadi. Invaluable cooperation was extended by Shri Chandrashekhar Aphale, Shri Umesh
Sant and Shri Nitin Deshpande. The program was followed by delicious refreshment.
The next meeting was held on 23rd May 2013 which was started with „Omkar‟. During the
meeting poems were read and funny experiences in overseas trips were shared. The members
expressed their views over generation gap. It was decided to arrange the program of dance
performance by the granddaughter of our member Mrs. Sudha Darda on third Tuesday of June
2013. Accordingly, on 18th June 2013 Miss Kohinoor Darda gave her dance performance. She is
expert in Kuchipudi. Mrs. Gayatri Ambekar is her Guru. Her gestures and skill of dancing
impressed everybody.
On 16th July 2013 Shri Vijay Falnikar and Smt. Sadhana Falnikar, founders of „Aple Ghar‟
institution addressed the members. They informed in detail how they take care of orphans and
helpless children. They have introduced this project subsequent to the death of their only son
Vaibhav. They also run a rest home for old and homeless people. They have also started
classes for elder children imparting them training on special skills to facilitate getting jobs for
them. They have started hospital as well as mobile dispensary. They talked in brief about the
hardship faced during childhood, the efforts they had put in as well as their meeting with their
Guru Shri Kale Sir.
Individual Success Stories-
1) Miss Aditi Mahajan granddaughter of our member Shri Ganesh Warekar won the pre quarter final badminton match of the championship competition for the group of girls under 13. She had secured 3rd seeding. She defeated her opponent Miss Sahnya Kulkarni in straight sets 21-14, 21-18. Some of her shots were excellent. Congratulations Miss Aditi.
2) Shri Aniket Late, son of our E.C. member Shri Vijay Late has secured first class ( with Distinction) in B.E.(Mech.) examination. Hearty Congratulations.
3) Considering the present lifestyle it has become difficult to spare 45-60 minutes daily for exercise. Non availability of time is not an excuse, but has become factual position. To reach to a ground or gymnasium or a swimming tank etc. is time consuming. To overcome all these hurdles and carry exercises at home our member Shri Anil Barve has written a book which is explaining how one can keep physically fit by taking simple exercises at home. First edition of this book was published on Akshyya tritiya, 13th May 2013 followed by a second edition published on the day of Gurupournima the 22nd July 2013. We congratulate Shri Barve.
4) The Editor and Creator of a distinctive glossary is our life member Shri Shrikant Dhundiraj Joshi. The lexicon titled „Marathi Shabda Vaibhav‟ has been published recently by Nitin Publications at the hands of Dr. N. M. Joshi and Shri Sudhir Gadgil a famous interviewer and compeer as the Chief Guest. This word list having 600 pages includes 1400 basic words and 22500 other words originated from these basic words. The editor has given the basic words and other words in their groups with their prevailing meaning as well as secret meaning with its cultural, political and social background. Simplicity, easiness, preciseness, origin of the word, meaning with explanations are the characteristics of this lexicon. The book really reflects the glory of Marathi Language. We congratulate Shri Joshi.
5) Miss Neha Deshpande, daughter of our life member Smt.Shubhada Deshpande has come out successfully with flying colours in the U.P.S.C. examination. We congratulate Miss Deshpande.

1) WP 8311/2012 Subject- 2nd option of pension was denied to those who had resigned and those who were
retired compulsorily.
The petition was dismissed in July 2013. As per Pension Regulations 1995-Regulation
no.22(1) past service of employees who have „resigned‟ disqualifies them for availing
pension as retirement benefit.
All the petitioners had put in more than 20 years of service and hence requested the Court
to strike out the word „resigned‟ and make them eligible for pension. The reasons for
rejection were as under.
The Honorable Court had relied on the decision of Honorable Supreme Court in the case of
UCO Bank v/s Sanwarmal. The judgment refers to Supreme Court words which state that
the words „resignation‟ and „retirement‟ carry different meanings in common parlance.
„An employee can resign at any point of time even on the second day of his appointment,
but in the case of retirement he retires only after attaining the age of superannuation or in
the case of voluntary retirement, after completion of qualifying service.‟ It is precisely this
distinction that is drawn in 2010 pension scheme and 1995 pension regulations. Both are
restricted to a limited and a well defined class of beneficiaries. Had the scheme been
intended to apply to those who had resigned it would have undoubtedly said so. The
distinction is far from artificial.
