AND SPORTS FISHING

Of the 31st of August

Nineteen ninety saw the approval of the Fishing Law –Law nr. 3/90, of the 26 th of September-

which defines the legal framework that, in general, governs the actions of the fishing

administration and the economic agents, thus granting the Government regulatory powers

whose aim is to ensure the execution of its objectives that constitute the basis for review of the

fishing legislation in the country.

In accordance with the provisions in paragraph e), nr. 1 of article 153 of the constitution of the

Republic, including articles 14 and 69 of Law nr. 3/90, of the 26 th of September, the Council of

Ministers decrees that:

Article 1. The Regulation for Recreational and Sports Fishing and its respective annexure that

are an integral part of this decree are hereby approved.

Article 2. The Regulation for Amateur Fishing (Sports Fishing) approved by Decree nr. 518/73,

of the 12th of October, is hereby revoked, and so are the provisions referring to sports fishing

included in Legislative Diploma nr. 1977, of the 10th of May of 1960 –Fishing in Inland Waters

and Pisciculture– as well as the legal provisions in other diplomas contrary to the Regulation

hereby approved.

Article 3. This decree shall come into force on the 1st of January 2000.

Regulation for Sports and Recreational Fishing

ARTICLE 1(Definitions)

1. The expressions used in this Regulation have the meanings defined in Law nr. 3/90, of the 26th of September –The Law of Fisheries- and in Decree 11.0 16/96, of the 28th of May –Sea Fishing Regulation.

2. For the purpose of this Regulation, the complementary expressions used in it have the meaning stated in the definitions below:

a) Found: Any object floating or stranded in water under Mozambican jurisdiction, found or driven to the shore by the sea, proceeding from a shipwreck or ship;

b) Apnea: a temporary suspension or pause of breathing;c) Recreational boat: any boat exclusively used for leisure, nautical sports or recreational or

sports fishing regardless the type of propulsion used. d) Local traffic boat: any boat used to transport passengers and/or cargo within a port and

within a radius of 20 miles from the base port;e) Sports fishing: the fishing activity carried out for non-profit purposes by an amateur fisher in

accordance with international and specific sports fishing contest regulations; f) Recreational fishing: the fishing activity carried out for non-profit purposes by an amateur,

outside sports fishing contests;g) Surface fishing: fishing practiced from the shore or from a boat;h) Underwater fishing: fishing practiced by people floating in the water or immersed, in apnea

or using artificial breathing means, with or without the aid of a boat;i) Amateur fisher: any fisher who carries out fishing for non-profit purposes and for the

purpose of recreation, hobby, tourism or sport;j) Casting net: the art of fishing using a single piece of net which is thrown by hand;k) Artificial breathing: breathing done with the aid of artificial means, in closed or open circuit;l) Fishing trophy: The species listed in Annex IV of this Regulation;m) Snorkel: individual device used for breathing when floating in the water;n) Fishing rod/cane: fishing device, with or without fishing wheel for fishing using a fishhook.

ARTICLE 2(Object)

The object of this regulation is to regulate the provisions of Law nr. 3/90, of the 26 th of September –Law of Fisheries- relating to recreational and sports fishing in the jurisdictional waters of the Republic of Mozambique.

ARTICLE 3(Scope of the Regulation)

This Regulation applies to all persons, single or collective, national or foreign, that practice recreational or sports fishing in the jurisdictional waters of the Republic of Mozambique.

ARTICLE 4(Management and organization of the activity)

1. The Ministries of Agriculture and Fisheries are responsible for promoting the preparation of the plans for the organization of the recreational and sports fishing activities, which shall include:

a) Identification of the target species, zones included, and evaluation of their situation; b) Objectives to be reached with the organization;c) Specification of the management policies to be adopted with regard to the activity.

2. For the purpose of preservation of resources, the Minister of Agriculture and Fisheries may, at the proposal of the National Directorate of Fisheries, determine the number of licenses for recreational and sports fishing to be issued yearly.

