You are required to prove your case If the Commission finds that the report was filed timely or that there were unusual circumstances that excused the failure, it may waive the fine, in whole or in part The Commission may reduce a fine after considering the factors in Section 106.265, Florida Statutes.. If the Commission finds that the rep01t was not timely filed and there were no unusual circumstances, the fine will be upheld

THIS MATTER was heard by the Flo1ida Elections Commission (Commission) at its

regularly scheduled meeting on Febrnary 26, 2014, in Tallahassee, Flo1ida

Based on the Complaint, Repo1t of Investigation, Staff's Recommendation, and oral

statements (if any) made at the probable cause hearing, the Commission finds that there is

probable cause to charge Respondent with the following violation:

On or about Febrnary 4, 2013, Respondent violated Section 106 141(1), Flo1ida Statutes, when he failed to file his 2012 Te1mination Report reflecting the disposition of all remaining campaign funds ..

As the Respondent, you may elect to resolve this case in several ways .. When I took upon myself to enter the campaign for Pinellas Co ity Sheriff, I maintained at the

time and do to this date that no other candidate in the campaign was q alified to enter the race

because the Florida Constitution maintains that there must be separati i of powers between the Executive, Legislative and Judicial branches of the government,, When t ~ Florida Supreme Court

undertook to make every lawyer who is a member of the Florida Bar in ne State of Florida a member of the Judicial branch, they thereby excluded any lawyer from becoming a tnember of the Executive or Legislative branches. The Florida Bar has a monopoly on the judicial bri ch, which is bad enough, but to also deny the checks and balances in the legislative and executive bran 1es would create a tyranny in

our state.

I entered the race to bring public awareness to this critical issu• I accepted no financial backing

for my campaign and my campaign was my own, Because I still believe was the only legitimate

STAFF RECOMMENDATION FOLLOWING INVESTIGATION

Pursuant to section I 06 25( 4 )( c ), Florida Statutes, under signed staff counsel files this written recommendation for disposition of the complaint in this case recommending that there is probable cause to charge Respondent with violating Section 106.141(1), Florida Statutes Based upon a thorough review of the Report of Investigation submitted on December 2, 2013, the following facts and law support this staff recommendation:

1. On March 25, 2013, the Florida Elections Commission ("Commission") received a sworn complaint from Deborah Clark ("Complainant") alleging that Greg S Pound (''Respondent") violated Chapter 106, Florida Statutes ..

2 Respondent was a candidate for Pinellas County Sheriff in the 2012 election cycle ..

3 By letter dated September 11, 2013, the Executive Director notified Respondent that Commission staff would investigate the following statutory provision:

Section 106.141(1), Florida Statutes: Greg Pound, candidate for Pinellas County Sheriff in the 2012 general election, failed to file his 2012 Termination Report reflecting the disposition of all remaining funds, as alleged in the complaint

4 Respondent filed his Appointment of Campaign I reasurer and Designation of Campaign Depository form ("DS-DE 9") with the Pinellas County Supervisor of Elections office on May 26, 2011, and designated himself as Treasurer .. (ROI Exhibit 1)1

5 Scott Kirby, Pinellas County Elections Administrator, sent an email reminder on December 21, 2012, and on January 24, 2013, to all 2012 Genernl Election Candidates & Treasurers, including Respondent, and reminded them that the I ermination Report was due in the Elections Office no later than February 4, 2013 The email also informed Respondent that he could file his I ermination Report any time and that he did not have to wait until the deadline to submit the report. (ROI Exhibits 2 & 3)

6 On F ebrnary I, 2013, Scott Kirby sent a third email reminder to "Greg Pound -2012 Candidate for Sheiiff," and all the othe1 Geneial Election Candidates & Treasm ers, info1ming them that the 2012 After Geneial Election Treasmer' s Te1mination Repoit was due in the Elections Office no later than Monday, Febrnary 4, 2013 However, it is unclear whethe1 the reminde1 was sent to the email address Respondent piovided on his DS-DE 9 form (ROI Exhibit 4)

7 Despite having received three email reminde1s fiom the Pinellas County Supervisor of Elections office, Respondent failed to file his 2012 Termination Repoit on Febrnary 4, 2013 (ROI Exhibit 6)

8 On Febrna1y 5, 2013, Scott Kirby sent Respondent another email reminding him that he needed to come in and sign his Termination Repoit because it was late. (ROI Exhibit 5)

9.. By letters dated Febrnary 8, 2013, and Febrnary 22, 2013, Respondent's filing office1 informed him that it had not received his 2012 Genernl Election Termination Report The February 22, 2013, lette1 was sent via ce1tified mail and both letters were mailed to the address Respondent listed on his DS-DE 9 fo1m (ROI Exhibits 6 & 7)

11. "P1obable Cause" is defined as reasonable grounds of suspicion suppo1ted by circumstances sufficiently strong to war1ant a cautious pe1son in the belief that the person has committed the offense charged .. Schmitt v. State, 590 So 2d 404, 409 (Fla .. 1991) Piobable cause exists where the facts and circumstances, of which an [investigator] has 1easonably trustwo1thy info1mation, are sufficient in themselves fo1 a reasonable man to reach the conclusion that an offense has been committed Department of Highway Safety and Motor Vehicles v Favino, 667 So 2d 305, 309 (Fla .. I st DCA 1995)..