Our Advocate Shri M.D.Deshpande opines that the judgment needs further study to explore
the possibility of filing review petition or special leave petition in Supreme Court.
2) Denial of 2nd option of pension WP 1096/2012. The case refers to employees resigned before 27-4-2010 (the date of B.P.Settlement) but relieved after 27-4-2010 and were in service on 27-4-2010. Though these employees are eligible for pension their claim was rejected by our Bank. The case was admitted on 11-2-2013 and is pending.
3) Denial of 2nd option of pension to resignees (WP 9589/2011) There were six retirees who had sought voluntary retirement as per OSR rule no. 19(1).
Hence their claim for pension is perfectly eligible as per guidelines conveyed by IBA
vide circular no. Cir/HR & IR/2012-13/G @6213 dt. 9-11-12. However Bank is not
issuing circular for grant of pension to them.
There are 23 retirees who were eligible for VRS as per OSR 19(1) but they were
allowed to leave the Bank on resignation. IBA has clarified that if it is a bonafide mistake
on the part of Bank it should be placed before the Board for taking a review and issuing
necessary directions in this behalf. In other banks such retirees have started getting
pension, but in our Bank no action has been initiated so far.
4) Writ Petition No. 8564/2011. Sub – 100 % neutralization in dearness relief to retirees prior to 1-11-2002.
Single Judge of Madras High Court ordered on 14-12-12 that petitioners of Canara
Bank, Bank of Baroda, and Indian Overseas Bank who are retirees prior to 1-11-2002
are eligible for 100 % dearness neutralisation as similar benefit is granted to retirees
after 1-11-2002.
Canara Bank and Indian Overseas Bank had gone in appeal against above decision
before Divisional Bench of Madras High Court and the case was decided in favour of

respondent Banks dismissing the decision made earlier in favour of petitioners. While
giving this decision the Divisional Bench made following observations.
a) The benefits arising out of wage revision under 8th BPS w.e.f. 1-11-2002 towards
D.A. relief at 100 % neutralization cannot be granted to employees retired during the
period of earlier BPS i.e. 7th BPS because retirees prior to 1-11-2002 and retirees after
1-11-2002 cannot be said to be similarly placed.
b) Banks have pleaded that if 100 % D.A. neutralization demand by pre November 2002
retirees is considered favorably during 10th BPS Negotiations there will be considerable
financial burden which will have to be carved out from wage increase package meant for
staff in service.
c) Pension of petitioners is out of settlement and not on account of statutory right.
d) With the help of case law the judge has put up that prescription of cut off date for
giving benefits can not be considered as arbitrary and irrational.
e) When two sets of employees of the same rank retire at different points of time, one
set cannot claim the benefit extended to other set on the ground that they are „similarly
situated‟ and though they are retired with the same rank, they are not of the same class
or homogeneous group and hence article 14 of the constitution of India is not applicable.
(Article 14 refers to equality before law.)
Aggrieved petitioners are likely to explore the possibility of filing special leave petition in Apex
Court. We may add that there is writ petition (c) no. 1931/2002 pending in Delhi High Court
against Govt./ State Bank Of India and the petitioners are Premvati Bagga and Others. The
issue relates to the claim of the petitioners / pensioners of SBI for equality for grant of pension
with other pensioners because otherwise as per pension scheme of SBI the retirees prior to 1-
11-93 are said to have lesser pension emoluments than those who have retired after 1-11-93. It
is worthwhile to note here that Delhi High Court has directed SBI to procure the details of total
corpus available with pension fund, how the same is invested and what is the average rate of
return on entire corpus of the pension fund for about last ten years.
As regards our petition no. 8564/2011 we have to state that we have recently filed an affidavit in
July 2013 with a view to convince the court that the Bank has adequate surplus in pension fund
to pay if 100% neutralization in Dearness Relief is granted to all those who have retired before
1-11-2002, even retrospectively. The affidavit is backed by data obtained under Right to
Information Act 2005. The next date of hearing is 04.09.2013.
