Rejection hurts. But the pain is magnified when rejection is unexpected or proves costly.

According to a recent survey by the National Association of Realtors, 15 percent of buyers are being rejected for a mortgage after they’ve submitted a purchase contract on a particular home.

That means they have paid good money to formally apply for a loan, which typically involves a fee of several hundred dollars for an appraisal on the home the borrower

wants to purchase.Sometimes, rejection

even happens at the eleventh hour, upending moving plans. “I have seen [lending firms] decide not to wire the money when everyone is sitting at the closing table,” observes Paul Logan, president of the Pennsylvania Association of Mortgage Brokers.

To be sure, in this ultra-conservative, post-credit-collapse era, some homebuyers do everything right, only to find out that a lender decides it would be wrong to give them a

loan. Here, a look at ways to reduce the risk of a rejection blindsiding your homebuying plans:

Pre-approval is Conditional

While to a layman’s ear the terms “qualified” and “conventional” both convey eligibility, in the mortgage-lending business there’s a stark difference: When someone is “pre-qualified,” it means that chances are pretty good they can get a loan of a certain size, but when

they’re “pre-approved” it looks more certain.

When a real estate is working with a buyer, the agent should make sure the buyer has a reliable pre-approval for a certain loan amount so that they know to look at homes in a particular price range, asserts John Sullivan, past president of the National Association of Exclusive Buyers Agents.

Although most lenders will pre-approve a customer for free, they should give the

process scrutiny, running customers information through an underwriting program and probably verifying data by asking for pay stubs and other documents, adds Neil Caron, vice president of Freedom Mortgage in Mount Laurel, N.J.

Still, a pre-approval is a snapshot of the borrower as he embarks on home shopping. Sometimes, borrowers trip up their chances for a loan by making changes in their financial life, by adding big charges to their credit cards, for instance, or taking out another loan, such as for a new car.

Sugarcoating Can Go Sour

Borrowers want to look good to a lender, but polishing the facts so that the truth is fuzzy doesn’t benefit anyone.

Be precise about all the numbers, lenders advise. And, remember that an approval is really stronger when the lender does at least a cursory verification of your credit, income and other factors.

Knowing that borrowers are often sensitive about bearing their financial souls, Jack Guttentag, who runs the website www.mtgprofessor.com, has developed a free pre-qualification tool. “It’s

designed to let you see where you stand,” he says. “And it will offer [links] that give information on remedying your weaknesses.”

Agents Should Spot Trouble

Financing also can fall through because of the property, not the borrower.

“Say, for instance, the appraisal finds there is chipped paint,” says David McIlvaine, a broker with Keller Williams in Ellicott City, Md.

“When a buyer is getting an FHA loan, or even some conventional loans, they won’t be approved until that’s fixed.” Experienced agents should spot such trouble before a borrower submits his formal loan application, McIlvaine says.

Will Sellers Share the Pain?

No matter how careful a buyer and his agent may be, rejection can still come unexpectedly.

So can buyers minimize the hurt of rejection by having sellers pick up the costs? “You can ask,” says Sullivan. “But I don’t think a good seller’s agent would advise [the seller] to agree to it.”

McIlvaine adds that he has rarely seen the request, “but buyers who’ve been rejected before may decide that it’s worth a try.”

Drive around and you might see a lot of for-sale signs up, but the number going up as a result of a foreclosure is on the decline.

Realtytrac’s 2011 year-end U.s. Foreclosure Market Report, released Jan. 12, shows a total of 2,698,967 foreclosure filings – default notices, scheduled auctions and bank repossessions – on 1,887,777 properties in 2011, a decrease of 34 percent in total properties from 2010. Overall, foreclosure activity was 33 percent the 2009 total and 19 percent below the 2008 total. total foreclosure activity and the foreclosure rate were both at their lowest annual level since 2007.

Despite the numbers, the most hard-hit area remain so.

More than 6 percent (one in 16) of Nevada housing units had

at least one foreclosure filing in 2011, making it the state with the highest rate of foreclosure for the fifth consecutive year. arizona, the second-highest state for foreclosures three years running, had a 4.14 percent of housing units (one in 24) with at least one foreclosure filing.

Part of the reason for the decline is because of delays in the foreclosure process, leading to an increase in the foreclosure timeline. In the fourth quarter of 2011, U.s. properties took nearly a year (348 days) to complete the foreclosure process, up from 336 days is Q3 and up form 305 days during Q4 2010. the state of New york documented the nation’s longest foreclosure period, with those completing the process in Q4 2011 having taken an average of 1,019 days to close.

It’s tough out there, but looking to 2012, landlords are optimistic, according to a recent Rent.com survey of property managers representing approximately 29,000 apartment communities.

