5th March, 2012 of the Chief Secretariat (Housing), Government ofPuducherry and published in the Part-I of Extraordinary Official GazetteNo. 21, dated 8th March, 2012 namely:-

(1) These Bye-laws and Regulations may be called the PuducherryBuilding Bye-Laws and Zoning Regulations (Amendment), 2017.

(2) The provisions of these bye-laws and zoning regulations shallapply to the planning area declared vide:-

(i) G. O. Ms. No. 79/84/F6, dated 17th August 1984, notifiedin the Gazette No. 35, dated 28th August 1984;

(ii) G.O. Ms. No. 93/85/F6, dated 8th July 1985, notified in theGazette No. 31, dated 30th July 1985; and

(iii) G.O. Ms. No. 68/89/F6, dated 26th July 1989, notified inthe Gazette No. 83, dated 31st July 1989 of Housing Secretariat,Puducherry and such other areas in the Union territory of Puducherrynotified from time to time.

(3) They shall come into force on and from the date of theirpublication in the Official Gazette.

In the Puducherry Building Bye-laws and Zoning Regulations, 2012after Annexure-XXI, the following Annexure-XXII shall be inserted,

"ANNEXURE- XXII

1. INTEGRATION OF ENVIRONMENTAL CONDITION INSANCTION OF BUILDING PLANS

(1.1) The environmental conditions to be integrated with buildingpermission being granted by the Planning Authority concerned and theconstruction of buildings as per the size, shall adhere to the objectivesand monitorable environmental conditions are given in the Table-1, Table-2and Table-3.

(1.2) For building plans with a total Built-up Area (BUA) between5,000 Sq.m. and 1,50,000 Sq.m. no separate environment clearance willbe required from the Ministry of Environment, Forest and ClimateChange (MoEF&CC)for individual buildings provided that theincorporating different set of environmental conditions are beingintegrated in the building permission conditions to address environmentalconcerns making it legally enforceable.

(1.3) As per the final notification vide No. S.O. 3999 (E), dated9-12-2016 of the Ministry of Environment, Forest and Climate Change(MoEF&CC), Government of India, the concerned Planning Authority,which is authorized to sanction building plans, shall ensure at the timeof sanctioning a building plan that the environmental requirementsstipulated in Table-1 (for BUA above 5,000 Sq.m. and upto 20,000Sq.m.), Table-2 (for BUA above 20,000 Sq.m. and up to 50,000 Sq.m.)and Table-3 (for BUA above 50,000 Sq.m. and upto 1,50,000 Sq.m.),as the case may be, are complied with.

(1.4) The Planning Authority concerned may certify thecompliance of the environmental conditions prior to issuance ofCompletion Certificate, as applicable as per the requirements stipulatedfor such buildings based on the recommendation of the EnvironmentalCell constituted in the Planning Authority.

(1.5) In order to implement the integration of environmentalcondition in building Bye-laws, the Planning Authority concerned mayconstitute the Environment Cell (herein after called as Cell), forcompliance and monitoring and to ensure environmental planning withintheir jurisdiction.

(1.6) For the purpose of certification regarding incorporation ofenvironmental conditions in buildings, the Ministry of Environment,Forest and Climate Change (MoEF&CC) shall accredit the QualifiedBuilding Environment Auditors (QBEAs) through a qualified agencies toassess and certify the building projects, as per the requirements of thisnotification and the procedure for accreditation of Qualified BuildingAuditors and their role as given at Appendix-I.

(1.7) The Cell shall monitor the implementation of the bye-lawsand rules framed for Integration of environmental conditions forconstruction of building and the Cell may also allow the thirdpart auditing process for oversight, if any.

(1.8) The Cell shall function under the administrative control ofthe Planning Authorities.

(1.9) The composition and functions of the Cell are given atAppendix-II.

(1.10) The Planning Authorities while integrating the environmentalconcerns in the building bye-laws, as per their size of the project, shallfollow the procedure, as given below:

BUILDINGS CATEGORY '1' (5,000 to < 20,000 Square meters)

A Self declaration Form to comply with the environmentalconditions (Table-1) along with Form 1A and certification by theQualified Building Environment Auditor to be submitted online by theproject proponent besides application for building permission to thePlanning Authority along with the specified fee in separate accounts.Thereafter, the Planning Authority may issue the building permissionincorporating the environmental conditions in it and allow the projectto start based on the self declaration and certification along with theapplication. After completion of the construction of the building, theproject proponent may update Form 1A online based on audit done bythe Qualified Building Environment Auditor and shall furnish the revisedcompliance undertaking to the Planning Authority. Any non-complianceissues in buildings less than 20,000 square meters shall be dealt at thelevel of Planning Authority through existing mechanism.