3. For the purpose of establishing measures that aim at organizing the activity, the Minister of Agriculture and Fisheries shall consult the Commission for Fishery Administration, created by Decree nr. 16/96, of the 28th of May –Regulation for Maritime Fishing- besides other entities considered convenient.

4. The studies justifying the resource management measures, object of recreational and sports fishing, shall be put at the disposal of the mentioned Commission in nr. 3 of this article.

CHAPTER IITypes of fishing, fishing gear and boats.

ARTICLE 5(Types of fishing)

1. In the scope of recreational and sports fishing, following types of fishing may be practiced:a) Surface fishing;b) Underwater fishing.

2. It is forbidden to practice underwater fishing using artificial breathing devices other than the snorkel.

ARTICLE 6(Surface fishing gear)

1. Surface fishing may only be practiced using fishhook, with or without the aid of a fishing rod, with or without fishing wheel.

2. The maximum number of hooks to be used in surface fishing may not exceed three.3. Amateur fisher may use casting net exclusively for the purpose of catching live bait to be

used in recreational and sports fishing.

ARTICLE 7(Underwater fishing gear)

1. Underwater fishing may be practiced using knives, spears or weapons, provided the force used to propel spears is an elastic or compressed air. Underwater fishing gear may have one spear only, with one or two points.

2. It is forbidden to use of weapons whose propelling force is the detonation of any chemical substances.

3. It is forbidden to use harpoons with explosive tips.4. It is strictly forbidden to carry loaded weapons or weapons in ready-to-shoot conditions

outside the water, even when locked.

ARTICLE 8(Protection)

1. When practicing surface fishing, amateur fishers shall, except in cases of mutual agreement or for security reasons, keep a distance of at least:a) Ten metres – when fishing from the shore;b) When fishing from a boat, these shall manoeuvre in accordance with the International

Rules in order to avoid collisions at sea (RIEAM).2. In underwater fishing, the fishers shall for security reasons maintain a minimum distance of

twenty metres between them, except in cases of mutual agreement or for security reasons.

ARTICLE 9(Other forbidden fishing gear and methods)

1. The existence of fishing gear, weapons or capture devices, not foreseen in this regulation, on board or in an amateur fisher’s possession, shall be considered a transgression, and shall be punished in accordance to this Regulation.

2. It is forbidden to transport and use of or attempt to use explosives or toxic substances or even tools for fishery by electrocution.

ARTICLE 10(Boat)

1. For the purpose of recreational fishing using a boat, following boats may be used: recreational boats, local traffic boats and artesanal fishery boats.

2. In sports fishing with a boat, only recreational boats may be used.

3. The boats mentioned in nr. 1 and 2 of this article, when used in recreational and sports fishing, the boats are equalized to fishing boats for the purpose inspection and compliance with the provisions of this Regulation and other fishing legislation.

4. Inspection of the security conditions of the boats used in recreational and sports fishing is the responsibility of the maritime authority.

5. The provisions in the previous numbers are applicable to foreign boats.

CHAPTER IIIAreas and periods for recreational and sports fishing

ARTICLE 11(Areas)

1. Recreational and sports fishing is allowed in the Republic of Mozambique, except in port areas where boats manoeuvre and the areas where it is forbidden by proper legislation.

2. In areas indicated for swimming, amateur fishers may not practice surface fishing or underwater fishing less than 100 metres away from the swimmers.

3. The Minister of Agriculture and Fisheries may -by means of ministry diploma, and with the consent of the Commission for Fishery Administration- determine other areas where

recreational and sports fishing is restricted for the purpose of preservation of resources, scientific investigation or public hygiene.

ARTICLE 12(Periods)

1. Surface fishing may be practiced by day or by night.2. Underwater fishing may only be practiced from sunrise to sundown.3. The Minister of Agriculture and Fisheries may -by means of ministry diploma, and with the

consent of the Commission for Fishery Administration- determine other periods for practice of recreational and sports fishing for the purpose of preservation of resources, scientific investigation and other national interests.

