RecaptureCanyonisopentoanyonewhowantstohikeorhorsebackintoenjoyitsquietbeautyandmarvelattheimportantarchaeologicalsitesleftbehindthousandsofyearsagobyancestralPueblopeople,saysScottMiller,seniorregionaldirectorwithTWSinDenver.Portionsofitareclosedtomotorizeduse.TheWildernessSocietyandmanyotherorganizationsandindividualshaveadvocatedforthoseportionsoftheCanyontoremainclosedtomotorizedusesoitsvaluablenatural,cultural,andhistoricresourcescanbeprotectedforandenjoyedbybothcurrentandfuturegenerationsthroughlowerimpactvisitation.

AsthestewardofpubliclandsforallAmericans,theBureauofLandManagement(BLM)hasadutytoconsideravarietyofcompetingusesonthelandsitmanagesandmakearesponsibledecisionastowhatusesareappropriateondifferentlandscapestheagencyisinthemidstofassessingthoseusesatRecaptureCanyon,saysMiller.AnystakeholderwhobelievesthattheBLMisnotlivinguptoitsobligationscanresorttothecourtstoensurethatallrightsarerespectedandpointsofviewconsidered.

Planstowillfullyviolatefederallawandtodisregardotherstakeholdersanddamagenaturalandculturalresourcesintheprocessarereprehensible.TheBLMhasoursupportinitseffortstoprotectthespecialresourcesofRecaptureCanyon.

TheBureauofLandManagementiswarningriderstostayout,vowingprosecutionagainstthosewhoignorealawputinplaceafteranillegaltrailwasfoundthatcutsthroughruinsthatarenearly2,000yearsold.Thecanyonisopentohikersandhorsebackriders.

Thegroup'sactofdefianceisthelatestillustrationofgrowingtensionbetweenangryWesternresidentsandthefederalgovernmentovermanagementofpubliclands.Buttheoffroadprotestisn'texpectedtoendinaconfrontationlikeotherrecentones.

TheBLMdoesn'tplantoblockaccessorconfronttheriders,saidSanJuanCountySheriffRickEldredge,whohasbeenbriefedontheagency'splans.Theagencywill,however,documentpeoplewhorideATVsontheprohibitedtrail,hesaid.

Theprotest'sorganizer,SanJuanCountyCommissionerPhilLyman,saidheexpectedhundredsatanearbycityparkforamorningrallybutonlyahandfultorideontherestrictedtrail.Hehasdrummedupinterestonsocialmediabutisn'trecruitingmilitanttypes.

Lyman,anaccountantwhosefamilyhasbeenintheregionforfourgenerations,saidtheridewasademonstrationofhisdisgustwithwhathecalledthefederalgovernment'soverreachingcontrolofpubliclandsanddisregardforlocalopinion.

"Thoseancientsitesaretheequivalenttochurches,"saidMarkMaryboy,aformerNavajoNationCouncildelegate."It'sverydisappointingthattheyhavenorespectforNativeAmericanculture."

ThecanyonisoutsidethesmallcityofBlandingandabout40milesnorthwestofthejunctionofUtah,Arizona,NewMexicoandColorado,knownastheFourCorners.

TheprotestcomesamidaperiodofhightensionoverBLMpractices.

Lastmonth,theBLMhadastandoffwithgunwieldingmilitantsinNevadaoveradisputeabouttheroundupofrancherClivenBundy'scattle.BLMultimatelysteppeddown.UtahranchersandcountyleadersrecentlythreatenedtobreakfederallawandroundupwildhorsesthissummeriftheBLMdidntdoitfirst.Earlierthisweek,aBLMemployeeinUtahwasthreatenedwhiledrivingonthehighwaybytwomenwithaweaponholdingasign,"Youneedtodie."

ThefederalgovernmentownstwothirdsofUtah'sland,andtheRepublicandominatedLegislaturepassedalawin2012thatdemandsthestatebegivencontrolofthoselands,excludingnationalparks,before2015.

MotorizedaccesstoRecaptureCanyonandotherareasinUtah'swildernesshasbeenasourceoftensionfordecades.ATVridersrodeanotherofflimitstrailin2009inaprotest.TheBLMgaveinformationabouttheriderstofederalprosecutors.Nochargeswerefiled.

Lymanbelievesit'spossibletoreopenthecanyontoATVswhilepreservingtheartifacts,contendingthatridersareresponsible.ButJessicaGoadoftheCenterforWesternPrioritiesdisagrees,pointingoutthatATVridersblewtheirchancewhenauthoritiesdiscoveredtwomenusedpicksandshovelstocreateanoffroadrecreationalvehicletrailinthecanyonpriortothe2007ban.

PatShea,aformernationalBLMdirectorwhoisnowanattorneyinSaltLakeCity,saidactsofcivildisobedienceputfederalagenciesinadifficultposition.Topreventinjuriesandbloodshed,theymustavoidclashesandworktodeescalatesituations,butcomingoffweakbringsitsownconsequence.

WeregretthattheillegalATVrideplannedfortomorrowappearstobegoingforward.RecaptureCanyonispubliclandbelongingtoallAmericansandcontainsancientculturalsitesandartifactsthatareatseriousriskofbeingdestroyedordamaged.

TheBLM'smultipleuseandsustainedyieldmissionistoensurethehealthandproductivityofthepubliclandsfortheuseandenjoymentofpresentandfuturegenerations.However,multipleusedoesnotmeaneveryuseoneveryacre,andthelimitedclosureshelpprotectthesesensitiveresourcesfromfurtherdamageandshowsrespecttothosewhosefinalrestingplaceisinthecanyon.