OTHER BUILDINGS CATEGORIES (> 20,000 Square meters)

The project proponent may submit online application in Form 1Aalong with specified fee for environmental appraisal and additional feefor building permission. The fee for environmental appraisal will bedeposited in a separate account. The Environment Cell will process theapplication and present it in the meeting of the Committee headed bythe authority competent to give building permission in that PlanningAuthority. The Committee will appraise the project and stipulate theenvironmental conditions to be integrated in the building permission.After recommendations of the Committee, the building permission andenvironmental clearance will be issued in an integrated format by thePlanning Authority.

The project proponent shall submit Performance Data andCertificate of Continued Compliance of the project for the environmentalconditions parameters applicable after completion of construction fromQualified Building Environment Auditors every five years to theEnvironment Cell with special focus on the following parameters:-

(a) Energy Use (including all energy sources).

(b) Energy generated on site from onsite Renewable energysources.

(c) Water use and waste water generated, treated and reused on site.

(d) Waste Segregated and Treated on site.

(e) Tree plantation and maintenance.

After completion of the project, the Cell shall randomly check theprojects compliance status including the five years audit report.The State Governments may enact the suitable law for imposing penaltiesfor non-compliances of the environmental conditions and parameters.The Cell shall recommend financial penalty, as applicable under relevantState laws for non-compliance of conditions or parameters to the PlanningAuthority. On the basis of the recommendation of the Cell, the PlanningAuthority may impose the penalty under relevant State laws. The casesof false declaration or certification shall be reported to theaccreditation body and to the local body for blacklisting of QualifiedBuilding Environment Auditors and financial penalty on the owner andQualified Building Environment Auditors.

No Consent to Establish and Operate under the Water (Preventionand Control of Pollution) Act, 1974 and the Air (Prevention and Controlof Pollution) Act, 1981 will be required from the State PollutionControl Boards for residential buildings up to 1,50,000 square meters.";

Waste 3 Solid waste: Separate wet and dry binsmanagement must be provided in each unit and at the

ground level for facilitating segregationof waste.

Sewage: In areas where there is nomunicipal sewage network, onsite treatmentsystems should be installed. Naturaltreatment systems which integrate withthe landscape shall be promoted. As faras possible treated effluent should bereused. The excess treated effluent shallbe discharged following the CPCB norms.

Sludge from the onsite sewage treatment,including septic tanks, shall be collected,conveyed and disposed as per theMinistry of Urban Development, CentralP ub l i c Hea l th and Environmenta lEngineering Organisation (CPHEEO)Manual on Sewerage and SewageTreatment Systems, 2013.

The provisions of the Solid Waste(M ana gement ) R ule s 2 0 1 6 an d t hee-waste (Management) Rules 2016,and the Plastics Waste (Management)Rules 2016 shall be followed.

Energy 4 Compliance with the Energy ConservationBuilding Code (ECBC) of Bureau ofEnergy Efficiency shall be ensured as

per the provisions under chapter-IV ofclause 68, Energy Conservation Buildingsof the Puducherry Building Byelaws andZoning Regulations, 2012.

Outdoor and common area lighting shallbe Light Emitting Diode (LED).

Energy 4 Solar, wind or other Renewable Energyshall be installed to meet electricitygeneration as per the provisions underchapter-IV of clause 68, EnergyConservation Buildings of the BuildingBye-laws and Zoning Regulations, 2012.

Solar water heating system shall beprovided as per the provisions underChapter-IV of clause 68, EnergyConservation Buildings and as in theAnnexure-XVIII of the PuducherryBuilding Byelaws and ZoningRegulations, 2012 to meet the hot waterdemand of the commercial and institutionalbuilding. Residential buildings are alsorecommended to meet its hot waterdemand from solar water heaters, as faras possible.

Concept of passive solar design thatmi n imiz e en e r gy c o ns ump t io n i nbuildings by using design elements, suchas building orientation, landscaping,efficient building envelope, appropriatefenestration, increased day lightingdesign and thermal mass etc. shall beincorporated in the building design.

Wall, window, and roof u-values shall beas per ECBC specifications.

Air quality 5 Dust, smoke and other air pollutionand noise prevention measures shall be provided

for the building as well as the site. Thesemeasures shall include screens for thebuilding under construction, continuousdust/ wind breaking walls all around the site(at least 3 meter height). Plastic/tarpaulinsheet covers shall be provided for vehiclesbringing in sand, cement, murram and otherconstruction materials prone to causingdust pollution at the site as well as takingout debris from the site.