Despite having received three email reminders from his filing officer, Respondent still has not filed his 2012 Termination Report

2. On May 26, 2012, Respondent filed his Appointment of Campaign Treasurer and Designation of Campaign Depository (DS-DE 9) form, appointing himself as his campaign treasurer To review a copy of the DS-DE 9 form, refer to exhibit 1

3. Complainant is the Pinellas County Supervisor of Elections, and Respondent's

5 Complainant states that Respondent was notified prior to the due date that his termination report was required, and was notified again when the report became overdue

6 On December 21, 2012, Complainant sent Respondent an email reminding him of the requirement to file a 2012 TR Report. "The only report you are now required to file is your "After General Election Treasurer's Termination Report". This termination report is due in the Elections Office no later than Monday, February 4, 2013" This email was sent to the email address that Respondent provided on his DS-DE 9 form To review a copy of this December 21,

8. On February 1, 2013, Complainant sent Respondent another reminder email regarding his 2012 TR Report with delivery confirmation .. This email required Respondent to confirm receipt by replying to the email "This method of confirmation shall serve as proof of delivery" To review a copy of this February 1, 2013 email with confirmation email, refer to exhibit 4.

On February 5, 2013, Complainant sent Respondent an email in regards to two telephone conversations that they had regarding the 2012 TR Report "As per conversation on Friday and Monday you were to come in to sign your Treasurer's Report Your report is now late When do you intend to sign and submit your report? Please let me know ASAP " This email was also sent to the email address that Respondent provided on his DS-DE 9 form To review a copy of this February 5, 2013 email, refor to exhibit 5

10. On February 8, 2013, Complainant sent Respondent a failure-to-file letter informing him that his 2012 TR Report had not been received. This letter was sent to the address Respondent provided on his DS-DE 9 form.. This letter included the various methods that Complainant used to make Respondent aware of the requirement to file his 2012 TR Report To review a copy of this February 8, 2013 letter, refer to exhibit 6.

11 On February 22, 2013, Complainant sent Respondent a second failure-to-file letter informing him that his 2012 TR Report had not been received .. This letter was also sent to the address Respondent provided on his DS-DE 9 form This letter also included the various methods that Complainant used to make Respondent aware of the requirement to file his 2012 TR Report. To review a copy of this February 22, 2013 letter, refer to exhibit 7

12 In a November 26, 2013 telephone interview with Ms Jewel Marcus, Respondent's deputy filing officer, I was advised that Respondent still has not filed his 2012 TR Report that was due on February 4, 2013

the ruling bodies of Pinellas County Government from County Attorney's Office, to the County Commissioners, and the other leaders. According to Florida law, constitution, and facts, we have an illegal Sheriff~ along with illegal County Commissioners all refusing to abide by the rule of law. Section 3, called the "separation-of~power clause," a person cannot be a member of the judicial branch and hold an office in another branch If you do not understand, then read the Federalist

to keep the people we put into power from getting a monopoly over the people for whom they work, We the People. In the Florida Constitution, lawyers are prohibited frnm running for this

Constitutional office of Sheiiff It's a conflict of interest. So I filed a notice and complaint of civil rights violations under the Florida Constitution and criminal complaint for knowingly acting

under the false pretences of being legal Candidates for Sheriff, also citing Deborah Clark, Supervisor of Elections, for the authorization of these Candidates.

