AMERICAN CONSERVATIVE UNION FOUNDATION’S 2018 Ratings of New York

Dear Fellow Conservative,

The American Conservative Union Foundation is proud to present our ratings of the 2018 meeting of the New York State Legislature. Like our Ratings of Congress, which date back 47 years, our state ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy i.e., conservatism is the political philosophy that sovereignty resides in the person, and then apply our understanding of government (its essential role is to defend Life, Liberty and Property).

Because our ratings are designed to educate the public about how consistently elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. ACUF state ratings—launched in 2011 with ratings for five states—have become a nationally recognized resource for evaluating over 8,000 elected officials comprising each of America’s 99 state legislative chambers.

Each election cycle, citizens choose leaders whose vision for the state most closely matches their own, hoping that candidates’ promises will be kept. ACUF’s ratings measure whether those promises were fulfilled or forsaken. With nearly a decade of data on state legislators’ voting records and average scores for every legislative chamber, citizens in every state can assess how effectively their lawmakers have applied conservative philosophy to the role of government.

We at ACUF believe, as Ronald Reagan once said, that freedom is never more than one generation away from extinction. We hope that by providing this unique tool, these ratings will empower Americans to exercise their right to protect our unique American democracy from tyranny.

SELECTING THE VOTES

ACU researched and selected a range of bills before the New York State Legislature that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of New York’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. S 7323 Increasing Taxpayer Costs through Adherence to the Davis-Bacon Act. This bill limits competition and drives up taxpayer costs by significantly limiting which contractors may submit bids for public works contracts. Under the bill, contractors are ineligible to bid on a state public works project if they have been disbarred from federal public works projects for not abiding by the Davis-Bacon Act, a Depression-era policy that forces companies contracting with the state to pay their workers above-market wages. ACU has long opposed the Davis-Bacon Act and “prevailing wage” mandates which needlessly drive up taxpayer costs and opposed this bill. The Senate passed the bill on January 8, 2018 by a vote of 61-0.

2. S 7327 Forcing Private Businesses to Provide Bathroom Access. This bill forces private businesses to provide individuals who have Crohn’s disease, ulcerative colitis and other medical conditions access to the business’ bathrooms. Access must be provided even if the bathroom is not open to the general public and is intended for employees only. While ACU sympathizes with those who experience frequent bathroom use resulting from medical conditions, we support private property rights and oppose this government intrusion into private business operations and opposed this bill. The Senate passed the bill on January 9, 2018 by a vote of 61-0.

3. S 365 Improving Fiscal Responsibility by Implementing a Spending Cap. This bill helps protect the state during periods of economic difficulty by implementing a spending cap and bolstering the state’s rainy day fund. Under the bill, spending is capped at the average rate of inflation from the three previous years, and the maximum capacity of the state’s rainy day fund is increased from 3 percent to 10 percent. ACU supports this crucial measure to rein in the state’s out-of-control spending and reduce the fiscal hardship borne by taxpayers during economic downturns and supported this bill. The Senate passed the bill on January 9, 2018 by a vote of 41-20.

4. S 1207 Making the Property Tax Cap Permanent. This bill helps protect property owners from skyrocketing taxes by making permanent a property tax cap which was set to expire. Due to the extension of the cap, which was originally enacted in 2011, increases in property tax levies are limited to 2 percent each year or the rate of inflation. ACU supports this protection to maintain housing affordability and prevent government from pricing families out of their homes and supported this bill. The Senate passed the bill on January 9, 2018 by a vote of 51-10.

5. S 7295 Eliminating Due Process and Expanding Bureaucratic Powers. This bill provides unelected bureaucrats carte blanche authority to take “enforcement action” if they suspect in a dwelling the existence of lead paint which could cause lead poisoning. Specifically, the bill eliminates due process by no longer requiring the Commissioner of Health to hold a formal hearing allowing the accused the opportunity to prove that paint within their property does not pose a health risk. Instead, the bill provides the commissioner or a representative of the commissioner to take whatever enforcement action they deem appropriate. ACU Foundation’s Center for 21st Century Property Rights is a leading voice on this issue and others relating to the protection of real property. ACU supports due process and strong property rights and opposes expanding the powers of unelected government bureaucrats and opposed this bill. The Senate passed the bill on February 12, 2018 by a vote of 59-0.