Sand, murram, loose soil, cement, stored onsite shall be covered adequately so as toprevent dust pollution.

Wet jet shall be provided for grinding andstone cutting. Unpaved surfaces and loosesoil shall be adequately sprinkled with waterto suppress dust.

All construction and demolition debris shallbe stored at the site (and not dumped on theroads or open spaces outside) before theyare properly disposed. All demolition andconstruction waste shall be managed as perthe provisions of the Construction andDemolition Waste Rules 2016. All workersworking at the construction site andinvolved in loading, unloading, carriage ofconstruction material and constructiondebris or working in any area with dustpollution shall be provided with dust mask.

For indoor air quality the ventilationprovisions as per National Building Code ofIndia shall be made.

5 (a) The location of the DG set and exhaust pipeheight shall be as per the provisions of theCPCB norms.

Green cover 6 A minimum of 1 tree for every 80 squaremeters of land should be planted andmaintained. The existing trees will becounted for this purpose. Preference shouldbe given to planting native species.

6 (a) Where the trees need to be cut ,compensatory plantation in the ratio of1:3 (i.e., planting of 3 trees for every 1 treethat is cut) shall be done and maintained.

Sewage: Onsite sewage treatment ofcapacity of treating 100% waste waterto be installed. Treated waste water shallbe reused on site for landscape,flushing, cooling tower, and other end-uses. Excess treated water shall bedischarged as per CPCB norms. Naturaltreatment systems shall be promoted.

Concept of passive solar design thatminimize energy consumption inbuildings by using design elements, suchas building orientation, landscaping,efficient building envelope, appropriatefenestration, increased day lightingdesign and thermal mass etc. shall beincorporated in the building design.

Wall, window, and roof u-values shall beas per ECBC specifications.

4 (a) Solar, wind or other RenewableEnergy shall be installed to meetelectricity generation as per the provisionsunder the clause 68, chapter-IV, EnergyConservation Buildings of the PuducherryB u i l d i n g B ye - l a ws a n d Zo n i n gRegulations, 2012.

4 (b) Solar water heating system shall beprovided as per the provisions under theclause 68, chapter-IV, Energy ConservationBuildings and as in the Annexure-XVIII ofthe Puducherry Building Bye-laws andZoning Regulations, 2012 to meet thehot water demand of the commercial andinstitutional building. Residential buildingsare also recommended to meet its hotwater demand from solar water heaters,as far as possible.

4 (c) Use of environment friendly materialsin bricks, blocks and other constructionmaterials, shall be required for at least20% of the construction materialquantity. These include fly ash bricks,hollow bricks, AACs, Fly Ash LimeGypsum blocks, Compressed earthblocks, and other environment friendlymaterials.

Fly ash should be used as buildingmaterial in the construction as per theprovisions of the Fly Ash Notification ofSeptember, 1999 as amended from timeto time.

buildings are also recommended to meetits hot water demand from solar waterheaters, as far as possible.

5 (c) Use of environment friendly materialsin bricks, blocks and other constructionmaterials, shall be required for at least20% of the construction material quantity.These include flyash bricks, hollowbricks, AACs, Fly Ash Lime Gypsumblocks, Compressed earth blocks, andother environment friendly materials.

Fly ash should be used as buildingmaterial in the construction as per theprovisions of the Fly Ash Notification ofSeptember, 1999 as amended from timeto time.

Air quality 6 Dust, smoke and other air pollutionand noise prevention measures shall be provided

for the building as well as the site. Thesemeasures shall include screens for thebuilding under construction, continuousdust/wind breaking walls all around the site(at least 3 meter height). Plastic/tarpaulinsheet covers shall be provided for vehiclesbringing in sand, cement, murram and otherconstruction materials prone to causingdust pollution at the site as well as takingout debris from the site. Wheel washing forthe vehicles used be done.

Sand, murram, loose soil, cement, storedon site shall be covered adequately so asto prevent dust pollution.

Wet jet shall be provided for grinding andstone cutting. Unpaved surfaces and loosesoil shall be adequately sprinkled withwater to suppress dust.

All construction and demolition debrisshall be stored at the site (and not dumpedon the roads or open spaces outside)before they are properly disposed. Alldemolition and construction waste shall bemanaged as per the provisions of theConstruction and Demolition WasteRules 2016.

Environment 1 0 An Environmental Management Planmanagement (EMP) shall be prepared and implemented

and conservation, water efficiency andconservation, solid waste management,renewable energy etc . are keptoperational and meet the requiredstandards. The environmental cell shallalso keep the record of environmentmonitoring and those related to theenvironment infrastructure.

