Section1‐PlanIntroduction

1.1 PurposeThepurposeofthisPlanistoensuretheeffectiveperformanceofReclamationDistrictNo.2062(RD2062)responsibilitiesinafloodemergencyincollaborationwithotherjurisdictionsperformingemergencyfunctionswithinandaroundtheDistrict.ThisPlanwillbeusedinconjunctionwiththeemergencyoperationsplansoftheStateofCaliforniaandtheSanJoaquinOperationalArea(SJOA)tofacilitatemulti‐jurisdictionalcoordinationwithinDistrictboundaries.Althoughthisisapublicdocument,specificproceduresandinformationofasensitivenature,aswellaspersonalinformation,mayberemovedfrompubliclyavailableversions.Thefulldocumentissubjecttorestricted‐usehandlingprocedures.ThisPlanmeetstherequirementsofSection9650oftheCaliforniaWaterCode.1.2 ScopeRD2062isanindependentjurisdictionwithresponsibilityfortheoperationandmaintenanceoftheleveesystemwithinitsjurisdictionalboundaries.ThisemergencyoperationsplandescribesdetailedproceduresformeetingthisDistrict’sresponsibility.OperationalplansofotherjurisdictionswithpublicsafetyresponsibilitieswithintheDistrictareonlyreferencedinthisPlan. ThisPlanwillcoverindetailthefollowing;

1.3 PlanStructureThisPlanisstructuredasatraditionalfunctionalemergencyoperationsplaninaccordancewithComprehensivePreparednessGuide(CPG)101issuedbytheFederalEmergencyManagementAgency(FEMA).Consistentwiththatguidance,andbecauseoftheDistrict’slimitedresponsibilitiesandlackofinternaldepartments,thisemergencyoperationsplanconsistsofthisPlanandonehazard‐specificannex,AnnexA–FloodContingencyMap(AnnexA).TheDistrict’sexistingfloodcontingencymapwillconstitutethisAnnexAcontainingtheDistrict’sspecificfloodresponseprocedures.ThemostcurrentfloodcontingencymapforthedistrictcanbeaccessedattheSJOAfloodcontingencymapwebsite.SeeFigure1.

Section2‐ConceptofOperations2.1 SituationOverviewSeetheSJOAHazardMitigationPlanforacomprehensivefloodriskassessmentfortheCountyofSanJoaquin.SeeAnnexAforDistrictboundaries,levees,pumpingstations,supplydepots,historicalfloodingsummary,locationsofpastbreachesandareasofhistoricseepageorerosion,topography,andcharacteristicsofwaterwaysfrontingDistrictlevees.RD2062,StewartTract,isboundedontheeastsidebytheSanJoaquinRiver,onthenorthsidebyOldRiver,andonthesouthwestsidebyParadiseCut.ThesouthernboundaryoftheDistrictistheUnionPacificRailroadrightofway,adjacenttoReclamationDistrictNo.2107(RD2107),whichformsanintegralphysicalpartofthetract.Asaresult,theU.S.ArmyCorpsofEngineersandCaliforniaDepartmentofWaterResourcesviewbothRD2062andRD2107asonefloodprotectionsystem.TheareassurroundingtheDistrictarewithinthefloodplainandprotectedbylevees.AccesstotheDistrictisfromStewartandMantheyRoadsviaInterstate5onthesouthsideandParadiseRoadfromtheeast.FutureaccesswillbethroughReclamationDistrict17intheformoftwonewbridgesandthroughanexpandedParadiseRoad.TheSanJoaquinRivervariesbetween150to200feetwidealongtheDistrictboundaries.OldRivervariesbetween100to125feetwideandParadiseCutisapproximately500‐600feetwidealongthesouthwestside.TheSanJoaquinRiverandOldRivercarrywateryearroundbutParadiseCutonlycarrieswaterduringhighwaterevents,withtheexceptionofirrigationwaterpumpedintotheCutbyParadiseMutualWaterCompany.NomajorislandsorbarriersexistintheSanJoaquinorOldRiverchannelsalongtheDistrictboundary.TwolinesoftheUnionPacificRailroadcrossStewartTracteasttowestonembankmentsandraisedtrestles.AhightrafficlinecrossesthesouthernportionofRD2107,roughlytwo‐thirdsofmilesouthofInterstate5inRD2107,primarilyontrestles,andasecondary,less‐usedline(alongtheboundarybetweenthetwodistricts),crossestheTractroughlythree‐fourthsmilenorthofInterstate5onaraisedembankmentpenetratedbyculverts.TheDistrictiscurrentlyprotectedbyleveesplacedwhentheareawasentirelyagricultural.Constructiononnewleveesmeeting200‐yearstandardsbeganin2005‐2006tosupportaplantourbanizethedistrict.Aninitialringleveeincorporatingportionsoftheoriginaldistrictleveeandnewdrylandleveesegmentswerecompletedin2005andawidenedSanJoaquinRiversegmentcompletedin2006.AdditionalleveeconstructionwilloccurovertimeastheRiverIslandsmasterplannedcommunitydevelopsundertheState’s200‐yearfloodprotectionstandard.Thiswillbecompletedinphaseswithimprovementofexistingleveesegmentstothenewstandardswithconstructionorre‐sitingofdrylandleveesegmentsforeachphase.Thisprocesswillleadtothepresenceofaringleveemeetingthe

