XIII. Status of cases in connection with Sabarimala &

Ban of Pan Masala & Gutkha Sabarimala: As per the directions in the judgement on SCCR No.1 of 2012 of the Hon’ble High Court of Kerala, permanent food testing lab has been set up at Sannidhanam & Pampa for the analysis of raw materials used for Appam, Aravana prasadam and samples of aravana prasadam with the financial and infrastructural support of Travancore Devaswom Board. Commissioner of Food Safety has visited Sabarimala on 19.06.2012 to implement the directions contained in the order of Hon’ble High Court of Kerala. A detailed letter in this regard have been sent to Commisisoner of Devaswom board for taking immediate steps for the modifications of Appam, Aravana plant and the for the setting up of permanent testing lab and posting of staff in the lab, purchase of raw materials conforming the standards laid down in the Food Safety & Standards Act, 2006 to maintain quality etc. The list of equipment, glasswares and chemicals required for the new testing lab at Sannidhanam & Pampa has been forwarded to TDB. Pan Masala & Gutkha Ban:

Commissioner of Food Safety, Kerala has banned Pan Masala and Gutkha containing tobacco and/or Nicotine under clause.2.3.4 of the Food Safety & Standards (Prohibition & Restriction on Sales) Regulation, 2011 in the State of Kerala on 22.05.2012.

Now there are 10 writ petitions challenging the validity of the provisions contained in Regulation 2.3.4, are pending before the Single bench of the Hon’ble High Court of Kerala above ban order. In the same time, while disposing a Public Interest Litigation, the division bench of Hon’ble High Court has issued strict direction for the enforcement of the said order.