Forum of Retired Bank Employees-
The CWC meeting was held on 19-7-2013.
1) Family Pension –With a view to seek active support of all UFBU constituents as regards grant of family pension on lines of RBI/Govt. a detailed letter was sent on 24-5-2013 with copies marked to various organizations of retirees with a request to initiate similar correspondence from their end to underscore the urgency and priority that is needed to be given to sort out this issue.
2) Meeting at Dombivali on 8-5-2013 – Shri Mukund Phatak activist of BOMREWO had taken initiative to arrange a meeting which was attended by 36 activists from 10 PSU banks. Shri M.D. Deshpande President of FORBE presided over the meeting. He informed
about various developments on legal front and insisted upon the need of unity among

the retirees. He suggested that a committee of 4/5 activists be formed to arrange
monthly meetings of members to exchange the views on recent and ongoing
developments concerning the world of Bank retirees. Accordingly a committee was
formed to whom FORBE will send communications on important issues.
3) Denial of pension due to delay in submission of 2nd Pension Option form – (WP no. 1020/2012- Mumbai High Court decided on 12-6-2013) Shri K.S.Mirza – a retiree of Union Bank of India was out of India when the circular about
2nd option of pension was issued and period for submission of option form was over
when he had returned to India. The Bank had denied the pension purely on technical
reason that claim for pension was submitted after the stipulated due date.
Taking into account the peculiar facts and circumstances of the case, the Court directed
the Bank to grant pension to the petitioner stating that this decision shall not be treated
as a precedent.
4) Membership Position – The total number of members including individual members and the indirect members
who are members of affiliated organizations has crossed the figure of 4100. The
individual members include retirees from 2 different banks.
5) Group Mediclaim Policy – The data of retired pensioners of Bank of Maharashtra covering agewise strength of
8355 retirees has been received and the same has been forwarded to PSUs of General
Insurance sector for information and for doing the needful.
6) Indian Banks Association – The Commissioner of Information New Delhi has given decision on 6-8-2008 on appeal
no. 2622/ILBP/2008 that IBA is not a public authority under RTI Act 2005 regulation no.
2(h) because it is neither substantially funded by Govt. nor it is under the control of Govt.
In the recent meeting of CWC of FORBE the members expressed in one voice that
there is urgent need to study the legality of role played by IBA because lacunae
observed in Bipartite Settlements have resulted in recurring monetary losses to retirees.
IBA is not available even for dialogue. In the absence of mechanism to sort out problems
of poor retirees, they are forced every now and then to knock the doors of Courts to
seek justice and in most of the cases they have been awarded favourable judgments.
The Bank Managements are found to be in no way concerned to rectify the
shortcomings of BPS and state that IBA has been given mandate for entire exercise of
wage negotiations with the unions of staff in service.
Shri Mankeshwar, Vice President of FORBE is of the opinion that if found necessary we
may have to approach Honorable Supreme Court making a properly made out case
regarding the role of IBA. For this purpose information on various points will have to be
obtained under RTI Act also if felt necessary.
7) Forum‟s President and Advocate Shri M.D.Deshpande had filed writ petition in Mumbai High Court (WP no. 2767/2012) for petitioners from Union Bank of India who had voluntarily retired as per the scheme under OSR-19(1), but were denied 2nd option of pension for wrong reasons. In November 2012 IBA had directed that all voluntarily retired employees be granted pension if they are eligible under OSR – 19(1). The case will be withdrawn soon as all these petitioners have started getting pension.

8) Forum‟s affiliated unit viz. United Western Bank Retired Employees‟ Organisation has started holiday home facility for their members in their own premises at Sadashiv Peth, Pune 30.
9) The Writ Petition no. 184/2011 about re fixation of pension stands transferred to Delhi
High Court by Supreme Court. In the petition filed by Federation of State Bank of India & others against Govt. of India and others as respondents, Supreme Court has given a decision on 27-2-2013 that the pension payable to the employees retired prior to 1-11-2007 be equivalent to the pension payable to the employees who have retired subsequent to 1-11-2007. In this respect if there are any deficiencies in pension regulations and service conditions then it is a part of service conditions of employees of that Bank. Hence, the subject of writ petition does not come under the purview of Supreme Court as per section 32 of the constitution of India and it is, therefore, transferred to Delhi High Court. The Bench was advised to decide over the same within six months from receipt of all documents. The new case number at Delhi High Court is being obtained and details of progress are awaited.