higherprotectionstandardssituatedwithintheexistingdistrictleveesystemuntilcompletebuildout.Thissystematicexpansionofthedrylandleveesegmentsmaybecurtailedandreconstructionoftheexistingfederalprojectleveesnotalreadyreconstructedperformedwhenthependingenvironmentalimpactstudy(EIS)forRiverIslandsisapprovedunderaRecordofDecisionandsubsequententitlements(e.g.Section408authorization)issued.Ineithercase,eventuallytheoriginaldistrictleveeswillberebuilttothehigherstandardexceptthatonthesouthwestsidetheimprovedleveesegmentwillbesetbackaminimumof150feetfromthecurrentleveepositionalongParadiseCut.Theresultingsetbackleveewillbebuilttothesamestandardsastheotherprojectlevees.Accordingtothe2010governmentcensus,thepopulationonStewartTractis17.Salesofhomesinthecurrentringleveeurbanarea(RiverIslandsPhase1area)beganinearly2014.Populationwillgrowovertimetoapproximately30,000atfullbuildoutinthenext10to20years.RD2062isthreatenedprimarilyfromriverinefloodsalongtheSanJoaquinRiveranditstributariesinthevicinity.DeltahightidaleventshaveminimumeffectonwaterelevationsaroundtheDistrict.ParadiseCutcarriesflowsofftheSanJoaquinRiverwhenwaterelevationsexceedtheheightofaweirplacedatthemouthoftheCut.2.2 GeneralApproachtoSeasonalFloodOperationsDistrictstaffwillcarryoutroutinepreparednessactivitiesatthebeginningofthefloodseasonasdescribedbelow.AnnexAdescribestheconceptofoperationsforactiveDistrictfloodfightactivities.Section3,OrganizationandAssignmentofResponsibilities,ofthisPlandescribesauthoritiesandresponsibilitiesforperformingroutineandemergencyactivities.2.2.1 RoutinePreparednessandInfrastructureMaintenanceTheDistrictperformsthefollowingroutinepreparednessactions.1. AnnualinspectionandinventoryofDistrictfloodfightsupplies,basedontheDWR

“AdvancedPreparationforFloodsandPatrolling”,and“FloodFightChecklist”5. Semi‐annualjointinspectionofleveeswithStateinspectors6. PeriodicjointinspectionofleveeswithFederalinspectors7. Annualinspectionandmaintenanceofaccesscontrolgatesonlevees8. Annualinspectionandmaintenanceofpumpingstations.Districtownspumpingstationsforinternaldrainagecontrol.Theprimarydistricttenant,GeorgePerryandSons,maintainsalldistrictpumpstations.AnotherRiverIslandsdevelopmentrelatedpublicagency(includingtheDistrict)mayassumemaintenanceofthesefacilitiesinthefuture.

