Section1‐PlanIntroduction

1.1 PurposeThepurposeofthisPlanistoensuretheeffectiveperformanceofReclamationDistrictNo.2062(RD2062)responsibilitiesinafloodemergencyincollaborationwithotherjurisdictionsperformingemergencyfunctionswithinandaroundtheDistrict.ThisPlanwillbeusedinconjunctionwiththeemergencyoperationsplansoftheStateofCaliforniaandtheSanJoaquinOperationalArea(SJOA)tofacilitatemulti‐jurisdictionalcoordinationwithinDistrictboundaries.Althoughthisisapublicdocument,specificproceduresandinformationofasensitivenature,aswellaspersonalinformation,mayberemovedfrompubliclyavailableversions.Thefulldocumentissubjecttorestricted‐usehandlingprocedures.ThisPlanmeetstherequirementsofSection9650oftheCaliforniaWaterCode.1.2 ScopeRD2062isanindependentjurisdictionwithresponsibilityfortheoperationandmaintenanceoftheleveesystemwithinitsjurisdictionalboundaries.ThisemergencyoperationsplandescribesdetailedproceduresformeetingthisDistrict’sresponsibility.OperationalplansofotherjurisdictionswithpublicsafetyresponsibilitieswithintheDistrictareonlyreferencedinthisPlan. 1.3 PlanStructureThisPlanisstructuredasatraditionalfunctionalemergencyoperationsplaninaccordancewithComprehensivePreparednessGuide(CPG)101issuedbytheFederalEmergencyManagementAgency(FEMA).Consistentwiththatguidance,andbecauseoftheDistrict’slimitedresponsibilitiesandlackofinternaldepartments,thisemergencyoperationsplanconsistsofthisPlanandonehazard‐specificannex,AnnexA–FloodContingencyMap(AnnexA).TheDistrict’sexistingfloodcontingencymapwillconstitutethisAnnexAcontainingtheDistrict’sspecificfloodresponseprocedures.ThemostcurrentfloodcontingencymapforthedistrictcanbeaccessedattheSJOAfloodcontingencymapwebsite.SeeFigure1.

Section2‐ConceptofOperations2.1 SituationOverviewSeetheSJOAHazardMitigationPlanforacomprehensivefloodriskassessmentfortheCountyofSanJoaquin.SeeAnnexAforDistrictboundaries,levees,pumpingstations,supplydepots,historicalfloodingsummary,locationsofpastbreachesandareasofhistoricseepageorerosion,topography,andcharacteristicsofwaterwaysfrontingDistrictlevees.RD2062,StewartTract,isboundedontheeastsidebytheSanJoaquinRiver,onthenorthsidebyOldRiver,andonthesouthwestsidebyParadiseCut.ThesouthernboundaryoftheDistrictistheUnionPacificRailroadrightofway,adjacenttoReclamationDistrictNo.2107(RD2107),whichformsanintegralphysicalpartofthetract.Asaresult,theU.S.ArmyCorpsofEngineersandCaliforniaDepartmentofWaterResourcesviewbothRD2062andRD2107asonefloodprotectionsystem.TheareassurroundingtheDistrictarewithinthefloodplainandprotectedbylevees.AccesstotheDistrictisfromStewartandMantheyRoadsviaInterstate5onthesouthsideandParadiseRoadfromtheeast.FutureaccesswillbethroughReclamationDistrict17intheformoftwonewbridgesandthroughanexpandedParadiseRoad.TheSanJoaquinRivervariesbetween150to200feetwidealongtheDistrictboundaries.OldRivervariesbetween100to125feetwideandParadiseCutisapproximately500‐600feetwidealongthesouthwestside.TheSanJoaquinRiverandOldRivercarrywateryearroundbutParadiseCutonlycarrieswaterduringhighwaterevents,withtheexceptionofirrigationwaterpumpedintotheCutbyParadiseMutualWaterCompany.NomajorislandsorbarriersexistintheSanJoaquinorOldRiverchannelsalongtheDistrictboundary.TwolinesoftheUnionPacificRailroadcrossStewartTracteasttowestonembankmentsandraisedtrestles.AhightrafficlinecrossesthesouthernportionofRD2107,roughlytwo‐thirdsofmilesouthofInterstate5inRD2107,primarilyontrestles,andasecondary,less‐usedline(alongtheboundarybetweenthetwodistricts),crossestheTractroughlythree‐fourthsmilenorthofInterstate5onaraisedembankmentpenetratedbyculverts.TheDistrictiscurrentlyprotectedbyleveesplacedwhentheareawasentirelyagricultural.Constructiononnewleveesmeeting200‐yearstandardsbeganin2005‐2006tosupportaplantourbanizethedistrict.Aninitialringleveeincorporatingportionsoftheoriginaldistrictleveeandnewdrylandleveesegmentswerecompletedin2005andawidenedSanJoaquinRiversegmentcompletedin2006.AdditionalleveeconstructionwilloccurovertimeastheRiverIslandsmasterplannedcommunitydevelopsundertheState’s200‐yearfloodprotectionstandard.Thiswillbecompletedinphaseswithimprovementofexistingleveesegmentstothenewstandardswithconstructionorre‐sitingofdrylandleveesegmentsforeachphase.Thisprocesswillleadtothepresenceofaringleveemeetingthe