6. S 722 Increasing Transparency under the Freedom of Information Law. This bill requires the owner or operator of a farm business to be notified if a third-party requests information about their business from the state through the Freedom of Information Law (FOIL). ACU supports increased government transparency and the proper use of FOIL, which is oftentimes abused by third-party advocacy groups to attack businesses and the property rights of business owners, and supported this bill. The Senate passed the bill on March 5, 2018 by a vote of 43-17.

7. S 3698 Ensuring Enforcement of Federal Immigration Laws and Prohibiting “Sanctuary Cities.” This bill prohibits state and local entities from enacting “sanctuary policies” which are designed to obstruct the enforcement of federal immigration laws. The bill requires local authorities to fully cooperate with federal authorities and prohibits state funding to localities that fail to comply. ACU supports efforts to assist the federal government in performing its constitutional role to enforce our nation’s immigration laws and supported this bill. The Senate passed the bill on March 21, 2018 by a vote of 32-29.

8. S 7503 Providing Taxpayer Funding to Abortion Providers, Special Interests and Left-Wing Advocacy. This appropriations bill contains hundreds of pages of funding for programs and initiatives that improperly expand the role of government. Specifically, the bill provides funding for abortion providers such as Planned Parenthood, subsidies and grants that benefit select industries, and millions of dollars in funding to unions and other groups which advocate for left-wing interests. ACU believes abortion is a human tragedy and supports restrictions to end the practice, opposes this bill’s absurd waste and misuse of taxpayer funds for clearly partisan initiatives and opposed this bill. The Senate passed the bill on March 30, 2018 by a vote of 57-1.

9. S 8121 Permanently Revoking Second Amendment Rights for Misdemeanor Crimes. This bill permanently revokes the Second Amendment rights of individuals who have merely committed certain misdemeanor offenses. The bill is extremely wide-sweeping and permanently prevents individuals from possessing a firearm, even after they have paid their debt to society. The Nolan Center for Justice is a leading voice on this issue and works to improve public safety, reduce costs, and ensure the proper administration of justice. ACU supports the founders’ belief in the Second Amendment and opposed this bill. The Senate passed the bill on March 30, 2018 by a vote of 40-19.

10. S 8401 Protecting Taxpayers by Requiring a Super Majority for Tax Increases. This bill helps protect taxpayers from unnecessary tax hikes by requiring a two-thirds majority vote in the Assembly and Senate in order to raise any tax or surcharge. Additionally, if the state legislature empowers a local government to impose taxes, a two-thirds majority vote in the local government is also required. ACU supports reining in rampant and unnecessary spending which harms taxpayers, believes tax increases should only be a measure of last resort and supported this bill. The Senate passed the bill on May 7, 2018 by a vote of 41-21.

11. A 3767 Interfering in the Marketplace by Subsidizing Microenterprises. This bill interferes in the marketplace and improperly utilizes taxpayer funds for the benefit of select organizations and individuals through the establishment of a microenterprise development program. This program provides funding to certain nonprofit organizations, which in turn are supposed to provide assistance primarily to low-income individuals for business startups. ACU is a leading voice in support of entrepreneurship, however, we believe the market is the best mechanism to direct funding and oppose the use of taxpayer funds to provide competitive advantages to certain organizations and businesses favored by the government and opposed this bill. The Senate passed the bill on June 6, 2018 by a vote of 61-0.

12. A 2549 Advancing a Political Agenda through a Wage Disparity Study. This bill forces the state Department of Civil Service to utilize scarce taxpayer resources for a comprehensive study and report examining public employee wage disparities. The study must examine wage disparities by gender, race and national origin through an inconsistent and selective methodology. ACU believes wage discrimination is wrong and any employer who does not properly compensate employees will face repercussions in the marketplace. ACU opposes this measure that is primarily designed to advance a political agenda and subjects the state and taxpayers to additional avenues of unnecessary and costly litigation and opposed this bill. The Senate passed the bill on June 6, 2018 by a vote of 59-2.

13. A 7218 Infringing Parental Rights by Raising the Tanning Age. This bill prohibits all individuals under the age of 18 from obtaining a tan from an ultraviolet radiation device of a tanning facility, even if they have the consent of a parent or guardian. Under previous law, individuals under age 17 were prohibited from obtaining a tan, but individuals ages 17 and 18 were allowed with parental consent. ACU supports protecting parental rights and opposes this government overreach into family decisions and opposed this bill. The Senate passed the bill on June 12, 2018 by a vote of 59-2.

