Dear Fellow Conservatives,
We are pleased to present the American Conservative Union Foundation’s ratings for the 2016 meeting of the Wisconsin State Legislature. Like our Congressional Ratings, our State Ratings reflect how elected officials view the role of government in an individual's life. The Wisconsin legislators with the highest scores voted most consistently with the ideals articulated in the U.S. Constitution: limited and transparent government, individual rights, personal responsibility, and lasting cultural values.
In 2015, ACU Foundation was proud to make history by being the first organization to rate every single state legislature across the full spectrum of issues, helping each voter understand how his or her state ranks among the rest.
Ultimately, we are trying to help people understand what conservatism is and how it improves the lives of everyday Americans. Conservatism is the political philosophy that sovereignty resides in the person. We think that understanding this idea is essential if Americans are to successfully govern themselves again.
Working with our policy centers and fellows, the ACU Foundation engages in deep policy analysis to help create our annual state scorecards. We have enhanced the vote descriptions this year to show this effort more clearly.
By examining all 50 of our State Ratings, we can see which states have most effectively promoted conservative solutions and which have struggled. Our ratings also help identify legislators who have courageously fought against liberal majorities. We hope that this guide helps you learn how well, or poorly, your legislators work to preserve the values we share.

SELECTING THE VOTES
ACU researched and selected a range of bills before the Wisconsin State Legislature that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Wisconsin’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. AB 310 Taxpayer Funded Abortion. This bill directs that state funds for family planning services and health services only go to organizations that do not provide abortions, do not make referrals for abortions, and do not have affiliates that provide or make referrals for abortions. ACU believes abortion is a human tragedy, supports restrictions on the practice, and supported this bill. The Senate passed the bill on January 20, 2016 by a vote of 19-14.
2. AB 373 Civil Service Reform. This bill reforms the state’s civil service rules in a number of ways, including replacing the civil service exam with resume-based hiring, increasing the length of probation for new employees, and changing layoff guidelines to emphasize job performance rather than seniority as a contributing factor. The bill also prohibits agencies from asking on an employment application whether an applicant has a criminal record. ACU supports reform that serves the taxpayer rather than the bureaucracy and supported this bill. The Senate passed the bill on January 20, 2016 by a vote of 19-14.
3. SB 238 Medicaid Reimbursement Reform. This bill requires family planning clinics to limit their billing to the state’s Medicaid program for prescription drugs to the actual cost of acquiring the drugs in addition to the dispensing fee. ACU supports Medicaid reform and supported this bill. The Senate passed the bill on January 20, 2016 by a vote of 19-14.
4. SB 449 Teacher Hiring Flexibility. This bill eases rigid regulations on teaching requirements for vocational education. It eliminates the requirement for a teaching license and replaces it with a point system that takes into account appropriate college degrees and knowledge of the subject matter being taught. According to the ACU Foundation’s Family Prosperity Index, educational attainment is an important cultural value that yields substantial economic returns for families and for states. ACU supports flexibility in hiring the best teachers and supported this bill. The Senate passed the bill on February 9, 2016 by a vote of 19-13.
5. SB 422 Franchise Regulations. This bill establishes that under state employee law franchise holders’ employees are not employees of the central franchise owner or corporation. This is in response to a National Labor Relations Board ruling, saying that the home company of the franchise is the employer of every single employee in each individual franchise. ACU opposes the NLRB's politically motivated rulings which harm employment opportunities and supported this bill. The Senate passed the bill on February 9, 2016 by a vote of 19-13.
6. AB 384 Nuclear Power Regulations. This bill ends the 33-year moratorium on new nuclear reactors, which was put in place following the 1979 Three Mile Island accident in Pennsylvania. ACU supports all forms of energy, believes government should not support one form of energy over another, and supported this bill. The Senate passed the bill on February 16, 2016 by a vote of 23-9.
7. SB 459 Waterfront Development. This bill eases regulations on property owners’ ability to build on wetlands by changing the state’s method used to approve a project. Builders will now be permitted to build on wetlands they own rather than force the builders to purchase non-wetland land for their project, as had been the law in the past. ACU supports strengthening property rights and supported this bill. The Senate passed the bill on February 16, 2016 by a vote of 19-13.
8. SB 503 Sales Tax Reform. This bill simplifies Wisconsin’s complex sales tax system for building contractors so that taxes on “real property” and “personal property” will be harmonized. Currently, items inside the building are classified as “personal property” and the sales tax has to be charged in a separate transaction with the customer. Under this bill, the building contractor will pay the sales tax at the time of purchase. Research based on the ACU Foundation’s Family Prosperity Index shows that reducing tax burdens increases economic growth, which increases family prosperity. ACU supports this common sense tax reform and supported this bill. The Senate passed the bill on February 16, 2016 by a vote of 19-13.
9. SB 533 Illegal Immigrant Benefits. This bill prohibits local governments from issuing illegal immigrants identification cards that can be used to obtain government benefits. ACU opposes special benefits for illegal immigrants and supported this bill. The Senate passed the bill on February 16, 2016 by a vote of 19-13.
10. AB 568 Property Rights Reform. This bill reforms a number of property rights laws, including strengthening the right of landlords to evict tenants for criminal activity and banning local governments from forcing property owners to preserve the “special character” or “historic” interest of the property. ACU Foundation’s Center for 21st Century Property Rights engages heavily on this issue and supports strengthening property rights and ACU supported this bill. The Senate passed the bill on February 16, 2016 by a vote of 19-13.

