The building will be home for over 25 departments, including: the Tax Office, County Clerk, Auditor's Office, Public Works, Information Technology, Treasurer's Office, Human Resources, Purchasing and other departments. The Records Building Complex will also house the Commissioners Court, making it one of the largest and most utilized County public buildings. The project costs were presented through the Construction Manager at Risk's Guaranteed Maximum Price (GMP) in July 2018 and approved by the Commissioners Court under Court Order 2018-0770. At that time, pursuant to best practices, staff held the project contingency of $10,664,391.89 outside of the construction manager's budget to be let in a controlled process to cover the end of project expenses and any approved miscellaneous items. After due diligence and review the final amount of $8,870,511.00 has been agreed for approval and release. Included within this cost are bulletins impacted by the design revisions, environmental impacts and scope related to additional work throughout the project. Below is a summary of the approved reconciliation of the budget and recommended fund transfers.

Below is a summary of the approved reconciliation of the budget and recommended fund transfers.

All costs incurred are within the approved project budget and can be accommodated by transferring funds within current project accounts. With this final commitment the project will be left with $1,783,881.00 from the $200,000,000 bond issue. At the conclusion of the project staff will recommend the use of the budget savings in accordance with the debt issuance provisions for the project. OPERATIONAL IMPACT: Changes throughout the project developed both because of design enhancements and design changes as work progressed in the field. Examples include:

• The project had to adjust to further unknown conditions found as work progressed in the vertical structure and required new design solutions for existing concrete repairs. Also, several issues were encountered with existing City of Dallas utility infrastructure needing certain design modifications in addition to adapting to new City of Dallas emergency code requirements for a secondary fuel source for the emergency generator.

• Asbestos materials continued to be discovered as demolition continued. These ACM/LCM materials still continue to be found throughout the building during more detailed demolition where it was not possible to find in the original surveys. The team minimized removal and disposal costs where possible by using approved techniques to eliminate hazards in handling and disposal.

• Allowances for additional scope items are budgeted and included to incorporate items not originally in a specific scope. These items include scope originally planned to be performed by others but to minimize schedule affects were deemed to be more expeditiously procured and managed by the construction manager thereby minimizing time and costs.

• Move management, relocation move scopes and lease space building closeout were added. In addition, with the increase in useable space associated furniture is needed and is included.

• Even though much of the paper files are being digitized there are still many departments that require long term storage. Inclusion of high density storage to the project offers increased storage capacity in much less space allowing for more work space to be occupied by other critical County services.

• Finally, the work included in this budget will allow for further renovation, and enhancement of the Plaza and necessary water fountain repairs for the benefit of downtown visitors, building customers and employees.

This final directive obligates the construction manager to complete the job, per the respective bulletins issued by the designed team, for the agreed upon amounts. Additionally, other items that were identified as owners items in the approved project budget are being requested to be to be transferred to the 441-000-8130 account to cover the costs presented in change directive. Further, funds within the 441 account will need to be balanced with account code 441-000-7010 to recover overruns, in accordance with the Commissioners Court approved budget for the project, due to extended lease agreements and other miscellaneous charges for building improvements at the leased facilities. FINANCIAL IMPACT: Staff recommends the transfer of project funds within the budget into the Manhattan I Byrne I 3i building improvements account in the amount of $8,870,511.00. Funding to complete the transfer will be made available through Fund 441 and 196. LEGAL IMPACT: This contract has been reviewed by the District Attorney's Office, Civil Division. PROJECT SCHEDULE: N/A SBE PARTICIPATION: With all items for the project contracted, the final MWBE participation for the project is 51%. ADMINISTRATIVE PLAN COMPLIANCE: This authorization supports Vision 1 of the County’s Administrative Plan that Dallas County is an operationally a model governmental entity. Dallas County Facilities Management strives for the upkeep and safety of Dallas County Facilities that are used on a daily basis by Dallas County citizens and employees. RECOMMENDATION: Approve the reconciliation of the project budget and transfer of funds into the building improvements account to fund Manhattan I Byrne I 3i in the amount of $8,870,511.00. MOTION: On a motion made by TBD, and seconded by TBD, the following order will be voted on by the Commissioners Court of Dallas County, State of Texas: Be it resolved and ordered that the Dallas County Commissioners Court does hereby

approve the reconciliation of the project budget and transfer of funds into the building improvements account to fund Manhattan I Byrne I 3i in the amount of $8,870,511.00 for the completion of the final change order using all remaining funding available within the Fund 441 accounts and the remainder amount supplemented by Fund 196. General

1. The allowance prices have not been verified by subcontractors due to missing drawings and information lacking sufficient detail. Manhattan-Byrne-3i will reconcile these allowances based on Construction Documents when they are provided for use.

2. It is understood that allowances for this work are to be a “Not to Exceed” amount and Manhattan-Byrne-3i shall provide pricing on all items to Owner for review and approval prior to use. The Owner has the right to redistribute or utilize the allowance monies as they see fit.

3. All conditions within this change order are an amendment to the GMP Update executed on June 5, 2019.

4. Design related administrative, verification, and conformance requirements for LEED/WELL construction are by others.

Insurance, Staff Rates and Bonds

1. Builder’s Risk (“all-risk”) Insurance is included per Manhattan-Byrne-3i Joint Venture policy ters and conditions.

2. Included in this change order are the costs for Manhattan-Byrne-3i Joint Venture’s Wrap-Up Insurance Program. The agreed to rate for this program is included at 2.5% of the total project costs, excluding Work Authorizations 1 through 4. At the end of the project, the amount charged will be reconciled against the total contract amount minus those amounts specifically excluded.

3. We have not included any sales tax.

4. We have included General Conditions and Requirements at 6% of the work value.

5. Performance and Payment Bods for Manhattan-Byrne-3i Joint Venture has been included in this change order.