APPENDIX-I

Accreditation of Environmental Auditors(Qualified Building Auditors)

The Ministry of Environment, Forest and Climate Change(MoEF&CC), through qualified agencies shall accredit the QualifiedBuilding Environment Auditors (QBEAs). The Qualified BuildingEnvironment Auditors could be a firm / organization or an individualexpert, who fulfils the requirements. The Ministry will implement thisprocess of accreditation through Quality Council of India (QCI),National Productivity Council or any other organization identified bythe Government. The organizations like Indian Green Building Council,Bureau of Energy Efficiency etc. can also be associated in the processof accreditation, training, and renewal. The environmental consultantsaccredited by the QCI for building sector will be qualified as QBEAs.The QBEAs will meet the following criteria. The accrediting agencycan improvise on these criteria.

Qualifications of the Auditor:

(a) Education: Architect (Degree or Diploma), Town Planners(Degree), Civil Engineer /Mechanical Engineer (Degree or Diploma),PG in Environmental Science or any other qualification as per thescheme of the accreditation.

Training:

(b) Mandatory training to be given by the accreditation body ortheir approved training providers. This will be as per the scheme ofthe accreditation.

(e) The accreditation will be valid for 5 years and will berenewed as per the process developed under the accreditation scheme.

Accountability/Complaint redressal mechanism: Any complaintsregarding the quality of the work of QBEAs shall be made to theaccreditation body. The accreditation body shall evaluate the complaintand take appropriate action including black listing or cancellation ofthe accreditation with wide public notice. This will be in addition tothe action at the level of planning authority for penalty and blacklisting.The Ministry can also take such action in case of specific complaintor feedback.

APPENDIX-II

Environmental Cell at the Level of Planning Authority:

An Environmental Cell shall be setup at the planning authoritylevel to support compliance and monitoring of environmentalconditions in buildings. The Cell shall also provide assistance inenvironmental planning and capacity building within their jurisdiction.The responsibility of this cell would be monitoring theimplementation of this notification and providing an oversight tothe Third-Party Auditing process. The cell will operate under theplanning authority.

Constitution of the cell:

The cell will comprise of at least 3 dedicated experts in followingfields:

(a) Waste management (solid and liquid)

(b) Water conservation and management

(c) Resource efficiency including Building materials

(d) Energy Efficiency and renewable energy

(e) Environmental planning including air quality management.

(f) Transport planning and management.

The Cell shall induct at least two outside experts as per therequirements and background of dedicated experts. Existingenvironmental cells at the level of planning authority can be co-optedand trained for this Cell.

Financial Support:

An additional fee may be charged along with processing fee forbuilding permission for integrating environmental conditions and it'smonitoring. The planning authority can fix and revise this additionalfee from time to time. The amount of this fee shall be deposited in aseparate bank account, and used for meeting the requirement of salary /emoluments of experts and running the system of online application,verifications and the Environmental Cell.

Functions of the Cell:

(1 ) The cell shall be responsible for assessing and appraising theenvironmental concerns of the area under their jurisdiction wherebuilding activities are proposed. The Cell can evolve and proposeadditional environmental conditions as per requirements. Theseconditions may be area specific and shall be notified in advance fromtime to time. These additional conditions shall be approved followinga due consultation process. These environmental conditions will beintegrated in building permissions by the sanctioning authority (i.e)planning authority.

(2 ) Develop and maintain an online system for application andpayment of fees. The Cell shall maintain an online database of allapplications received, projects approved, the compliance audit report,random inspections made. The Cell shall maintain a portal for publicdisclosure of project details including self certification andcompliance audit reports filed by the Qualified Building EnvironmentAuditors for public scrutiny of compliance of environmental conditionsby the project.

(4) The Cell shall review the applications; finalize the additionalenvironmental conditions if required within 30 days of the submissionof the application to the planning authority.

(5) The Cell shall adopt risk based random selection of projectsfor verifying on site for certification of QBA, compliance ofenvironmental conditions and five yearly audit report.

(6) The Cell shall recommend to the planning authority forfinancial penalty for non-compliance of environmental conditions bythe project proponent.

( 7 ) The Cell shall recommend to the accrediting body andthe planning authority against any Qualified Building EnvironmentAuditor, if any lapse is found in their work.

The selection process of Environmental consultants who arewilling to serve as Qualified Building Environment Auditors (QBEA)shall be as per the procedures laid down in the notification issued bythe Ministry of Environment, Forest and Climate Change (MoEF&CC),Government of India.
