NOTIFICATION

The Lieutenant-Governor, Puducherry is pleased to enhance the financial assistance to the houseless poor below poverty line for construction of house and for the said purpose among others hereby makes the following rules further to amend the Puducherry Perunthalaivar Kamaraj Centenary Housing Scheme for the Houseless Poor Rules, 2003 issued vide Notification under G.O. Ms. No. 17/2003-Hg., dated 5-12-2003 and published in the Extraordinary Official Gazette No. 35, dated 10th December 2003 of the Chief Secretariat (Housing), Puducherry namely :—

1. Short title and commencement.— (1) These rules may be called the Puducherry Perunthalaivar Kamaraj Centenary Housing Scheme for the Houseless Poor (Amendment) Rules, 2007.

(2) They shall come into force on and from the date of their publication in the official gazette.

2. Amendment of rule 2.— In the Puducherry Perunthalaivar Kamaraj Centenary Housing Scheme for the Houseless Poor Rules, 2003 (hereinafter referred to as the said rules), in rule 2, after clause (q), the following clauses shall be inserted, namely :—

‘(r) “religious institution” means a Hindu religious institution or any other institution notified by the Government as a religious institution for purpose of these rules;

(s) “institution land” means any land belonging to a religious institution.’

3. Amendment of rule 3.— In rule 3 of the said rules, for the words, figures and brackets “Rs. 50,000 (Rupees fifty thousand only)”, the words, figures and brackets “Rs. 1,00,000 (Rupees one lakh only)”, shall be substituted.

4. Amendment of rule 4.— In rule 4 of the said rules, after clause (iv), the following shall be inserted, namely :—

“(v) the intending beneficiary or his/her spouse is not a Government servant;

(vi) a hut owner who has lived for more than ten years in an institution land.”

5. Amendment of rule 5.— In rule 5 of the said rules, after clause (d) of sub-rule (ii), the following clauses shall be inserted, namely :—

“(e) a certificate in Form-IV issued by the competent authority of the religious institution to the effect that,—

(i) the applicant has lived for more than ten years in the institution land; and

(ii) the religious institution has no objection to the applicant, constructing a house on the institution land by availing of financial assistance under the “Puducherry Perunthalaivar Kamaraj Centenary Housing Scheme for the Houseless Poor Rules, 2003.”

6. Amendment of rule 7.— In rule 7 of the said rules, for the words and figures “Rs. 50,000”, the words and figures “Rs. 1,00,000” shall be substituted.

7. Amendment of rule 10.— In rule 10 of the said rules, for the words and figures “Rs. 50,000, Rs. 20,000, Rs. 15,000 and Rs. 15,000” occurring therein, the words and figures “Rs. 1,00,000, Rs. 40,000, Rs. 30,000 and Rs. 30,000” shall respectively be substituted.

8. Insertion of new rule 10A.— In the said rules, after rule 10 as so amended, the following rule shall be inserted, namely: —

“10A. Compliance of construction.— (1) After receipt of the 1st instalment of Rs. 40,000, the beneficiary should complete the construction of house to the lintel level within a maximum period of 4 months from the date of payment of the first instalment of financial subsidy by the Puducherry Slum Clearance Board.

(2) After receipt of 2nd instalment of Rs. 30,000, the beneficiary should complete the construction of roof within a maximum period of 4 months from the date of payment of the second instalment of financial subsidy by the Puducherry Slum Clearance Board.

(3) After receipt of 3rd and final instalment of Rs. 30,000, the beneficiary should complete the construction of house in all respects within a period of 4 months from the date of payment of the 3rd and final instalment of financial subsidy by the Puducherry Slum Clearance Board.”

9. Amendment of Forms.— In the said rules,—

(a) for Form—I, the following form shall be substituted, namely :–

(b) for Form—III, the following form shall be substituted, namely :–

Form–III as appended to this G.O.

(c) after for Form—III, as so amended the following form shall be inserted, namely :–

Form–IV appended to this G.O.

(iii) in the event of my failure to construct the house as specified under the said rules, I shall refund the entire amount to the Puducherry Slum Clearance Board;

(iv) in the event of my failure to refund the subsidy amount, I hereby agree that the Puducherry Slum Clearance Board shall exercise full right to recover from me legally the entire amount of subsidy with interest thereon as recommended by the Advisory Committee;

(v) in the event of my failure to construct the house within the stipulated time as specified in rule 10(A) of the said rules, I agree that the Puducherry Slum Clearance Board shall initiate legal action against me for such failure.
