1. General Provisionsa. These development standards form a part of the rezoning plan associated with the rezoning petition filed by Redwood USA toaccommodate the development of a multi-family residential communityon that approximately 20.54 acre site located on the southwest side ofRidge Road, which site is more particularly depicted on the rezoning plan(the "site"). The site is comprised of tax parcel no. 02972118 B.

b. Development of the site will be governed by the rezoning plan, thesedevelopment standards and the applicable provisions of the City ofCharlotte zoning ordinance (The ''Ordinance'). Unless the rezoning planor these development standards establish more stringent standards, theregulations established under the ordinance for the R-8MF zoning districtshall govern the development and use of the site.

c. The development depicted on the rezoning plan is schematic innature and intended to depict the general arrangement of uses andimprovements on the site. Accordingly, the configuration, placement andsize of the principal building footprint as well as the internal drives andparking areas depicted on the rezoning plan are schematic in nature and,subject to the terms of these development standards and the ordinance,are subject to minor alterations or modifications during the designdevelopment and construction document phases.

d. Future amendments to the rezoning plan and/or these developmentstandards may be applied for by the then owner or owners of the site inaccordance with the provisions of chapter 6 of the ordinance. Alterationsto the rezoning plan are subject to section 6.207 of the ordinance.

e. Dedication and fee simple conveyance of all rights of way to the Cityshall occur before the site's first building certificate of occupancy is issued.

2. Permitted Usesa. The Site may only be devoted to a multi-family residential communitycontaining a maximum of 95 attached dwelling units and to anyincidental and accessory uses relating thereto that are allowed in theR-8MF zoning district.

b. A single story accessory structure such as a gazebo or picnic sheltermay be constructed in the amenity area located adjacent to the potentialBMP.

3. Transportationa. Vehicular Access to the site will be from Ridge Road as generallydepicted on Rezoning Plan. The placement and configuration of thevehicular access points are subject to any minor modifications required toaccommodate final site and construction plans and designs and to anyadjustments required for approval by the Charlotte Department ofTransportation (CDOT) and/or the North Carolina Department ofTransportation (NCDOT) in accordance with applicable publishedstandards.

b. Petitioner shall install Public Street A and Public Street B in thelocation generally depicted on Rezoning Plan. Public Streets constructedon site will conform to the Local Residential Medium Street TypicalSection as depicted on Rezoning Plan.

c. The site will utilize private streets and private driveway connectionsas well as the construction of two public streets that will connect to RidgeRoad and provide future connectivity to adjacent properties to thenorthwest and southeast.

d. Parking for each individual unit is provided in a two car garage withan additional two spaces within the driveway area. Additional guestparking spaces have been provided and dispersed evenly across the site.

e. The alignment of the internal driveways and vehicular circulationareas may be modified by the Petitioner to accommodate changes for thefinal layout, traffic patterns and any adjustments required for approval byCDOT or NCDOT in accordance with applicable published standards,modifications shall be minor.

f. All transportation improvements will be approved and constructedbefore the site's first building certificate of occupancy is issued

4. Architectural Standardsf. The maximum height in stories of the principal buildings to beconstructed on site shall be one (1) story.

g. The maximum height in feet of the principal buildings to beconstructed on the site shall be 20'. Building height shall be measured asprovided in the ordinance.

h. Attached to the rezoning plan are conceptual, schematic images ofsome elevations of the principal buildings to be constructed on the site.They are intended to depict the general conceptual architectural style,design treatment and character of the elevations of the buildings to beconstructed on site. Changes and alternations to the exterior of theprincipal buildings to be constructed on site that do not materially changethe overall conceptual architectural style, design treatment and charactershall be permitted.

i. Vinyl may be used as an exterior building material on the principalbuildings to be constructed on site.

5. Streetscape and Landscapinga. The Petitioner has included a conceptual landscaping plan for the

overall site to demonstrate design intent for streetscape along privatestreets, public streets as wells open space and perimeter buffer areas.

b. The Petitioner will provide an 8' planting strip and a 6' sidewalk forPublic Street A and Public Street B as generally depicted on the rezoningplan.

c. The Petitioner will provide a resident dog park.

d. An entry feature with landscaping and project identity signage will beprovided at main entry along Ridge Road.

6. Environmental Featuresa. Development of the site shall comply with the Charlotte City Councilapproved and adopted Post Construction Controls Ordinance.

b. The location, size and type of storm water management systemsdepicted on the rezoning plan are subject to review and approval as partof the full development plan submittal and are not implicitly approvedwith this rezoning. Adjustments may be necessary in order toaccommodate actual storm water treatment requirements and actual sitedischarge points.

c. The development of this site will comply with the City of Charlottetree ordinance.

d. It is anticipated that solid waste and recycling collection services areto be provided by a private collection service and in this event, roll-outbins will be provided for each dwelling unit.

7. Signagea. Principal signage for the Site shall consist of a monument style sign tobe located at project entry and will be in accordance with the CharlotteLand Development Standards Manual and per ordinance.

8. Lightinga. All freestanding lighting fixtures installed on the Site (excluding lower,decorative lighting that may be installed along the driveways andsidewalks and landscaping lighting) shall be fully capped and shieldedand the illumination downwardly directed so that direct illumination doesnot extend past any property line of the Site.

b. The maximum height of any freestanding lighting fixture installed onthe site shall be 21 feet from grade.

c. Any lighting fixtures attached to principal buildings to be constructedon the Site shall be decorative, capped and downwardly directed.

9. Phasinga. Project will be constructed under one continuous phase, with initialconstruction occurring at project entry at Ridge Road.

10. Binding Effect of the Rezoning Applicationa. If this rezoning petition is approved, all conditions applicable to thedevelopment of the Site imposed under the Rezoning Plan will, unlessamended in the manner provided under the Ordinance, be binding uponand inure to the benefit of the Petitioner and subsequent owners of theSite and their respective heirs, devisees, personal representatives,successors in interest or assigns.