14. S 8821 Ensuring Dignity for Incarcerated Women. This bill helps to maintain safe and sanitary prison conditions by ensuring state correctional facilities provide necessary feminine hygiene products to female inmates. The Nolan Center for Justice is a leading voice on this issue and works to reduce taxpayer costs, improve public safety, and responsibly reduce incarceration rates. ACU supports reducing costs, improving prison health and safety and protecting human dignity and supported this bill. The Senate passed the bill on June 12, 2018 by a vote of 59-2.

15. A 10150 Continuing Cronyism through the Extension of a Solar Energy Tax Break in NYC. This bill extends government interference in the marketplace by extending through 2021 a tax abatement of 5 percent for property owners in New York City who install solar electric generating systems. The 5 percent tax abatement is valid for four years, meaning the bill subsidizes 20 percent of the costs of the solar systems. ACU supports all sources of energy and opposes this government favoritism which shifts tax burdens to other property owners and opposed this bill. The Senate passed the bill on June 13, 2018 by a vote of 60-0.

16. A 8205 Providing Business the Ability to Correct Violations before Being Fined. This bill provides businesses the ability to correct certain regulatory violations before being fined by the state regulatory agency. Additionally, the state must provide literature or an in-person meeting to inform small businesses of regulations impacting them. ACU supports this small effort to provide some relief from government regulatory burdens and supported this bill as a step in the right direction. The Senate passed the bill on June 18, 2018 by a vote of 61-1 but it was vetoed by the governor.

17. S 8380 Hiking Income Taxes to Expand Paid Family Leave. This bill will result in higher income taxes by adding bereavement as a valid use for paid leave under the New York Paid Family Leave Program. This mandatory state-run program provides up to 12 weeks’ paid leave at 67 percent of employees’ average weekly wage. The program is funded by an additional tax on all employee paychecks. ACU believes employees should have the right to negotiate their own benefits and opposes socializing paid leave through a mandatory government program and opposed this bill. The Senate passed the bill on June 19, 2018 by a vote of 61-1 but it was vetoed by the governor.

18. S 5549 Providing Additional Subsidies to Renewable Energy Facilities. This bill provides large-scale renewable energy facilities with subsidies based on each megawatt-hour of electricity they produce. Furthermore, any facility which faces “financial hardship” is eligible for an additional subsidy. ACU supports all sources of energy, believes government should not subsidize producers or favor one source of energy another, supports the full repeal of the state’s upcoming 50 percent renewable energy mandates which will result in skyrocketing energy prices and opposed this bill. The Senate passed the bill on June 19, 2018 by a vote of 62-0.

19. A 10768 Expanding Cronyism through the Creation of a TV Ad Production Tax Credit. This bill expands through 2024 a tax credit provided to companies which produce television advertisements in the state. Under the program, applicants are eligible for subsidies worth as much as 25 percent of their production expenses. ACU opposes providing tax advantages to select companies and industries favored by government, which distorts the free marketplace and shifts tax burdens to other companies and industries not favored by government, and opposed this bill. The Senate passed the bill on June 19, 2018 by a vote of 60-2.

20. A 397 Advancing New York’s War on Tobacco by Prohibiting Smoking and Vaping in Private Homes. This bill advances the state’s war on tobacco and raises childcare costs by prohibiting smoking and vaping in private homes that provide childcare services. The bill prohibits smoking and vaping within the entire home at all times, even while children are absent. ACU opposes this overly broad and overreaching bill that infringes individual liberties and parental rights and opposed this bill. The Senate passed the bill on June 20, 2018 by a vote of 60-0.

21. S 8441 Mandating Health Insurance Coverage of Fertility Services. This bill mandates that all public and private health insurance policies offered in the state provide up to $50,000 in coverage for fertility services, including in vitro fertilization. While ACU sympathizes with those who rely on this coverage, we oppose health insurance mandates which drive up the cost of health care for everyone and restrict the ability for consumers to choose the policies that best suit their needs and opposed this bill. The Senate passed the bill on June 20, 2018 by a vote of 51-9.