higherprotectionstandardssituatedwithintheexistingdistrictleveesystemuntilcompletebuildout.Thissystematicexpansionofthedrylandleveesegmentsmaybecurtailedandreconstructionoftheexistingfederalprojectleveesnotalreadyreconstructedperformedwhenthependingenvironmentalimpactstudy(EIS)forRiverIslandsisapprovedunderaRecordofDecisionandsubsequententitlements(e.g.Section408authorization)issued.Ineithercase,eventuallytheoriginaldistrictleveeswillberebuilttothehigherstandardexceptthatonthesouthwestsidetheimprovedleveesegmentwillbesetbackaminimumof150feetfromthecurrentleveepositionalongParadiseCut.Theresultingsetbackleveewillbebuilttothesamestandardsastheotherprojectlevees.Accordingtothe2010governmentcensus,thepopulationonStewartTractis17.Salesofhomesinthecurrentringleveeurbanarea(RiverIslandsPhase1area)beganinearly2014.Populationwillgrowovertimetoapproximately30,000atfullbuildoutinthenext10to20years.RD2062isthreatenedprimarilyfromriverinefloodsalongtheSanJoaquinRiveranditstributariesinthevicinity.DeltahightidaleventshaveminimumeffectonwaterelevationsaroundtheDistrict.ParadiseCutcarriesflowsofftheSanJoaquinRiverwhenwaterelevationsexceedtheheightofaweirplacedatthemouthoftheCut.2.2 GeneralApproachtoSeasonalFloodOperationsDistrictstaffwillcarryoutroutinepreparednessactivitiesatthebeginningofthefloodseasonasdescribedbelow.AnnexAdescribestheconceptofoperationsforactiveDistrictfloodfightactivities.Section3,OrganizationandAssignmentofResponsibilities,ofthisPlandescribesauthoritiesandresponsibilitiesforperformingroutineandemergencyactivities.2.2.1 RoutinePreparednessandInfrastructureMaintenanceTheDistrictperformsthefollowingroutinepreparednessactions.1. Annualinspectionandmaintenanceofpumpingstations.Districtownspumpingstationsforinternaldrainagecontrol.Theprimarydistricttenant,GeorgePerryandSons,maintainsalldistrictpumpstations.AnotherRiverIslandsdevelopmentrelatedpublicagency(includingtheDistrict)mayassumemaintenanceofthesefacilitiesinthefuture.

