Rule 33. (1) Before the construction or alteration of a sewerage system or portions thereof, plans and specifications shall be submitted to the Department for review and issuance of a construction permit.

(a) "Alteration" means the construction of any modification or addition to an existing sewerage system which changes the process or system capacity

A Part 41 permit may be required - contact the local district office of the DEQ for determining if a Part 41 permit is necessary

An appropriately sized liner pipe is inserted into an existing pipe

The change in the Pipe Diameter is usually greater then 5% of the existing pipe diameter size

The change in pipe diameter will significantly decrease the hydraulic capacity of the collection sewer for that run

A Part 41 permit will be required due to the change in the hydraulic capacity of the sewer

Insertion of a cone shaped bursting head that fractures the old pipe and pushes the fragments into the surrounding soil

A new pipe is pulled into place

Typically, the pipe inserted is of larger diameter than the existing sewer pipe, which will alter the hydraulic capacity of the sewer

A Part 41 permit is required, due to the change in the hydraulic capacity of the sewer

“A city, village, county, township, authority, or other public body, including an intermunicipal agency of 2 or more municipalities, authorized or created under state law; or an Indian tribe that has jurisdiction over construction and operation of sewage treatment works or other projects qualifying under section 319 of title III of the federal water pollution control act, 33 USC 1329.”

Public bodies (other than cities, villages, counties, and townships) and Authorities applying for SAW grants or loans must indicate the relevant authorizing statute in the application.

New $2 million grant cap per community

- 90% grant/10% local match up to $1 million - 75% grant/25% local match for 2nd million - 100% grant to disadvantaged communities, municipalities in receivership, municipalities operating under an emergency manager, municipalities operating under a financial consent agreement

Complete inventory of system assets

• Condition assessment is allowed but reasonable assumption of some assets is acceptable

• Cleaning/Televising entire system is not expected

Wastewater must show significant progress towards funding structure w/in 3 years

• initial rate increase to close 10% of gap w/in 3 years with 5 year plan to eliminate full gap

Stormwater must be implemented w/in 3 years

Wastewater applicants agree to NPDES Asset Management conditions in their next permit reissuance

Must address a problem or need (water quality issue, lower costs, less energy, green innovative)

Must meet one of four categories

Pilot study work plan must be submitted with grant application

If demonstration is determined feasible grantee must agree to construct a full-scale project

the region, if influenced by climate

The technology has not been previously used in the United States, if independent of climate influences

The technology is an application of an existing technology applied to a different media (e.g. a water supply treatment technology applied to the wastewater field)

The technology is an application of an existing technology applied to a different pollutant (e.g. previously used to address pollutant ‘X’, proposed to address pollutant ‘Y’)