22. S 7960 Increasing Taxpayer Costs by Limiting Competition in Government Procurement. This bill unnecessarily drives up taxpayer costs by establishing a new pilot program under the Dormitory Authority of the State of New York which requires up to $25 million of procurement contracts be awarded only to small businesses which are women- or minority-owned. ACU supports equal rights and opportunities under the law for all and opposes government discrimination on the basis of sex or race and opposed this bill. The Senate passed the bill on June 20, 2018 by a vote of 60-0.

23. A 10828 Expanding Affordable Housing and Placing an Additional $1 Billion in Taxpayer Funds at Risk. This bill increases the bonding authority of the New York City Housing Development Corporation from $12.5 billion to $13.5 billion, resulting in an additional $1 billion in taxpayer funds being placed at risk for purposes of financing “affordable housing.” ACU supports efforts to help people live happier, healthier, more productive lives and efforts to reduce intergenerational poverty by encouraging individuals to become self-sufficient. Furthermore, we believe New York City needs to turn to free-market solutions to solve its housing problems and opposes placing even more taxpayer funds at risk of default and competing with the private sector through lending and opposed this bill. The Senate passed the bill on June 20, 2018 by a vote of 60-0.

1. A 9605 Providing Illegal Immigrants Access to Scholarships and Grants. This bill, known as the New York state DREAM Act, establishes a new commission and fund to provide post-secondary education scholarships and grants to those who entered the country illegally. ACU supports assisting the federal government in its constitutional role to enforce our nation’s immigration laws, opposes the use of taxpayer resources to benefit those who entered the country illegally and opposed this bill. The Assembly passed the bill on February 5, 2018 by a vote of 89-44.

2. S 7327 Forcing Private Businesses to Provide Bathroom Access. This bill forces private businesses to provide individuals who have Crohn’s disease, ulcerative colitis and other medical conditions access to the business’ bathrooms. Access must be provided even if the bathroom is not open to the general public and is intended for employees only. While ACU sympathizes with those who experience frequent bathroom use resulting from medical conditions, we support private property rights and oppose this government intrusion into private business operations and opposed this bill. The Assembly passed the bill on February 13, 2018 by a vote of 132-1.

3. S 7323 Increasing Taxpayer Costs through Adherence to the Davis-Bacon Act. This bill limits competition and drives up taxpayer costs by significantly limiting which contractors may submit bids for public works contracts. Under the bill, contractors are ineligible to bid on a state public works project if they have been disbarred from federal public works projects for not abiding by the Davis-Bacon Act, a Depression-era policy that forces companies contracting with the state to pay their workers above-market wages. ACU has long opposed the Davis-Bacon Act and “prevailing wage” mandates which needlessly drive up taxpayer costs and opposed this bill. The Assembly passed the bill on March 5, 2018 by a vote of 127-6.

4. S 7295 Eliminating Due Process and Expanding Bureaucratic Powers. This bill provides unelected bureaucrats carte blanche authority to take “enforcement action” if they suspect in a dwelling the existence of lead paint which could cause lead poisoning. Specifically, the bill eliminates due process by no longer requiring the Commissioner of Health to hold a formal hearing allowing the accused the opportunity to prove that paint within their property does not pose a health risk. Instead, the bill provides the commissioner or a representative of the commissioner to take whatever enforcement action they deem appropriate. ACU Foundation’s Center for 21st Century Property Rights is a leading voice on this issue and others relating to the protection of real property. ACU supports due process and strong property rights and opposes expanding the powers of unelected government bureaucrats and opposed this bill. The Assembly passed the bill on March 5, 2018 by a vote of 101-33.

5. A 2406 Obstructing Second Amendment Rights by Burdening Firearm Purchasers with Unnecessary Delays. This bill obstructs Second Amendment rights by more than tripling the waiting period to 10 business days (previously three) to complete a background check in order to purchase a firearm. Under federal law, those seeking to purchase a firearm must undergo a background check through the National Instant Criminal Background System (NICS). ACU supports the founders’ belief in the Second Amendment, believes the right should not be limited by the incompetence of government to complete “instant” checks and opposed this bill. The Assembly passed the bill on March 6, 2018 by a vote of 121-14.