The Vacancy EconomyJob market conditions remain the greatest factor in determining

vacancies. In 2011, just 52 percent of property managers reported job loss as a significant factor affecting vacancy rates, down from 70 percent last year and 90 percent in 2009. Beyond that, 46 percent of property managers said vacancies were affected by tenants who could not afford their rent or were trying to save more money, down from 59 percent the year before. Just 23 percent of property managers cited tenants doubling up or taking on roommates as factors driving vacancies, down from 48 percent in 2010.

Got Credit?Property managers continue to see year-over-year declines in

creditworthiness among prospective applicants, with 43 percent citing a decline in creditworthiness in 2011, down from 53 percent in 2010 and 78 percent in 2011. an additional 43 percent say creditworthiness has remained flat, with 14 percent citing an uptick.

WHERE’S my 20?

QUESTION: I have an 80/20 mortgage. the 80 first

loan is being foreclosed, but the 20-percent second loan still is outstanding, and payment is being demanded. this is different than the situation you recently described where the second lender foreclosed but the first did not. What happens now?

ANSWER:Imagine that you bought

a $300,000 property with a $240,000 first loan and a $60,000 second. you’re not paying the first loan so

the first lender forecloses. If the property finally goes to foreclosure the first lender will bid for the property - usually just enough to cover their debt, say $240,000 for purposes of illustration but maybe less today. If another bidder makes a higher offer the property will be sold and the first lender will be paid off. If no higher offer is received the first lender will get title to the property and the second lender will be wiped out.

the second lender in this situation might bid at the foreclosure auction to gain title, but without equity this seems pointless. the second lender in many states also might file a deficiency claim against the borrower for any unpaid debt, but if the borrower has no assets or income why bother?

If the property was owned as a prime residence then any unpaid mortgage balance

is likely to be untaxed. However, if the property is owned by an investor then it’s possible that unpaid loan debt will be seen as “imputed” income and subject at least to federal income taxes. see a tax professional for details.

Is there any good outcome in this situation? the owner might try for a loan modification under the government’s Making Home affordable plan, but if equity or income are insufficient, that may not work. For details, visit MakingHomeaffordable.gov.

In addition, speak with a foreclosure-defense attorney. ask about rules and court decisions in your jurisdiction and the obligation of the lender before foreclosing to mediate, offer a modification and show “standing” as the note owner.

One of the best things a landlord can do during a recession is to pay more attention to their rental properties, ensuring the properties

are in tip-top shape so they can get the most out of each unit at a time when the rental market is most competitive. this might require some

renovations, which landlords should be making periodically anyway, regardless of how strong or tenuous the economy might be.

• Update the paint. apartments are typically empty when shown to prospective renters, and any

issues with the paint job are very noticeable during such viewings. If the paint

is outdated or there is any fading, update the walls with a fresh coat of paint.

It’s ideal to do so whenever a tenant moves out, but landlords whose buildings

have a high turnover rate likely won’t need to repaint every time a tenant

moves out. When adding a new coat of paint, choose a light, neutral color to

give the property a fresh, inviting look.

• Replace the carpeting. Carpeting is another area prospective renters are instantly

drawn to when viewing an apartment. New carpeting is always

attractive to potential tenants, and landlords won’t have to break

the bank to replace the carpets when an existing tenant moves

out. Instead of expensive carpeting, choose a medium grade carpet with a neutral color, ideally beige or light brown, which

can hide spills or stains should the next tenant prove messy and move out after the original lease terms are up. Before laying

carpet, don’t forget to lay down quality padding underneath. such padding makes the carpet feel softer and of higher quality.

• Upgrade the appliances. Perhaps nothing evokes a stronger response from

prospective renters than a property’s appliances.

Outdated appliances make renters speculate as

to what else might be outdated and if the building

is well taken care of. On the other hand, newer

appliances, particularly stainless steel items, create

a contemporary feel and give the impression, true

or false, that a landlord won’t allow the building to

grow dated or fall into disrepair. When shopping for

appliances, choose ones that are more basic so any

eventual repairs won’t be too complicated or costly.

Newer appliances enable landlords to charge more

rent for a given property, and many renters would

agree that such properties are worth the extra money.

• Install new windows. Older buildings tend to have creaky or drafty

windows, which not only makes the property

colder during the winter months, but it also drives

up utility costs as renters are forced to turn up the

thermostat to combat drafts and cold air entering

the unit. New windows can eliminate such drafts

and reduce utility costs, something landlords

can use to their advantage when discussing the

property with potential tenants. landlords might

even be able to earn tax breaks when installing

new, energy-efficient windows. Discuss if any such

breaks exist with the local municipality.

When it comes to renovating a rental property, landlords can make a handful of small renovations that, while relatively inexpensive, enable them to earn substantially more money from each unit over the long haul.