LocationofthepublicsafetyevacuationmapforRD2062isshownonAnnexA.2.4 FloodFightOperationsFloodfightoperations,includingleveepatrol,willbeconductedinaccordancewiththeproceduresinthisBasicPlanandthoseshownonAnnexA.AnnexAdisplaystheDistrict’sconceptofoperationsforemergencycommunications,patrol,andfloodfight.Floodfightprocedureswillincludedewateringoperations.ThisconceptofoperationsandrelatedresponseprocedureswillbemodifiedasneededbytheDistrictIncidentCommandertomeetthedemandsofactualemergencyconditions.PlansofjurisdictionswithresponsibilityforwarningandevacuationwithintheDistrictarereferencedonAnnexAaswellasinthisPlan.2.5 FederalandStateDisasterAssistanceTheDistrict’spolicyistomaintainmitigationandemergencyplansandprocedures,aswellasthephysicalconditionofitslevees,atthelevelrequiredtobeeligiblefordisasterpublicandindividualassistanceprogramssuchastheFederalStaffordActandPL84‐99programaswellastheCaliforniaDisasterAssistanceAct(CDAA).TheDistrictiscurrentlyworkingtowardsreinstatementintothePL84‐99programleveerehabilitationcomponentalongwithRD2107.Emergencyoperationswillbeconductedanddocumentedincompliancewithconditionsofthoseprogramsforreimbursementofdisasterexpenses.TheDistricthasassigneditsDistrictEngineertomaintainnecessarydocumentationduringanemergencyandtoparticipateinanyavailableassistanceprogramsafteradisasteronbehalfoftheDistrict.ToensurethattheDistricttakesstepstoquicklyaccesstherecoveryprocess,theseactionsshouldbeconsideredifanincidentisimminentoroccurring:

Section3‐OrganizationandAssignmentofResponsibilities

3.1 OrganizationTheDistrictwilluseitspaid,contract,andvolunteerstaffasshownbelowtoperformitsresponsibilitiesinafloodemergency.3.2 AssignmentofResponsibilitiesTheDistrictBoardofTrusteeshasmadethefollowingassignmentsofauthorityandresponsibilitytoensurethatneededemergencyactionscanbetakenpromptlyandefficiently.3.2.1 MakeLegalandFinancialCommitmentsonbehalfofDistrictTheDistrictPresidentshallhavetheauthority,oncetheDistrictBoardofTrusteeshasconcurredthatalocalemergencyisoccurring,to1)makealegalorfinancialcommitmentonbehalfofDistrictduringemergencyoperationsand2)purchaseadditionalfloodfightsuppliesormaterials.IntheabsenceofthePresidentorathisorherdirection,anysingletrusteeortheDistrictSecretarycanalsobeauthorizedasnecessary.Regardlessofthisauthority,thereisnolimittothecommitmentthatcanbemade.AnysingletrusteeortheDistrictSecretaryintheabsenceoftheDistrictPresidentcantaketheseactionsuponrecognitionofathreattoleveeintegrityevenwithoutpriorconcurrenceoftheDistrictBoardofTrusteesthatalocalemergencyisoccurring,butinthiscasetheDistrictBoardofTrusteesmustbenotifiedoftheactionwithin24‐hours.TheDistrictPresidentordesigneeshallsignwrittencontractswithprivatevendorsorotherpublicagenciesstemmingfromemergencyactionsasdescribedabove.

Emergency response and construction records, including field reports, procurement and construction management files are maintained by both the District and the District Engineer and are retained as prescribed by the grant authority. District maintains a safety plan for employees and work rules as appropriate.

FORM“A‐3”CONTRACTOR shall be responsible for its own work, property, and/or materials untilcompletionandfinalacceptanceoftheworkbytheDISTRICT.Intheeventoflossordamage,itshallproceedpromptlytomakerepairsorreplacementofthedamagedwork,property,and/ormaterialsatitsownexpense,asdirectedbytheDISTRICT.CONTRACTORwaivesallrightsCONTRACTORmighthaveagainstDISTRICTforlossofordamagetoCONTRACTOR'swork,property,ormaterials.PaymentshallnotbeconstruedasawaiverofthisorofanyothertermsoftheContract.CONTRACTORshallpayforallmaterial,labor,taxes,insuranceandotherclaims,liabilities,and obligations of any nature arising from any aspect of itswork performed under thisContract, and shall furnish satisfactory evidence of such payments upon request ofDISTRICT. CONTRACTORagrees to indemnify, defend, andholdharmless INDEMNIFIEDPARTIESfromallsuits,liens,orotherclaimsofanynaturearisingfromitsfailuretomakesuchpayments.CONTRACTORshallprovideandmaintainatalltimesduringtheperformancethefollowinginsurance:

Workers’ Compensation insurance meeting the requirements of both the State ofCaliforniaandtheFederalLongshoreandHarborWorkers’CompensationActtotheextentapplicable.