TheDistrictdoesnotuse“phases”whereobjectiveconditionstriggeragroupofactions.EachactionindicatedwillbetakenuponreachingthetriggerconditionshownorifDistrictstafffeelsitiswarranted.Asnotedbelow,theDistrictEngineerisresponsibleformonitoringobjectiveconditionsaffectingtheDistrict.Districtstaffwilltakealloftheaboveactionsupontheidentification,orverifiedreport,ofanyoutoftheordinaryconditiononaDistrictleveethatpresentsapotentialriskoffailure.2.3 PublicAlertandWarningTheDistrictwillpromptlynotifyjurisdictionsresponsibleforalertingandwarningthegeneralpublicuponidentificationofathreattoDistrictlevees.TheDistrictwillprovidedetailedinformationonthecharacteristicsofthethreatandwillassist,totheextentpossible,withnotificationofthepublicifrequested.Allalertandwarningofthegeneralpublicwillbecarriedoutinaccordancewiththeplansofprotectedjurisdictions.ThefollowingjurisdictionsareresponsibleforalertingandwarningthegeneralpublicwithinRD2062.CityofLathropLathropPoliceServices(SanJoaquinSheriff)Lathrop‐MantecaFireDistrictAlertingandwarningwillbeconductedjointlybythesejurisdictionsthroughtheSJOAusingtheprocedurescontainedintheSJOAWarningAnnex(seewww.sjgov.org/oes).TheDistrictwillprovidearepresentativetotheOperationalAreaandSJOAJointInformationCentertoassistwithalertandwarningmessagesifrequested.Inthefuture,evacuationmapsandbrochuresforthepublicwillbeavailableatadedicatedwebsitemaintainedbySJOA(seeFigure2).ThesemapswillcontaininformationonreceivingalertsandwarningswithintheDistrictalongwithevacuationandsafetyinstructions.RD2062hasbeendesignatedthe“StewartTractEvacuationZone.”ForRD2062thereisalsoa“RIVERISLANDSSHELTER‐IN‐PLACEMAP”mapmaintainedbytheCityofLathropandtheSanJoaquinCountyOfficeofEmergencyServicesforthecontingencythaturbanpopulationswithintheRiverIslandsatLathropPhaseIRingLeveeareisolatedbyfloodingofareasadjacenttothishigherstandardlevee.


LocationofthepublicsafetyevacuationmapforRD2062isshownonAnnexA.2.4 FloodFightOperationsFloodfightoperations,includingleveepatrol,willbeconductedinaccordancewiththeproceduresinthisBasicPlanandthoseshownonAnnexA.AnnexAdisplaystheDistrict’sconceptofoperationsforemergencycommunications,patrol,andfloodfight.Floodfightprocedureswillincludedewateringoperations.ThisconceptofoperationsandrelatedresponseprocedureswillbemodifiedasneededbytheDistrictIncidentCommandertomeetthedemandsofactualemergencyconditions.PlansofjurisdictionswithresponsibilityforwarningandevacuationwithintheDistrictarereferencedonAnnexAaswellasinthisPlan.2.5 FederalandStateDisasterAssistanceTheDistrict’spolicyistomaintainmitigationandemergencyplansandprocedures,aswellasthephysicalconditionofitslevees,atthelevelrequiredtobeeligiblefordisasterpublicandindividualassistanceprogramssuchastheFederalStaffordActandPL84‐99programaswellastheCaliforniaDisasterAssistanceAct(CDAA).TheDistrictiscurrentlyworkingtowardsreinstatementintothePL84‐99programleveerehabilitationcomponentalongwithRD2107.Emergencyoperationswillbeconductedanddocumentedincompliancewithconditionsofthoseprogramsforreimbursementofdisasterexpenses.TheDistricthasassigneditsDistrictEngineertomaintainnecessarydocumentationduringanemergencyandtoparticipateinanyavailableassistanceprogramsafteradisasteronbehalfoftheDistrict.ToensurethattheDistricttakesstepstoquicklyaccesstherecoveryprocess,theseactionsshouldbeconsideredifanincidentisimminentoroccurring:

Section3‐OrganizationandAssignmentofResponsibilities

3.1 OrganizationTheDistrictwilluseitspaid,contract,andvolunteerstaffasshownbelowtoperformitsresponsibilitiesinafloodemergency.3.2 AssignmentofResponsibilitiesTheDistrictBoardofTrusteeshasmadethefollowingassignmentsofauthorityandresponsibilitytoensurethatneededemergencyactionscanbetakenpromptlyandefficiently.3.2.1 MakeLegalandFinancialCommitmentsonbehalfofDistrictTheDistrictPresidentshallhavetheauthority,oncetheDistrictBoardofTrusteeshasconcurredthatalocalemergencyisoccurring,to1)makealegalorfinancialcommitmentonbehalfofDistrictduringemergencyoperationsand2)purchaseadditionalfloodfightsuppliesormaterials.IntheabsenceofthePresidentorathisorherdirection,anysingletrusteeortheDistrictSecretarycanalsobeauthorizedasnecessary.Regardlessofthisauthority,thereisnolimittothecommitmentthatcanbemade.AnysingletrusteeortheDistrictSecretaryintheabsenceoftheDistrictPresidentcantaketheseactionsuponrecognitionofathreattoleveeintegrityevenwithoutpriorconcurrenceoftheDistrictBoardofTrusteesthatalocalemergencyisoccurring,butinthiscasetheDistrictBoardofTrusteesmustbenotifiedoftheactionwithin24‐hours.TheDistrictPresidentordesigneeshallsignwrittencontractswithprivatevendorsorotherpublicagenciesstemmingfromemergencyactionsasdescribedabove.

3.2.2 RepresentDistrictinOperationalAreaEmergencyManagementCommitteeTheDistrictIncidentCommanderisauthorizedandresponsibleforrepresentingtheDistrictatunifiedfieldcommandsasmaybeestablishedbytheSJOAaswellasforrepresentingtheDistrictattheSJOA,andmayspeakfortheDistrictinmatterspertainingto1)theconditionofDistrictlevees,2)protectiveactiondecisionsbeingmadebypublicsafetyagencies,and3)anyrequeststomodifyorconformDistrictresponsethatcomeoutofthemulti‐agencycoordinationprocess.TheBoardPresidentwillissueaDelegationofAuthorityletter(seeAttachment2)confirminganddefiningthesespecificauthoritiesatthetimeofanemergencyandformallyidentifyingtheDistrictIncidentCommanderandDeputyIncidentCommanderuponreachingthetriggerconditiondescribedinSection2.2.3.3.2.3 ProvidePublicInformationTheDistrictBoardPresidentisauthorizedtospeaktothemediaonbehalfoftheDistrictaspartoftheSJOAJointInformationCenter.TheDistrictBoardPresidentmayassigntheSecretaryasthePublicInformationOfficer.3.2.4 MaintainEmergencySuppliesandEquipmentTheDistrictEngineerorDistrictSecretaryisauthorizedandresponsibleformaintainingtheDistrict’semergencyfloodfightingsupplies.TheDistrictEngineerwillensurethatsuppliesaremaintainedatinventorylevelssetbytheDistrictBoardofTrusteesoratanyminimumlevelsthatmaybesetbytheDepartmentofWaterResourcesguidanceorstatutes.TheDistrictEngineerisauthorizedtoacquiresuppliesasnecessarytomaintainthoselevels.3.2.5 MonitorWaterConditions,Elevations,andForecastsTheDistrictEngineerisauthorizedandresponsibleformonitoringwaterconditions,elevations,andforecastsforthepurposeofidentifyingconditionswarrantingadditionalactionbeyondroutinefloodpreparednessasoutlinedinthisPlan.3.2.6 Activateand/orDirectDistrictStaffduringEmergencyOperationsTheDistrictIncidentCommander,asassignedbytheDistrictPresident,isauthorizedandresponsiblefor:

3.2.7 DocumentExpenditures,EmergencyActions,andRequestsforMutualAidTheDistrictEngineerandDistrictSecretaryorelectedofficialareauthorizedandresponsibleformaintainingnecessarydocumentationofemergencyexpenditures,damagetoDistrictinfrastructure,anduseofsupplyinventoriesinaccordancewiththerequirementsoffederalandstatedisasterassistanceprograms.TheDistrictEngineerandDistrictSecretaryorelectedofficialareauthorizedandresponsibleforthepreparationandsubmissionofdisasterassistanceclaimsduringtherecoveryperiodthroughallfederalandstatedisasterassistanceprogramsthatmaybeapplicableandrelevanttoDistrictcostsandmutualaidrequests.

DistrictstaffauthorizedandresponsibleforcarryingouttheactionsoutlinedinSection3,OrganizationandAssignmentofResponsibilitieswillusethedirection,control,andcoordinationfacilitiesandprocessesdescribedinthissection.Communicationsandlogisticssystemsforcommand,coordination,andresponsearedescribedinSections5and6.DistrictstaffwillusetheNationalIncidentManagementSystem(NIMS),andtheStandardizedEmergencyManagementSystem(SEMS),toorganizeDistrictresponseactivities.DistrictstaffwillcomplywiththeproceduresoftheSanJoaquinCountyUnifiedFloodFightCommandtowhichtheDistrictisassigned,theSJOAMulti‐AgencyCoordinationSystem(MACS),oranyother“asneeded”commandstructureputinplacebylocalofficialsforpurposesofinter‐agencycoordination.4.1.1. 4.2 ManagementandCoordinationwithOtherJurisdictionsTheDistrictwillensurethatpropermanagementandcoordinationismaintainedwith1)otherpublicagenciesandjurisdictionsoperatingwithintheDistrictincludingtheCityofLathropandSanJoaquinCounty,2)neighboringreclamationdistricts,and3)theSJOA.Thefollowingprocedureswillbefollowedtoaccomplishthisfunction.4.2.1 UnifiedFloodFightCommandPostTheCityofLathrophasestablishedafloodfightcommandwithapre‐identifiedcommandpostlocationtofacilitatecoordinationandmutualaidbetweenneighboringreclamationdistrictsandsupportingcityagencies.TheDistrictIncidentCommanderwillreporttothisfloodfightcommandlocationtocoordinatethedevelopmentandimplementationofincidentactionplans.Unifiedsituationassessment,resources,andtacticalplanningofmulti‐agencyfloodfightactivitieswilltakeplacewithinthisunifiedcommand.ThelocationoftheCityofLathropfloodfightcommandisatthecorporateyardlocatedat:15755S.SeventhStreet. TheSJOAPlanning/IntelligenceSectionwillprovidedisasterintelligenceandsituationalstatustoparticipatingjurisdictionsuponactivationinanemergency.ThisDistrictwillparticipateasneededinthisdisasterintelligenceandinformationsharingprocess.Seewww.sjgov.org/oesforrelevantSJOAplans.RD2062isasignatorytotheSJOAAgreementandassuch,itsIncidentCommanderwillparticipateinSJOAmulti‐agencycoordinationprocessesandproceduresonbehalfoftheDistrict.GeneraltraveltimesfromDistricttotheSJOAemergencyoperationscenteris15minutes.DistrictrepresentativemayremotelycommunicatewiththeSJOAEOCthroughcellulartelephone.4.2.3 State‐FederalFloodOperationsCenterTheDepartmentofWaterResourceshasspecialauthorityunderWaterCodeSection128toassistreclamationdistrictswithfloodfightoperations.TheDepartmentofWaterResourcesmaintainstheState‐FederalFloodOperationsCenter(FOC)toperformthesefunctionsandsupporttheoperationsofotherStateandFederalagencies.TheDistrictwillmaintaincommunicationswiththeFOCinordertoreceiveandprovideinformationwiththatfacilityandtorequesttechnicalassistance.TheDistrictwillcommunicatewiththefloodoperationscenterthroughtelephonesystemsorSouthDeltaUnifiedFloodFightCommandmulti‐agencycoordinationactivitieswhereFOCrepresentativesarepresent.4.2.4 SJOAJointInformationCenterPublicInformationtothepublicandjurisdictionswillalsobecoordinated,planned,andcarriedoutthroughtheSJOAJointInformationCenter(JIC).TheDistrictwillassistwithriskcommunicationasrequestedbytheoperationalarea.Seewww.sjgov.org/oesforrelevantSJOAplansandprocedures.TheDistrictwillprovideapublicinformationofficerasrequestedwhowillhaveauthoritytoapproveinformationreleases.TheDistrictinformationofficerwillidentifythelocationandscheduleofthejointinformationcenterfromtheSJOAPublicInformationOfficeratthebeginningofthefloodevent.