Florida Supreme Court has ruled, Lawyers who are members of the Florida Bar are barred legally from running for public office in the executive and legislative branches. The Constitution prohibits them from running for mayor, commissions, school board, sheriff, the Legislature of any other elected office that is not part of the judidal branch of government. ... Florida Bar was "unified" with, and became a part of the Supreme Court. A candidate;! who withdraws, becomes unopposed, Is defeated or elected to office must, within 90 days, dispose of funds in the campaign account and file a campaign treasurer's report reflecting the disposition of funds {Termination Report). The report must Include the following information:

• 1he name and address of each person or unit of government to whom any of the funds were distributed and the amounts;

• The name and address of each person to whom an expenditure was made together with the amount and purpose; and

I am the only legal candidate for Sheriff in Pinellas County. And I have made that assertion to the ruling bodies of Pinellas County Government from County Attorney's Office, to the County Commissioners, and the other leaders According to Florida law, constitution, and facts, we have an illegal Sheriff, along with illegal County Commissioners all refusing to abide by the mle of law. They believe the law only applies to the people, not them, because they are in power.. This may sound bizarre, but this is what we are dealing with in Pinellas County government By finding one of their puppet judges to wave the gavel and say it's o . .k. I said not just no, but I said, "Hell No " I refused to go along--to get along with conuption, and I refuse to resign my campaign for Sheriff. I am still the only legal candidate in this race .. I have talked with judges, lawyers, and law professors and they all agree.. These people are out of control. And I have talked with yom lawyer for the Election Office, although I cannot now recall his name ..

Article II, Section 3 of our Constitution is not rocket science Children can understand the concept of separation of powers, it's like having a mommy, a daddy, and GOD. Why has the Elections Commission waited this long to move on this issue or case? Is it to allow those I have raised the issues toward to get in the seat of power .. I have asked you to please look at the law, and I pray you will make time to read what you might not be aware of~-what is going on in this part of the State of Florida I know you w01k with over 67 counties in Flolida. Pinellas County leads the State, and the whole Country in illegal pharmaceutical drugs being sold through dmg mills, I'm talking big dollars--like millions .. This might sound a little crazy, but I believe Yahweh, the GOD of Israel has fixed this Sheriff's race such that I will be by law the Sheriff in Pinellas County, to clean up the conuption in Pinellas County Government, to be an example to

the rest of the State of Florida and the United State of true reform in government.

In the Florida Constitution, lawyers are prohibited from running for this Constitutional office of Sheriff. It's a conflict of interest So I filed a notice and complaint of civil rights violations under the Florida Constitution and criminal complaint for knowingly acting

under the false pretences of being legal Candidates for Sheriff, also citing Debornh Clark, Supervisor of Elections, for the authmization of these Candidates.

Florida Supreme Comt has ruled, Lawyers who are members of the Florida Bar are baned legally from running for public office in the executive and legislative branches .. The Constitution prohibits them from mnning for mayor, commissions, school board, sheriff, the Legislature of any other elected office that is not part of the judiCial branch of government.. ... In 1949 the

Flmida Bar was "unified" with, and became a part of the Supreme Court. an illegal Sheriff; along with illegal County Commissione1s all refusing to abide by the mle of

law .. They believe the law only applies to the people, not them, because they are in power. This

may sound bizaire, but this is what we are dealing with in Pinellas County gove1nment. By

finding one of their puppet judges to wave the gavel and say it's o.k. I said not just no, but I said,

"Hell No." I refused to go along--to get along with couuption, and I refuse to resign my

campaign for Sheriff. I am still the only legal candidate in this 1ace.. I have talked with judges,

lawyers, and law professo1s and they all agiee.. These people are out of control. And I have

talked with your lawyer for the Election Office, although I cannot now recall his name ..

Aiticle ll, Section 3 of our Constitution is not rocket science .. Children can unde1stand the

concept of separation of powers, it's like having a mommy, a daddy, and GOD. Why has the

Elections Commission waited this long to move on this issue or case? Is it to allow those I have

raised the issues toward to get in the seat of power .. I have asked you to please look at the law,

and I pray you will make time to read what you might not be aware of--what is going on in this

part of the State of Florida. I know you work with over 67 counties in Florida .. Pinellas County

leads the State, and the whole Country in illegal pharmaceutical drugs being sold through d!ug

mills, I'm talking big dollars--like millions .. This might sound a little crazy, but I believe

Yahweh, the GOD oflsrael has fixed this Sheiiffs race such that I will be by law the Sheriff in

Pinellas County, to clean up the conuption in Pinellas County Government, to be an example to

the rest of the State of Florida and the United State oftme refo1m in govemment.

I have been exposing in and working with Pinellas County community gioups, trying to clean up

the organized crime of our leade1s for over nine years. We have found absolute power absolutely

conupts, like our commissioners refusing to step down after then te1m expiies .. If have time, read

the newspaper reports on this case regarding our commissioners having no respect for law, but

they control eve1ything in the County .. But consider how much money the Sheriff gets, along

with the courts, and eveiyone else within the system. There is a financial incentive .. And they

have done everything but kill me It's time to get outside help; we need your help ..