CHAPTER IVFishing products and findings

ARTICLE 13(Species to be captured and number of pieces)

1. The maximum number of demersal species to be brought to land, daily and per amateur fisher, is ten pieces. Fishing of species subject to restrictions may not exceed the numbers established in Annex I of this Regulation.

2. In fishing contests, it is forbidden to capture demersal species, and each fisher may not capture more than ten pieces of each species regardless the number of days that the contests should last.

3. For the purpose of preservation and management of the resources, the Minister of Agriculture and Fisheries may -by means of ministry diploma, and with the consent of the Commission for Fishery Administration- determine other numbers of pieces and restrictions per boat, and determine sizes and minimum weights for the species to be captured.

ARTICLE 14(Protection of the species)

1. It is forbidden to fish the protected species indicated in Annex II of this Regulation.

2. All protected species captured in the practice of recreational and sports fishing or pieces caught in excess of the number of pieces indicated in Annex I or in nr. 1 and 2 of article 13 shall immediately be returned to the water.

3. The Minister of Agriculture and Fisheries may -by means of ministry diploma, and with the consent of the Commission for Fishery Administration of the Ministry for Environmental Action Coordination- establish the list of the species subject to the special, total or partial protection regime and to the individual conditions applicable to that regime.

ARTICLE 15(Fishing Trophies)

1. The capture of species considered fishing trophies is subject to special licenses.2. For the purpose of compliance with the previous number, the Provincial Fishery

Administration services, or, in their absence, the entities which have been granted due competency by the Minister of Agriculture and Fisheries, shall issue capture vouchers, subject to payment of the fee defined in Annex III of this Regulation.

3. The species classified as fishing trophies are stated in Annex IV, and alterations to this list are decided by the Minister of Agriculture and Fisheries, with the consent of the Commission for Fishery Administration.

ARTICLE 16(Statement of captures)

1. The Minister of Agriculture and Fisheries may establish obligatory statement of the captures with regard to the areas, periods and determined species for the purpose of research and management of the resources.

2. Annex V of this Regulation contains a copy of the capture statement form.

ARTICLE 17

(Purpose of the captures)

1. The species captured during the practice of recreational or sports fishing may not be sold directly or indirectly.

2. Except for the fishing trophies, exportation of captured species is subject to provisions established in Decree nr 10/98, of the 17 of March –Regulation for Inspection and Guarantee of Fishing Products.

3. All the species captured, in competition or outside competition, whose rarity or importance, from biological point of view, justifies their preservation, are property of the State, and shall be delivered to the Ministry of Agriculture and Fisheries free of charge, as soon as possible and in optimal conditions of preservation.

ARTICLE 18(Findings)

Findings found during practice of underwater fishing may not be removed, and their location shall immediately be informed to the maritime authority, and they shall be subject to the legal provisions governing the matter.

CHAPTER VFishing Licensing

ARTICLE 19(Fishing licences)

1. The practice of surface fishing from a boat and underwater fishing are subject to licensing and payment of the fees defined in Annex III of the this Regulation.

2. For the purpose of identification of persons practicing the activities indicated in nr. 1 of this article, these shall bear a license named “Licence for Recreational and Sports Fishing”, which is shown on Annex VI to this Regulation.

3. In accordance with this Regulation, following types of licences for recreational and sports fishing are createda) Monthly licenceb) Quarterly licencec) Annual licence

ARTICLE 20(Purpose of the fees)

The amounts resulting from collection of the fees for recreational and sports licences shall be delivered to the Treasury of the Finance Department of the respective fiscal area, by means of Form B, no later than the 10th of the month following the month it was charged.

ARTICLE 21(Alteration of fees)

The fees referred to in nr. 1 of article 19 may be altered by means of a joint dispatch from the Minister of Agriculture and Fisheries and the Minister of Planning and Finance.