10) 7th Bipartite Settlement (1997to2002) –Denial of fixation of pension at 50% of actual pay
at the time of retirement (1616/1684). The case is pending in Supreme Court under no.SLP 24889/2011.The parties are G.
Pilani vs. Bank of Baroda. The issue relates to payment of arrears arising out of pension
difference and payment of commutation difference to a large number of retirees who had
retired between April 98 and October 2002. The 7th wage revision Bipartite Settlement
fixed pension of those who had retired after April 1998 on the index of 1616 while
pension of staff in service was fixed on the index of 1684. This was resulted in fixation of
pension at about 42% of pay instead of 50%as per pension regulations. This position
was corrected under 8th Bipartite Settlement (2002-2007). However the arrears were
paid w.e.f. 1-5-2005 instead from the date of retirement. The amount involved in arrears
is fairly large.
Mr. G. Pilani, a retiree from Bank of Baroda had filed a writ petition in Madras High
Court. The single Judge had decided the case in favour of Bank of Baroda. Aggrieved by
above decision Mr. G. Pilani filed writ appeal under no. 1209/2007. The case was
decided in favour of petitioners by Divisional Bench of Madras High Court on 28-6-2011
directing the Bank to remove the anomaly and pay the difference amount of pension and
commutation from the date of retirement till 1-5-2005. Bank of Baroda has not honored
the decision of Divisional Bench and filed special leave to appeal (civil) bearing no.
24889/2011. (From the judgment and order dt. 28-6-2011 in W.A. 1209/2007 of the High
Court at Madras ). The hearing was last made on 20-7-2012 and application for
impleadment and intervention were allowed. The order further stated that „ operation if
the impughed order shall remain stayed in the meanwhile subject to the condition that
the petitioner bank (BOB) continues to pay to its employees pension in terms of BPS dt.
7-3-2000.
The Writ Petition No.7443/2003 filed by Bank of Maharashtra Retired Employees
Welfare Organisation against Bank of Maharashtra in Mumbai High Court has been
tagged to the case pending in Supreme Court.
Some of the pensioners of State Bank of India who had retired drawing 7th BPS scale
aggrieved by the denial of their pension computed on the basis of actual pay drawn by
them at the time of retirement have filed writ petitions in various High Courts which are
pending at different stages of hearing.

In Kerala High Court the Writ Appeal filed by State Bank of India and Govt. against the
judgment ordering payment of pension on 7th BPS pay scales on the same basis as paid
on 8th BPS pay scales is pending.
WP no. 34619/2003 decided by High Court of Karnataka at Bengluru on 23 March 2011
in favour of petitioners from State Bank of Mysore stating that the Bank shall refix
pension considering addition to service up to five years being qualifying service as per
clause 29(5) of Pension Regulations 1995. While doing so the Bank shall take into
consideration actual pay drawn for last 10 months for the purpose of computing pension.
Note – All the petitioners had retired as per Bank‟s VRS scheme in 2001 but were
denied pension as per regulation 29(5).
All India Retired Bank Employees Association and Others had filed Writ Petition No.
WP(C) 6907 of 2012 against Union of India and Others claiming refixation of pension
from date of retirement and not from 1-5-2005 as stipulated in 8th BPS. The pensioners
have lost the case because Delhi High Court held that 1) this was agreed by UFBU with
IBA and 2) cutoff date decision is prerogative of employer.
11) Writ Petition (C) 5030/2010 in Delhi High Court –Shri R.P.Goswami & Shri M.B.Jain vs. Indian Overseas Bank. Next date of hearing is 26-8-13. At the joint request
of counsel for the parties, adjourned to 26-8-13 as per order dt. 15-3-13.
The Writ covers following issues.
A) Pension Updation – Revision of pension with every wage revision so that equally placed retirees draw the same pension irrespective of date of retirement.
B) 100% Dearness Relief neutralization to pre November 2002 retirees as is given to retirees after 1-11-2002.