11. SB 407 Fiscal Responsibility. This bill requires that every state agency must submit a proposal to reduce their state operations budget by 5 percent and a second proposal that would hold their budget levels flat. ACU strongly supports this fiscally responsible approach to government spending and supported this bill. The Senate passed the bill on February 16, 2016 by a vote of 19-13.
12. AB 730 Container Bans. This bill prohibits local governments from banning or restricting “auxiliary containers,” which are defined as a bag, cup, bottle or other packaging. ACU believes government should not limit people’s choices on how they take their groceries home and supported this bill. The Senate passed the bill on February 16, 2016 by a vote of 19-13.
13. AB 25 Appliance Regulation. This bill prohibits the state’s Department of Natural Resources from promulgating a rule or enforcing a federal rule that changes performance or emission standards for commercial or residential wood burning heaters beyond those in effect as of December 31, 2014. ACU opposes the continuous increase in energy mandates on appliances, mandates that drive up the cost to consumers, and supported this bill. The Senate passed the bill on March 15, 2016 by a vote of 19-13.
14. SB 615 School Choice. This bill expands a school voucher program that allows disabled students attending public school to receive a $12,000 scholarship to attend a private school and prohibits local schools from raising taxes to “offset” losses of revenue from the program. According to the ACU Foundation’s Family Prosperity Index, higher taxes and government spending reduce personal income and private sector job growth, thereby undermining family self-sufficiency and the economy. ACU supports school choice and supported this bill. The Senate passed the bill on March 15, 2016 by a vote of 19-13.
15. AB 720 Foreclosure Regulations. This bill gives lenders a yearlong period with which to sell a property in foreclosure. This reverses previous legislation that allowed local governments to force a quick sale, making it harder for lenders to get value for their investments. ACU supports strengthening property rights and supported this bill. The Senate passed the bill on March 15, 2016 by a vote of 18-14.
16. AB 901 Government Funding of the Arts. This bill provides additional funds to the Wisconsin Arts Board to obtain a matching grant from the National Endowment for the Arts. ACU does not believe funding for the arts is a proper role for government and opposed this bill. The Senate passed the bill on March 15, 2016 by a vote of 29-3.

1. AB 647 Broadband Subsidies. This bill accelerates the expansion of a government program to subsidize high speed internet services in “underserved” areas by removing the annual cap on Public Service Commission grants. ACU opposes this interference in the free market that drives of the cost of internet service for those not receiving government funds and opposed this bill. The Assembly passed the bill on February 11, 2016 by a vote of 81-15.

This bill penalizes so-called “sanctuary cities” – local governments that prevent officers from reporting the immigration status of those charged with a crime – by reducing state aid a certain amount each day the policy is in place. ACU supports enforcement of our immigration laws and supported this bill. The Assembly passed the bill on February 16, 2016 by a vote of 62-35.
7. SB 533 Illegal Immigrant Benefits. This bill prohibits local governments from issuing illegal immigrants identification cards that can be used to obtain government benefits. 8. AB 669 Corporate Welfare Fraud. This bill creates criminal penalties for fraudulently obtaining benefits, such as grants, loans, and tax breaks, from the Wisconsin Economic Development Corporation. ACU opposes these corporate welfare programs that often have little oversight and supported this bill. The Assembly passed the bill on February 16, 2016 by a vote of 63-35.