6. A 1748 Declaring a Fundamental Right to Abortion. This bill, known as the Reproductive Rights Health Act, declares that it is a fundamental right to kill unborn children. Additionally, the bill significantly expands the ability of abortion providers to take the lives of the unborn through the first 24 weeks of pregnancy. ACU believes abortion is a human tragedy, supports restrictions on the practice and opposed this bill. The Assembly passed the bill on March 13, 2018 by a vote of 93-44.

7. S 7503 Providing Taxpayer Funding to Abortion Providers, Special Interests and Left-Wing Advocacy. This appropriations bill contains hundreds of pages of funding for programs and initiatives that improperly expand the role of government. Specifically, the bill provides funding for abortion providers such as Planned Parenthood, subsidies and grants that benefit select industries, and millions of dollars in funding to unions and other groups which advocate for left-wing interests. ACU believes abortion is a human tragedy and supports restrictions to end the practice, opposes this bill’s absurd waste and misuse of taxpayer funds for clearly partisan initiatives and opposed this bill. The House passed the bill on March 30, 2018 by a vote of 118-12.

8. S 8121 Permanently Revoking Second Amendment Rights for Misdemeanor Crimes. This bill permanently revokes the Second Amendment rights of individuals who have merely committed certain misdemeanor offenses. The bill is extremely wide-sweeping and permanently prevents individuals from possessing a firearm, even after they have paid their debt to society. The Nolan Center for Justice is a leading voice on this issue and works to improve public safety, reduce costs, and ensure the proper administration of justice. ACU supports the founders’ belief in the Second Amendment and opposed this bill. The Assembly passed the bill on March 30, 2018 by a vote of 94-34.

9. A 9819 Blocking Offshore Oil and Gas Production. This bill is designed to hinder oil and gas production in federal waters and will result in higher energy costs for all Americans. Under the bill, the Department of Environmental Conservation and other state agencies are prohibited from leasing or conveying any portion of state coastal lands if the action would result in an increase in oil or natural gas production in federal waters. Furthermore, the bill bolsters the prohibition of drilling in state coastal lands. ACU supports all sources of energy and opposes this attack on the Trump administration’s efforts to reduce energy costs and expand economic growth and opposed this bill. The Assembly passed the bill on April 24, 2018 by a vote of 121-8.

10. A 9740 Advancing New York’s War on Lightbulbs. This bill prevents the sale of lightbulbs, also known as compact fluorescent lights (CFLs), that exceed a certain cap on mercury content established by the legislature. ACU opposes this government overreach and control over the way people light their homes, especially considering the legislature previously mandated the use of CFLs in place of traditional bulbs, and opposed this bill. The Assembly passed the bill on April 25, 2018 by a vote of 128-0.

11. A 7218 Infringing Parental Rights by Raising the Tanning Age. This bill prohibits all individuals under the age of 18 from obtaining a tan from an ultraviolet radiation device of a tanning facility, even if they have the consent of a parent or guardian. Under previous law, individuals under age 17 were prohibited from obtaining a tan, but individuals ages 17 and 18 were allowed with parental consent. ACU supports protecting parental rights and opposes this government overreach into family decisions and opposed this bill. The Assembly passed the bill on April 25, 2018 by a vote of 107-19.

12. A 3358 Expanding the Coverage of Hate Crimes. This bill expands New York’s hate crime statute to include “gender identity and expression.” ACU believes this kind of legislation violates the “double jeopardy” clause of the U.S. Constitution and opposes attempts to determine people’s thoughts when they commit a crime and opposed this bill. The Assembly passed the bill on May 7, 2018 by a vote of 96-43.

13. A 397 Advancing New York’s War on Tobacco by Prohibiting Smoking and Vaping in Private Homes. This bill advances the state’s war on tobacco and raises childcare costs by prohibiting smoking and vaping in private homes that provide childcare services. The bill prohibits smoking and vaping within the entire home at all times, even while children are absent. ACU opposes this overly broad and overreaching bill that infringes individual liberties and parental rights and opposed this bill. The Assembly passed the bill on June 4, 2018 by a vote of 134-1.

14. A 10150 Continuing Cronyism through the Extension of a Solar Energy Tax Break in NYC. This bill extends government interference in the marketplace by extending through 2021 a tax abatement of 5 percent for property owners in New York City who install solar electric generating systems. The 5 percent tax abatement is valid for four years, meaning the bill subsidizes 20 percent of the costs of the solar systems. ACU supports all sources of energy and opposes this government favoritism which shifts tax burdens to other property owners and opposed this bill. The Assembly passed the bill on June 11, 2018 by a vote of 137-1.