ARTICLE 22(Request for renewal of fishing licence)

1. The requests for the attainment or renewal of fishing licence shall include following documents or authenticated photocopies:a) Request for fishing licence in accordance with Annex V.b) Previous fishing licence, in case of renewal.

2. The requests for a fishing licence referred to in the previous number shall be submitted to the decision of the Provincial Fishery Administration services or, in their absence, to the entities with due competency granted by the Minister of Agriculture and Fisheries.

3. The concession of the fishing licence to a minor may only take place when the request is accompanied by an authorisation issued by the parents with a signature authenticated by a notary.

4. In case of loss or destruction of the fishing licence, a second licence may be issued on request from the interested party and against payment of the fee set out in Annex III.

5. The Minister of Agriculture and Fisheries may delegate the competency to license recreational and sports fishing to other entities.

ARTICLE 23(Quotas for fishing licences)

1. In order to guarantee the attainment of fishing licenses, the authority with competency will grant the national nautical clubs and sports associations and tourism agents fishing licence quotas.

2. The quotas mentioned in the previous number enable the national nautical clubs and sports associations to attain fishing licences in favour of their members.

3. The entities benefiting from the quotas are subject to payment of the same fees applicable for the situations mentioned in article 19 of this Regulation.

ARTICLE 24(Validity)

The licences for recreational and sports fishing granted in accordance with this Regulation are valid for the periods indicated in the licences, which may not exceed a year. These licences will expire on the 31st of March of each year.

ARTICLE 25(Untransmissibility)

The licences for recreational and sports fishing issued in terms of this Regulation are not transferable.

ARTICLE 26(Refusal, cancellation or suspension)

1. The entities with competency to grant and renew licences for recreational and sports fishing, have the competency to refuse the respective requests, as well as to revoke or suspend licences for recreational and sports fishing.

2. Requests or renewal of licences for recreational and sports fishing shall be refused if the applicant should have been subject to revocation or suspension of the licence due to repeated non-compliance with this Regulation.

3. Requests for granting of quotas for annual fishing licences to national nautical clubs and sports associations and tourism operators in case of non-compliance with the obligations stated in article 27 of this Regulation.

4. In case of refusal of granting or renewal of licence for recreational and sports fishing, the applicant may appeal to the entity hierarchically superior to the one refusing the request.

CHAPTER VIFishing contests

ARTICLE 27(Fishing contests)

1. Only those fishing contests organized by national sports clubs or associations will be authorised.

2. Foreign sports clubs and associations are allowed to participate in the organization of fishing contests, provided they are associated to similar national entities.

3. The execution of fishing contests shall be announced by the organizing entity to the Provincial Fishing Administration services or, in their absence, to the entities vested with such competency by the Minister of Agriculture and Fisheries, no less than thirty days in advance, by sending a filled copy of the form in Annex VIII, including the respective regulations of the fishing contests.

4. The fishing contest may be forbidden if reasonable motives should justify such measure regardless whether for purpose of preservation of resources, hygiene or public security.

5. The entity organizing the fishing contest shall provide the maritime authority of the jurisdictional area with a copy of the announcement mentioned in nr. 3 of this article duly registered as received by the entity with authority.

CHAPTER VIIObligations

ARTICLE 28(Obligations of the fishers)

1. The amateur fishers practicing recreational and sports fishing are obliged to:

a) Comply with regulations applicable to the fishing activity and other legislation related to the activities carried out in Mozambican jurisdictional waters;

b) Collaborate with inspectors in their actions for the implementation of the rules in this Regulation and for the protection of the environment;

c) Collaborate with relevant authorities in the prevention of and struggle against pollution of the waters;

d) Inform the relevant authorities of the occurrence of non-compliance with this Regulation and with other legislation applicable to recreational and sports fishing.