The three candidates that ran against me were lawyers, and in the Florida Constitution Article II,

Section 3, called the "separation-of-power clause," a person cannot be a membei· of the judicial

branch and hold an office in another branch .. If you do not understand, then read the Federnlist

Papers 10 and 5L This will help you understand why this concept was put into our constitution··­

to keep the people we put into power from getting a monopoly over the people for whom they

work, We the People .. In the Flolida Constitution, lawyers ar·e prohibited from xunning for this

Constitutional office of Sheriff. It's a conflict of interest So I filed a notice and complaint of

civil lights violations under the Florida Constitution and criminal complaint for knowingly acting

under the false pretences of being legal Candidates for Sheriff, also citing Deborah Clark,

Supervisor of Elections, for the authoiization of these Candidates ..

The Florida Constitution's separation-of-powers clause, Article II, Section 3, is unambiguous .. It

states: "NO person belonging to one branch shall exeicise any power appertaining to either of the

. other two branches." The key to the knowledge oflaw is truth .. The truth never changes; it's the

same yesterday, today, and forever. And it applies equally to all people .. In out country and our

county, the Constitution is the supreme law of our country. But this law, while being the supreme

law of the land, will always be subject to the laws "ofnatur·e and natur·e's GOD." Everyone in

governmental office 01 civil service takes the following oath to defend the Constitution, which is

a contract between the people and those that wo1k in government for the people, "I do solemnly

affum that I will support and defend the Constitution of the United States against all enemies,

foreign and domestic, and that I will bear true faith and allegiance to the same " Our republic is a

ttipartite conception: legislative, executive, and judicial .. It will not succeed if the people who ar·e

supposed to be in office to defend justice, but ar·e there for personal gain ..

These leaders in Pinellas County think they are above the law. Please, Google the News Articles

"Term Limits do not apply to Pinellas County Government." The County Commissioners have

passed their te1m limits and refuse to step down, and the ex-Sheiiff had three of his lawyer [liars

and criminal soul mates] friends running to cover-up the monies that have been going out the

back door. As my mother in-law has verified through words to me as the Compttuller for the

past thirty years. Deputy George A. Loeffler, said to the Executive Staff of the Sheriff's Dept.,

for telling the people of Pinellas County about Bob Gualtieri and Scott Swope illegally running

for the SherifP s Office.. I want justice restored this why I have run for sheiiff twice, because of

the conuption in our local government. These people have no check and balance, and no free

speech in a free speech zone ..

Commissioners [that term limits do not apply to ] My Mother in-law, as Comptroller for thirty

years, just retired, but is still active in Pinellas Government coveting-up millions of tax dollars

going out the of the County into their pockets .. In the first race I ran for Sheriff was in 2008

against Jim Coats .. As I was exposing the conuption of money laundering, along with all kinds of

sexual crimes against children being used for sex crimes, like Bernie McCabe, or Judge Dowdy

sitting in court, hearing court cases, looking at child porn, while hooked to a penis pump.. You

couldn't make the stuff up. This has been going on for year·s because no one is willing stop it

Establishing an Office Account- F.S.106.141(5)

A candidate elected to office or a candidate who will be elected to office by virtue of being unopposed may, in addition to disposing of all the funds in the campaign account in accordance with F.S. 106 141(4), transfer funds from the campaign account to an office account up to the limits listed below:

• $5,000 for a candidate for multicounty office; • $5,000 multiplied by the number of years in the term of office for which elected, for a candidate for

legislative office; • $2,500 multiplied by the number of years in the term of office, for a candidate for county office orfor a

candidate for any election conducted on less than a countywide basis;

• $6,000 for a candidate for retention as a justice of the Supreme Court; • $3,000 for a candidate for retention as a judge of a district court of appeal;

• $1,500 for a candidate for circuit or county court judge.

Filing the Termination Report- F.S. 106.141(1) & (l)(a)

A candidate who withdraws, becomes unopposed, is defeated or elected to office must, within 90 days, dispose offunds in the campaign account and file a campaign treasurer's report reflecting the disposition of funds (Termination Report) .. The report must include the following information:

• The name and address of each person or unit of government to whom any of the funds were distributed

and the amounts; • The name and address of each person to whom an expenditure was made together with the amount and

purpose; and • The amount of such funds transferred to an office account together with the name and address of the

bank in which the office account is located. • If a refund check is received after the campaign account is closed and all surplus funds have been

disposed of, the check may be endorsed by the candidate and the refund disposed of pursuant to FS. 106,141 An amended termination report must be filed with the appropriate filing officer showing the

refund and disposition.

F.S. 106.07(8)(b) states the fine for filing a late termination report is $50 per day for each day late, not to exceed 25% of the total contributions or expenditures, whichever is greater for the period covered by the

late report.