TheBLMUtahwillseekappropriatepenaltiesagainstanyonewhowillfullyviolatesthelaw.Asalways,ourfirstandmostimportantprioritywillbethesafetyofthepublicandouremployees,andouractionswillreflectthat.

Therearemorethan2,800milesoftrailsonpubliclandsthatareopentoATVusewithinashortdriveofBlandinginotherwords,theapproximatedistancebetweenNewYorkCityandLosAngeles.ThisextensivetrailsystemoffersOHVridersvastanddiverseopportunitiestorideandrecreateonpubliclandsinsoutheasternUtah.InordertoprotectthericharchaeologicalrecordleftbytheAncestralPuebloanswhooncecalledthisareahomefornearlytwomillennial,thetrailwasclosedtomotorizedaccessin2007.TheBLMiscommittedtoconstructivelyaddressingcompetingresourcedemandsonpubliclandsintheareaandwillcontinuetoengagewiththecountyandotherstakeholders.

PubliclandsmanagedbytheBLMinUtahcontributesignificantlytotheStateseconomyandhaveapositiveimpactonnearbycommunities.DiverserecreationalactivitiesonBLMmanagedlandsinUtahprovided$490millioninlocalandnationaleconomicbenefitsin2012.

Blanding ATV enthusiasts claim federal authorities illegally exclude their machines from nearbyRecapture Canyon, but their protest ride Saturday has become a source of dismay for some tribalmembers whose ancestors inhabited this canyon long before Anglo ranchers ran cows there.And some Navajo are incensed that the potential for confrontation has led to the cancellation of aweekend retreat for disabled veterans in nearby Bluff.Officials with the Hopi Cultural Preservation Office say an illegal ride, organized by an elected official,would be yet another gesture of disrespect leveled at American Indians cultural heritage, which isembedded in the landscape and has been longed pillaged by the descendants of San Juan CountysAnglo pioneers.The tribe claims an ancestral affiliation with the prehistoric Puebloans who built cliff dwellings andkivas and buried their dead in Recapture Canyon between 750 and 1150 AD.We believe the [Bureau of Land Management] should be providing more law enforcement to protectand preserve the cultural and natural resources for which it is the Nations caretaker, and notproviding more motorized access to areas containing cultural and natural resources that it hasdemonstrated that it is unable to protect, wrote Leigh J. Kuwanwisiwma, the tribes preservationdirector, in a May 1 letter to BLM.But the offices Terry Morgart concurred that a show of force could provoke a confrontation with anti-federal activists who may join the locals protest.But if BLM keeps acquiescing it will make it worse too, because [ATV enthusiasts] will keep uppingthe ante. Whats to keep them from going out there anytime they want? Morgart asks.Recapture Canyon enjoys no permanent protection, but the BLM closed it to motorized use in 2007,citing damage to numerous archaeological sites from illegal trail construction.

The countys right-of-way application, which would put the Recapture trail in local hands, has draggedon for eight years. The delay has prompted San Juan County Commissioner Phil Lyman and otherBlanding residents to stage Saturdays ride as a way to assert local jurisdiction over public lands thattheir families have used for generations.Lyman contends the protest is motivated by love of the land and he says riders would prefer to avoiddamaging cultural resources. He asked the BLM to show him where the trail crosses archaeologicalsites.He originally proposed riding the entire seven-mile stretch closed to motorized use, but he now plansto ride in and out on a 1.5-mile stretch on the canyons north end.In a Facebook post he is directing participants to established trails on the canyon rim if they want toavoid violating the BLMs rules. OnSaturday,SanJuanCountyCommissionerPhilLymanandacadreofantifederalgovernmentprotestorswilldrivetheirOHVspastaClosedtoMotorizedUsesignandintoRecaptureCanyon,aplacerenownedforitsAncestralPuebloanruinsmorethanathousandyearsold.Andtheywillmostlikelyrideintothenationalspotlight.

CivildisobedienceisatimehonoredAmericanright,asisdrummingupmediaattentionforyour

cause.AndCPAArespectstherightofSanJuanCountyresidentstoseekpeacefulredressoftheirgrievanceswiththeBLMthroughanylawfulmeans.

TherearecompellingreasonswhytheBureauofLandManagementhasclosedRecaptureCanyontomotorizedvehicles.

1)Theroadwasillegallyconstructedbylocalresidentssevenyearsagowithoutthebenefitofanyenvironmentalstudiesastowhatresourceswouldbeaffectedbyvehicletravel.

2)Theroadpassesthroughthemiddleofsixnationallysignificantarchaeologicalsitesthatincluderesidencesandstoragestructures,aswellasthreereligiousstructuresknownaskivas.

3)Notonlydidtheroadconstructionirreparablydamagetheseancientsites,butvehiculartravelhasandwillcontinuetodegradethesites.

4)ThecanyonandthesitesfoundthereareoftremendousspiritualsignificancetomodernPuebloangroups(Hopi,Zuniandothers)andtotheNavajo.

Vehicledamagetovegetationandriparianareascanberepairedovertime.Damagetoarchaeologicalsitesispermanentandtheinformationaboutourcollectivepastisthenlostforever,Spanglersaid.

OHVtravelthrougharchaeologicalsitescausesacceleratederosionofintactdepositsburiedbeneaththeroad,whichifstudiedinproperscientificcontextcanofferimportantinsightsastohowprehistoricpeopleslivedandthrivedinthisremarkablelandscape.Vehicletravelcanalsobreakartifactsandfacilitatethecollapseofstructuralwalls.