Insurance covering Public Liability, PropertyDamage, and Contractor’s ContractualLiability arising out of or relating to CONTRACTOR's performance hereunder (allincluding but not limited to work performance and the operation of automobiles,trucks and other vehicles) in amounts of not less than $1,000,000 per occurrence,protecting CONTRACTOR and INDEMNIFIED PARTIES against liability for damagesbecauseofinjuries(includingdeath)andinanamountofnotlessthan$1,000,000peroccurrence against liability for damages to property. All of the following shall benamed as additional insureds on said policies: “ReclamationDistrict No. X and itsboardoftrustees,officers,agentsandemployees;andtheStateofCalifornia,andallofitsagencies,departments,officers,agentsandemployees.”

All insurance required hereunder shall be maintained in full force and effect in acompany or companies satisfactory to DISTRICT, shall be maintained atCONTRACTOR'sexpenseuntilperformanceinfullhereofandsuchinsuranceshallbesubject to requirement thatDISTRICTmustbenotifiedby thirty (30)days'writtennoticebeforecancellationofanysuchpolicy.Intheeventofthreatenedcancellationfornon‐paymentofpremium,DISTRICTmaypaysameforCONTRACTORanddeductthe same payment from amounts then or subsequently owing to CONTRACTORhereunder.

Evidence of such insurance shall be furnished by CONTRACTOR toDISTRICT uponrequest.

PursuanttoLaborCodeSection1771forcontractsover$1,000.00,thisdistrictworkswith the Compliance Monitoring Unit/Division of Labor Standards Enforcement andrequiresthatallcontractorsandsubcontractorsworkingonthisprojectkeepcertifiedpayrollrecordsinaccordancewithLaborCodeSection1776,andtosubmitelectronicallyviatheDepartmentofIndustrialRelations(DIR)ComplianceMonitoringUnitwebsite.ForanyquestionspleaseemailCMU@dir.ca.govorcall916‐263‐1811.Pursuant to Labor Code Section 1771.1, a contractor or subcontractor shall not bequalifiedtobidon,belistedinabidproposal,subjecttotherequirementsofSection4104ofthePublicContractCode,orengageintheperformanceofanycontractforpublicwork,unless currently registered andqualified toperformpublicworkpursuant to Section1725.5.Inaccordancewith theprovisionsofLaborCodeSection1720etseq., theDivisionofLaborStandardsandResearchhasdeterminedthegeneralprevailingratesorwagesandemployer payments for health and welfare, pension, vacation, travel time, andsubsistencepayasprovidedforinLaborCodeSection1773.8.ItshallbemandatoryupontheCONTRACTORhereinanduponanySubcontractortopaynotlessthanthesaidspecifiedratestoalllaborers,workers,andmechanicsemployedbythemintheexecutionoftheAgreementpursuanttoLaborCodeSection1774.TheCONTRACTORshallpostjobsitenotices,asprescribedbyregulation1771.4(a)(2).

The District or District Representative shall make periodic site visits to observe andinterview workers regarding the payment of prevailing wages and proper workclassifications.ContractorandeachSubcontractorshallcooperateandcoordinatewiththeDistrictandprovideunaccompaniedaccesstoworkersonthejobsite.Attentionisdirectedtotheprovisionsinsection1777.5andsections1777.6oftheLaborCode concerning the requirement to employ apprentices by the CONTRACTOR or anySubcontractorunderit.Contractors and any Subcontractors shall be assessed penalties for violating labor codesectionsasstatedaboveandasspecifiedinthelaborcode.CONTRACTORcertifiesthatheisawareoftheprovisionsofSection3700oftheLaborCodewhichrequireeveryemployertobeinsuredagainstliabilityforworkers’compensationortoundertakeself‐insuranceinaccordancewiththeprovisionsofthatcode,andthathewillcomply with such provisions before commencing the performance of the work of thisContract.