2. Those fishers who, in accordance with this Regulation, should be required to present the statement of their capture shall put the products captured at the disposal of duly authorised and identified technicians of the Institute for Fishery Research (Instituto de Investigação Pesqueira) for the purpose of biological sampling.

ARTICLE 29(Obligations of sports Clubs and Associations and Tourism Operators)

1. The sports clubs and associations and the tourism operators dedicated to recreational and sports fishing have the same obligations as the amateur fishers mentioned in the previous article.

2. The sports clubs and associations and the tourism operators must specially enforce compliance with the provisions of this Regulation and other fishing legislation among their member amateur fishers.

CHAPTER VIIIInspection, infractions and penalties

ARTICLE 30(Inspection)

The Ministry of Agriculture and Fisheries is responsible for inspecting the recreational and sports fishing, through the entities with competency to do inspections and in accordance with the legislation in force.

ARTICLE 31(Infractions)

Following activities constitute serious infractions to this Regulation:

a) The attempt to or actual fishing without a licence;b) The performance of fishing contests that have not been previously notified to the relevant

authority or that have been forbidden;c) Transport, use of or attempt to use explosives or toxic substances or even electrocution

fishing gear;d) The use of or attempt to artificial breathing equipment;e) Fishing in forbidden areas;f) Flight or attempt to flee upon interpellation by relevant authority;g) The use of unauthorised fishing gear;h) Capture or possession of protected species;i) Capture and possession of number of pieces exceeding the authorised limit;j) Capture and possession of a number of pieces sizes and weights below the established

limits;k) Sale of the catch.

ARTICLE 32(Penalties)

1. With regard to the infractions listed in article 31 of this Regulation, the penalties shall be graduated in the following parameters:

(i) Paragraphs a) and b) – fifty to one hundred million Meticais;(ii) Paragraphs c), d), e) and f) – thirty to forty million Meticais (iii) Paragraph g) – fifteen to twenty million Meticais;(iv) Paragraph h) – eight to ten million Meticais per piece.(v) Paragraphs I), j), and k) – fifty to one hundred million Meticais per Kilo.

2. Regardless the fine given.a) The fishing gear and other tools, substances and products used in the infractions

foreseen in paragraphs a), c), d) and g) of the pervious article shall be apprehended and declared lost in favour of the State;

b) All the fish in the possession of the author of the infraction foreseen in paragraphs h), I), j) and k) of the previous article shall be apprehended and declared lost in favour of the State;

3. In case of recidivism, the amounts of the fines established in nr. 1 of this article shall be double, and the licence for recreational and sports fishing shall be suspended for a maximum period of six months or revoked, according to the gravity of the infraction.

ARTICLE 34(Alteration of the amount of the fines)

The amounts resulting from the collection of fines set in this Regulation shall be delivered to the Treasury of the Finance Department of the Respective fiscal area under corresponding title of consigned revenue, until the 10th day of the month following the month of collection.

The destination of the revenues resulting from collection of fines for the infractions established in this Regulation shall be determined by means of a joint dispatch from the Minister of Agriculture and Fisheries and the Minster of Planning and Finance.

CHAPTER IXFinal provisions

ARTICLE 35(Annexure)

This Regulation contains following annexure:

Annex I – List of species subject to restriction, related to article 13;

Annex II – List of protected species, related to article 14;

Annex III – Fees for Fishing Licensing and Trophies, related to articles

15 and 19;

Annex IV – List of fishing trophies, related to article 15;

Annex V – Daily Capture Card, related to article 16;

Annex VI – Model of the licence for recreational and sports fishing, related article 19;

Annex VII - Form for request of fishing licence, related to article 19;

Annex VIII - Form for notification of sports fishing contests, related to article 25.

The Minister of Agriculture and Fisheries may, at the proposal of the National Directorate of Fisheries and by means of a ministry diploma, alter the models set out in Annexure V, VI, VII and VIII of this Regulation.