Section5‐Communications5.1 CommunicationsOrganizationTheDistrictwillmaintainadequatecommunicationsequipmenttoimplementthisemergencyplan.Thissectionidentifiesequipmentand/orsystemsavailableforcommunications,1) BetweenDistrictstaff,contractors,andotherstaffworkingunderDistrictsupervision2)WithotherpublicagenciesoperatingwithintheDistrict3)Withneighboringreclamationdistricts4)WiththeSJOAEOC5)WiththeStateFloodOperationsCenter5.2 DistrictCommunicationsEquipmentandProcessesTheDistrictdoesnotownoroperatecommunicationsequipmentcurrently.TheDistrictwillrelyprimarilyonpersonalcellphonesofitsstaffandtrustees,tomaintaincommunicationsbetweentheBoardofTrustees,DistrictSecretary,DistrictIncidentCommander,andotherTemporaryHelpresponsestaffthatmaybehiredduringtheemergencyperiod.IntheeventoffailureofcellulartelephonesystemstheDistrictwillusemessengerstotransmitinformationbetweenitsstaffandotherjurisdictionsaswellasregularlyscheduledcoordinationmeetingsofthefieldunifiedcommandsandtheSJOAorganization.5.3 CommunicationswithOtherJurisdictionsTheDistrictwillmaintaincommunicationswithotherjurisdictionsbycellulartelephoneandbyparticipationinmeetingsoftheCityofLathropandSouthDeltaUnifiedFloodFightCommand.TheCityofLathropandtheSanJoaquinOperationalAreamayassignradioorphonecommunicationsequipmenttotheDistrictifthiswillprovidereliablecontact.5.3.1 SJOAEmergencyOperationsCenter(EOC)TheDistrictwillmaintaincommunicationswiththeSJOAEOCbycellulartelephoneandparticipationinscheduledmeetingsoftheSJOAmanagement.TheDistrictwillmaintaintelephonenumbersassignedbytheSJOAforusebyreclamationdistrictstocontacttheEOC.5.3.2 DepartmentofWaterResourcesState‐FederalFloodOperationsCenterTheDistrictwillcommunicatewiththeFloodOperationsCenterbycellulartelephone.Additionalcommunicationsequipmentmayalsobeprovidedtoensurecontact.


