1898,andcametoforceApril11,1899,Article3specifiedSpaincededtotheU.S.the

Philippines in thePeace Treaty. That,United Stateswasdesignated as the receiving

country,in

the

transfer

of

the

SOVEREIGNTY

of

the

Philippines

from

Spain

to

the

United

StatesconductedthruU.S.M.G.andthisisaninterimstatuscondition,specifiedupon

thedateofcession,underTHEINTERNATIONALLAW,anauthorizedCivilUnitedStates

astheReceivingCountryforthecession,governmentforthePhilippines,towhomthe

TheU.S. CONGRESS drafted the Philippine Constitution which was ratified in

TheFilipinopeople,imploringtheaidofDivineProvidence,inordertoestablishagovernmentthat

Section1.ThePhilippinescomprisesalltheterritorycededtotheUnitedStatesbytheTREATYOF

PARIS concludedbetween theUnited Statesand Spainon the tenthdayofDecember,eighteen

hundredandninetyeight, the limitswhicharesetforth inArticle IIIofsaidtreaty,together

withalltheislandsembracedinthetreatyconcludedatWashingtonbetweentheUnitedStates

andSpainontheseventhdayofNovember,nineteenhundred,andthetreatyconcludedbetweenthe

UnitedStatesandGreatBritainontheseconddayofJanuary,nineteenhundredandthirty,andall

territoryoverwhichthepresentGovernmentofthePhilippineIslandsexercisesjurisdiction.

DeclarationofPrinciples

Section1.ThePhilippines,isarepublicanstate.Sovereigntyresidesinthepeopleandallgovernment

authorityemanatesfromthem.

Section2.ThedefenseoftheStateisaprimedutyofgovernment,andinthefulfillmentofthisdutyall

citizensmayberequiredbylawtorenderpersonalmilitaryorcivilservice.

Section3.

The

Philippines

renounces

war

as

an

instrument

of

national

policy,

and

adopts

the

generally

acceptedprinciplesofinternationallawaspartofthelawoftheNation.

However,inthe1935Constitution,anOrdinancewasAppended,provisionsfor

relinquishmentweremade.Pleasereviewtheattachedclippedpage;

PresidentofthePhilippineswiththePresidentoftheUnitedStatesonthefourthofJuly,nineteen

hundredandfortysix,pursuanttotheprovisionsofCommonwealthActnumberedsevenhundred

andthirtythree,butinnocasetoextendbeyondthethirdofJuly,nineteenhundredandseventy

four,thedisposition,exploitation,development,andutilizationofallagricultural,timber,and

minerallandsofthepublicdomain,waters,minerals,coal,petroleum,andothermineraloils,all

forcesofpotentialenergy,andothernaturalresourcesofthePhilippines,andtheoperationof

publicutilities,ifopentoanyperson,beopentocitizensoftheUnitedStatesandtoallformsof

businessenterprisesownedorcontrolled,directlyorindirectly,bycitizensoftheUnitedStatesin

thesamemannerasto,andunderthesameconditionsimposedupon,citizensofthePhilippinesor

corporationsorassociationsownedorcontrolledbycitizensofthePhilippines.

FromtheRATIFICATIONOFTHESameTREATY December10,1898ArticleXIIITheRightofpropertysecuredbycopyrightandpatentsacquiredbySpaniardsintheIslandofCuba

andinPuertoRico,thePhilippinesandothercededterritories,atthetimeoftheexchangeoftheratificationsof

thistreaty,shallcontinuetoberespected.Spanishscientific,literaryandartisticworks,notsubversiveofpublic

orderintheterritoriesinquestion,shallcontinuetobeadmittedfreeofdutyintosuchterritories,fortheperiod

oftenyears,tobereckonedfromthedateoftheexchangedoftheratificationsofthistreaty.

ArticleXIV Spainwillhavethepowertoestablishconsularofficersintheportsandplacesoftheterritories,the

sovereigntyoverwhichhasbeeneitherrelinquishedorcededbythepresenttreaty.

Notwithstanding the foregoing, Amendmentof1987Constitution,ArticleXVI,

Section 2, provides a new nation and government, by the PhilippinesCongress, the

I.P.R.A.8371 , asthePRIMARYGOVERNMENT,SOVEREIGNTY, ratified in1997THIS IS