15. S 8821 Ensuring Dignity for Incarcerated Women. This bill helps to maintain safe and sanitary prison conditions by ensuring state correctional facilities provide necessary feminine hygiene products to female inmates. The Nolan Center for Justice is a leading voice on this issue and works to reduce taxpayer costs, improve public safety, and responsibly reduce incarceration rates. ACU supports reducing costs, improving prison health and safety and protecting human dignity and supported this bill. The Assembly passed the bill on June 12, 2018 by a vote of 141-0.

16. A 4738 Completing the Socialization of Health Care. This bill completely socializes health care in New York by establishing a single-payer system. Under the bill, health care, including vision and dental (without deductible or copay), is provided to everyone regardless of income, employment or any other qualification. Furthermore, the bill bans all private insurance and imposes a progressive payroll tax, of which at least 80 percent will be paid by employers. ACU has long opposed Obamacare and its disastrous mandates which have led to skyrocketing health care costs, believes this call to socialize health care is absurd and opposed this bill. The Assembly passed the bill on June 14, 2018 by a vote of 91-46.

17. A 8205 Providing Business the Ability to Correct Violations before Being Fined. This bill provides businesses the ability to correct certain regulatory violations before being fined by the state regulatory agency. Additionally, the state must provide literature or an in-person meeting to inform small businesses of regulations impacting them. ACU supports this small effort to provide some relief from government regulatory burdens and supported this bill as a step in the right direction. The Assembly passed the bill on June 14, 2018 by a vote of 138-0 but it was vetoed by the governor.

18. A 10828 Expanding Affordable Housing and Placing an Additional $1 Billion in Taxpayer Funds at Risk. This bill increases the bonding authority of the New York City Housing Development Corporation from $12.5 billion to $13.5 billion, resulting in an additional $1 billion in taxpayer funds being placed at risk for purposes of financing “affordable housing.” ACU supports efforts to help people live happier, healthier, more productive lives and efforts to reduce intergenerational poverty by encouraging individuals to become self-sufficient. Furthermore, we believe New York City needs to turn to free-market solutions to solve its housing problems and opposes placing even more taxpayer funds at risk of default and competing with the private sector through lending and opposed this bill. The Assembly passed the bill on June 18, 2018 by a vote of 107-33.

19. A 10474 Extending and Increasing Solar Energy Subsidies through Net Metering. This bill extends through 2021 the state’s net metering law and increases the amount of energy created by solar producers that is eligible for subsidies, which are funded by higher electricity rates imposed on other ratepayers. Due to the bill, solar energy producers can produce up to 5 megawatts (previously 1 megawatt) of power and remain eligible for above-market rate payments for the excess power they return to the grid. Furthermore, the bill expands the law to include “community” net metering, commonly referred to as “solar gardens,” which involve the production of solar energy at locations far-removed from the community using the energy. ACU opposes net metering programs that result in one set of ratepayers subsidizing others, opposes government favoring one source of energy over another and opposed this bill. The Assembly passed the bill on June 19, 2018 by a vote of 122-17.

20. A 10768 Expanding Cronyism through the Creation of a TV Ad Production Tax Credit. This bill expands through 2024 a tax credit provided to companies which produce television advertisements in the state. Under the program, applicants are eligible for subsidies worth as much as 25 percent of their production expenses. ACU opposes providing tax advantages to select companies and industries favored by government, which distorts the free marketplace and shifts tax burdens to other companies and industries not favored by government, and opposed this bill. The Assembly passed the bill on June 19, 2018 by a vote of 108-37.

21. S 8380 Hiking Income Taxes to Expand Paid Family Leave. This bill will result in higher income taxes by adding bereavement as a valid use for paid leave under the New York Paid Family Leave Program. This mandatory state-run program provides up to 12 weeks’ paid leave at 67 percent of employees’ average weekly wage. The program is funded by an additional tax on all employee paychecks. ACU believes employees should have the right to negotiate their own benefits and opposes socializing paid leave through a mandatory government program and opposed this bill. The Assembly passed the bill on June 20, 2018 by a vote of 111-32 but it was vetoed by the governor.