Section6–Logistics,FinanceandAdministration6.1 MutualAidTheDistrictisasignatorytotheCaliforniaMasterMutualAidAgreement,andtheSJOAAgreement.Districtstaffwillfollowtheprocessesoutlinedinthosedocumentsforrequestingandprovidingmutualaid.TheDistrictwillcoordinatedirectlywiththeCityofLathropforanymutualaidpriortocoordinatingwiththeSJOA.TheCitywillcoordinateonbehalfoftheDistricttoseekmutualaidwiththecountythroughtheSJOA.TheSJOAAgreement,andSanJoaquinCountyOrdinanceshaveprovisionsallowingtheSJOALogisticsSectionandSanJoaquinCountyPurchasingAgenttoacquireandtransport,onbehalfoftheDistrict,resourcesrequestedbytheDistrict.Mutualaidrequestsfortechnicalassistanceandservices,floodfightcrews,suppliesandmaterials,andotherresourceswillbemadethroughtheSJOALogisticsSectionand/ortheOperationalAreaPublicWorksMutualAidCoordinator.Seewww.sjgov.org/oesforoperationalareaplansandprocedures.6.2 ResourcesSeeAttachment3forinventoryofdistrictfloodfightresources.SJOAmaintainsseventwenty‐footcontainerswithfloodfightsuppliesthatthedistrictcandrawonthroughtheSJOAAgreement.InventoryofthatresourcecanbeobtainedfromSJOA.Inaddition,DWRstoresresourcesatthePortofStocktonarea.6.3 ProcurementDistrictmaintainsstandardformsandprocessesforinitiatingandexecutingcontractswithprivatevendors.TheDistrictmaintainsastandardcontractformforcontractsunder$25,000inano‐bidenvironment.TheDistrictmaintainsaseparatecontractformforcontractsover$25,000addingabondingrequirement.Contractsover$25,000willbeawardedthroughaninformalbidprocessifpracticableinlightofemergencyconditions.Ifanemergencysituationispresent,theDistrictmayadministercontracts,aslegallyallowedunderadeclaredemergency.(SeeAttachment4forsamplecontract)6.4 LogisticsFacilitiesSeeAnnexAforlocationsofpre‐planneddeliverypoints,locationsofDistrictsupplies,andDistrictsupplystagingareasandpoints.6.5 FinanceandAdministrationThe District maintains financial and administrative records associated with emergency response in accordance with 44 C.F.R. Part 13--Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments. Emergency response and construction records, including field reports, procurement and construction management files are maintained by both the District and the District Engineer and are retained as prescribed by the grant authority. District maintains a safety plan for employees and work rules as appropriate.

All insurance required hereunder shall be maintained in full force and effect in acompany or companies satisfactory to DISTRICT, shall be maintained atCONTRACTOR'sexpenseuntilperformanceinfullhereofandsuchinsuranceshallbesubject to requirement thatDISTRICTmustbenotifiedby thirty (30)days'writtennoticebeforecancellationofanysuchpolicy.Intheeventofthreatenedcancellationfornon‐paymentofpremium,DISTRICTmaypaysameforCONTRACTORanddeductthe same payment from amounts then or subsequently owing to CONTRACTORhereunder.

Evidence of such insurance shall be furnished by CONTRACTOR toDISTRICT uponrequest.