C) Automatic rise in pension as is granted to Central/State Govt. employees between 20% to 100% according to age attainment between 80 years and 100 years.
D) Arrears to be paid on pension payable at 50% of last drawn average emoluments
for 10 months from date of retirement.
12) M. C. Ratnakaran vs. Canara Bank.
In the High Court of Kerala at Earnakulam OP 37198 of 2001(C) decided on 31-8-2010 –
Shri Ratnakaran retired on 14-8-2001 i.e. during the period of 7th BPS (1997to2002).
„Pay‟ for the purpose of pension for retirees between 1-4-1998 and 31-10-2002 was
decided to be aggregate of pre revised pay and D.A. thereon calculated at 1616 points
of All India Average Consumer Price Index for industrial workers in the service 1960 =
100. This 7th BPS was signed on 27th March 2000 and pension regulations were
amended on 30-11-2002.
The petitioners claimed that since amended rules for payment of pension have come
into force legally on 30-11-2002, he must be paid pension based on actual pay drawn at
the time of retirement in August 2001. The Court has directed Canara Bank to pay
pension as per rules in force as on 14-8-2001. Ultimately Shri Ratnakaran was eligible to
get pension based on actual pay at the time of retirement.
14) Karnataka High Court dismissed WP No. 35355-35361 2010(S-R) on 20-9-2012.
Sub – Validity of condition requiring staff in service to deposit 2.8 times of pay of
November 2007 and PF retiree to deposit 1.56 times of PF plus interest received at the

time of retirement – stipulated in JT Note dt. 27-4-2010 to seek pension under 2nd option
of pension.
Observations of Court –
A) These conditions were result of prolonged discussions regarding funding gap ascertained and agreed in the agreement.
B) Serving petitioners are representatives of Unions who have signed agreement on their behalf.
C) Clause No. 13 of JT. Note provides that IBA and UFBU who are parties to JT. Note will not raise any demand of any nature whatsoever on any bank in respect of the matters covered in the JT. Note during the operation of the JT. Note.
D) This agreement being in two parties – IBA and UFBU it does not permit Court to alter the conditions and petitioners cannot question the settlement individually.
E) JT. Note terms are binding on all petitioners. F) Writ Petition itself is not maintainable. There are no grounds to interfere with the
agreement. G) Hence Writ Petition fails and dismissed.
14) Great Victory to all pensioners of Allahabad Bank Employees Pension Scheme (old). The scheme has three retiral benefits – Provident Fund (both contributions), Gratuity
and Paltry Pension – (unlike Pension Regulations 1995) as is in SBI/PSU Banks. There
is no family pension in the old pension scheme. The issue is about pension in lieu of
gratuity in the old pension scheme.
The contention of the pensioners is that pension and gratuity are two different issues
and cannot be clubbed together. In 1985 All India Allahabad Bank Retired Employees
Association filed case in Lucknow Bench of Allahabad High Court. In one case Hon.
Supreme Court held that gratuity is different from pension and has no relation to each
other.
Lucknow Bench of Allahabad high Court ordered for payment of gratuity under Statutory
Gratuity Act.
The Bank paid very paltry gratuity amount and stopped payment of pension from
October 2010 under unlawful instructions.
Shri Mehta and Shri Agarwal the retirees went in Mumbai High Court and won the case
and the Bank had to pay pension.
On 10-4-13 Lucknow Bench of Allahabad High Court pronounced the judgment
favouring petitioners for grant of pension with arrears. The matter was discussed in the
Board and the Bank was likely to go in appeal. But Mrs. Shubhalaxmi Panse,
Chairperson, took positive step and instructed for payment of pension arrears
amounting to Rs. 1.00 lakh to Rs. 3.00 lakhs to total 166 retirees and pension got
restored in July 2013.
All these pensioners are grateful for positive approach of Mrs. Shubhalaxmi Panse –
Ex.G.M. of Bank of Maharashtra.
All the representatives of UFBU met Honorable Finance Minister of India Mr. P.
Chidambaram at 3.00 p.m.on 6-8-2013. The letter submitted at that time included the
problems faced by the retirees also. The follow up is made about pension updation,
D.A. neutralization, increase in exgratia paid to retirees prior to 1986 etc.
