    1898,andcametoforceApril11,1899,Article3specifiedSpaincededtotheU.S.the

    Philippines in thePeace Treaty. That,United Stateswasdesignated as the receiving

    country,in

    the

    transfer

    of

    the

    SOVEREIGNTY

    of

    the

    Philippines

    from

    Spain

    to

    the

    United

    StatesconductedthruU.S.M.G.andthisisaninterimstatuscondition,specifiedupon

    thedateofcession,underTHEINTERNATIONALLAW,anauthorizedCivilUnitedStates

    astheReceivingCountryforthecession,governmentforthePhilippines,towhomthe

    PrincipalOccupyingPowercanrelinquish Territory,NOW, EXIST!

    TheU.S. CONGRESS drafted the Philippine Constitution which was ratified in

    1935,thisoccurredduringthetimeoftheCommonwealthAct733betweenUnitedStates

    and Republic of the Philippines 19011946; And an inauguration of Philippine

    Preamble

    TheFilipinopeople,imploringtheaidofDivineProvidence,inordertoestablishagovernmentthat

    shallembodytheirideals,conserveanddevelopthepatrimonyofthenation,promotethegeneral

    welfare,andsecuretothemselvesandtheirposteritytheblessingsofindependenceunderaregime

    ofjustice,liberty,anddemocracy,doordainandpromulgatethisConstitution.

    TheNationalTerritory

    Section1.ThePhilippinescomprisesalltheterritorycededtotheUnitedStatesbytheTREATYOF

    PARIS concludedbetween theUnited Statesand Spainon the tenthdayofDecember,eighteen

    hundredandninetyeight, the limitswhicharesetforth inArticle IIIofsaidtreaty,together

    withalltheislandsembracedinthetreatyconcludedatWashingtonbetweentheUnitedStates

    andSpainontheseventhdayofNovember,nineteenhundred,andthetreatyconcludedbetweenthe

    UnitedStatesandGreatBritainontheseconddayofJanuary,nineteenhundredandthirty,andall

    territoryoverwhichthepresentGovernmentofthePhilippineIslandsexercisesjurisdiction.

    SpainandtheUnitedStates,inArticleIIISpaincedestotheUnitedStatesthearchipelagoknownasthe

    PhilippineIsland,andcomprehendingtheislandslyingwithinthefollowingline: linerunningfromwesttoeast

    alongornearthetwentiethparallelofnorthlatitude,andthroughthemiddleofthenavigablechannelofBachi,

    fromtheonehundredandeighteenth(118th)totheonehundred andtwentyseventh(127th)degreemeridianof

    longitudeeastofGreenwich,thencealong theonehundredandtwentyseventh(127th) degreemeridianof

    longitudeeastofGreenwich, totheparalleloffourdegreesandfortyfiveminutes(4, 45)northlatitude,thence

    ($20,000,000.00)within

    exchange

    ratification

    present

    treaty.

    ARTICLEII

    DeclarationofPrinciples

    Section1.ThePhilippines,isarepublicanstate.Sovereigntyresidesinthepeopleandallgovernment

    authorityemanatesfromthem.

    Section2.ThedefenseoftheStateisaprimedutyofgovernment,andinthefulfillmentofthisdutyall

    citizensmayberequiredbylawtorenderpersonalmilitaryorcivilservice.

    Section3.

    The

    Philippines

    renounces

    war

    as

    an

    instrument

    of

    national

    policy,

    and

    adopts

    the

    generally

    acceptedprinciplesofinternationallawaspartofthelawoftheNation.

    However,inthe1935Constitution,anOrdinancewasAppended,provisionsfor

    relinquishmentweremade.Pleasereviewtheattachedclippedpage;

    PresidentofthePhilippineswiththePresidentoftheUnitedStatesonthefourthofJuly,nineteen

    hundredandfortysix,pursuanttotheprovisionsofCommonwealthActnumberedsevenhundred

    andthirtythree,butinnocasetoextendbeyondthethirdofJuly,nineteenhundredandseventy

    four,thedisposition,exploitation,development,andutilizationofallagricultural,timber,and

    minerallandsofthepublicdomain,waters,minerals,coal,petroleum,andothermineraloils,all

    forcesofpotentialenergy,andothernaturalresourcesofthePhilippines,andtheoperationof

    publicutilities,ifopentoanyperson,beopentocitizensoftheUnitedStatesandtoallformsof

    businessenterprisesownedorcontrolled,directlyorindirectly,bycitizensoftheUnitedStatesin

    thesamemannerasto,andunderthesameconditionsimposedupon,citizensofthePhilippinesor

    corporationsorassociationsownedorcontrolledbycitizensofthePhilippines.