CONTRACTORspecificallyobligates itself toDISTRICT in the followingrespects (and thisagreementismadeuponsuchexpresscondition),towit:foranycost,expenseorjudgment(includingattorney'sfees)paidorincurredinthatbehalf.CONTRACTORshallbefullyandexclusivelyresponsibleforandshallpaywhendueanyandallapplicablecontributions,allowancesorotherpaymentsordeductions,howevertermed,requiredbyunionlaboragreementsnoworhereafterinforce.CONTRACTOR shall indemnify INDEMNIFIED PARTIES against, and save them harmlessfromanyandallloss,damage,costs,expensesandattorney'sfeessufferedorincurredonaccountofanybreachoftheaforesaidobligationsandcovenants,andanyotherprovisionsorcovenantsofthisContract.At any time before final settlement or adjudication of any loss, damage, liability, claim,demand,suitorcauseofactionforwhichCONTRACTORherebyagreestoindemnifyandsaveINDEMNIFIEDPARTIESharmless,DISTRICTmaywithhold fromanypaymentsdueor tobecomedueunderthisContractthereasonablevaluethereof,asdeterminedbyDISTRICT.CONTRACTOR specifically agrees that it is, or prior to the start of work hereunder willbecome,aCONTRACTORandanemployingunit subjectasanemployer, toall applicableUnemploymentCompensationStatutes.CONTRACTORfurtheragreesasregards,(a)theproduction,purchaseandsale,furnishinganddelivering,pricing,anduseorconsumptionofmaterials,suppliesandequipment,(b)thehire,tenureorconditionsofemploymentofemployeesandtheirhoursofworkandratesofandthepaymentoftheirwages,and(c)thekeepingofrecords,makingofreports,andthepayment, collection, and/or deduction of Federal, State and Municipal taxes andcontributions that CONTRACTORwill keep and have available all necessary records andmakeallpayments,reports,collections,deductions,andotherwisedoanyandallthingssoastofullycomplywithallFederal,StateandMunicipal laws,ordinances,regulations,andrequirements in regard to any and all saidmatters insofar as they affect or involve theCONTRACTOR's performance of this Contract, all so as to fully relieve INDEMNIFIEDPARTIES fromandprotect itagainstanyandall responsibilityor liability thereforeor inregardthereto.CONTRACTORshall protect andkeep INDEMNIFIEDPARTIESharmless and free fromallliability,penalties,losses,damages,costs,expenses,causesofaction,claimsandjudgmentsresulting from injury or harm to any person or property arising out of or in any wayconnectedwiththeperformancehereof.CONTRACTORshallfurtherholdINDEMNIFIEDPARTIESharmlessfromliabilityorclaimsfor any injuries to or death of CONTRACTOR's employees resulting from any causewhatsoever,andshallindemnifyINDEMNIFIEDPARTIES

PursuanttoLaborCodeSection1771forcontractsover$1,000.00,thisdistrictworkswith the Compliance Monitoring Unit/Division of Labor Standards Enforcement andrequiresthatallcontractorsandsubcontractorsworkingonthisprojectkeepcertifiedpayrollrecordsinaccordancewithLaborCodeSection1776,andtosubmitelectronicallyviatheDepartmentofIndustrialRelations(DIR)ComplianceMonitoringUnitwebsite.ForanyquestionspleaseemailCMU@dir.ca.govorcall916‐263‐1811.Pursuant to Labor Code Section 1771.1, a contractor or subcontractor shall not bequalifiedtobidon,belistedinabidproposal,subjecttotherequirementsofSection4104ofthePublicContractCode,orengageintheperformanceofanycontractforpublicwork,unless currently registered andqualified toperformpublicworkpursuant to Section1725.5.Inaccordancewith theprovisionsofLaborCodeSection1720etseq., theDivisionofLaborStandardsandResearchhasdeterminedthegeneralprevailingratesorwagesandemployer payments for health and welfare, pension, vacation, travel time, andsubsistencepayasprovidedforinLaborCodeSection1773.8.ItshallbemandatoryupontheCONTRACTORhereinanduponanySubcontractortopaynotlessthanthesaidspecifiedratestoalllaborers,workers,andmechanicsemployedbythemintheexecutionoftheAgreementpursuanttoLaborCodeSection1774.TheCONTRACTORshallpostjobsitenotices,asprescribedbyregulation1771.4(a)(2).

The District or District Representative shall make periodic site visits to observe andinterview workers regarding the payment of prevailing wages and proper workclassifications.ContractorandeachSubcontractorshallcooperateandcoordinatewiththeDistrictandprovideunaccompaniedaccesstoworkersonthejobsite.Attentionisdirectedtotheprovisionsinsection1777.5andsections1777.6oftheLaborCode concerning the requirement to employ apprentices by the CONTRACTOR or anySubcontractorunderit.Contractors and any Subcontractors shall be assessed penalties for violating labor codesectionsasstatedaboveandasspecifiedinthelaborcode.CONTRACTORcertifiesthatheisawareoftheprovisionsofSection3700oftheLaborCodewhichrequireeveryemployertobeinsuredagainstliabilityforworkers’compensationortoundertakeself‐insuranceinaccordancewiththeprovisionsofthatcode,andthathewillcomply with such provisions before commencing the performance of the work of thisContract.
